A SPECIAL ORDINANCE AMENDING THE ZONING MAP FOR 33.378 ACRES OF A
CERTAIN PARCEL FROM 0-1 TO A PLANNED UNIT DEVELOPMENT DISTRICT
Whereas, the Zoning Map designates certain property commonly known as Hayes
Arboretum as an 0-1 Greenbelt District.
Whereas, it is desirable to change the zoning designation for a 33.378 acre tract within the
above described real estate, and more particularly described as follows, to wit:
Beginning at a mag nail set on the west line of the
Southwest Quarter, Section 35-14-1, said mag nail
being 1451.89 feet south 00 degrees, 04 minutes
and 01 second west of a mag nail found at the
northwest corner of said Southwest Quarter; and
running thence from said beginning pint, south 89
degrees, 55 ninutes and 59 seconds east, 225.00 feet
to an iron rod set; thence north 00 degrees, 04
minutes and 01 east, 460.00 feet to an iron rod set;
thence north 45 degrees, 04 minutes and 01 seconds
east, 150.00 feet to an iron rod set; thence south 89
degrees, 55 minutes and 59 seconds east, 1470.00
feet to an iron rod set; thence south 00 degrees, 04
minutes and 01 second west, parallel to the west
line of said Southwest Quarter, 636. 46 feet to an
iron rod set; thence, along the north right of way of
Woodside Drive and United States Highway No.
40, the following calls and distances: south 49
degrees, 36 minutes and 02 seconds west, 41.45 feet
to an iron rod set; thence south 53 minutes, 20
minutes and 18 seconds west, 90.55 feet to an iron
rod set; thence south 59 degrees, 24 minutes and 20
seconds west, 51.19 feet to an iron rod set; thence
south 58 degrees, 18 minutes and 29 seconds west,
45.89 feet to an iron rod set; thence south 69
degrees, 25 minutes and 13 seconds west, 91.78 feet
to an iron rod set; thence south 76 degrees, 45
minutes and 22 seconds west, 120.72 feet to an iron
rod set; thence south 84 degrees, 38 minutes and 13
seconds west, 387. 68 feet to an iron rod set; thence
south 87 degrees, 55 minutes and 31 seconds west,
925.31 feet to an iron rod set on said west line;
thence north 00 degrees, 04 minutes and 01 seconds

east, along said west line, to the beginning point
description, containing an area of 33.387 acres.
to a Planned Unit Development District, within an 0-1 Greenbelt District, to
allow the tract to be used as a retail shopping center.
NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana,
that the zoning designation of a 33.378 acre tract within the Hayes Arboretum, and more
particularly described above, is hereby changed to a Planned Unit Development District to allow
the property to be used as a retail sales shopping center. A preliminary plan is attached to this
ordinance as "Exhibit A." The Concept Plan and Draft Development Plan, which will be attached
to this Ordinance, prior to its promulgation and marked as "Exhibit B," are also hereby approved.
Passed and Adopted this day of 2003, by the Common
Council of the City of Richmond, Indiana.
