HomeMy Public PortalAbout007-2003 - Zoning - 3433 East Main - R-2 to C-2ORDINANCE 7-2003 A SPECIAL ORDINANCE AMENDING THE ZONING MAP FOR A CERTAIN PARCEL FROM R-2 TO C-2 Whereas, the Zoning Map designates certain property commonly known as 3433 East Main Street, Richmond, Indiana, and legally described as follows, to wit: Being a part of the Southeast Quarter of Section 34, Township 14 North, Range 1 West, in the City of Richmond, Wayne County, Indiana, and being more particularly described as follows: Beginning at a point on the west line of a tract of land owned by Wal-Mart Stores, Inc. as recorded in Deed Record 471, page 609 in the Office of the Wayne County Recorder, Wayne County, Indiana, said point being more particularly described as follows: Commencing at an iron pipe found at the southeast corner of the Southeast Quarter of said Section 34, and running thence south 89 degrees, 51 minutes and 00 seconds west, along the south line of said Southeast Quarter, 572.00 feet to a point on the west line of said Wal-Mart Stores, Inc. tract, and on the east line of a tract of land owned by Sedd Realty as recorded in Deed Record 473, page 498 in said Recorder's Office; thence north 00 degrees, 12 minutes and 05 seconds east, along said west and east lines, 515.01 feet to the beginning point of this description, and running thence from said beginning point, south 89 degrees, 51 minutes and 00 seconds west to a point; thence north 45 degrees, 00 minutes and 00 seconds west, 80.87 feet to a point; thence north 00 degrees 07 minutes and 40 seconds east, 211.85 feet to a point on the south right-of-way line of United States Highway Number 40; thence north 87 degrees, 47 minutes and 30 seconds east, along said south right-of- way, 203.09 feet to a point on the west line of a tract of land owned by Sparkling Image I an Indiana General Partnership as recorded in Deed Record 457, page 108 in said Recorder's Office; thence south 00 degrees 22 minutes and 35 seconds east, along the west line of said Sparkling Image I tract, 250.56 feet; thence south 00 degrees, 12 minutes and 05 seconds west 25.91 feet to the place of beginning, containing an area of 1.241 acres. as a R-2 One Family Residence District; and Whereas, it is desirable to change the above described real estate's zoning designation to C-2 Commercial District, because the surrounding properties are zoned for commercial use. Additionally, the owner of said real estate wishes to use the parcel for a banking center. NOW THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana, that the above described property is changed to C-2 Commercial District. Passed and Adopted this 17th day of March 2003, by the Common Council of the City of Richmond, Indiana.
