HomeMy Public PortalAbout10-06-2011 agendaOctober 6, 2011 The Agenda Meeting of the Mayor and Council of the Borough of Agenda Meeting Carteret preceding the Regular Meeting, October 20, 2011, was held on Thursday, October 6, 2011, 6:00 P.M., Council Chambers, Memorial Municipal Building, 61 Cooke Avenue, Carteret, New Jersey. The following were noted present: Roll Call Mayor Daniel J. Reiman Councilmember Vincent Bellino Jorge Diaz Dennis DiMascio " Randy Krum Susan Naples Joseph Sitarz Also noted present was Borough Attorney Robert Bergen and Also Noted Present Municipal Clerk Kathleen M. Barney. The Clerk stated that on January 3, 2011, the 2011 Annual Notice Statement of was mailed to The Home News Tribune, The Star Ledger and Meeting Notice posted on the Bulletin Board. It was published in The Home News Tribune and The Star Ledger on January 4, 2011. The Meeting was opened with a minute of silent prayer and the Silent Prayer /Pledge Pledge of Allegiance led by Mayor Daniel J. Reiman. of Allegiance October 6, 2011 Minutes: Approved Upon MMS &C by Councilmembers Diaz and Sitarz and unanimous affirmative vote of the full Council present, the minutes of September 22, 2011 were approved and transcribed and engrossed by the Clerk. Re: Commendations Mayor Reiman addressed John Wyatt and said they would wait and see if some of his staff will show up to receive their commendations. Ordinance ORDINANCE — First Reading First Reading ORDINANCE 11 -27 was introduced.and adopted on First Reading ORDINANCE #11 -27 and the Clerk authorized and directed to advertise same for Public Capital Improvement Hearing to be held upon MMS &C by Councilmembers Within the Special Sitarz and Naples. Upon individual roll call vote Councilmembers Improvement District" Bellino, Diaz, DiMascio, Krum, Naples and Sitarz voted in the Affirmative. "ORDINANCE #11 -27" "CAPITAL IMPROVEMENT ORDINANCE PROVIDING FOR VARIOUS IMPROVEMENTS WITHIN THE SPECIAL IMPROVEMENT DISTRICT IN THE BOROUGH OF CARTERET AND FUNDED BY THE BUSINESS PARTNERSHIP" Ordinance #11 -26 ORDINANCE — Public Hearing 10 -6 -11 Public Hearing Open The Clerk stated that Ordinance #11 -26 was introduced and adopted on First Reading at an Agenda Meeting of the Borough Council of the Borough of Carteret held on September 22, 2011. It was duly published in The Home News Tribune on September 27, 2011 with notice it will be considered for final passage after Public Hearing to be held October 6, 2011 at approximately 6:00 P.M. 2: October 6, 2011 The Ordinance was posted on the bulletin board and copies were made available to the general public and according to law, she read the Ordinance by title. Upon MMS &C, by Councilmembers Diaz and Naples and unanimous affirmative vote of the full Council present, the Mayor declared the Public Hearing to be open. There were no comments from the public. There being no comments or objections to the Ordinance, the Mayor declared the Public Hearing to be closed upon MMS &C by Councilmembers Diaz and Sitarz and unanimous affirmative vote of the full Council present. Upon MMS &C by Councilmembers Diaz and Naples ORDINANCE #11 -26 "AMENDING AND SUPPLEMENTING CHAPTER 109, ENTITLED 'UNIFORM CONSTRUCTION CODES "' was finally adopted. Upon individual roll call vote, Councilmembers Bellino, Diaz, DiMascio, Krum, Naples and Sitarz voted in the affirmative. Public Hearing Open Public Hearing Closed Ordinance #11 -26 Amending & Supplementing Chapter 109 Entitled 'Uniforms Construction Codes' Adopted October 6, 2011 APPROVED AND ADOPTED: October 6, 2011 INTRODUCED: September 22, 2011 Advertised as Adopted on First Reading with notice of Public Hearing: September 27, 2011 HEARING HELD: October 6, 2011 Approved By: Mayor Daniel J. Reiman Advertised as Finally Adopted: October 11, 2011 Public Hearing - 10 -20 -11 Ordinance #11 -20 1. #11 -20 Appropriating $650,000.00 from the Green Acres Public Hearing State Grant Fund and Park Improvements. The Mayor said the Public Hearing will be on October 20, 2011. Resolutions RESOLUTIONS: 1. Directing the Issuance of Various Raffle Licenses. 2. Professional Services - Slavin & Morse, LLC Re: ABC Related Matters. 3. Professional Services - T &M Associates, Re: Roosevelt Avenue Sanitary Sewer Surcharge Scope & Fee Estimate. 4. Approving Renewal of ABC License for 2011/2012, Re: Karen Bezner, Esq. Chapter VII Trustee for Albob, Inc. Mayor Reiman said this is the Bankruptcy Trustee in the State. Mayor Reiman They issued a special ruling in regard to the license. This is the ABC License for the old Partner's Pub which was then Bob Bucklew's which was then something else. Karen Bezner is the bankruptcy trustee for Albob Inc. 5. Professional Services -CME Associates, Re: Milik Street Area Drainage System Project. 6. Award of Bid - Romanowski Avenue and High Street Improvements to Lancha Construction. 4 October 6, 2011 Resolutions #11 -187 through #11 -191 were introduced by the Mayor. Mayor Reiman asked if there were any questions on the resolutions, •IhL referred them to the Council for action. Upon MMS &C by Councilmembers Sitarz and Krum, and unanimous affirmative vote of the full membership present, the following resolutions were adopted. PAYMENT OF BILLS — Upon MMS &C by Councilmembers Diaz and Bellino, all bills appearing on the prepared list properly audited and signed were ordered to be paid. Upon individual roll call vote, Councilmembers Bellino, Diaz, DiMascio, Krum, Naples and Sitarz voted in the affirmative. APPLICATIONS: Carteret Volunteer Fire Department #1 — New Member, Gerald Obriwin. The Mayor asked the Clerk if this had been approved by the Police Department. The Clerk replied yes, he was approved. Upon MMS &C, by Councilmembers Naples and Krum, the application was approved. Upon individual roll call vote, Councilmembers Bellino, Diaz, DiMascio, Krum, Naples and Sitarz voted in the affirmative. REPORTS: 1. Clerk's Office — September 2011. 6• October 6, 2011 2. Inspection of Buildings — September 2011. Upon MMS &C, by Councilmembers Bellino and Krum and unanimous affirmative vote of the full Council present, all reports were ordered to be received and placed on file. BUSINESS TO BE ADDED — Business to be Added Mayor- 1. Appointments - Plumbing Sub Code Official — Arthur Arthur McCall McCall. Mayor Reiman said that Art McCall has been the Plumbing Sub Code Official for about five (5) years. He was provisional so they did a State wide regional test so we have to officially appoint him to the Sub code Official spot again. 2. Housing Authority— Chester Bohanek, Jr. Chester Bohanek, Jr. Mayor said his term is about to expire so we'll reappoint him. 3. Assistant Municipal Clerk— Linda Rivera. Linda Rivera Mayor said Linda Rivera, has served as our Assistant Municipal Clerk for 12 years. So, the State finally determined that there is a need for a ranking. She has been ranked as number one, so, she'll be officially appointed to that position. Upon MMS &C, by Councilmembers Sitarz and Bellino and Approved unanimous affirmative vote of the full Council present, the Council approved the appointments. Upon MMS &C, by Councilmembers Diaz and Bellino and Open to Public unanimous affirmative vote of the full Council present, the meeting was Opened to the Public. October 6, 2011 Discussion Kevin Urban asked if there was anything they can do with regard to acoustics at the Municipal Court? Mayor Reiman said they we directed the Buildings & Grounds Department to evaluate that with the Court System and the court staff. As you know, that particular system is designed for recording not necessarily for amplification, although he does believe that they do have assisted listening devices. We do have them here as well. If you see the sign over there, if some point in time you can't hear, there is an assistant amplification device that you can put on and it ties right into our system. We have asked Debbie Uhouse and Tony Neibert to get together and hopefully it is a simple solution, it may just be adding speakers throughout the Courthouse. Meeting Closed Upon MMS &C by Councilmembers Sitarz and Bellino and unanimous affirmative vote of the full Council present, the public portion of the meeting was closed. Commendations COMMENDATIONS- Mayor Reiman and Council President Bellino Hurricane Irene and etc. Mayor Reiman said despite the Hurricane, there was no loss of life in Carteret. We can't say enough about the Office of Emergency Management. When there are floods, snowstorms and hurricanes that your office is there along with their staff and volunteers. They help Carteret and save lives and doing it with no thanks sometimes from people in the Borough. He said he has special commendations and read the names. The Mayor then congratulated Chief Wyatt on a job well done. The Chief thanked the Mayor for his kind words. After no further discussion, upon MMS &C by Councilmembers Adjourned Diaz and Krum and unanimous affirmative vote of the full Council present, the meeting was adjourned at approximately 6:10 P.M.
