HomeMy Public PortalAbout070-2003 _hazardous materials fund_ORDINANCE NO. 70-2003 A SPECIAL ORDINANCE ESTABLISHING A NEW HAZARDOUS MATERIALS RESPONSE FUND WHEREAS, pursuant to I.C. 36-8-12.2-1 et seq. a City Fire Department may impose a charge upon any person who is a responsible party for creating a hazardous materials emergency which requires a response by the Fire Department; and WHEREAS, the above charge may include the total value of all assistance provided, as allowable by state law; and WHEREAS, prior to July 1, 2003, any and all monies collected herein had to be deposited into a City's General Fund and could be used only for the following, to -wit: (a) purchase of supplies and equipment used in providing the response assistance, (b) training for members of the department relating to a hazardous materials response, and (c) payment to any third party with whom the department contracts to provide response assistance; and WHEREAS, due to the nature of the General Fund, any monies not used for the specific purposes and retained at the end of a fiscal year, would revert to the following year's General Fund; and WHEREAS, effective July 1, 2003, due to a change in state law, a City may now establish a separate non -reverting Materials Response Fund, into which all collected reimbursements may be deposited and from which all response expenses may be expended; and WHERAS, it is desirable for the city of Richmond to establish such a separate fund in order to assure that the hazardous material emergency response program remains a self-sustaining program and may carry over any unused monies from year—to—year. NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana, as follows: A. A separate non -reverting fund known as the Hazardous Materials Response Fund is hereby established. B. The Hazardous Material Response Fund shall be administered according to Indiana law including, but not limited to, I.C. 36-8-12.8- 8.1.
