A SPECIAL ORDINANCE AMENDING THE ZONING MAP FOR A CERTAIN
PARCEL FROM R-3 TO R 3 SPECIAL USE DISTRICT
Whereas, the Zoning Map designates certain property commonly known as 1907 Chester
Boulevard, and legally described as provided and follows, to wit:
The entire north half of the following described real estate: A
part of the northwest quarter of Section 28, Township 14,
Range 1 West, bounded as follows, to wit: Beginning 22.071
rods south of the northwest corner of said quarter said point
being the southwest comer of a certain 5 acre tract conveyed
by Emmett W. Hensley and wife to Clarence W. Abel and
wife Bertha L. Abel, by deed recorded in cord 159,
page 483, running thence south 12.07 east
66.28 rods; thence north 12.07 he st 66.28 rods
to the place of beginnin e c ontaining 5 acres
more or less and th thereof containing 2-112
acres, more or I olIowing described real
estate; Being a pa northwest quarter of Section 28;
Township 14 No ange 1 West in Wayne Township,
Wayne County, Indiana and being more particularly
described as follows: Beginning at a point in the west line of
the northwest quarter of said Section 28; said point being
311 feet south of the northwest comer of said quarter, and
running thence from said beginning point east, parallel to the
north line of said quarter, 1093.62 feet; thence south, parallel
to the west line of said quarter, 53.16 feet; thence west
parallel to the north line of said quarter, 1093.62 feet to a
point in the west line of said quarter; thence north, along said
west line, 53.16 feet to the place of beginning, containing an
area of 1.33 acres, more or less.
EXCEPT:
A part of the Northwest Quarter of Section 28, Township 14
North, Range I West, Wayne County, Indiana, and being that
part of the grantors' land lying within the right of way lines
depicted on the attached Right of Way Parcel Plat marked
Exhibit `B", described as follows: Beginning at a point on
the west line of said section South 0 Degrees 25 minutes 31
seconds West 94.793 meters (311.00 feet) from the northwest
corner of said section, said northwest corner being designated
as point "206" on said plat, which point of beginning is the
northwest corner of the grantors' land; thence South 89
degrees 18 minutes 02 seconds East 15.000 meters (49.21
feet) along the north line of the grantors' land; thence South 0
degrees 25 minutes 31 seconds West 46.598 meters (152.88
feet) to a point "1093" designated on said plat, which point is
on the south Iine of the grantors' land; thence North 89
degrees 09 minutes 23 seconds West 15.000 meters (49.21
feet) along the south line to the west line of said section;
thence North 0 degrees 25 minutes 31 seconds East 46.560
meters (152.76 feet) along said west line to the point of
beginning and containing 0.0699 hectares (0.173 acres, more
or less, inclusive of the presently existing right of way which
contains 0.0568 hectares (0.140 acres), more or less. The
portion of the above described real estate which is not
already embraced within the presently existing right of way
contains 0.0131 hectares (0.033 acres), more or less.
as an R-3 One to Eight Family Residence District; and
Whereas, it is desirable to change the above described real estate's zoning designation to
an R-3 Special Use District in order to allow the occupier to maintain an
administrative office building on the premises; and
NOW THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana,
that the zoning designation for the above described property is changed to an R-3 Special Use
District.
