The regular meeting of the Planning Commission of the City of Temple City was called to order by Chairman Atkins at 7:30 P, M. , . June 23, 1970. 2. The Pledge of Allegiance to.the Flag ,was led by Chairman Atkins. 3. ROLL CALL: Present: Commissioners: Dennis, Garvin, Lawson, Atkins Absent: Commissioners: Beckman Also Present: City Manager Koski, Asst. City Attorney White, and Planning Director Dragicevich. Chairman Atkins stated that Commissioner Beckman had notified staff he would be unable to attend tonight's meeting because of business commitments. Commissioner Lawson moved to excuse Commissioner Beck- man's absence for cause, Commissioner Garvin seconded and the motion passed, 4. APPROVAL OF MINUTES: Regular Meeting of May -26, 1970. There being no additions or corrections to the minutes, Commissioner Lawson moved they be approved as presented. Commissioner Garvin seconded, and the motion. passed. UNFINISHED BUSINESS: �% 5. PLANNING COMMISSION CONSIDERATION Re Revised Tentative Tract Map 30308 5522 Gracewood,.Arcadia, California The Planning Director gave a brief history of this item, stating that Tentative Tract Map No, 30308 had been ,approved .on January 6, 1970, by the City Council. A.zone variance was requested for further addition to the hospital complex (Case No. 70 -313) and was granted by the City Planning Commission on May 12, 1970. The . approval being requested this evening was merely a formality, re- quiring.a motion to recommend to the City Council approval of this Revised Tentative Tract Map No. 30308. There was no objection to this suggestion, and Commissioner Garvin moved to recommend to the City Council approval of subject tract map. Commissioner Lawson seconded and the motion passed. " 1 NEW BUSINESS 6, PUBLIC HEARING: CONDITIONAL USE ;PERMIT CASE NO. 7G-317 William D. Hughes ). 815 Hampton Road, Arcadia ) and ) Owners Irving Riemer ) 1515 Meredith Avenue, Pasadena ) Paul W. Campbell, District Manager for "Burger King" - Applicant 2101 South Atlantic Boulevard Los Angeles The Planning Director gave the factual report, stating that the applicant proposes to construct and operate a drive-in restaurant at the southwest corner of Rosemead and Wedgewood Street in a C -M zone. He explained the plot plan marked Exhibit "A" which shows existing and proposed development, and gave the factual data and zoning history of the property. He concluded by listing the staff proposals which PLANNING COMMISSION MINUTES June 23, 1970 PAGE TWO are on file in the Planning Department, • The public hearing was declared opens Mr. Carol Langley, General Superintendent in charge of building for "Burger King ", speaking in favor, stated that, while the City of Temple City listed this operation as a drive-in restaurant, there are 68 permanent seats within the building. In his opinion this is a very clean - looking building, and the operation is one that will not cause a public nuisance, being well rune He continued that the applicant will accept the conditions set forth by the Planning Commission. He said the business operates in two shifts and employs approximately 22 people, most of whom will be residents of Temple City. The store manager for the proposed operation lives in the vicinity. The local district office of "Burger King" is in Los Alamitos, Hours of operation, he continued, would be 11:00 a. m. to 11:00 p.m. daily except Friday and Saturday nights when the operation would stay open until 12:00 p.m. if the City allows these hours. 1 Mr. :Bob Sorenson,.9981 Bogue Street, Temple City,.member of the Youth Commission and Chairman of a committee to further youth employment in .the City, spoke in..support of the conditional use permit application. If.it is approved, he stated, there would be nine youths employed on each shift, for a total of.18,from.Temple City, and this business would create job opportunities for local youth, Mr. Dana Godfrey, .5613 No Cambur. y, .Temple City, a l so.,a member of the Youth Commission and member of. the committee for youth employment, .spoke in: favor of the proposed application because of the job oppor- tunities it would create, Chairman Atkins asked if Mr. Godfrey was aware of the problems the City was having.with another drive -in business in.town, Mr. Godfrey said he was aware of them, but that the "Burger King" was a family -type business, unlike the other drive -in eating es- tablishments in town. There being no one else to speak in favor, Chairman Atkins asked those in opposition to speak. Mrs. Thomas Schlotfeldt, 8911 Wedgewood Street, was not against the application, but was concerned about who was going to be in charge of the operation at night. She further stated that many drivers don't realize that Wedgewood is a dead -end street and speed into it and are half -way down the street before they discover it is not a through street, and the traffic, especially during racing season, is cause for concern. Mr. Joe Conti, 8919 Wedgewood Street, said the City had several restaur- ants in this area and there was no need for another one; that this use was not a highway -type operation, and was a poor usage of the land. He felt the possible employment of eighteen local youths was not a signi- ficant factor. Mrs, Anna Brinko,.8922 E. Wedgewood Street, had visited some of the "Burger King" establishments and found them ;clean and not at all ob- jectionable; her objection to the application was because she presently had a problem of drainage from her neighbors' properties, and feared this installation would add to this problem. Mr. Harry Lawton, 8846 Wedgewood Street, stated there were 30 automo- biles owned by residents on that street, 22 or 24 of which are used daily. He was concerned about the traffic the proposed use would generate; that the northwest corner of Wedgewood and Rosemead was a "blind corner ", Children living on that street ride their bicycles to school, and this use would make it more hazardous for them to use bi- cycles. Also, people going from, south to north have difficulty, making a turn to get into Wedgewood, and particularly when the racetrack is open. SHe concluded by reading a letter from a neighbor who was unable to attend the meeting, Mr, Robert Avery, 8924 Wedgewood Street, who ob- jected to the proposed use because of noise and bright lights and who feared this use would lower property, values in the area. PLANNING COMMISSION MINUTES June 23, 1970 PAGE THREE Virginia Garrett, 8925 Wedgewood Street, was concerned about the cus- •tomers from "Burger King" possibly parking on Wedgewood Street, She has tenants and needs the little parking facilities that exist on that street for her tenants' visitors. There was no one else to speak against the application, and the appli- cant was offered an opportunity for rebuttal, II Mr. Langley addressed the Commission, said that "Burger King" is owned by Pillsbury Corp., which organization is very :strict in the management of "Burger King" Restaurants. There will always be two adults in:attend- ance, during business hours, and they are to supervise the parking lot in addition to the restaurant. They do not tolerate motorcycles racing around, nor cars loitering in the area:- no loitering in the restaurant either. He suggested the installation: of a "No Left Turn" sign on the exit on Wedgewood Street. He said one of the exhibits, a rendering, was representative of their structure; however, to comply with some area's codes, and variations in the lots, deviations are sometimes necessary. The employees would park to the rear of the establishment, leaving the front and sides available for customer parking. Commissioner Lawson moved to close the public hearing. Motion was . seconded by Commissioner Garvin and passed. IIIICity Manager Koski stated the suggestion of a "No Left Turn" sign .on the Wedgewood Street exit from the proposed use, "Not a Through Street" signs at entrance to Wedgewood Street off Rosemead Boulevard, and any type of engineering implement to keep persons from driving up onto residential front lawns, will be incorporated. Regarding children play- ing on the street, he said the streets are primarily for automobiles. There will be sidewalks around the premises of the restaurant to allevi- ate the danger of traffic for children. Regarding the drainage problem; that was mentioned, if the permit is granted it will be carefully re- viewed by the Engineering Department staff to see that no water from the premises is directed to adjacent residences. He felt, too, that something could be done for the resident who spoke about the drainage problem she presently had, to alleviate it. Regarding the noise, there will be no more noise than what others have on Las Tunas Drive where R -1 development is immediately . adjacent to C zoning. With proper manage- ment and reasonable closing hours there should be no problems. Because of the number of parking spaces on the proposed restaurant's premises, . there should be no problem of cars parking on Wedgewood Street, Regard - ingthe flow of traffic on Rosemead,, there are storage pockets there presently, and if they prove insufficient they may have to be modified, 1110 Street lighting in .that area will be improved, and any other traffic de- vices, or signs, or whatever can be done, will be considered to preserve the integrity of the .residential area. In Commission discussion Commissioner Garvin said he had no disagreement with the proposal; many other more objectionable uses could locate there without a public hearing. He stated he would not base his decision on the employment factor. He did feel this use would be an improvement to the area, and would serve that end of town where he :knew of only two restaurants, one of which was not a family -type. place. In addition to staff recommendations, posting of a "No Left Turn" sign on the exit on Wedgewood Street, and the hours of operation from 11 :00 a,m. to 11:00 -p, m, , Sunday to Thursday, 11:00 a.m. to 12:00 p. m. , Friday and Saturday, he would be in favor of the application. Regarding loitering or motor- cycle problems, and the possible lack of "adult" management in the even- ings, he felt that if such problems arose, the local law enforcement would handle it, and the City would pursue it with the management. • " 1 1 PLANNING COMMISSION MINUTES June 23, 1970 PAGE FOUR Commissioner Dennis asked the Planning Director about staff proposal regarding a 6 ft. high masonry 'wall to be built along the westerly property line except along required front yard area facing Wedgewood Street where the " wall would not exceed 3 0 ..inches in height. He felt the wall should be set 10 ft. from the curb. It was - explained that these requirements were in with the zoning ordinance. Com- missioner Dennis stated that, if the wall were built on the applicant's property, it would not be in the required front yard area on Wedgewood, but on the rear of the property facing Rosemead. " City Manager Koski said this could be arranged: with the property: owner to the west so as to be agreeable with both parties. Commissioner Dennis questioned the need for 30" high decorative wall facing Wedgewood and Rosemead, The Planning Director explained that, where landscaping is suggested, it would be designed to be visible from public street(s). Commissioner Dennis continued that this was a highway-oriented business, and locat- ing where it should be, and he had no objections, with staff recommenda- tions, Commissioner Lawson stated the application met the conditions of the conditional use permit. He wanted the light standards not to be ex- posed, as part of . the conditions of granting. He further felt "No Left Turn" signs could be installed at all exits, eliminating a possible hazard on Rosemead Boulevard, also. Commissioner Atkins said e basic asic conditions for granting a conditional use permit had been met in this instance; the business is appropriate for the location and hopefully will.peecipitate other improvements in that area. Commissioner Garvin moved to grant Conditional Use Permit 70 -317 on the basis that it meets the conditions set forth in the zoning ordinance, subject to staff recommendations plus a condition governing the hours of operation and the installation of "No Left Turn" signs on all exits, and that there be no exposed lights. Commissioner Lawson seconded and the motion carried, Asst. City Attorney White read Resolution 70 -38 1 PC, ,A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TEMPLE CITY GRANTING CONDITIONAL USE PERMIT IN CASE NO, 70 -3.17, Commissioner Lawson moved to waive further reading and adopt; motion was seconded by Commissioner Garvin and passed. Commissioner Dennis suggested a recommendation be made to the Traffic Commission to make a study of conditions at this location, The City SManager assured him the County Engineers would consider the .traffic situa- tion before building permit was issued. 1 " 7. COMMUNICATIONS The Planning Director called attention to a letter from Mr. Walter Fietze, 5649 Loma Avenue, Temple City, referring to the condition of properties at the northwest corner of Oak Avenue and Las Tunas Drive, and the northeast corner of Cloverly Avenue and Las Tunas Drive, He informed the Commission that a letter was sent by the staff in reply to Mr. Fietze, on behalf of the Commission. Planning Director referred to the memo in the packets concerning a possible amendment to the Pet Ordinance to assist residents of the City who have aviaries and are unable to meet the requirements set forth. The Commissioners decided to take this matter under considera- tion.at a study session, The Planning Director informed the Commission that the Arcadia Plann- ing Commission: would hold, �public hearing on the proposed Santa .Anita Fashion Center (to be located at Huntington Drive and Baldwin Avenue) on July 2, 1970, 8:00 p.m. in the First Avenue School, Arcadia, PLANNING COMMISSION MINUTES June 23, 1970 8, TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK PAGE FIVE Mr, Dana Godfrey referred to the remark Commissioner Garvin made in Commission discussion on Case 70-317 about not approving .a case because of the employment opportunities it might offer residents of the City. Commissioner Garvin explained to Mr. Godfrey the basis for granting a conditional use permit were regulated by State law and the zoning ordinance, and while he was concerned about job opportunities for youth, this factor could not be considered a legal basis for granting a permit or zone variance. The City Manager assured Mr. Godfrey that the City Council and the Commission were concerned with the economic development of the community, and wanted to encourage a.solid tax base. Chairman Atkins referred to the General Plan wherein the matter of employment, working force, economic elements are discussed, and perhaps the Youth Commission would be interested in stiudying this Plan, The City Manager said a:synopsis of. the General Plan would be made available to Mr. Godfrey's committee. 9. MATTERS FROM CITY OFFICIALS Commissioner Lawson asked the cost for a vehicle or pedestrian bridge to be built at Wedgewood Street, and it was determined the cost would be prohibitive when :related to the number of users, Chairman Atkins referred to a letter he had received from Mr. Leroy Miller, 9352 Lower Azusa Road, asking for a decision on changing of the zone on his - property,as soon as possible, 'The City Attorney, who had been :consulted by staff on this matter, said the Planning CommTssion can make a decision at any time, but that it should be put on the agenda prior to a decision, The City Attorney said it was unfair to ask Mr. Miller to wait six months for a decision; if the Planning Commission was unwilling to grant the zone change because of the General Plan, then deny the request, and Mr. Miller will have legal recourse before the City Council, Commissioner Garvin felt the people in the area should be notified, even though this notification would not be required by law since this hearing is a closed one. City Manager Koski said all those who appeared and spoke at the hearings on this matter could be noti- fied. Asst. City Attorney White said this action was not technically or legally required, but could be done, giving the reason for making the decision prior to the three - months agreed upon at the last hear - ingon this case, It was .decided toput this item .on:the agenda for July 14, 1970, at the regular meeting. The Planning Director informed the Commission that the staff is chang- ing the General Plan map and •text in accordance with the suggestions which emanated from the joint session on this matter between the City Council and the Commission. A decision was made to hold a study.-session on July 16, 1970, at 7:30 P, Ma i n the North Meeting Room of the City Hall. The Commissioners were asked to inform the secretary on 1) their tentative vacation schedule, and 2) their 'plan.: to attend the League of California Cities Conference this year. 10, ADJOURNMENT There being no further business, Commissioner Garvin moved to adjourn to the next regular meeting of the Planning Commission on July 14, 1970, 7:30 p. m, i n the Council Chambers of the ity Halle Motion was seconded by Commissioner Dennis _nd passe M=- 1iaadjourne at 9:15 p.m. Chairman
