ALLEYS WITHIN THE LYNWOOD TOWNE CENTER
Comments:
On February 17, 1987, the City Council adopted Resolut�on
87-22 setting the date for a public hearing on the alley
vacation within the Lynwood Towne Center. No objections were
received. Utility easements will be maintained.
Recommendation:
That the City Council of the City of Lynwood adopt the
attached .resolution entitled, "A RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF LYNWOOD, ORDERING THE VACATION AND
ABANDONMENT OF PUBLIC STREETS AND ALLEYS WITHIN THE LYNWOOD
TOWNE CENTER FOR THE DEVELOPMENT PURPOSE OF HOPKINS
DEVELOPMENT COMPANY AS SHOWN ON MAP OF TRACT NO. 2551, IN THE

Comments :
On January 20, 1987, the City Council adopted Resolution 87-4
setting the date for a public hearing on the alley vacation.
The Fire Department and the Sheriff's Department have no
objections. Public utility easements and access will be
maintained.
Recommendation:
That the City Council of the City of Lynwood adopt the �

� On August L"o, 198'7, the Federal Emergenc,y Manajement Agency (FE:`IAI
pub:Lished a final rule in the Federal Register w�ich revises
National Flood Insurance Program (NFIP) flood plain mana�ement
. criteria. The firial. rule became effective on October 1, 1986.
h;FtP criteri.a require, as a c aridition of continued eligi-bili.tti
for pdrti.cipation in NFIP, that communiti.es revi.se the.ir flood
pl.ain managemenY. re�ulat.ions to make them consi.stenY, c:i.th ant-
rev.ised NFIY reguTation,within six months of the effective date
of that revision.
DISCliSSIOti:
The Pinal rUle and the Flood Damage Px•evention Chapter of our i
City Code have beeri revi.ewed by staff. The main bul.k of the I
re��ised NrIP criteria was to incor.porate the terms "i�lanuFactur.�d
Ffome" and i�3anufactured Home Parl; or Subdivsion" and to appl,y t,he i
same standards �,o "�lanufactured Homes" as are applied to I
co�ventional structures. A new provision was also added, c:hich �
specifi.cally- requires that mechanical and utilitv equi.pment be i
designed and/or elevated to prevent water�from enterin� or I
accumulating in its components. an ordinance is therefore, I
prepared to brin� our City Code into conformity wit.h the revi.sed i
NFIP regulations.

Jay-Kim Engineering, we submit the following revised cost proposal
for changes in well design. This cost proposal is submitted in place of i
our previous proposal dated February 13, 1987 and is the result of the �
price review and discussions with Mr. Eric Randall. �
These mistakes involved the deep cement surface serl and changes in gravel I
pack design. In submitting our original cost proposal for these changcs,
we used our standard prices for these items and neglected to take into

Section 65400 of the Government Code mandates as follows:
"After the *** legislative body has adopted all or part of
a general plan, the planning agency shall do both of
� the following:
"(a) Investigate and make reco'mmendations to the
legislative body• regarding reasonable and
practical means for imp'lementing the general plan
� or elements of the general p1an, so that it wi11
serve as ' an effective guide for
* * * orderly * * * growth and development,
preservation and conservation of open space land
*** and natural.resources,. and the efficient
expenditure of public funds relating to the
subjects addressed in the general plan ***.
"(b) Provide an annual report to the legislative body
on the status of the plan and progress in its
� implementstion."
The annual report of the Lynwood General Plan is hereby submitted
' for City Council review. The recommendations from the Planning
Commission have been incorporated into this final report.
In California, state law also requires each city and county to
adopt a general plan documenting its decisions concerning the
future of the community. Preparing, adopting, and maintaining a
general plan serves to:�
o Identify the community's environmental, social, and
economic goals.
o State the local government's policies on the
maintenance and improvement of existing deVelopmert and
the location and characteristics of.future development
needed to achieve community goals.
o Establish• within local government the ability to
analyze local conditions and to respond to problems and
opportunities concerning community development in a way
consistent with local, regional, and state goals and
policies.
o Provide citizens with information about their community
and with opportunities to understand and participate in
the planning and decision-making process of local
' government.
o Create a basis for subsequent planning efforts, such as
the preparation of specific.plans and special studies.
The basic legal conception of the general plan has changed little
in the.last 50 years. But as planning theory and practice have

evolved and as co�ity needs have cnanged, �ew ideas about the
apprcpriate structure and function of the general pldn have
em�rged. Some of these ideas are complementary; others seem to
conflict.
Traditionally, .the gtneral plan was conceived as a set of broadly
stated policies with .more inspirational than legal effect.
However, the enactment of requirements in 1971.that zoning and
subdivision approvals be consistent with the general plan and
subsequent litigation reinforcing these requirements have elevated
the general plan to the status of a constitution for local �
development. As a consequence, local officials are under
increasing pressure to adopt precise policies and plan proposals
• and create clear star.dards for making consistency determinations.
Hence the trend toward increasing spec?ficity.
Loca1 governments . increasingly include short-term imple-
mentation programs in their general plans. Local officials
see the inclusion of short-term programs as a means of
establishing direct links to the capital improvement program and
annual budget cycle, as-well as a means of directing the location
of new development in the short term through zoning and
subdivision actions.
Including a short-term implementation program in the general plan �
also means a commitment to constant monitoring and frequent
revisions. While the qeneral plan should 'ne thoroughly reviewed
at least every five years, many jurisdictions review and revise .
their short-term implementation programs annually, in conjunction
with the budgetary cycle, to reflect changes in funding sources,
� the results of continuous monitoring, and immediate needs and
problems. - ,• .

Similarly, some local governments continually update the data
base upon which the general plan policies are based as a means of
determining the need for policy changes and maintaining a current
base of information for evaluating project proposals. In the
end, constant monitoring and frequent revision ensure that the �
plan is a realistic and a useful guide for day-to-day decision-
making.
Further; while past general •plans have largely focused on
physical development, in recent years there has been a growing
recognition of the need to include economic and social concerns
and to link them to the policies guiding physical development.

� planning"/"comprehensive planning" tr�nd by broadening their
general plar_s to include these other concerns.
An adequate general plan is one that, beyond meeting the minimum
requirements of state law, establishes a useful guide for local
decision-making. To be legally adequate, a general plan must
_ address each issue prescribed by state 1aw as it applies to the
community; address each issue through data and analysis, policy,
and an,implementation program; be internally consistent and long-
term; and cover all territory wifhin the jurisdiction and any
adjacent related lands, while reflecting the needs of the
regional population. There is also a"common sense" standard of
, adequacy which requires that the general plan focus on the issues
of greatest local concern, be organized and written in a manner
so that it serves as a clear and useful guide for decision-makers
and .citizens, and be available to all those concerned with the
community's deveZopment.
, The Legislature has identified in Government Code section 65302
seven (7) mandatory elements that it believes every City and
County must include in its general p1an:
' . The Land Use Element distribution, location, and extent
(including staadards ior population density and buiiding
intensity) of the uses of land for housing, business,

industry, • en space, educatior., •blic buildings and
' grounds, solid and liquid waste disposal facilities,, and
other categories of public and private uses.
. The Circulation Element identifies che general location
and exter.t of . exis.ting and proposed major roads,
highways, railroad and transit routes, terminals, and
other local public utilities and public facilities.
. The Housing Element consists of standards and plans for
the improvement oi housing and the provision of adequate .
sites .for housing to.meet .the needs of all economic
segments of the community.
- The Conservation Element provides for tne conservation,
development, and use for natural resources, including
water, forests, soils, river, lakes, harbors, fisheries,
wildlife, minerals, and other natural resources.
The Open-space Element details plans and measures tor the
preservation of open space for natural resources, for the
managed production of resources, for outdoor recreation,
and for public health and safety. �
. The Noise Element examines noise sources yielding
information to be used in setting land use policies for
.' compatible uses and for developing and enforcing a local
noise ordinance.
. The Safety Element estabI.ishes standards and plans for
the protection of the.community frcm unreasonable risks
associated with the effects of seismically induced
surface rupture, ground sfiaking, flooding and urban fires "
and other geologic hazards.
ISSUES AND ANALYSIS
The General Plazi is an essential instrument to ensure that the
public welfare is being served. Without it there can be no
rational allocation of land use. It is therefore of great
importance that such instrument is regularly updated to reflect
the changes in the communtiy.
The Lynwood General Plan, adopted in 1977 consisted of the
following nine (9) elements: 1) Community Safety, 2) Noise,
3) Open Space, 4) Conservation, 5) Housing, 6) Circulation, 7)
Scenic Highways, 8) Land Use, 9) Seismic Safety:
° The Lynwood General Plan has undergone several amendments since
its adoption including the addition of a Recreation Element in
' 1982 and a complete revision of the Housing Elem�nt in 1984. The '
Housing Element must be updated or revised every five years. The
Housing Element was submitted to the State of California Housing
and Community Development Department for review, comments and
cer�ification. After making suggested revisions, the document
was certified in February. The final document was submitted to
the Planning Commission and the City Council for adoption; the
Housing Element was adopted on April 17, 1985.
State Law has repealed the scenic highway element while the
seismic safety element is incorporated in the safety element.
This reduces the number of state mandated elements for the
General P1an from nine (9) to seven (7).
Land Use
The City Council adopted two aJnendments to the Land Use Element
, of the General Plan during 1986. These amendments, reflecting

the� changes to the Land Use Element of the General Plan, are
listed below and are shown on the maps identified as Exhibit ti
and Exhibit B.

Location No. 1 is south on Atlantic between Cardwell and Olanda
Streets. Although this area is designated Multi-Family
Residential in the General P1an, this site is surrounded by
. commercial uses., Further,. it is Staff's professional opinion
that, _since the site is zoned commercial and the adjacent land
uses are commercial, it would be appropriate to amend.the General
Plan to reflect this change in land use. Furthermore, the
commercial strip would be a buffer between the single-family land
uses to the east.and the multiple-family land uses to the west.
Location No. 2 is north on Long Beach Boulevard between Wisconsin
and Michigan Avenues. The lots are at the rear of the commercial
frontage on Long Beach Boulevard. Although these parcels are
designated on the General Plan Map as Multiple-Family
Residential, they are being used for commercial purposes. Also,
' the zoning classification is predominantly commercial along Long
Beach Boulevard and State Street. It is Staff's professional
opinion that it would not be feasible.to develop only two lots
with automobile parking only, with the current standards required
by the Municipal Code. Also, residential development would not
be appropriate .in proximity to a major arterial such as Long
Beach Boulevard.
_ Because Lynwood is fully built-up, changing land use will often
take place through the replacement of structures with new
bui2dings. Thss unavoidable process of renewal and replacement
should take place with the least possible disruption to the life
of the city. Trends in family size and socio-economic
conditions, for example, affect the city's housing and employment
patterns. These .alterations will eventually be reflected in
changed land. use .patterns. By tracing historical patterns,
surveying_current.trends and interpreting future projections, the
Land Use Element of our General Plan will identify emerging �
issues to which public policy must respond. •
The � General Plan establishes the frame work for guiding
development within the City. Future land-use planning efforts
depend upon the City's ability to effectively implement the
General P1an. There are several tools which have been adopted to
aid in, this implemer.tation; included are zoning ordinances,
subdivision regulations, building and housing codes, specific
plans, capital improvement programs and redevelopment. The
following is a summary of the City of Lynwood's participation in y
and utilization of these techniques during 1986.
A. ZONING
Zoning is considered the primary tool for implementing
the Comprehensive Plan. The establishment of zoning
districts coupled with corresponding development
standards provides the criteria and implementation
mechanism by which the utilization of land in the City
is brought into consistence with the broader objectives
• of the General Plan.
The Zoning � Ordinance establishes the use of
discretionary permits and site-speci£ic review
' _procedures .as definitive methods for supporting and
enhancing the goals and objectives of the General Plan.

Site plan review, conditional use • mits, changes of
' zone and the abatement of non-conforming uses are
� techniques which can be utilized under the Ordinance.
The following procedures were utilized during 1985 as a
means of maintaining consistency with the General Plan.

City Council for consideration; the appeals sought a
reversal of the decisions of the Planning Commission
approving development in the commercial zones.
B. SUBDIVISION'REGULATIONS
The process of subdividing land has a substantial
effect .on the development of a the division of
land is one of the most irreversible actions that a
local government can undertake. Once approved, lot
lines become difficult to modify even though there are
, mechanisms for doing so under the regulations of the .
State of California Subdivision Map Act.
A subdivision ordinance was approved and adopted by the
City Council in December, 1985, to specifically provide
regulations for subdivision processing and development
within the City. The'inclusion of the Subdivision
Ordinance in the Zoning Code emphatically improves
the City's ability to respond effectively and
positively to requests for subdivisions or parcel maps.

C. SPECIFIC PLANS
... _Specific .Plans represent refinements to the General
• Plan. They are useful planning tools for areas
expected to undergo either public or private
redevelopment (or in many cases development at new
intensity or character). Specific Plans describe in
detail how an area is expected to be developed complete
with cr.iteria and development requirements.
.. Although no new specific plans were initiated in 1986,
. it is hoped that this technique will be utilized for
several areas in.1987, especially in those sections of
the City which are targeted for redevelopment, e.g.,
the Long Beach Boulevard commercial corridor, including
the Commercial Center Site and the Alameda Industrial
Corridor.

D. BUILDING AND HOUSING COD�S
The City has adopted tne latest editions of the
' Uniform Building Code and the Uniform Plumbing Code;
' the Uniform Mechanical Code; the National Electrical
Code and State of California Housing Code. These codes
regulate building and safety. During 1986, an
aggressive prograsn of Code Enforcement was maintained,
' concentrating on violations and potential violations
within the residential, commercial and manufacturing
areas of the City. This program is a means of
implementing the Housing Element and Community Safety
- Slement of the General Plan.
E. CAPITAL IMPROVEMENT PROGRAM
The Capital Improvements Program is a tool which can be
� used to implement the Land Use, Circulation and
� Recreation Elements of the General Plan. Included are
programs such as st-reet and sidewalk improvemen*_s, park
improvements, development of public facilities and
landscaping programs. The following is a listing of
the capital improvement projects undertaken in 1986.

The project involved relocation of existing City
water mains which were to be displaced by the
construction of tfie 2-105 Freeway. The project
was awarded to Pascal and Ludwig Engineers for
� $2,026,000. At the end of 1986, 650 _of the
project was completed. "
2. Street Improvements - Los Flores Boulevard
The project involved the reconstruction and re-
surfacing of Los Flores Boulevard, west of
AtlantiC Avenue and north of Elmwood Avenue. The
project was awarded to Showman Construction Co.
for 599,700. The project was completed in 1986.
3. Lindbergh Park Project
A brand new City park was constructed on E1
Segundo Boulevard. It. involved a grading
operation, installation of an irrigation system,
planting trees, sodding grass, sand-box and
playground equipment at a cost of $150,000.
- 4. Street Improvements - Norton Avenue
' The project involved the reconstruction and re-
surfacing of Norton Avenue from Drury Lane to
Santa Fe Avenue. The project was awarded to
Shawman Construction Company for 544,800. The
project was completed in December, 1986.
` F. - REDEVELOPNIENT
_ Redevelopment is one of the most power£ul tools �
available to local governments to implement their
General Plans. In instances where the private sector
_alone is unable or unwilling to asseemble .lands and
reinvest the necessary capital for revitalizing
blighted or underdeveloped areas, the redevelopment
process is a means of trans£orming a deteriorated area
into a more productive one.

� In 1986, The Lynwood Recevelopment Agency approved the
development plans for two shopping centers:
1),. Imperial ?iighway and Long Beach Associates.
- Location: 11122-38 Long Beach Boulevard.
(See Attachment C.)
- Description: A 11,089 square feet shopping
center with parking for 56 cars. There will
be 3,750 square feet for fast food use and
7,339 square feet will be allocated to gen-
eral retail. This project is the first
within the Project Area "A."
2) Lynwood Towne Center; Hopkins Lynwood
� Associates.
- Location: Long Beach Boulevard between
Imperial Highway and Fernwood
Avenue. -(See Attachment D.)
- Description: The development of a 114,000
square feet, one-story commercial/retail
facility with 646 parking spaces.
The independent Annual Financial and Compliance Report
for 1986 was prepared and is on file in The Community
Development Division.
G. REVISING AND AMENDING THE GENERAL PLAN
The General Plan is a dynamic document because it is
based on community values and an understanding of
existing and projected conditions and needs, all of
which continually change. Loca1 governments should
plan for change by establishing formal procedures• for
regularly monitoring, reviewing, and amending the -
general plan. The portions of the plan with a short-
, term focus, such as the implementation program, should
. be reviewed annually and revised as necessary to
reflect the availability of new implementation
tools, changes in funding sources, and the results of
monitoring the effectiveness of past decisions. The
entire plan, including the basic policies, should be
thoroughly reviewed at least every five years and
revised as necessasry to reflect new conditions, local
attitudes, and political realities. The housing
element must be reviewed and updated at least every
five years (Title 25, California Administrat�ve Code
Section 6472). Obviously, the longer the interval
between revisions of the General Plan, the greater the
effort and extent of each revision.
. If the Planning Commission or City Council finds itsel£
making frequent piecemeal amendments, major defects may
oceur in the general plan because values and needs may
have changed or the plan may have become too inflexible ,
and precise. In these cases, the jurisdiction should
not further erode the plan through amendments.
Instead,'it should undertake a major revision.
In reviewing proposals for general plan amendments,
1oca1 officials should remember that the general plan �I
� is a policy document for the entire community and that '
it may be amended only "in the public interest"
(GOVernment Code Section 65356.1). In other words, the
plan should be amended only when the city, with the I
support of a broad consensus, determines a change is i
necessary, not merely because a property owner or group �,
of citizens desires the amendment. Every general plan �
amendment, additionally, must be consistent witn the
rest of the general plan or appropriate changes need to . i
be made t.o maintain consistency. I

The City of Lynwood General Plan in its present form is
nearing its eleventh year as the policy document
j guiding the City's growth process and except for the
Housing Element, has not been completely and
methodically revlsed to reflec� changinq patterns in
the growth of the community. Several "piecemeal"
amendments have been instituted to the plan but in
light of the need to have a viable, comprehensive
. planning tool the Community Development Department
. strongly recommends that a complete major revision of
the entire General Plan be undertaken as soon as
possible.
RECOMMENDATIONS:
Staff respectfully requests that the City Council consj.der the
following recommendations suggested by the Planning Com.mission
for Council's consideration:
1) Revise the entire General Plan with the following
Elements included: Land Use, Circulation, Housinq,
, Conservation, Open Space, Noise, Safety, Economic
Development, Recreation and a Community Design Element.
"G) Prepare revisions to the Housing Element as necessary,
ensuring that its programs, policies and procedures are
consistent with an overall update of the other
elements.
3) Conduct a detailed revision of the Land Use Element to
reflect changing community needs and modifications in
the Zoning Ordinance, establishing a consistency
, between the two and the actual land use. .
4) Include the Century Freeway (I-105) into the
circulation element reflecting the impacts of the total
transportation artery on the intersecting and
complementing street system. Coordinate this element
with the .Land Use Element addressing changes in land
, uses along the freeway and identify new land use
opportunities.
5) Restructure the Noise Element to reflect the impacts of
the Century Freeway on land uses adjacent to the right- �
� of-way' and establish criteria for mitigation of any
impacts.
6) Establish a Community Design Element to develop a
consistent, viable and distinctive community image
incorporating the multiple facets of design techriques
and standards. Prepare a criteria of standards for
aesthetics and design ir conjunction with tne 'Zoning
Ordinance.
7) Prepare an Economic Development/Redevelopment Element
which serves as a guideline and framework for the
City's economic development and redevelopment efforts
delineating policies, programs and implementation
, plans.
8) Establish an Energy Policy as a part of the General
Plan under the Conservation Element.

. 9) Conduct public study sessions or workshops to discuss
and develop a vision oi Lynwood's future, as well as
defining goals for each element of a new Comprehensive
Plan. Furthermore, tnese workshops may be involved in
the formulation of implementation strategies, such as a
conscious local government program intended to
. influence the rate, amount, type, location, and/or
quality of future development within our City.
� 10). Prepare speci£ic plans for the Long Beach Boulevard
Commercial Corridor (including the Commercial Center
site -- Lynwood Towne Center) and the Alameda
Industrial Corridor.
Staff further requests, if it is the Council's pleasure, to
direct staff to report back to the Council on (a) a planning
work program to implement any or all of the above
recommendations; (b) projected costs and sources_of funding;
and (c) drafts for Request for Proposals to solicit the
required planning consulting services.

RE: Need for a Comprehensive General P1an Revision
There is increasing concern and irustration on the part of
Lynwood Citizens relative to the City's development_ and aesthetic
profile. The need exi.sts to restore Lynwood's vitality, liveability
and sense of purpose. To achieve these ends, a community should be
' able to look to its Comprehensive General P1an for direction.
However, the Lynwood Plan fails provide positive guidelines for
Lynwood's present day developmental needs. Contrary to the General
P1an's racist inferences that Blacks and Hispanics have led to �
coa�unity decline, it is the generally disorganized nature of this
essential planning document that perpetuates co�munity stagnation
and blight.
As members of the City Council, we are charged with ,the
responsibility of making multi-million dollar decisions that affect
the lives of Lynwood Citizens. In recent weeks we were asked to
provide direction relative to a$3.75 million dollar bond issue. � �
Although Lynwood residents will have to support this debt for years"
to come, City Council does not even have the benefit of a viable I
planning document to provide adequate guidance. �
The General P1an should serve as a policy guide for City Council I
as well as admiaistration. It should ensure consistency in the �
decision making process of Council and our Advisory Com�issions by I
defining goals and standards for their implementation. The General �
P1an should also provide the private sector with a guide to relate �
its development plans to the policies and objectives of the Community. '

Unforturnately, the Lynwood General Plan �ails to neet these
criteria £or need of serious revisions and updating.
The State mandates that certair. elements be included in the
General P1an. However, some cities have found it necessary to
also include other optional elements such zs a Communtiy Design
Element and an Economic Development Element. Lynwood should at
least incorporate these two additional elements into its plan.
Community Desi�n Element
A Community Design Elemen*_ of the General Plan would establish
goals and policies to enhance the liveability and investment
potential of Lynwood by ensuring the highest attainable 1eve1 of
quality in the design and re-design of the City's physical forms.
Among Lynwood most prominent needs is to present a positive
image of our community.
, For Lynwood to grow and develop to its potential, it is important
that the basic image of the City, serve as the basis of confidence
and co�itment by residents and the business coffiunity alike. .A
Community Design Element wi11 help us to make decisions on proposed
developments and expenditures for beautificat.ion. It will lead us
as members of Council to carefully weigh their value in terms of how
they will.contribute in a positive way to the total image of the City.
Economic DesiQn Element
Improving the investment climate in Lynwood goes hand-in-hand
with the goal of improving the.City's physical and social image. An
Economic Development Element wou�d outline new methods and strategies
£or the purpose of creating new cpportunities for future econo�ic
growth and development within the community. The standards and
criteria needed to facilitate quality development and minimize
negative environmental impacts would be a;•key part of this document.
The Economic Development Element would consider overall
economic trends and growth potential for Lynwood, options for
creating employment, and providing additional goods and services.
Policies aimed at creating balanced growth and qualitative change
would be a basic component o£ this element.

Conclusion
The General Plan is in serious need of revision. The document
is frought with racial stereotypes and lacks objectivity. Most
importantly, the data on which the E1an is based is no longer valid.
The General Plan is one of the most essenti2l policy docunents
� in the City. It is reco�ended that Council direct staff to solicit
proposals for the preparation of a revised Gonprehensive General
Plari including Coumiunity Design and Economic Development Elements.
It is also reco�ended that the General Plan be evaluated i�mediately
for legal adequacy.

'Ib r�uest that the City Coimcil adopt a moratoritnn on the permitting/
lic�nsing of multi-tenant, indoor retail centers.
SACSCQ20UND
Multi-tenant, indoor retail centers (e:g. ir.door swap'meets, flea markets,
. etc.) or facilities are a relatively new conrept in axrmercial land use
practices. This ccann�rcial use is presently ex�riencing a strong
growth pred�ninantly in older coinriercial strips within underutilized or
vacant lan�e conTnercial buildings such as su�rniarkets, theaters, bowling
alleys, etc. Typically the buildings house a collection of several vendors
of low-briced merchandise such as clothing, shoes, toys, jewelry, small
appliances and otlier household goo3s, as well as iood ita�ns. The vendors
occupy separate stalls ranging from approxunately 300 square feet up to
1,000 square feet of space. The Planning Division has recently received one
(1) �rmit application to operate a multi-tenant, indoor retail center at
the bowling alley at the southwest corner of Centusy Boulevard and Ernestine
Street in the Civic Center area. Presently the City's Zoning Ordinance
does not �ntain any provisions to regulate this ty� of use.
ANALYSIS & �NCLUSION
Staff believes that while it may not be in the best interest to the City to
tbtally preclude such c�nnercial use, there is a need to regulate i.t. Un-
regulated multi-tenant, indoor retail centers have the potential for seriously
impacting'the parking and vehicular circulation in the ca�rcial strips where
these uses may be located. Furthermore, these unregulatecl uses may result in
health and safety problems primarily in the areas of building improv�nents and
facilities and in food preparation and crons�snption. Lack of adequate regula-
• tions may also preclude the City fran collecting its share of sales tax
' revenues and licensing fees. If these facilities are not well conceived, well
financed and well managed, the multi-tenant, indoor retail centers may have
' the potential to further deteriorate the City's older ��cn�ercial strips with
their blighting influence.
In order to fully assess the potential impacts of multi-tenant, indoor retail
centers in Lynwood staff has initiated a study on this new concept in land
use. This study includes a survey of develognent standards and operational
controls being considered or implemented by other jurisdictions in the region.
Therefore, in order to allow the City to enact appropriaLe regulations concerning
the subject land use, and preclude the establislanent of such multi-tenant,
indoor retai.l centers prior to the adoption of the regulations, staff rec�nciends
" that the-City Coimcil consider imp�sing a moratoritan on the permitting/lic�nsing
of such uses in the City. .

Staff respect£ully requests that after consideration the City Council adopt
, the attached e�rergency ordinan� imposing a moratoriiun on the permitting/

REGARDING P-JRCHASING AND TRAVEL AND b?EETINGS
BACKGROUND
There has never been a written policy on how the Mayor and
Council expend monies on budget line items. There is, however, a
code section which requires that all purchases must be preceded
by a purchase requisition/purchase order. The purpose of the
purchase requisition/purchase order requirement is to make sure
that t�ere is no duplication in buying, that there is no
inordinate acquisition of items that results in stock piling,
that there is proper bidding followed when needed, that there is
control on favoritism towards vendors and in general to make it
easier to oversee any purchase whether it be for paper clips or
automobiles. When the manager assumed his tenure, purchasing
needed to be revamped and more fully controlled than it had in
prior years. Those problems have been resolved in cooperation
with the department heads and their staff. No policies were
established for Mayor and Council because they do very little
purchasing, therefore, it has never been firmly established how
they should go about ordering materials or services.
Requisitions and purchases are checked against the depar unent's
budget to ensure availability of funds.
ANALYSIS
Council should follow the code by having purchase orders prepared
whenever goods or services are ordered. It also should establish
a limit in accordance with the code which is $500.00 per
purchase, above which, phone bids are required. You may wish to
put a check on yourselves in the ordering of professional
services and goods by requiring that any services or goods
ordered be reviewed by other council members by having the
request placed ir. everyone's box with a requirement that a
response must be made within five (5) days or the purchase
stands. Staff is also concerned with the per diem level of
expenses for travel and meetings. We are aware that $35.00
cannot cover meals, taxi, telephone, etc. on out of town trips.
Staff is therefore requesting that the per diem level be raised
from $35.00 per day to $50.00 per day.
RECOMMENDATION

Staff respectfully requests that the Mayor and Council approve �
the attached policy on purchasing procedures for City Council and
Mayor and adopt the resolution raising the per diem from 535.00 '
to 550.00. ,

SFCTION 1. Recitals. The City Council of the City of
Lynwood fincs, determir,es and declares:
(a) '!'he City Council previously enacted Ordinance
No. 1134, which granted a non-exclusive tranchise for a
cable television system in the City to California
Cablesystems, Inc.; and
(b). The said Urdinance �o. 1134 was subsequentiy
amended by Ordinances Nos. ]149, 1253 and 1274, which
modified the initial tErms and conditions or the
£ranchise; and
(c) As the result of negotiations based upoti
actual operating results as well as future projections,
,the City of Lyno�ood desires to continue amendr�ents
- to the Franchise terws and conditions in an efrort to
insure the future viability of caole service for Lhe i
residents of the City. i
SECTI()N 2 . Section 5.5 of Ordinance No. 1134 " Faithful
Periornance Bond" is hereby aiuended ro read as follows:
"5'.5 Faithful Performance Bond. Upon tne �
effective date o= the Franchise, as amended, Grantee
shall furnish prooi of the posting of a faithful
performance bond, which may be a corporate surety bond, I
running to the Grantor, in the penal sum of $150,OOU. j
The faithful performance bond sha11 be in a form I
approv�ed by the City Attorney. Upoa demonstration by �
Grantee to the sacisfaction of Grantor, pursuant to the

provided customers-premises equipment n�cessary to
interface with the cable communications syscems at a
cost to be determi�ed by Grantee. Equipment
commercially available and not directly linked to the
cable system, such as d2ta terminals, video ca�eras and
microphones, may be supplied by Grantee or, provided no
harm is caused or results to the cable comr�unications
system by the cable system user.
Grantee shall not be required to activate the
institutional services, nor build the i:�stitutional
network until December 24, 1987. At that time, Grantor.
may require construction and activation of the
originally proposed network or acceptable aLi:ernatives
if it determines that the constr.uction and operation of
an institutional network are technically ?nd
economically feasible as we11 as in accordance with the
regulations of the Public Utilities Commission and the
Federal Communications Commission. When Grantor reviews �
the economic and technical feasibility o= the I
institucional network, it sha11 giv� due consideration
to an�� alternative proposals Granr_ee may *r�ish to make
for delivery of institutional services, including, buc
not limited Lo, the delivery of these services on the
residential networlc. Grentor may also continue to
author�ze de1�y in constraction of the institutionat
network if it determines th�t such delay is warrented
due to a lack of technical or econonic feasibility.".

Grantee shalt provide support for local p*ogramming, as
a minimum:
• (a) Reasonable, scheduled use of ai1 cablecasting
access facilities by non-commerr_ia1, tax-exempt
organizations at no charge.
(b) Payment to Grantor or a non-profit coryoration
. to be designated by Grantor tne total sum of 4b of
Grantee's gross revenues received and attributable to
Lynwood in calendar year 1986, plus the sur� of
$20,000.

� SECTION 7. This Ordinance ar�ending and adding to
Urdinance 1134 of the City of Lynwood is enacted in light of
the current 'inancial situation of the G_*antee, Roge-s Cab1e-
systems of Califonria, Inc., and in reliance on the in�egrity
and ability of its parent Rogers U.S. Cablesysr_ems, Inc. to
perform �Jli?"SUilRL �o this Ordinance. Accordingly, this
Ordinance may be immediately repealed, at Grantor's option,
should Grantee assign its rights, duties and.obligations
under the Franchise to any other nerscn or entity. Assign-
, ment sha11 be deened to include, but not be limited to, (1)
the transfer or sale of any stock of Grantee" from Rogers U.S.
Cablesyst-ems, Inc. to any third party, (2) the assignment o�
the assets of Grantee, inc"luding this Franchise, to any third
party, or (3) the merger, dissolution, consolidation, or
o�:h:r reorganization of Grantee, including the creation of
any limited partnership. Grantor acknowledges that the s41e
of,Rogers U.S. Cablesyste�ns, Inc. stock to Rogers Cable-
systems of America shail not rzsult in repeal of this
� Urdinance.
SECTIU� 8. The f'ederal "Cable Communications Policy Act '
of 198�ontains several provisions treating cable i
television system franchises in effect on the date ef the
Federal Act differently than franchises granted after the I
F'ederal Act. By er.acting this Ordinance, which amends and I
adds to Ordinance 1134 of the City of Lynwood, neither j
Grantor nor Grantee intend that the Franchise be constraed as �
a new Franchise outside of the scope of the "grandfather" �
clauses of the rederal Act.
SECLTON 9. The Grantee and its Parent Corporation i
shall, within sixty (6U) days after passage of this �
Ordinance, file in the office ot the City Clerk a written �
acceptance of this Ordinance eaecuted by Grantee and its
� Parent Corporation, in a form approved by the City Atcorney. I
The Parent Corporation, by execuLing and filing the �
Acceptance, guarantees performance by Grantee oi a11 �
Grantee's obligations hereunder and agrees to perform those ,
obligations and Grantee`s behalf, if so ordered by Grantor, I
in the event Grantee for any reason whicn is within its �
control or reasonably foreseeable fai�s to perform them. The I
Acceptance sha11 include a provision stating that the Grantee I
and its Parent Corporation recognize that this Ordinance does �
, not affect the status ot i:he Franchise as a przexisting �
f�anchise ;aithin the meaning of the Federal "Cable �
Communications Policy �ct o` 7984" and surther sLating that ;
