AN ORDINANCE AUTHORIZING THE ACQUISITION OF CERTAIN
PROPERTY IN CONNECTION WITH THE SABO STREET PUMP
STATION EXPANSION
WHEREAS, the Borough of Carteret (the "Borough") is in the process of expanding
the Sabo Street Pump Station in order better to serve the people of Carteret; and
WHEREAS, in order to accomplish the planned expansion it is necessary for the
Borough to acquire certain adjoining property.
NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the
Borough of C'arteret that the Borough shall acquire a portion of Lot 29 Block 50.01
which is currently owned by Milik Street Associates, a copy of a survey prepared by
a surveyor on behalf of the Borough outlining the property (the "Property") to be
acquired is attached.
BE IT FURTHER ORDAINED that this action is permitted by N.J.S.A. 40A: 12.-3
BE IT FURTHER ORDAINED that the purchase price of the Property shall not
exceed $10,000, which is in keeping with an appraisal prepared on behalf of the
Borough with consideration given to cost avoidance and acquisition timing.
BE IT FURTHER ORDAINED that the Mayor and Municipal Clerk be and are
hereby authorized to execute on behalf of the Borough a purchase agreement
consistent with the Ordinance, along with such other documents, including, but not
limited to, a sub-division application, as are necessary to carry out the intended
purpose of this Ordinance.
BE IT FURTHER ORDAINED that this Ordinance shall be advertised as
prescribed by law.
