HomeMy Public PortalAboutMinutes - 1973/03/13 - Regular1 PLANNING COMMISSION MINUTES March 13, 1973 INITIATION CALL TO ORDER The regular meeting of the Planning Commission of the City of Temple City was called to order by.Chairman Garvin at 7:30 p.m., March 13, 1973. 2. PLEDGE OF ALLEGIANCE The Pledge of Allegiance to the Flag was led by.Chairman Garvin. 3. ROLL CALL: Present: Commissioners - Atkins, Collister, Lawson, Garvin Absent: Commissioner — Beckman Also present were Asst. City Attorney White and Planning Director ,Dragicevich. APPROVAL OF MINUTES: Regular meeting of February 27, 1973: Commissioner Lawson referred to para. 9, pg. 3, which should read "applicant's request would result in 42% coverage of lot area ". Commissioner Collister moved to approve the minutes as corrected. Motion was seconded by Commissioner Atkins and passed with no objection. 5. PUBLIC HEARING: CONDITIONAL USE PERMIT CASE 73 -388 Edward M. Posso Owner 3001 Coolidge Avenue Los Angeles, California Guillermo & Alicia Rey - Applicants 10403 Tujunga Canyon Boulevard Tujunga, California Site: 9100 Las Tunas Boulevard (Mr. Burrito) Planning Director stated public notices had been sent as required and that applicant proposes to serve beer and wine for consumption on premises of existing restaurant within 200 feet of R.-zoned property. The Director then referred to the plot plan marked Exhibit "A" showing existing development of the property and the layout of the existing restaurant, gave the factual data and the staff proposals if the Commission grants the request, all of which are on file in the Planning Department. There were no questions of the Planning Director, and the public hearing was declared open. Mr. Guillermo Rey, 10403 Tujunga Canyon Boulevard, Tujunga, Ca., stated he was familiar with the proposals by the staff and had no objections to them. Mr. Ernest Loredo, 6424 Day Street, Tujunga, said beer and wine would be served only with meals, and not alone as this establishment is not a bar. The hours of operation are 11:30 a.m. to 8:30 p.m. The kitchen closes at 8:30 p.m. There was no one speaking against the request. Commissioner Atkins moved to close public hearing, seconded by Commissioner Collister and motion passed. PLANNING COMMISSION MINUTES Meeting of March 13, 1973 PAGE TWO The Commissioners, in closed discussion, were in agreement that beer and wine were consistent with this type of operation, not injurious to surrounding properties. Other restaurants in the area serve beer and wine with no problem. The request meets the requirements for granting a conditional use permit. Commissioner Atkins moved to grant conditional use permit in Case 73 -338 with staff proposals, as it meets the conditions for grant- ing. Motion was seconded by Commissioner Lawson and passed. Asst. City Attorney White read title to Resolution 73- 490PC, A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TEMPLE CITY GRANTING CONDITIONAL USE PERMIT IN CASE NO. 73-388. Commissioner Atkins moved to waive further reading and adopt, seconded by Com- missioner Colllster and motion passed with no objections. PUBLIC HEARING: CONDITIONAL USE PERMIT CASE NO. 73 -389 Robert Kukurin - Owner 1434 Finegrove Avenue Hacienda Heights, California In -N -Out Burgers, Inc. - Applicant 1404 West Covina Boulevard San Dimas, California Site: 4804 Doreen Avenue Planning Director stated notices had been sent as required, and said the applicant proposes to establish a drive -in (drive -thru) restaurant on a vacant C -2 zoned parcel. He described the plot plan marked Exhibit "A ", gave the factual data and staff proposals if the Planning Commission grants the request. Two additional proposals were added to the staff report: (a) perimeter low walls between driveway and sidewalk or parkway, with landscaping area outside the wall, and (b) that outside lighting be shielded away from adjacent properties and public thoroughfares. Chairman Garvin suggested that, instead of having two curb cuts on Doreen Avenue, an alternative would be to have a 30 ft, driveway in the middle of the property. The Planning Director agreed that one driveway would be better, however, there was a problem with the loca- tion of the drainage basin. If it was agreeable with the applicant, the staff would work with him on this suggestion. The public hearing was declared open. Mr. Henry Snyder, President, In -N -Out Burger, 1404 W. Covina, San Dimas, said he had hoped they could change the drainage ditch and provide a better traffic flow. Commissioner Atkins asked if the rendering supplied to the Commission of the subject facility was an exact copy of what would be built. Mr. Snyder said it would be identical except the canopy in the picture is next to the building. The pictured facility is identical to one in Hacienda Heights. In the event of a back-up on Lower Azusa Road, Mr. Snyder continued, he suggested a sign "Please pull around rear ". The problem with traffic piling up in the Pasadena facility is that the lot is much smaller. He said he cooperates with City officials in every way he can to avoid problems. Also, when lanes are full people will drive to the back and use the walk -up window. The hours of operation are 10:30 a.m, to 1:00 a.m., with a closing of 1:30 a.m, on Friday and Saturday. Mr. Snyder had no disagreement with the staff proposals, except for installing a wall between lawn and driveway. If someone in a car in the driveway wants to get out it could present a problem. He prefers curbing. However, he will comply if it is required. Mr. Robert Kukurin, 1434 Finegrove Avenue, Hacienda Heights, owner of the subject property, said the site had been vacant for eight years and the taxes have increased yearly. He did not feel there would be a traffic or back -up problem. The other two drive- through food stands on Lower Azusa Road, the Jack -in -the -Box and the taco stand, have no problems. This is a business area, and progress is inevitable. He was in favor of the proposal. PLANNING COMMISSION MINUTES Meeting of March 13, 1973 Page three III In opposition: Mr. Daniel Giordani, 10619 Lower Azusa Road, east of the subject property, said the proposed canopy would be against his wall, and his bedrooms are directly on the other side of that wall. He also spoke of the traffic on Lower Azusa Road and was concerned about increased traffic problems. Mrs. Hazel Whi erman, 4810 N. Doreen Avenue, to the north of the subject property, was concerned that the storage area of the pro- posed project would cut off light and air to her home, and she asked that the developer consider sliding this storage area to the east. Also, ice crushing machines and trash areas in the storage area would be next to her bedroom window. 1 • 1 • 1 Mr. Daniel Giordani Jr., 10619 Lower Azusa Road, spoke of the traffic problem the proposed use would add to on Lower Azusa Road, and the late hours and noise of the facility, and the possibility of trash and litter. Mr. John Bloechle, 4832 N. Doreen, said the cities of El Monte and Temple City were planning to improve Lower Azusa Road and he wondered how much of the subject property would be dedicated at that time for right-of-way purposes. It was explained that the street is 80 ft. at this location presently, and that is full width. He was concerned about traffic exiting from the shopping area on the south side across from the proposed facility, and the fact that there is no east-bound turning lane at this point. In rebuttal, Mr. Snyder read the traffic counts at two other facilities and also at Lower Azusa Road, which was considerably lower. It was pointed out that, with the improvement of Lower Azusa Road the traffic is expected to increase 50 %. This project is expected to begin in the next fiscal year. He doubted that moving the storage area east would be desirable as it is part of the building design. He was not against moving the canopy away from the wall. He felt the canopy was a necess- ary item as people like to sit out there. His organization does not encourage loiterers and has no problem with the abuse of the canopy area. Chairman Garvin complimented Mr. Snyder on the clean appearance of the facilities he had observed. He was told the operators of the establish- ment were required to clean up the litter each hour. He has two shifts of employees and to change the hours of operation would not be accept- able. The men who work there participate in the profits and this accounts for employees staying with his organization for many years. The number of employees working at any one time would be, at most, 8 or 9. They would have to park on Doreen, or arrangements might be made to park in the Midway Shopping Center. Mr. Snyder had no objection to additional landscaping. Chairman Garvin asked if he would object to continuing the hearing for two weeks so applicant could check the drainage basin with the Engineering Dept. to determine if the driveways on Doreen could be altered to one 30-ft. driveway, and to show additional landscaping, a sign, location of speakers and the decorative wall separating landscaping area on Lower Azusa Road from the southerly driveways. Mr. Snyder had no objections. Chairman Garvin noted that no one had left the room, and suggested this matter be continued as an open public hearing. Mr. Kukurin, 1434 Finegrove Avenue, Hacienda Heights, addressed the Commission and said the wall on the eastern side of subject property was put up by him, although he and the neighbor to the east shared the expense of the materials. Commissioner Collister moved to continue the open public hearing to March 27th Planning Commission meeting, seconded by Commissioner Atkins and the motion carried with no objections. PLANNING COMMISSION MINUTES Meeting of March 13, 1973 Page four 0 7. PUBLIC HEARING: CONDITIONAL USE PERMIT CASE NO. 73 °390 Dr, Denver D. Coleman - Owner /Applicant 248 S. San Rafael Avenue Pasadena, California 1 1 Site: 8925 East Las Tunas Drive Public notices had been sent as required, the Planning Director stated, and added that the applicant proposes to expand an exist- ing vacant restaurant and modernize the appearance of the present facilities located in a C -2, General Commercial zone. He explained the plot plan marked Exhibit "A ", showing existing and proposed development, and referred to a rendering of the final project (Ex- hibits "B" and "C "). The Director gave the factual data on the property and the staff proposals if the request is granted. Property from Elm Street to Las Tunas at this location is under one ownership, he informed the Commission. The subject property and other parcels in this area are part of the Community Redevelopment Agency area and the present and proposed development comply with the Rosemead Boule- vard Redevelopment Plan. The proposed addition is 340 sq, ft., however, the seating capacity will decrease because of interior remodeling. The parking lot has been resurfaced and restriped, Director Dragicevich concluded. The public hearing was declared open, D.r. Denver Coleman, 248 S. San Rafael Avenue, Pasadena, said the plans call for improvement of the building so it will be a pleasing addition to the corner where it is located. The storage shed will be demolished, and other accessory building will be improved to appear like an integral part of the main building. He was aware, he said, if a development were to come in as part of CRA, his development might have to be demolished. There were no questions and Commissioner Lawson moved to close the public hearing, seconded by Commissioner Collister and the motion passed with no objections. In closed discussion the Commissioners were in agreement that the proposal would be an addition to the neighborhood and increase the value of adjoining properties. The streets are adequate to handle any increase in traffic caused by the proposed use, and the request meets the requirements for granting a conditional use permit. Com- missioner Atkins moved to grant Conditional Use Permit 73 -390 with staff recommendations as it meets requirements for granting, seconded by Commissioner Collister and passed with no objections. Asst. City Attorney White read title to Resolution 73 -491, A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TEMPLE CITY GRANTING CONDITIONAL USE PERMIT IN CASE NO. 73 -390. Commissioner Lawson moved to waive further reading and adopt, seconded by Com- missioner Atkins and passed with no objection. 8. COMMUNICATIONS A. Director Dragicevich referred to two communications from the Los Angeles Regional Planning Commission regarding subdivisions: (1) Parcel Map 3645, subdividing property on Wildflower Road and Tyler. Commissioners viewed the map and instructed staff to receive and file. (2) Parcel Map 3601, located on Acacia Avenue. The staff had sent a letter of objection because of creation of a land° locked parcel. The Commission were in agreement with staff's action. 9. A report on the result of the survey of property owners in the McCulloch- Daines- Welland -City boundary area was presented, and the Commission was informed that Councilman Dennis would dis- cuss this matter with the Planning Commission in the near future. B. A report on the Environmental Quality and Code Enforcement . program was 'presented, received and filed. C. Letter sent by staff to Mrs. Angela Rose re. i 1 lega l parking on her property, was presented to the Commission for information. D. Letter sent by staff to Ms. Vera Sherman, was referred to, answering Questions raised in her letter to the Chairman of the Planning Commission. E. Environmental Impact Statement requirements were explained by Asst. City Attorney White who said that AB 889 requires all local agencies to adopt objectives, criteria and procedures for evaluation of public projects and those private projects which are publicly approved in terms of their impact on the environment. These procedures, expected to be adopted by Apri 1 5, 1973, must be consistent with the "Guidelines for Implementation of Calif. Environmental Quality Act of 1970." He referred to summary of regulations for processing these reports prepared by the City Attorney's office. There would be ministerial and discretionary projects. Zone variances, conditional use permits would require a report. Commissioner Atkins asked if a developer of a large project, who met all the City requirements, would have to file such a report, and was told he would not, but that the developer with a small project, who required a conditional use permit or variance, would require the filing of such report. Commissioner Atkins moved to recommend to the City Council adoption of the proposed procedures, and added he was concerned about the inequity of small projects requiring a report versus large projects which may be constructed without filing such report. Motion was seconded by Commissioner Collister and passed by roll call vote with Commissioners Atkins, Collister and Law- son voting affirmative. Chairman Garvin abstained as he had not studied the background material. 11. ADJOURNMENT There being no further business, Commissioner Lawson moved to adjourn to the next Planning Commission hearing on March 27, 1973.
