HomeMy Public PortalAbout085-2003 _Roaming Hills annexation_ORDINANCE NO. 85-2003 A SPECIAL ORDINANCE ANNEXING CERTAIN CONTIGUOUS LANDS INTO THE CITY OF RICHMOND WHEREAS, The sole, fee simple owner of the certain real estate consisting of approximately 53.3 acres and more particularly described as: Beginning at a copperweld found at the southwest corner of the Southeast Quarter of said Section 9, and running thence north 00 degrees, 20 minutes and 00 seconds east, along the west line of said Southeast Quarter, 440.53 feet to an iron rod found; thence north 88 degrees, 57 minutes and 55 seconds east, 100.00 feet to an iron rod found; thence north 00 degrees, 20 minutes and 00 seconds east, parallel to the west line of said Southeast Quarter, 80.00 feet to an iron rod found; thence north 88 degrees, 57 minutes and 55 seconds east, 162. 63 feet to an iron rod found; thence south 00 degrees, 20 minutes and 00 seconds west, parallel to said west line, 141.01 feet to an iron pipe found; thence north 00 degrees, 20 minutes and 00 seconds east, parallel to said west line, 347.85 feet to an iron rod found; thence 43 degrees north, 31 minutes and 15 seconds east, 260.61 feet to an iron rod set on the westerly right of way line of the C&O Railroad; thence along the westerly right of way line of said Railroad the following courses and distances: south 46 degrees, 28 minutes and 45 seconds east, 418.78 feet to an iron rod found at a point of curve; thence along a 1377.63 foot radius curve to the right, and entering the Northeast Quarter of said Section 16, a chord which bears south 22 degrees, 29 minutes and 25 seconds east, a chord distance of 1121.84 feet to an iron rod found; thence south 01 degree, 32 minutes and 10 seconds west, 960.77 feet to a wood end post at the northeast corner of a tract of land owned by J. Franklin and Leota M. Overton, as recorded in Instrument No. 1996004698 in said Recorder's Office; thence leaving the westerly line of said Clark tract, south 51 degrees, 59 minutes and 10 seconds west, along the west line of said Overton tract, 264.00 feet to a mag nail set in the centerline of United States Highway Number 227, and being the southwest corner of said Overton tract; thence north 41 degrees, 00 minutes and 50 seconds west, along said centerline, 26.61 feet to a mag nail set at the southeast corner of Agee Overton tract, as recorded in Deed Record Book 469, Page 253 in said Recorder's Office; thence north 51 degrees, 53 minutes and 55 seconds east, along the east line of said last mentioned Overton tract, 263.68 feet to an iron rod found; thence north 40 degrees, 07 minutes and 35 seconds east, continuing along the east line of said last mentioned Overton tract, 73.15 feet to an iron rod found at the southeast corner of Irish Hills Subdivision, as recorded in Plat Book 11, Page 358 in said Recorder's Office; thence north 39 degrees, 51 minutes and 25 seconds east, along the southeasterly line of said Irish Hills subdivision, 143.50 feet to an iron rod found; thence north 46 degrees, 06 minutes and 25 seconds east, continuing along the southeasterly line of said Subdivision, 161. 75 feet to an iron pipe found on the west line of said Northeast Quarter; thence north 00 degrees, 34 minutes and 25 seconds east, along the west line of said Northeast Quarter, and continuing along the east line of said Subdivision and the extension thereof, 823.60 feet to the place of beginning, containing a total area of 54.916 acres, there being 0.350 acres in the Northwest Quarter of said Section 16 and 17.614 acres in the Southeast Quarter of said Section 9, there being 53.300 acres in Wayne Township, and 1.616 acres in the City of Richmond. has petitioned the City of Richmond to annex said property; and WHEREAS, the above described property is contiguous to the City of Richmond; and WHEREAS, a map illustrating the area to be annexed is attached hereto and marked as "Exhibit A." WHEREAS, Common Council must adopt a Resolution detailing how certain capital and non -capital services will be administered to the above described Create PDF files without this message by purchasing novaPDF printer (http://www.novapdf.com) property prior to the enactment of this Ordinance, although it is anticipated that no new or additional costs shall be incurred by the City due to the existing development infrastructure; NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana, as follows: That pursuant to Indiana Code § 36-4-3-5.1, the above described property is hereby annexed into the City of Richmond. 2. That such annexation shall become effective thirty (30) days after the adoption of this ordinance.
