PLANNING COMMISSION MINUTES
April 10, 1973
The regular meeting of the Planning Commission of the City of Temple
City was called to order by Commissioner Atkins, acting as Chairman
Pro Tem.

Director Dragicevich gave the background on this item, referring to
letter received from Mr, Roy G. Jones, Acme Rug & Upholstery, 9085
Las Tunas Drive, who was interested in moving his business into a
location in the C ®1 zone. Results of a survey conducted by the staff
were presented to the Commission, listing in which zone this use was
placed in other surrounding cities.
Attorney White pointed out the use in question had been omitted from
any zone in the Temple City Zoning Code. If the sale of upholstery
fabrics and supplies were placed in the C °1 zone, and the furniture
repair and upholstery were placed in C-2 zone, then that C-2 activity
could be conducted on the second floor of a C °1 location. The Com-
mission, tonight, was being asked to clarify an ambiguity and recommend
their findings to the City Council for their review. This is an emer-
gency measure, to be followed by public hearing to amend the code to
include these uses.
Present: Commissioners: Atkins, Beckman, Collister
Absent: Commissioners: Garvin and Lawson
Also present were City Manager Koski, Asst. City Attorney White, Plann-
ing Director Dragicevich and Planning Technician Burnham,
Commissioner Beckman moved to excuse Commissioners Garvin and Lawson
for cause, seconded by Commissioner Collister, and the motion carried
with no objections.
4. APPROVAL OF MINUTES: Regular meeting of March 27, 1973
There being no additions or corrections to the minutes; Commissioner
Collister moved they be approved as written, seconded by Commissioner
Beckman. Motion passed by roll call vote with Commissioners Beckman
and Collister voting for, and Commissioner Atkins abstaining.

Commissioner Beckman was of the opinion that the sale of fabrics and
supplies was similar to operations conducted in a department store.
He therefore moved to recommend to the City Council that the retail
sale of upholstery fabrics and related supplies be included as a per-
mitted use in the C-1 zone, Commissioner Collister seconded and the
motion passed.
Attorney White pointed out that the sale of rugs and carpets was not
listed in any zone in the Temple City ordi nance, Commissioner Beckman
commented he felt this use should be in the C ®1 zone, but that it
should specify that there would be no cleaning of rugs and carpets
done on the premises. The other Commissioners were in agreement, and
Commissioner Beckman moved to recommend placing this use in the C-1
zone with the prthvision that no cleaning is to be done on the premises.
Commissioner Collister seconded, and the motion carried.

Commissioner Beckman then moved to place furniture upholstery and
repair as an allowable use in the C ®2 zone, and the motion was
seconded by Commissioner Collister and carried.
Asst. City Attorney White read title to Resolution 73 °495 PC, A RESOLU-
TION OF THE PLANNING COMMISSION OF THE CITY OF TEMPLE CITY RECOMMENDING
TO THE CITY COUNCIL THE CLARIFICATION OF AMBIGUITIES IN THE TEMPLE
CITY ZONING CODE. Commissioner Beckman moved to waive further reading
and adopt, seconded by Commissioner Collister, and the motion carried.
6. PUBLIC HEARING: ZONE VARIANCE CASE N0. 73-393

City Attorney White informed applicant that the Temple City Code re-
quires a vote of at least three Commissioners to approve or deny
an application. Inasmuch as there are only three members of the Com-
mission present, a 2:1 vote would continue the hearing to the next
meeting. He asked applicant if he wished to have his case heard this
evening or wait until the next meeting. Mr. Eldon Bowen, representing
the applicant, requested the hearing to be held this evening.
The Planning Director stated the applicant proposes to build a condomin-
ium with reduced number of parking spaces and reduced side yard setback
for a number of parking spaces and garages. He explained the plot plan
marked Exhibits "A" and "B" and gave the factual data, concluding with
the staff proposals if the request is granted. 35 parking spaces for
the proposed use are required, and only 33 are proposed; setback for
parking spaces is required to be 5 ft., and it is proposed to have no
setback in the first 2/3 of the. lot.
The Commission's attention was then directed to the Environmental Report
prepared by staff on the proposal before them, and wereis,nstructed to
consider it before considering the zone variance request. The report
concluded that the project would increase density, and therefore there
would be more traffic. This area is presently zoned R ®3 (Multiple Resi-
dential). There would be an increase in demand for facilities and
services. The Planning, Director requested, therefore, that the Commis-
sioners make changes in the report as presented in their packets to this
effect, and further, on pg. 4, that the existing trees on the property
would be removed and new trees supplied by the applicant. On pg. 5,
item 11 (b), that a neighbor had contacted staff stating the project, if
approved, would block his view of the mountains, which comment should
be considered in the report. In conclusion, Director Dragicevich said
it was the staff's opinion that this project would not have a '!sub'
stantially adverse effect on the environment."
Asst. City Attorney instructed the Commissioners on the requirements to
be considered in adopting an Environmental Impact Report. The Commis-
sioners requested that staff fill in all spaces, rather than leaving
blank those not applicable to a - project.
The public hearing was declared open.

Mr. Eldon Bowen, representing the applicant, 2246 N. Lake, Altadena, said
a 27 -unit project could be built on the subject property, and if it met all
City requirements, would not have to go before the Planning Commission for
approval. However, the street is quiet, residential, and the proposed plans,
with medium density, were more suitable for the location, with green areas
and landscaping. Presently there is one old house and a few trees on one
lot and two lots are vacant. Because the occupants of the project will own
IIItheir own units, and be required to belong to a home owners' association,
the project will be well maintained. No one under 14 years of age will be
allowed to live in the units. Occupancy is generally 12 people per unit,
or about 21 people and 21 automobiles.
The Commissioners and Mr. Bowen discussed the possibility of re- orienting
the garages and parking spaces, and Mr. Bowen pointed out the re- orientation
would result in 60% of the area being utilized for parking and driveways,
would cut down on green areas and block the view. The present plan calls
for a 30 ft. drive which is the width required by the Los Angeles Fire
Department for use of their vehicles in the event of a fire. The garages
on the south property line will be kept at a minimum height, not to exceed
92 ft., by constructing a fire wall and eliminating the need for a parapet.
The wall along the parking spaces can be 6 ft, high, but he proposes a 5 ft,
height. The garages start 72 ft, from the curb line, and the house to the
.outh would probably have the view from one bedroom window affected.
There was no one to speak in favor.
Against:
Mr. Alfred Larson, 6059 Camellia, asked if granting this variance for multiple
residential project would set a.precedent for others to be built in that area,
and Commissioner Beckman said each request would come before the Commission
to be judged on its own merits.
Mrs. George Roberts, 6038 N. Temple City Boulevard, was concerned about the
location of the trash bins; if located at the westerly property line they
would adversely affect her rentals which back up to that line, over garages.
Applicant was agreeable to relocate the bins to the area between the garages
and parking spaces on the south side. She was further concerned that the
area from the property line to the wall, on the westerly side of the subject
property, would become a trash area. Applicant said the 'occupants of the
units would be property owners and interested in maintaining the appearance
of the property. The Commissioners added, further, that they had no juris-
diction over this item.
r. Joseph Renda, 6053 Camellia, asked if the project would affect his view,
and was assured it would not. Mr. Burnham pointed out on Exhibit "A"
that the northerly side of the project would have patios and landscaped
area, which would face Mr. Renda's southerly, property line.
Commissioner Beckman moved that the .public hearing be closed, seconded by
Commissioner Collister, and the motion carried.
In closed discussion Commissioner Beckman expressed a desire to see garages
moved to the property line because he, too, was concerned that the setback
area behind garages develops into a catch -all.
IIICommissioner Collister felt the applicant was utilizing the property to its
fullest potential; he did not feel the reduced parking was crucial,
Commissioner Atkins said the proposed plans looked very good, especially when
one considers the maximum use that could be made of the property in this zone,
and with the possibility that the City would have no control over such develop-
ment. This project, he continued, would be an asset to the community. He,
too, felt that the 5 ft. setback behind the garages might be a detriment. He
Suestioned the staff proposal for concrete. driveway approch and 6 ft. concrete
idewalk to be constructed next to the property line. It was agreed to corect this condition to "concrete driveway approach and sidewalk shall be con -
structed in accordance with City standards."

Commissioner Beckman moved to adopt the Environmental Impact Report, with
corrections as discussed; Commissioner Collister seconded, and the motion
carried.
Commissioner Collister moved to grant Zone Variance 73 -393, with staff
proposals as corrected, as it meets the criteria for granting a variance
and the property will be utilized to its best advantage with landscaping
IIIand open space. Motion was seconded by Commissioner Beckman and carried.
Asst. City Attorney White read title to Resolution 73 - 496PC, A RESOLUTION
OF THE PLANNING COMMISSION OF THE CITY OF TEMPLE CITY GRANTING ZONE VARIANCE
IN ZONE VARIANCE CASE 73 -393. Commissioner Beckman moved to waive further
reading and adopt, seconded by Commissioner Collister and passed.
7. A. Hearing Procedures (Government Code Section 65804)
Asst. City Attorney White explained these procedures were drawn
up by their office, are the same as those adopted by the City
Council on April 3, and by adoption of these procedures the
Planning Commission will comply with minimum due process pro-
cedures which will stand the test of time and court challenge.
He reviewed some of the points which the Commissioners wished
clarified. Commissioner Collister moved to adopt the hearing
procedures as presented; motion was seconded by Commissioner
Beckman and carried.
B. Referral from City Counci 1 :
Proposed Amendment to Municipal Code
Relating to Off- Street Parking in R -3
and R -4 zones (Res. 73 -485 PC )
The Planning Director informed the Commission that the City Council,
at their regular meeting of April 3, 1973, held public hearing to
consider- this matter and modified the Planning Commission recommenda-
tion in that the Council suggested one (1) open parking space for
each three (3) units in lieu of four (4) as recommended by the Plann-
ing Commission. The Commissioners were of the opinion that, since
only three members were present, this matter should be referred to
a study session when a full Commission would be present.

41119. MATTERS FROM CITY OFFICIALS

A. The Commissioners were reminded of the Contract Cities Convention
in Palm Springs April 27 through 29th.
B. Planning Technician Burnham reviewed the Environmental Quality and
Code Enforcement Program report he prepared for the Commissioners,
and asked that they report any item they might observe, applicable
under this program, to him.
C. Commissioner Beckman suggested the matter of parking recreational
vehicles on service station property be considered at a study
session. Both the Traffic and Parking Commission expressed the
opinion that prohibiting recreational vehicles from parking on
these properties had created a problem for their Commissions, he
said, by an increase in overnight parking permit requests for
passenger vehicles.
D. Commissioner Atkins called attention to the property across From the
car wash on Olive Street which, he felt, was a potential public
nuisance. Planning Technician Burnham said he was aware of the
%situation and was working on it.

There being no further business, Commissioner Beckman moved to adjourn
to the next regular Planning Commission meeting on April 24, 1973,
seconded by Commissioner Collister and carried. Meeting adjourned at
9 :05 p.m.
