Contractors who perform renovation, repairs, and painting jobs in pre -1978 housing and child- occupied facilities must, before beginning work, provide owners, tenants, and child -care facilities with a copy of EPA's lead hazard information pamphlet Renovate Right: Important Lead Hazard information for Families, Child Care Providers, and Schools. Contractors must document compliance with this requirement. After April 22, 2010, federal law will require you to be certified and to use lead -safe work practices. Projects must be done by a Certified Lead Renovation Firm AND a Certified Renovator When disturbing lead -based painted or coated surfaces or components more than 6 ft2 per interior room or 20 ft2 of exterior surfaces AND all window replacements and partial demolitions of any size. * * * * * * * * * * * * * * * * * * * * * Asbestos /Environmental Notification to Georgia EPD for Projects Involving Demolition, Wrecking, or Renovation The undersigned hereby acknowledges that the issuance of this permit does not in any way grant permission to the owner, owner's representative, or permit holder to proceed with demolition, wrecking, or renovation of a structure prior to the filing of any required ten (10) day "Project Notification for Asbestos Renovation Encapsulation or Demolition" form in accordance with the Georgia Asbestos Rules. The Georgia Environmental Protection Division administers the rules. In most cases, the rules require both the owner and the involved contractors to assure the portion of the building involved in the project is thoroughly inspected by an Accredited Asbestos Inspector for materials that contain asbestos; and the removal of the asbestos before renovation, wrecking, or demolition begins almost without exemption. Georgia EPD requires a completed demolition notification from be submitted 10 workings days in advance even if no asbestos is present in the building. Further guidance for regulatory compliance and contact telephone numbers are provided by the brochures entitled Asbestos & Renovation and Asbestos and Demolition. Other environmental issues such as asbestos removal techniques, lead abatement, ground contamination, or unusual site conditions may have EPD regulations that could affect the project. * * * * * * * * * * * * * * * * * * * * * BMPs While BMP deficiencies are not necessarily the fault of the owner or his agent, BMPs are their responsibility. Two areas of deficiencies are in the most basic and common BMPs; Co — Construction Exit and Sd1 — Sediment Barrier. ANALYSIS Section 3 -200 was amended by City Council on December 13, 2012. It reads: Sec. 3 -200. — Decks, walkways and patios. Decks and patios, as defined in Article 2, and walkways no higher than one foot above the nearest adjacent grade may be placed anywhere within the property boundaries. Decks and patios, as defined in Article 2, and walkways that extend beyond one foot of the nearest adjacent grade shall be required to meet all front, side and rear setback requirements. The 65% greenspace requirement of Section 3 -165 will not be violated if the materials for the proposed patio are impervious. As stated above, a patio at grade can be placed anywhere on a property. The patio request is in keeping with the C -1 Beach Business District as outlined in Section 4- 050(E): "The purpose and intent of commercial districts is to provide central locations for city businesses and services to meet the market needs of Tybee Island residents and visitors. The focus of the C -1 beach business land use district is to provide for commercial and residential land uses that support and complement recreational use of the beach and general tourism of the island. The land uses permitted in this district provide for a substantial amount of the island's employment base. The amount of C -1 acreage is directly proportional to the city's economic activity. These land uses are designed to harness economic activity of the daytime visitor as well as residents and overnight visitors." The project is located in the South End Business Overlay District. Section 4- 050(0) states: "All commercial and multi fancily residential uses are permissible subject to site plan approval. In this district, the site plans established here shall prevail over any setbacks in any other part of the Code, specifically including Section 3 -090 regardless of the use of the property. Mixed uses of the property are 1 permissible. Site plan approval is required for new construction and redevelopment of existing sites. New construction and when a project includes the redevelopment of a parcel, a development agreement with the owner /developer and the city specking the site plan, location of utilities, improvements, setbacks, driveway locations and dimensions and lot coverage may be required." The area near the Beachview Inn is a mix of residential and commercial uses. Butler Avenue is a main thoroughfare for vehicles and pedestrians on the south end of the island. The table below identifies the Recommended Development Strategies of the Comprehensive Plan's South End Neighborhood Character Area that are applicable to the patio project. Comprehensive Plan Section 1.2.13 Meets Strategy Y/N or N/A South End Neighborhood • Recommended Development Strategies 1' Future development and redevelopment should be very pedestrian- oriented with safe connections to adjacent neighborhoods and commercial areas. Y STAFF FINDING Staff finds the request for a patio at the Beachview Inn is in keeping with the character of the area. It does not conflict with the requirements of the Land Development Code.
