HomeMy Public PortalAboutResolutions__7/1/2021 RESOLUTION NO.21-35 0 RESOLUTION TRANSFERRING FUNDS WHEREAS,the following fund-to-fund transfers were approved as part of the 2020-21 budget of the City of Marcus;and WHEREAS,the 2020-21 budget was adopted on February 8, 2021;and WHEREAS, in accordance with Iowa Administrative Rules Code(ARC)545.25,all transfers of moneys made from one budgeted fund to another budgeted fund occurring, must be approved by Resolution to provide for more transparency; and NOW,THEREFORE, be it resolved that the following transfers are hereby authorized for fiscal year 2020-21 to be made in the month of July,2021. Harvey,City Clerk/Treasurer 0 0 C) r RESOLUTION NO. 21-36 RESOLUTION APPROVING AMERICAN RESCUE PLAN AWARD TERMS AND CONDITIONS AND ASSURANCES OF COMPLIANCE WITH TITLE VI OF THE CIVIL RIGHTS ACT OF 1964 WHEREAS,in 2021,the American Rescue Plan Act was enacted, and the City of Marcus, Iowa became qualified to receive an award of federal direct aid; and WHEREAS, said direct aid followed the efforts of the Iowa League of Cities and the National League of Cities'year-long"Cities Are Essential"advocacy campaign,which resulted in $65.1 billion of direct aid to every city, town, or village across the United States; and WHEREAS,as a condition to accepting such aid,the city must approve the application and the"U.S. Department of the Treasury Coronavirus Local Fiscal Recovery Fund Award Terms and Conditions" as well as provide"Assurances of Compliance with Title VI of the Civil Rights Act of 1964." NOW BE IT RESOLVED by the City Council of the City of Marcus, Iowa,that the City Council does hereby authorize the approval of the application and "U.S. Department of the Treasury Coronavirus Local Fiscal Recovery Fund Award Terms and Conditions." Harvey,City Clerk/Tress er p d C e RESOLUTION NO. 21-38 RESOLUTION APPROVING LEASE WITH T &M AVIATION WHEREAS, an agreement has been reached by the City of Marcus, Iowa with T & M Aviation to permit a helicopter pad upon an unimproved lot in the Marcus Business Park; and WHEREAS,the consideration includes maintenance,insurance and liability protection,for a period of one year,beginning May 1,2021 to April30,2022;with a provision for annual renewal; NOW BE IT RESOLVED by the City Council of the City of Marcus, Iowa,that the City Council does hereby authorize the execution of the Lease—Business Property—Short Form for: Lot 10 in the Marcus Business Park being a Subdivision of Parcel A of the Southwest Quarter of the Southwest Quarter (SW% SW%) of Section 3, Township 92 North, Range 42 West of the 5th P.M., in the City of Marcus, Cherokee County,Iowa,as shown in the Survey Plat recorded in Small Plat Book 11, Page 110 and as Doc.#06 1972. Harvey,City Clerk/Trea rer 0 a C RESOLUTION NO. 21-40 RESOLUTION APPROVING PROPOSED RESTRICTIVE SALE OF ABANDONED PROPERTY AT 708 E CEDAR STREET IN THE CITY OF MARCUS, IOWA WHEREAS, on this date a Public Hearing was held concerning the advisability of selling abandoned real estate located at 708 E Cedar St. to Gary and Connie Edwards by Quit Claim Deed including a right of reversion for rehabilitation; WHEREAS,the City has determined that a fair market value for the purchase of the premises is $1.00, and has directed an Abstract of Title be prepared for the Buyer; WHEREAS, a resolution by the City Council is required in order for the City of Marcus, Iowa to issue a Quit Claim Deed on the premises. NOW,THEREFORE,BE IT RESOLVED,the City Council of the City of Marcus Iowa, hereby agrees to sell the following described real estate to Gary and Connie Edwards as tenants in common$1.00: S20' E85' Lot Ten (10) & E85' Eight (8), Nine (9), & Ten (10) Block Four(3) Barnes Addition of the Town of Marcus, Iowa BE IT FURTHER RESOLVED, a Quit Claim Deed subject to a two-year right of reversion to the City of Marcus, Iowa for failure to bring the property into compliance with the International Property Maintenance Code as amended and incorporated into the City Code within one year is authorized to be issued by the Mayor and Clerk to complete the sale following payment.
