A SPECIAL ORDINANCE VACATING A PUBLIC WAY
WHEREAS, William Grimes has petitioned Common Council of Richmond, Indiana, requesting a
portion of a public right of way commonly known as South 15"' Street near South `U'
Street. A copy of a map showing the parcel to be vacated is attached hereto as "Exhibit
A"; and
WHEREAS, the abutting landowners are as follows:
(a) William H. & Earlene M. Grimes, 1423 South "U" Street
(b) Lee & Marian L. Pope, 2115 South 14"' Street (mailing address: RR 3 Box 90,
Liberty, IN, 47353)
(c) Lee & Marian L. Pope, 2100 South 14"' Street (mailing address: RR 3 Box 90,
Liberty, IN, 47353)
(d) James R. & Hattie L. Atkins d/b/a Jim's Body Shop, 2252 Straightline Pike
(e) William H. & Earlene M. Grimes, 1501 South "U" Street
WHEREAS, the roadway proposed to be vacated is undeveloped and currently maintained by
petitioner; and
WHEREAS, Common Council, pursuant to Indiana Code 36-7-3-12, conducted a public hearing on
said petition , 2003, after publishing legal notice thereof at least ten (10)
days in advance of said hearing as required by statute; and
WHEREAS, the Richmond Advisory Plan Commission, pursuant to Richmond Code 155.04(b),
conducted a public hearing on said petition , 2003 after publishing legal
notice thereof at least ten (10) days in advance of said hearing as required by ordinance;
and
WHEREAS, it is desirable to vacate said public way.
NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond,
Indiana, that subject to the preservation of easements for existing utilities, the portion of public way
described in attached Exhibit A is hereby vacated and that ownership of such land shall vest in the
abutting property owners.
Passed and adopted this _7th day of _July 2003, by the Common Council of the City of
Richmond, Indiana.
