Chairman ' s announcements Amendments to the BOH regulations on tobacco (flavored) became effective on September 1 , 2019 , The CDC is conducting an investigation on e- cigarettes because of a severe pulmonary outbreak. There has been confirmed EEE in mosquitos on Cape . Residents should take precautions . Hurricane season is here, residents should be prepared. There are checklists available online . 2. Citizen ' s forum No residents were present to speak. 3. Leslie and Carol Erikson — Title 5 Inspection 300 ' Pond Setback variance — 264 Griffiths Pond Road Leslie Erikson was present. He is requesting a variance to keep the SAS where it is currently located. This is a 5 bedroom system that was installed in 2002 . SAS is 215 feet from Griffith ' s pond. He stated that there really is no other option for placement. The system passed inspection with the exception of the distance to the pond. Dr. Scherzo asked if this was a year round home . Mr. Erikson stated that it was and that there are only 2 residents . Dr. Scherzo stated that the SAS is positioned parallel to groundwater flow. Mr. Dinwiddie asked about precedence with regards to phosphorus removing systems . Mrs . Graczewski stated that there are none at the moment. Mrs . Graczewski stated that the system is as far away from pond as possible and isn ' t very old. Mrs . von Hone stated that the groundwater separation should be taken into consideration also . Motion : Finding that the entire property is within the 300 foot setback, the SAS is as far away as possible and the system is fi•om 2002, grant the variance as requested to keep the SAS 215 feet from the pond. Down Cape Engineering, Inc. — Title 5 septic upgrade variance requests for 30 Old Salem Road Dan Ojala presented this to the Board. This is a septic upgrade to an older 3 bedroom dwelling. It is in Zone 2 . There is 20 feet of separation to groundwater. There is a vegetated area on property. Groundwater flow is north. System is built into the hill . There will be a vent. The following variances are requested: 1 . To allow the proposed SAS to be 5 feet from a property line 2 . To allow the proposed SAS to be over 3 feet but under 6 feet below finished grade (vent & H2O components to be provided) 3 . To allow the proposed SAS to be 87 .4 feet from a wetland The finished basement was questioned. The owner would be willing to put a 3 bedroom deed restriction on property. Simon Dickson, owner. The ceiling height according to building code is supposed to be 7 feet and he believes that the, basement wouldn't meet that requirement. The integrity of the septic tank was questioned due to its age. Motion : Finding that there is a 20 foot separation to groundwater, approve the variances as requested with the condition that the engineer provides a certified letter that the ceiling height in basement is under 7 ' in height. If that is not accurate owner must change the door to a 4 ' cased opening. The septic tank must be inspected for its integrity by the engineer or a Title 5 Inspector. Discussion on Cyanobacteria Advisory Posting — Walkers Pond Landing Karen Malleus, Coastal Health Resource Coordinator, Barnstable Health Division, gave a power point presentation. She spoke about who is responsible for responding to Cyanobacteria and noted that there is also authority under the bathing beach regulations . In 2015 Barnstable started their own monitoring. She spoke about how challenging it is to identify what type of bloom it is . She can give recommendations from EPA that can be used. Cyanobacteria monitoring collaborative, bloom watch app . Pet advisory at under 20, 000 cells; warning over 20 ,000 ; closure over 70 ,000 . Reopening should be a minimum of 2 weeks . Bryan Horsely, Restoration Technician, APCC, reiterated the information Karen gave. They monitor from the beginning of May until October. They can predict a bloom about a week in advance by measuring phycocyanin concentrations . Kevin Rike, part time resident of Brewster and Easthampton . They are having the same issue in Easthampton and wanted to participate in this discussion . They have a plan in place to deal with the Cyanobacteria and it is on their website if anyone is V nterested in viewing it. The Health Department will be collaborating with various stakeholders (ADCC, Brewster Ponds Coalition, Brewster DNR) during the off season to devise a strategy for Cyanobacteria advisory postings . 6. Liaison Reports Dr. Scherzo gave an update on the Dog Park Committee . He stated that they will be going out to bid again this fall. 7 . BOH Minutes for approval 5/15/19 : Minor changes made .
