GOV BOARD OF HEALTH MEETING WEDNESDAY AUGUST 21 , 2019 AT 7 : OOPM TOWN HALL, ROOM A Board members present : Annette Graczewski, MT (ASCP), Chairman; Carmen Scherzo, DVM, Vice Chairman and Joe Ford ? , Board members absent : Penny Holeman, MPH, MA, MS and Lucas Dinwiddie Others present : Amy von Hone, R. S . , C . H. O . , Health Director and Tammi Mason, Senior Department Assistant 1 . Chairman ' s announcements Mrs . Graczewski introduced Mrs . von Hone as the new Health Director The Massachusetts Department of Public Health has confirmed that mosquitos on Cape have tested positive for EEE . Fact sheets are available on the MDPH website . 2. William Ferry — 116 North Pond Drive — (continued from 8/7/19 meeting) variance request from the Leaching Facility Setback regulation William Ferry, Trustee for family that owns this property was present. This property is for sale and he is requesting that they be allowed to keep the SAS 295 feet away from pond . Dr. Scherzo voiced his concern about it being a leach pit. It is 25 years old and there is only a 5ft separation from the bottom of the pit to groundwater. Phosphorus is an issue for him. He feels that there is space for a new system. Mrs . Graczewski stated that there is actually 15 . 5 feet from bottom of pit and groundwater. Mrs . von Hone stated that she had looked at plan and at the test pits from 1990 and they didn't find groundwater before 13 feet. System is quite far from pond and the elevation is high. She explained why the inspection report stated 5 ' to groundwater. Dr. Scherzo wants the system moved beyond the 300 feet. He feels there is plenty of space . Mrs . von Hone mentioned that there was a hill there and they would have to pump up. Mr. Ford asked which way groundwater flowed . Mrs . Graczewski stated it was NNW. Motion : Finding that there is 15 feet to groundwater, the SAS is 295 feet from the pond, approve the request to leave the SAS where it is . Motion : Joe Ford Second : None Mr. Ford retracted his motion and the Board agreed to continue until the next Board meeting so that all members would be present. The Board came back to this request later on in the meeting and made the following motion: Motion : Finding that there is 15 feet to groundwater and the SAS is 297 feet from the pond, approve the request to leave the SAS where it ISO Motion : Joe Ford Second : Annette Graczewski Vote : 24 -0 Action : Motion carried 3 . Karen Abraham — 688 Main Street — appeal the Health Director 's decision in regards to a bedroom WWW.BREWSTER-MA . GOV BOH 8/21 / 19 Minutes Page 2 Ms . Abraham was present. She showed pictures of the room in question . Because of where the fireplace is, the walls cannot be moved. The door on the side of the room is a second egress . Mrs . Graczewski stated that because it has a means of egress and you have to walk through it to get to another room, she wouldn 't consider it a bedroom. Dr. Scherzo questioned the use of the garage . Ms . Abraham stated that right now she would like to make it an office, but would like to be able in the future to make it an accessory dwelling. Motion : Finding that the room in question (den) has an egress door in it and there will be difficulty with removing the doors due to the placement of the fireplace, a conclusion was made that this would not be considered a bedroom. Motion : Joe Ford Second : Annette Graczewski Vote : 241 0 Action : Motion carried 4. Discuss Citizen ' s forum Mrs . Graczewski shared the Select Board ' s policy on this . Dr. Scherzo had asked that this come back to the Board because he wants to put it at the beginning of the meeting, not the end. He thinks this should be well advertised. He thinks the chairman should go before the Select Board and let them know about this . He wants the same thing on our agendas that the Select Board put up on their agenda . Mrs . Graczewski suggested putting it first on the agenda, adding to the statement, and putting it on the website . Once these items are completed, she will then decide if it should go before the Select Board. Motion : Move up to number 2 on the agenda, put an announcement on our website . Motion : Joe Ford Second : Carmen Scherzo Vote : 3 -0 -0 Action : Motion carried 5. Discuss MDPH Fish Advisories Chris Miller was present. Sheep Pond, Mill Pond and Bakers Pond all have high levels of mercury. There are no public landings at Bakers Pond and Mill Pond. Sheep Pond has been posting at the public landing. Mrs . Graczewski stated that she had called Mike Beaty from the state . He stated that all ponds in Massachusetts are under an advisory. These 3 ponds are different because the fish flesh was actually tested, which confirmed the levels of mercury. Mrs . Graczewski asked if the Board wanted to consider posting all the ponds or just putting a message on the Town website. Mr. Miller stated that formal landings should be posted (around 7 or 8 of them) Mr . Ford has no opposition to posting signs . Motion : Post all the landings in Brewster Motion : Joe Ford Second : Carmen Scherzo Vote : 3 -0-0 Action : Motion carried 6. Discuss HAC letter re : CBD in food products Mrs . Graczewski spoke about the Barnstable County Department of Health & Environment subgroup working on this issue . They issued a letter that Health Departments could use to put retailers on notice that there may be some regulations coming down the line . She would rather take a wait and see approach to see if it is an issue before sending out that letter. Dr. Scherzo spoke about the last paragraph with regards to Hemp and its medicinal value . 7. Discuss draft Marijuana regulations BOH 8/21 / 19 Minutes Page 3 Motion : Continue this until the full Board is present. Topics the Chairman did not anticipate Mr. Ford asked that the Board reconsider agenda item #2 Informational items were noted . Meeting adjourned at 8 : 05PM i i� 3
