HomeMy Public PortalAbout17/03ORDINANCE NO. 17/03 AN ORDINANCE OF THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, PALM BEACH COUNTY, FLORIDA, AMENDING THE TOWN CODE OF ORDINANCES AT CHAPTER 14, ELECTIONS, SECTION 14-4, FILING REQUIREMENTS, BY ESTABLISHING A QUALIFYING PERIOD FOR CANDIDATES; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL OF ORDINANCES IN CONFLICT; PROVIDING FOR CODIFICATION; PROVIDING AN EFFECTIVE DATE. WHEREAS, pursuant to Florida Statute Section 101.62(4)(a), the Supervisor of Elections' Office shall send a vote -by -mail ballot to each absent uniform services voter and to each overseas voter who has requested a vote -by -mail ballot no later than 45 days before each presidential preference primary election, primary election, and general election, and; WHEREAS, the Towns' Code of Ordinances does not provide a specific date by which candidates seeking election must qualify; and WHEREAS, it is therefore required that the Town establish a qualification period for candidates to allow sufficient time for the ballot to be created and approved and sent to absent uniform services voters and to overseas voters pursuant to Florida Statute Section 101.62(4)(a). NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS Section 1. The Code of Ordinances of the Town of Gulf Stream is hereby amended at Chapter 14, Elections; Section 14-4 Filing Requirements to read as follows: Sec. 14-4. - Filing requirements. Any qualified candidate seeking election as a commissioner of the town shall file with the clerk of the town a petition signed by at least four registered voters of the town. The qualifying period for candidates shall begin at noon on the first Tuesday in December and end at noon on the third Tuesday in December prior to each election year. Section 2. Severability. If any provision of this Ordinance or the application thereof is held invalid, such invalidity shall not affect the other provisions or applications of this Ordinance which can be given effect without the invalid provisions or applications, and to this end the provisions of this Ordinance are hereby declared severable. Section 3. Repeal of Ordinances in Conflict. All other ordinances of the Town of Gulf Stream, Florida, or parts thereof which conflict with this or any part of this Ordinance are hereby repealed. Section 4. Codification. This Ordinance shall be codified and made a part of the official Code of Ordinances of the Town of Gulf Stream. Section 5. Effective Date. by law. This Ordinance shall take effect immediately upon its passage and approval, as provided PASSED AND ADOPTED in a regular, adjourned session of the Town Commission on the first reading this 13th day of Oct. 9th day of November 20 17.
