PLANNING COMMISSION MINUTES
December 8, 1970
INITIATION
1. The regular meeting of the Planning Commission of the City of
Temple City was called to order by Chairman Atkins at 7:30 p.m.,
December 8, 1970.
2. The Pledge of Allegiance to the Flag was led by Chairman Atkins.
3. ROLL CALL:
Present: Commissioners: Beckman, Dennis, Garvin, Lawson, Atkins
Absent: Commissioners: None
Also Present: City Manager Koski, Asst. City Attorney White, and
Planning Director Dragicevich.
4. APPROVAL OF MINUTES: Regular Meeting of November 24, 1970.
Chairman Atkins called attention to an omission in the minutes of
his expression of appreciation to the staff for all the work and
time they had expended on the General. Plan.
There being no further additions or corrections, Commissioner
Garvin .moved to approve the minutes as corrected. Motion was
seconded by Commissioner Lawson, and a roll call vote was taken.
Commissioners Dennis, Garvin, Lawson and Atkins voted in favor,
and Commissioner Beckman abstained due to absence at that meeting.
OLD BUSINESS
5. CONTINUED PUBLIC HEARING:
CONDITIONAL USE PERMIT CASE NO, 70-330
Pacific Ackworth Foundation, Owner - Applicant
6210 North Temple City Boulevard, Temple City
Chairman Atkins announced that a letter had been received from
Stuart Denker, Chairman of the Building Committee for the Pacific
Ackworth Foundation, requesting the',hearing on their request be
continued to January 12, 1971. Reason for the request was to allow
the members of the Foundation to rectify at least some of the condi-
tions found in violation of the Municipal Code by the Fire Depart-
ment and the, Building Department.

Stuart Denker, 2023 La France Street, So. Pasadena, representing
the applicant, said they want to demonstrate more than verbal
compliance, they want to demonstrate compliance physically. To
date they have taken out demolition permits to remove two struc-
tures. Whether or not the conditional use permit is granted they
want to clean up the property. The requested delay would give
the school time to regroup the students, as well. The Fire Depart-
ment violations, he stated, were corrected the day the letter from
that department was received.

Commissioner Garvin asked if they would be prepared for the meeting of
January 12, 1971, or was it possible they would ask for another con-
tinuance. He was against having the case prolonged indefinitely. Mr.
Denker assured him there would be no request, on January 12, 1971, for
continuance.
Chairman Atkins announced the public hearing was open. He said he
Iappreciated all those who came to the hearing, and advised the ,audience
that the Planning Commission could consider only the use of the property
and its appearance in the neighborhood. Minutes and tape of previous
hearing on this application are available for study, and he asked that
remarks made tonight be limited to new testimony.
Mr. John L. Shaw, 5816 Temple City Boulevard, stated he had been re-
tained by twenty -two residents on Camellia Avenue to represent them as
being opposed to this conditional use permit being granted. He pre-
sented for the record a petition signed by the people he represents.
He felt it was not fair to go into his presentation tonight if the
hearing is going to be continued; however, he did suggest a show of
those opposed be made tonight. Those opposed were asked by Chairman
Atkins to stand, and the count was 21 opposed.
avid Pearson, 382 W. Woodbury Road, Altadena, asked for a show of those
n favor, and the count was 45 in favor.
Mary Kokayo, 6149 Camellia Avenue, spoke about the unsightliness of the
subject property, and that it was a fire hazard, and asked if anything
would be done about this matter.
Asst. City Attorney White reminded those in the audience that, if they
had any testimony in addition to what was on tape and part of public
record, to return to the next meeting on this case and give specific
Itestimony.
Commissioner Beckman moved to continue the open public hearing to the
regular Planning Commission meeting of January 12, 1971. Motion was
seconded by Commissioner Lawson and passed.
At 7:55 p.m. Chairman Atkins declared a 5- minute recess to clear the
chambers. He called the meeting to order again at 8:00 p.m.
Chairman Atkins asked for a show of hands of the audience of those in-
terested in the hearing on the General. Plan, the next item on the agenda.

8. TENTATIVE PARCEL MAP NO. 529:
APPEAL OF CERTAIN CONDITIONS OF APPROVAL

Director Dragicevich told the Commission that the staff had approved
Ithis parcel map as the newly created lots would meet the City's require-
ments for width and area. It is routine, in lot splits, to contact the
Building, Fire and Public Works Departments for their recommendations.

4110 Two of the conditions of approval were the installation of a fire hydrant
(at Golden .West Avenue and Flaherty), and installation of sidewalks on
Flaherty. These were the conditions which the applicant was appealing.
Installation of the fire hydrant would include water mains, the total
cost of this item would be around $2300.
The public hearing was declared open.
Mr. James Brigham, 821 Arcadia Avenue, Arcadia, stated there is presently
a hydrant at the southeast corner of Garibaldi and Golden West Avenues,
which hydrant will be closer to the subject property than the proposed
one. The cost of the proposed hydrant, if installed,, would have to be
passed on to the buyers of the houses, and it would make developing
this property prohibitive. Regarding the sidewalks, there are none on
Flaherty Street and probably never will be. There are sidewalks on
Golden West Avenue.
Mr. G. Ho Bedell, 6126 Golden West Avenue, said to ask the applicant to
expend that amount of money to develop the property is penalizing one
individual. He stated the distance of the proposed residences to the
proposed hydrant would be greater than from the present hydrant. He
felt that the Planning Commission, in the future, might be interested

in improving the fire protection system as.a community -wide project.
n this case it is a heavy obligation to assess against one individual.
There being no one else to speak Commissioner Beckman moved to close
the public hearing; motion was seconded by Commissioner Garvin and
passed,
Commissioner Lawson, in closed discussion, said he favored the installa-
tion of sidewalks on Flaherty Street, but did not feel the fire hydrant
was that valuable to the neighborhood.
IlCommissioner Beckman concurred. He said the City should investigate
the water company servicing that area, as the water companies have a
reserve fund which builds upoon a regular basis to provide improvements
such as hydrants and water mains.
Commissioner Dennis said sidewalks should be required; the fire hydrant
requirement should be imposed if this were a major subdivision. The
benefit of the proposed hydrant accrues to the entire neighborhood. He
did not think it just to tie the expense of installing it for the build-
ing of three dwellings to one individual.
commissioner Garvin was in favor of the sidewalk installation, and
against the condition of the hydrant, and felt it was an imposition to
have the applicant pay a fee to appeal this condition. It was explained
this was proper procedure, since staff had no authority to waive a condi-
tion required by one of the three departments contacted. Staff can only
bring the appeal to the Commission for their evaluation and decision.
Chairman Atkins was in agreement with opinions expressed by other members
of the Commission.
Commissioner Garvin moved Tentative Parcel Map No. 529 be approved with
the deletion of Item 6 of conditions of granting, Commissioner Beckman
seconded and the motion carried.
Asst.. City Attorney White read title to Resolution 70- 395PC, A RESOLU-
TION OF THE PLANNING COMMISSION OF THE CITY OF TEMPLE CITY APPROVING
TENTATIVE PARCEL NO, 519. Commissioner Garvin moved to waive further
reading and adopt. Motion was seconded by Commissioner Beckman and
passed.

CONTINUED PUBLIC HEARING:
CONSIDER RECOMMENDATION TO ADOPT ELEMENTS
OF THE PROPOSED GENERAL PLAN FOR THE CITY
OF TEMPLE CITY.
Director Dragicevich said there had been some response to the
General Plan from the community. Suggestions and comments included
higher residential density on both sides of Baldwin from Lower
Azusa to City boundary to the north; allow for higher residential
density for existing deep and undeveloped residential lots;
extension and improvement of Golden West Avenue as suggested
by General Plan received favorable reaction; commercial develop-
ment rather than commercial and industrial on Lower Azusa Road.
Interest was shown in proposed parksites, proposed freeway, and
commercial development.
The public hearing was declared open.
Mr. J. H. McKim, 5125 Baldwin Avenue, stated that several years
ago he had attended a meeting similar to this one, regarding a
general plan for Temple City, and it was his opinion that Baldwin
Avenue was proposed for R -3 zoning. He said his property on
Baldwin Avenue is a deep lot with one residence and much unusable
land. Since Ba l dw.i n .Avenue is being extended to Arcadia and hook
up with the freeway he looks forward to more traffic on this
street. Chairman Atkins explained the Commission hasn't dealt
with zoning by specific classifications. If the proposed north -
south freeway becomes a reality, it will probably be located in
the western part ofthe City and will draw traffic away from Bald-
win Avenue. This freeway is projected within thenext 15 years.
Mr. McKim said Baldwin Avenue goes from the San Bernardino Freeway
to the Foothill Freeway and there will be increased traffic on
Baldwin. He was more concerned with what will happen in the next .
five years.
Mr. John Stacey, 5626 Gracewood, owns property on Baldwin Avenue,
also, and was interested in R -3 development of that street in the
future. H i s lot on Baldwin _ i s 80 x 200.
Mr. G. H. Bedell, 6126 Golden West Avenue, spoke about the commerci-
al strip along Las Tunas, a mile long and a block wide, and suggested
condensing it, and get some good commercial development in town. Con-
sideration should be given to two or three dense commercial areas.
West of Rosemead, he suggested be considered for professional build-
ings or a hospital. Enlarge present neighborhood shopping centers
but don't develop any more.
There being no one else to speak, Commissioner Garvin moved to
close the public hearing. Commissioner Dennis seconded the motion
and it passed.
Director Dragicevich suggested the addition of another element
concerning recreation and space. As of January 1, 1971, this may
become a mandatory element of the General Plan by the State.
Chairman Atkins expressed the opinion that he would rather go
the amendment route on this item, and the other Commissioners con-
curred.
Commissioner Garvin moved to recommend adoption of the November 20,
1970, revision of the General Plan to the City Council. Commissioner
Beckman seconded the motion and it passed.

RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TEMPLE CITY
APPROVING THE PROPOSED GENERAL PLAN AND RECOMMENDING I TS ADOPTION
BY THE CITY COUNCIL. Commissioner Beckman moved to waive further
reading and adopt. Commissioner Lawson seconded the motion and it
passed unanimously.
7. CONTINUED PUBLIC HEARING:
CONSIDER RECOMMENDATION TO AMEND THE TEMPLE
CITY ZONING CODE RELATING TO EXPANSION OF
NONCONFORMING STRUCTURES WITH SUBSTANDARD
SETBACK IN R ZONES.

Director Dragicevich explained the proposed amendment referring to
second story additions to nonconforming residential structures and
that such additions -would "not be allowed on accessory structures.
There being no questions from the Commissioners, the public hear-
ing was declared open.
Mr. G. H. Bedell, 6126 Golden West Avenue, asked about a proposed
extension to his garage to accommodate a longer automobile and
was told to contact the staff during regular business hours.
There being no one else to speak, Commissioner Dennis moved to
close public hearing. Motion was seconded by Commissioner Beckman
and passed.
In closed discussion the Commissioners concurred that the draft of
the proposed ordinance, as presented at this meeting, was what
they had wanted. Thereupon Commissioner Lawson moved to recommend
to the City Council addition of a new section to the Temple City
Municipal Code relating to nonconforming structures. Commissioner
Beckman seconded and the motion passed unanimously.
Asst. City Attorney White read title to Resolution 70-397PC, A
RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TEMPLE CITY
RECOMMENDING THE ADDITION OF NEW SECTION 9278.1 TO THE TEMPLE CITY
MUNICIPAL CODE RELATING TO NONCONFORMING STRUCTURES.
Commissioner Lawson moved to waive further reading and adopt.
Motion was seconded by Commissioner Beckman and passed unanimously.
COMMUNICATIONS
Director Dragicevich referred to memo on Zoning Modification Com-
mittee; copy of which was in the Commissioners' packets.
The Commissioners agreed that this item, as presented this evening,
reflected their thinking and desire. Commissioner Beckman moved
to set this item for public hearing at the regular Planning Com-
mission meeting on January 26, 1971. Motion was seconded by Com-
missioner Garvin and passed.
In answer to questions by the Commissioners, Asst. City Attorney
White explained that all that was required was that the ordinance
be passed, and the extent of the authority of this committee can
be decided by policy. This method is more liberal and easier to
change and allow for specific cases than a policy that is tied
down by ordinance as to exact authority. The proposed draft of
the Committee is modeled after similar ones for Arcadia and Al-
hambra.
Chairman Atkins explained the reasoning for a zoning modification
committee to those in the audience.

11. MATTERS FROM CITY OFFICIALS
Commissioner Garvin asked if any notification of the January 1,
1971, deadline of the Pet Ordinance would appear in publication.
City Manager Koski replied a couple articles would appear before
the end of the year.
Commissioner Garvin expressed disappointment that no one from the
business community of the -City was in attendance at the public
hearing on the General Plan. The City Manager explained that the
Chamber of Commerce had requested a presentation of the General
Plan at one of their meetings, possibly a breakfast meeting.
12. ADJOURNMENT
There being no further business, Commissioner Beckman moved to
adjourn the regular Planning Commission meeting to an adjourned
meeting in the North Meeting Room on December 10, 1970, at 7:30
p.m. Commissioner Lawson seconded, and the motion passed. The
meeting was adjourned at 9:25 p.m.
