The regular meeting of the Planning Commission of, the City of Temple City was called to order by Chairman Oakley at 7:30 P. M. 2, The Pledge of Allegiance to the Flag was led by Chairman Oakley. 3. ROLL CALL: Present: Commissioners Beckman, Garvin, Lawson, Millham, Oakley Absent: Commissioners - None Also Present: City Manager Koski, Asst. City Attorney Tweedy, Planning Director Dragicevich and Planning Technician Burnham. " 1 1 4, APPROVAL OF MINUTES: Regular Meeting of September 10, 1968: There being no additions or corrections to the minutes, Commissioner Millham moved they be approved as submitted. Commissioner Garvin seconded, and a roll call vote was taken as follows: AYES: Commissioners Garvin, Millham, Oakley NOES: Commissioners - None ABSTAINING: Commissioners: Beckman, Lawson Regular Meeting of October 8, 1968: There being no additions or corrections to the minutes, Commissioner Millham moved they be approved as submitted. Commissioner Beckman seconded, and a roll call vote was taken as follows: AYES: Commissioners: Beckman, Lawson, Millham, Oakley NOES: Commissioners; None ABSTAINING: Commissioners: Garvin APPROVAL OF RESOLUTION NO. 68 -315PC There being no additions or corrections to the Resolution, Commissioner Millham moved it be approved; it was seconded by Commissioner Beckman. A roll call vote was taken as follows: AYES: Commissioners: Beckman, Lawson, Millham, Oakley NOES: Commissioners: None ABSTAINING: Commissioners: Garvin PUBLIC HEARING: ZONE VARIANCE CASE NO. 68-268 Mr. and Mrs. Edward B. Forstall, Owner - Applicant 4814 N. He l eo Avenue, Temple City Site: Same The Planning Director stated the applicant proposes to convert existing garage into living space and build a new two -car garage with less than the required side and rear yard setbacks. He called their attention to the plot plan which showed existing and proposed development, and gave the factual data on the subject property. He read the staff recommenda- tions on file in the Planning. Department, and concluded that the issue in this case is that accessory structures on interior lots of unequal depths cannot be built to the lot side or rear property line (within the last third of the lot) without observing 5 ft. setbacks. Commissioner Beckman drew attention to the plot plan, that it showed a 3 ft. sideyard setback and no rear yard setback, and the Planning Director stated that the side yard setback is critical in this case due to the existing residential structure to the north, and that there is no development to the east of the subject property. PLANNING COMMISSION MINUTES October 22, 1968 - Page two. 1 1 • There being no further questions the public hearing was declared open. Mr. Edward B. Forstall, 4814 N. Heleo Ave., assumed the podium, and said he had nothing to add to the Planning. Director's presentation. Commissioner Millham asked if he had any objection to making the side yard setback 5 ft., and the approaches for automobiles would be within driving range. Mr. Forstall replied he wanted it this way for safety purposes; he would rather have 3 ft, than 5 ft. Com- missioner Beckman questioned whether he could build right on the rear property line. The Planning Director stated that he cannot in this case. The Planning Director called attention to another point to consider, under the L.A. County Building Code, that the garage cannot overlap the house, unless certain distance between the structures is met. Planning Technician Burnham demonstrated by a drawing. There followed considerable discussion by the Commission about relocating the doors, and also relocating the proposed garage. Mr. Forstall stated he had other plans for the property, such as installing a swimming pool in the future, and was disinclined to build the proposed garage behind the house. In answer to a question from Commissioner Millham, Mr. Forstall said there was no easement shown on his deed. There being no one else to speak in favor, and no one in opposition, Commissioner Beckman moved to close the public hearing. It was seconded by Commissioner Millham and so moved. In the Commission discussion that followed, the Commissioners generally agreed that there were alternates to the proposed plan that would be more acceptable than the one presented, and it was suggested that the applicant be returned to the podium and asked his opinion. Noting that no one had left the room, Chairman Oakley reopened the public hear - i ng. Mr. Forstall stated he had no objection to moving the garage forward (westerly) and building a fire wall. Commissioner Millham moved to continue the public hearing to the next regular meeting of the Planning Commission on November 12th, giving the applicant a chance to present a revised plot plan. It was seconded by Commissioner Beckman and so moved, 6. COMMUNICATIONS There were none. 7. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK There was no one. 8. MATTERS FROM CITY OFFICIALS Planning Director Dragicevich called the attention of the Commission to two cases being appealed to the City Council from Planning Commis- sion decisions: Zone Variance Case 68 -265 (the property at 6327 No. Primrose), and Zone Variance Case 68 -266 (the property at 10566 E. Live Oak). The Planning Director referred the Commission to the recent Zone Change request (Case No. 68-263), and stated that Mr. Brown had been .success- ful with his appeal to the County Tax .Assessor's Office, and his taxes will be reduced, inasmuch as it had been determined by that office that much of the property on his side of Lower Azusa Road had been incorrectly assessed. 1 PLANNING COMMISSION MINUTES October 22, 1968 —Page three. Commissioner Garvin asked if Mr. Shook or the Fire Department had been contacted regarding the conditions at 4906 Encinita, The Planning Director informed him that the Fire Department had been apprised of the situation, but no report had been received from them as to action taken. He said this matter would be pursued by the staff. 9. ADJOURNMENT There being no further business, Commissioner Beckman moved to adjourn to the adjourned meeting of the Planning Commission of October 22, 1968.
