Lela Hayward - Head Start Program 9. COUNCIL RECESS TO: LYNWOOD REDEVELOPMENT AGENCY LYNWOOD INFORMATION INC. PUBLIC ORAL COMMUNICATIONS (Regarding Agenda Items Only) SCHEDULED MATTERS 10. PUBLIC HEARING: PROPOSED ORDINANCE TO REGULATE HELISTOPS - Comments: This is a proposed amendment to Chapter 25, the Official Zoning Ordinance pertaining to development standards for helistops in conjunction with the construction of new facilities in the City. Recommendation: Waive reading and introduce the proposed ordinance. 11. PUBLIC HEARING: TOWING SERVICES Comments: Two (2) applications have been received for towing services: 1. Southeast Towing Service f � 2. James E. Delaney - Attorney During the first quarter of FY 88-89: 1. Southeast Towing has received three (3) city referrals (see attached memo -Sheriff's Department) and has complied with Ordinance 1040 Section 19-198. t 2. Winns Towing Service has received 490 city referrals per ^ memo Lynwood Sheriffs Department, and has not complied with Ordinance 1040 Section 19-198. 2 / • • 'CITY-COUNCIL MEETING OF NOVEMBER 1, 1988 Recommendation: Upon conclusion of the Public xearing, Council is requested to approve the application for Southeast Towing. CONSENT CALENDAR NOTICE All matters listed under the Consent Calendar will be acted upon by one Motion affirming the action recommended on the agenda. There will be no separate discussion on these items prior to voting unless members of the Council or staff request specific items be removed from the Consent Calendar for separate action. 12. ACCEPTANCE OF TREE MAINTENANCE PROJECT, AREA 3(FY 87-88) Comments : On May 17, 1988, the City Council awarded a contract to California Western Arborist, Inc. of Compton to perform tree maintenance services at various locations throughout the City. Area 3 has been completed in accordance with the plans and specifications. Recommendation: It is recommended that the City Council adopt the attached resolution accepting Area 3 as being complete in accordance with contract documents. 13. ATLANTIC AVENUE RECONSTRUCTION PROJECT (FROM BEECHWOOD AVENUE TO NORTH CITY LIMITS) Comments : A Request for Proposals for consulting engineering services was advertised. After careful evaluation of the consultants' qualifications, Don Greek and Associates (DGA) was selected as the most qualified firm. Recommendation: It is recommended that the City Council adopt the resolution awarding the contract to Don Greek and Associates for a fee of $25,560 and authorize the Mayor to execute the agreement. 19. NUISANCE ABATEMENT 9910 LONG BEACH BOULEVARD Comments: f To set Public Hearing to ascertain whether a nuisance is being maintained at 9910 Long Beach Boulevard. Recommendation: It is recommended that the City Council adopt the attached resolution entitled "A Resolution of the City of Lynwood Declaring Its Intention To Conduct A Public Hearing To Ascertain Whether A Nuisance Is Being Maintained On Certain , Real Property." I 3 • � CITY'COUNCIL MEETING OF NOVEMBER 1, 1988 15. AMENDMENT TO PUBLIC SERVICE CONTRACT WITH COMMUNITY LEGAL SERVICES Comments: The purpose of this item is to request Council approval of an amendment to a public service contract with Community Legal Services. Recommendation: Staff respectfully requests that Council 1) adopt the attached resolution approving a contract amendment with Community Legal Services and 2) authorize the Mayor to execute three (3) copies of the amendment to the agreement, upon approval by the City Attorney. 16. TIME EXTENSION FOR USE OF BOND PROCEEDS Comments : The purpose of this item is to request Council approval of a time extension to utilize bond proceeds in the Los Angeles County Single-Family Mortgage Revenue Bonds Aome Improvement Program (1986 Series A). Recommendation: Staff respectfully requests Council approval of the attached resolution authorizing an extension of the Bond Program Commitment period to November 1, 1989. 17. RENOVATION OF V.I.P. ROOM Comments: Funds have been approved for remodeling of VIP Room at Bateman Hall. Staff has investigated and found it to be more expedient to purchase furniture through informal purchase procedure. Recommendation: That City Council adopt a resolution authorizing staff to purchase furniture for the VIP Room through informal purchase procedure. 18. REQUEST FOR APPROVAL OF OUT OF STATE TRAVEL Comments: I The purpose of this item is to request Council approval of an � out of state travel request for the Housing and Community Development Manager to complete the requirements necessary for certification as an Economic Development Professional. Recommendation: Staff respectfully requests that Council approve the attached resolution which allows the Housing and Community Development Manager to travel to Washington, D.C., to complete course requirements for certification as an Economic Development Professional. 4 � � , CITY COUNCIL MEETING OF NOVEMBER 1, 1988 19. WARRANT REGISTER DATED NOVEMBER 1, 1988 Recommendation: It is recommended that the City Council approve the Warrant Register. DISCUSSION ITEMS 20. ROBERTS RULES OF ORDER Comments: The matter of establishing parliamentary procedures has been � brought up several times at Council Meetings. At the last regular Council Meeting of October 18, staff was instructed to place an item on the agenda for adoption of Roberts Rules - of Order. Recommendation: Staff awaits direction from City Council on this matter. 21. SELECTION OF A FINANCIAL CONSULTANT Comments: . Last February, 1988, formal bids were requested for financial consulting. Contracts were never issued on those bids and all bids were rejected on August. Recommendation: Council give staff direction on whom to hire as financial consultant. 22. AUTHORIZATION TO SUBMIT GRANT APPLICATION TO HUB CITIES CONSORTIUM Comments : Staff has submitted an application to the HUB Cities for the funding of job training through Project Impact. In addition to this grant, the HUB Cities has informed us that we can apply for matching funds to help pay the cost of on the job training to be conducted.by contractors through public works projects. Recommendation: I That Council authorize staff to submit a grant application for $50,000 to the HUB Cities Consortium for the Long Beach Blvd. construction project training proqram. IN THE COUNCIL CHAMBERS OF THE CITY HALL, 11330 BULLIS ROAD, I CITY OE LYNWOOD, CALIFORNIA. � 6 • � REGULAR MEETING OCTOBER 4, 1988 The City Council of the City of Lynwood met in a regular session in the City Hall, 11330 Bullis Road on the above date at 7:30 p.m. Mayor Richards in the chair. Councilmembers Neine, Henning, Morris, Wells, Richards, answered the roll call. Also present were City Manager Gomez, City Attorney Barbosa and � City Clerk Hooper. City Clerk Hooper announced the agenda had been duly posted according to The Brown Act. Ron Wright, 11364 Virginia, spoke regarding Public Safety Tax. Donal Martin, 3740 Carlin spoke regarding parking problems in area near his home. SCHEDULED MATTERS: Mayor Richards announced the time had arrived to conduct a public hearing on proposed ordinance to regulate helistops. It was moved by Councilmember Henning, seconded by Councilmember Heine to open the public hearing. Community Development Director Mas stated the Planning Commission had made certain changes in the ordinance addressing the concerns of Council when the ordinance was presented at an earlier date. Ron Wright, 11364 Virginia, stated there were enough ch ppers in — the air already. Spoke in opposition to the ordinance. AG�,��i�ITFii Hearing no further response, � I It was moved by Councilmember Heine, seconded by Counci member Henning to close the public hearing. I Councilmember Wells questined clause in the ordinance regarding "transportation of officers to the Justice Center." Councilmember Henning stated he didn't feel it would be safe r � � , to have a number of helicopters in the air,at any given time. Councilmember Morris spoke regarding transporting sick and injured persons in helicopters. Spoke in favor of helistops in the city. It was moved by Mr. Morris to accept the ordinance. Councilmember Henning spoke regarding the omission of the size of the helicopters and feels the noise level would be extremely loud. Lt. Mark Thompson, Sheriff's Department, discussed the type of helicopters used by the Sheriff's Department. i� Councilmember Heine seconded motion made by Councilmember Morris. Ricarda Bennett, St. Francis Medical Center, spoke regarding transporting of patients. Mayor Richards stated there was'some concern about the safety of the citizens in the city. Feels some of the language in the ordinance should be changed. After further discussion, Maker of motion and second, Councilmember Morris and Councilmember Heine modified motion to continue matter to the next Council meeting. CONSENT CALENDAR: All matters listed under the Consent Calendar were acted upon by one motion affirming the action recommended on the agenda unless members of the Council or staff requested the item removed for separate action. City Attorney Barbosa suggested Council go on record as acting .� upon item number 22-Resolutionestablishing findings relative to the hiring of local residents through City contractors- prior L to acting upon item number 11-Long Beach Boulevard improvement project, Phase Z-as number 22 sets forth findings with respect to youth employment and if Council accepts recommendations of staff on number 11, will be implementing those youth employ- ment requirements. Councilmember Henning requested item number 11-Long Beach Boule- vard Improvement Project-Phase I; and item 21-Stipend for Municipal Organizations. Councilmembr Wells requested item number 12-Prohibiting of Park- ing on City's Major Boulevards - Street Sweeping. Mayor Richards requested item number 22-Resolution establishing findings relative to the hiring of local residents through contractors. Mayor Richards questioned where the findings were listed in item number 22-Resolution establishing findings relative to the hiring of local residents through city city contracts. Was informed the findings were in resolution. City Council amend the authoxized position list to add one Admini- strative Aide position to the Engineering Division and delete one Office Assistant position. I � � RSSOLUTION NO. 88-174 entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD ACCEPTING AN EASEMENT FOR STREET DEDICATION FOR 10450 LONG BEACH BOULEVARD." was presented. RESOLUTION NO. 88-775 entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD AUTHORIZING THE CONSTRUCTION OF IMPROVEMENTS." was presented. Council approve conversion of Secretarial position to Administra- tive Aid position within the Recreation and Parks Department. � Council adopt policy, Administrative Officer's Guidelines for hearing on Disability Retirement Applications. � RESOLUTION NO. 88-176 entit2ed: "A RESOI.UTION OF THE CITY COUNCIL OF THE CZTY OF LYNWOOD AUTHORI2ING AN AMENDMENT TO THE FY 1988/89 BUDGET IN ORDER TO PURCHASE TWO PERSONAL COMPUTERS." was presented. Council authorize staff to apply for two million dollars in ICALFA funds to be utilized towards the Atlantic Boulevard Improvement Project. ORDINANCE entitled: "AN ORDINANCE OF THE CITY OF LYNWOOD AMENIID7G ORDINANCES NO. 1206, 1243� AND 1269 ESTABLISHING SALARIES FOR THE CITY COUNCILMEMBERS. RESOLUTION NO. 88-178 entitled: "A RESOLUTION OF THE CZTY COUNCIL OF THE CITY OF LYNWOOD ALLOWING AND APPROVIAIG THE DEMANDS ANC ORDERII9G WARRANTS THEREFOR." was presented. ' It was moved by Councilmember Henning, seconded by Councilmember Morris to adopt the resolutions and approve the items. Public Works Director Wang discussed implementing program de- signed to hire local residents by contractors doing business for the city. Stated a large number of applications had been received. Councilmember Henning stated the city and projects designed to - help young people, must come together in order for those in need of a job ..to be informed. By General Consent, it was agreed to hold a workshop meeting on this item. Date to be set by the City Manager. Councilmember Wells requested item number 12-Prohibiting of parking on City's major Boulevards-Street sweeping; and questioned how this was going to work as some of the streets are posted no parking on Thursday and Friday. By General Consent, item numb,er 12-Probibiting of parkinq on City's major Boulevards-Street sweeping; and item number 22-Imple- j mentation of a program to encourage the employment of local youth, be brought back for further clarification and information. Councilmember Morris spoke on item number 21-Stipend for Municipal Organizations. Stated he does not feel there should be any changes in the fees paid to Conncilmembers who attend these meetings. Spoke regarding �e city facilities. After Council discusison, By General Consent, it was agreed that the City of Lynwood would not participate in the program at this time. City Manager Gomez requested item number 25-Public Safety Tax be pulled from the agenda as word was received that the Telephone Company was opposing the item. � Councilmember Henning spoke regarding Telephone Company and the need for.them to work with the city. Items number 26-Zoning and General Plan Consistency, and � ' item number 27-Relocation Assistance to displacees resulting from Code Enforcement Action, were continued to a workshop meeting. Council reconvened at 11:05 p.m. City Barbosa stated Closed Session was held to appoint Bond Counsel for the refunding of Lynwood Redevelopment Agency Tax Allocation Bonds. It was moved by Councilmember Henning, seconded by Councilmember Wells to appoint Arnell and Hasties as Bond Counsel for the refunding of Lynwood Redevelopment Agency Tax Allocation Bonds. Nathaniel Davis, 11314 California Ave., spoke regarding traffic .,� congestion on Fernwood. Charles Andrews, Lynwood resident, spoke regarding landscaping he does. Left literature for Council to review. COUNCIL ORAL AND WRZTTEN COMMUNICATZONS: Councilmember Heine spoke regarding cleanup campaign in the city. Councilmember Henning spoke regarding pay phones that are in- stalled without a city business license. Questioned the status on the towing company. Councilmember Wells spoke regarding a schedule from the Young People of Lynwood on the alley cleanup. Also spoke on solicitors � � � � blocking the doorway to Lucky Market. , Mayor Richards complimented staff on the fine job done on the many projects that are in progress in the city. Community Development Director Mas introduced new Planning Manager, Aubrey Fenderson. Also spoke regarding the proposals received on the updating of the General Plan. There was no further business, and it was moved by Councilmember . Mas, Director v��� Community Development Department SUBJECT: Proposed Ordinance to Reaulate Helistops - Case No. 88008 Proposal• Pursuant to recent deveiopment activities, staff has prepared the attached• Ordinance reflecting the necessary development standards for helistops. t ' BackcTround At its meeting of.July 19, ihe City Council remanded the proposed . ordinance back to the City Planning Commission, in order to address , concerns about emergency uses. After review of the ordinance the City Planning Commission at its regularly scheduled meeting of September 13, resubmitted the item for Council consideration. On Octoher 4, the City Council continued the item because the ordinance was replaced by another version the night of the meeting and the Council requested that certain terminology and wording be addressed and changed. FACTS Specifically, the Lgnwood Regional Justice Center and St. Francis _ Medical Center have expressed interest in developing a helistop in conjuction with the construction of new facilities. The ordinance discusses specific Planning and Fire Department standards which are essential to active helistop facilities. The proposed ordinance has been reviewed and approved by the Fire Department. ' • Additionally, the ordinance addresses the noise issue by mandating the cooperation of the helicopter operator in using the most noise efficient models. 'This would mitigate the potential for noise impacts caused by the use of a helistop. , The' ordinance also addresses the added hazard caused by refueling ' and/or repairs by prohibiting this type of activity and prohibiting a heliport, as well. The ordinance has been revised to prohibit the operation of � helicopters except for emergency uses only. ISSUES AND ANALYSIS: The proposed helistop ordinance governs helicopter activity and helistop location. This is done by restricting flight patterns, time of flights and parcel size where helistops may be located. After consultations with the Los Angeles County Sheriff's Department and "St. Francis Medical Center, staff and the City Attorney have revised some of the wording in the first draft, which was found - objectionable by the City Council at its meeting of October 4, 1988. The approach patterns shall comply with the "Fly Neighborly Program to avoid fly-over of the residential neighborhoods as much as possible. 2. Construction of the Helistop facility shall comply with building design for load bearing standards relative to helistop landing pads. 3. Special landing permits for occasional landings at sites other than duly established helistops may.be issued by the ; Director of Community Development, subject to such conditions as may be imposed by the Fire Department. Such occasiona� use facilities shall be at qround elevation, or if at roof elevation; . the buildinq must have been designed to accommodate a helistop. 6. An application for a helistop Conditional Use Permit shall• - . be filed with the Director of Community Development, using forms provided' by that office. The application shall be . accompanied by a detailed plot plan showing location in relation to land use in the area, and the size and detail of the proposed helistop. A filing fee in the amount established by Resolution of the City Council for a , - Conditional Use Permit shall be paid at the time the application is filed. 7. Roof top installation helistops may be erected on the roofs of buildinqs, subject to the following conditions: , a. On all touch-down or landing areas, whether elevated or flush with the roof, provision shall be made for collecting volatile substance which may be spilled in event of any emergency. Separator or clarifier tanks for �collecting spilled volatile substance shall be installed under approval and supervision of the Fire Department. b. The roof-top shall have at least two (2) conforming exits and they shall be located in such a manner as to permit safe exit from the roof area in the event one of the • exits is blocked. : c. A wind indicating device shall be installed. A flag, banner, or similar device is acceptable. d. Two or more wet standpipes shall be provided and equipped with one and one-half (1-1/2) inch rubber lined • fire hose at least one-hundred {100) feet in length. Hose . shall be equipped with combination fog nozzles. Sufficient pressure shall be available to afford.a good fog pattern. Hose cabinets or racks shall be,located near the separate exits. Standpipe outlets shall be so located that a12 portions of the roof area shall be within one hundred twenty (120) feet of the outlet. ; , e. Two fire extinguishers of at least sixteen (16) BC .rating shall be provided, and be located remotely from each other. f. Lights as are installed to illuminate the touch-down pad shall be directed on to the touch-down pad only, and in ' such a manner that the light rays cannot interfere with the helicopter pilot's vision, or other aircraft flying within the area of the landing facility. : g. No persons shall be permitted in the general Tanding area in any location where any portion of their bodies will be hiqher than the touch-down area surface while landing or take-off operations are underway. h. Special landing permits for occasional landings at sites . . other than duly established helistops may be issued by the Director of Community Development, subject to such conditions as may be imposed by the Fire Department. Such occasional use facilities shall be at ground elevation, or if at roof elevation; the building must have been designed to accommodate a helistop. 6. An application far a helistop Conditional Use Permit shall be filed with the Director of Community Development, using forms provided':by that office. The application shall be accompanied by -.a detailed �lot plan showing location in relation to land use in the area, and the size and detail of the proposed helistop. �A filing fee� in the amount established by Resolution .'of the City Council for a Conditional Use Permit sha]:1 be paid at the time the application is filed. � - 7. Roof top installation helistops may be erected on the roofs of buildings, subject to the following conditions: a. On all touch-down or landing areas, whether elevated or flush with the roof, provision shall be made for collecting volatile substance which may be.spilled in event of any emergency. Separator or clarifier tanks for collecting spilled volatile.substance shall be installed under approval and supervision of the Fire Department. b. The roof-top shall have at least two (2) conforming �� exits and they shall be located in such a manner as to permit safe exit from the roof area in the event one of the exits is blocked. c. A wind indicating device shall be installed. A � flag, banner, or similar device is acceptable. d. Two or more wet standpipes shall be provided and I equipped with one and one-half (1-1/2) inch rubber lined fire hose at least one-hundred (100) feet in length. Hose I shall be equipped with combination fog nozzlQS. Sufficient pressure shall be available to afford a good fog pattern. Hose cabinets or racks shall be located near the separate exits. Standpipe outlets shall be so located that all i portions of the roof area shall be within one hundred twenty i (120) feet of the outlet. � e. Two fire extinguishers of at least sixteen (16) BC I rating shall be provided, and be located remotely from each � other. - � f. Lights as are installed to illuminate the touch-down pad shall be directed on to the touch-down pad only, and in such a manner that the light rays cannot interfere with the helicopter pilot's vision, or other aircraft flying within I the area of the landing facility. g. The roof-top shall be marked as prescribed by ,the . Federal Aviation Agency. . n. The City Engineer's approval of a building for use as . a roof-top facility.shall be required as to structural adequacy. 8.. Ground-level Installations a. This barrier in no instance shall intrude into the glideslope. c. No unauthorized persons whatsoever shall be permitted • ° within the general landing area during flight operations. d. The helicopter landing facility shall be marked as prescribed by the Federal Aviation Agency. e. Any light installed shall illuminate and be directed onto the touch-down pad only, and in such a manner that the light rays cannot interfere with the pilot's vision. " f. Said application included a funding recommendation in he amount of $30,000 to Community Legal Services for the provision of public services. 2. On August 2, 1988, Council directed that the contract with the Agency be approved for $20,000 with the provision that the remaining $10,000 be awarded upon demonstration of ` satisfactory performance as indicated by a six month performance review. 3. On Auqust 2, 1988, Council also directed that a contract with Project Zmpact be approved for $30,000 with the provision that the remaining $10,000 be awarded upon demonstration of satisfactory performance as indicated by a six month performance review. 4. On August 16, 1988, during Public Orals, Reverend Harris of Project Impact addressed City Council and presented a detailed breakdown of the Agency's proposed budget for CDBG funds. Reverend Harris indicated that the provision stated in Fact #4 above, would create budgetary problems for his agency. He then suggested that Project Impact be awarded the full $40,000 with the provision that the funds be cut off any time there is evidence of unsatisfactory performance. 5. After consideration of Reverend Harris' presentation, the Council reached consensus on approving an aqreement with Project Impact for $40,000 and also agreed to delete the clause in the previous agreement providing for a$10,000 retainer as described in Fact #3 above, and subsequently approved a contract with Impact in the amount of $40,000;. however, the agreement with Community Legal Services remained as is. Existing contract language for public service activities provides remedies/actions the city may exercise in case of non-performance. The Housing and Community Development Manager, who is responsible for implementing the City's economic development activities, has successfully completed the first three courses and must complete the final course to be certified as an Economic Development Professional. 5. At the last regular Council Meeting of October 18, staff was instructed to place an item on the agenda for adoption of Roberts Rules of Or- der. Each Councilmen has been given a copy of Roberts Rules of Order for their perusal and for reference. The City Attorney has informed staff that not too many Cities for adopted Roberts Rules of Order. The Fund does not engage diroctly Sn charltable activity,. but will mako contributions to organizations active in research, educetion, and charitable programs for childran, especially in the Pields oP child safety, missing children, family safety and child abuse. The board of directors of the Cund indantifles those organizations engaged in the most useful pursuits in � these areas and provides'financial ascistance, pacticularly to organizations aith important projects which could not otherwise ne pursued because oP the lack of Ptnancinq. Funds will ba raised through direct ' eales, telemarketing, direct-mail fundraising, by approachos to private foundations and corporations, and by endorsements. • The Fund will register as a charitablo organization in those states requiring euch reglstration as a precondition to fundraising. The Fund qua11f1es for Pederal tax-exarnpt status under section 501(c)(3) of the Internal Revenuo Code oP 19B6 and 1e a public charity under sections 170(b)(1)(a)(vt) and 509(a)(1) of the Code. Our direct sollcltalton will be handled by paid solicitors exchanging one special edition FUNd Check Book Por each $20.00 contribution. The total cost oP' fundraieing ' (commissione and cost of serchandiae of sale) will not exceed 50$ oP the Punds generated. All funds collected (profaosional Pundraisers check will be accepted ln leiu of cash) are to be deposited Snto local accounts owned by United Chi?dren's Fund. All disbursements will be under the direct eupervision of Alan Dye, Secretary/Treasurer, Unitod Children's Fund. The eolicitation will take place between tho hourc oP lU A.M. and 8 P.M. and will employ no ex-felons or persons under 18 years of age.
