REGULAR SESSION
WEDNESDAY, DECEMBER 18, 2002 4:00 P.M. CITY HALL
The Greencastle Board of Works met in Regular Session Wednesday, December 18, 2002, 4:00
p.m. at City Hall. Mayor Michael called the meeting to Order at 4:15 p.m. On the Roll Call, the
following were found to be present: Sue Murray and George Murphey.
CT Jones requested the INCODE contracts for Accounting and Utility Billing Software and
Hardware be added to the agenda.
Mayor Michael corrected the Minutes from September 18, 2002, Regular Session stating that in
the fifth paragraph of the first page that price was also an issue in selecting DLZ for the Phase I
Environmental Assessment. Motion to approve minutes from September 18, 2002, Regular - with
correction; November 20, 2002, Executive Session; November 20, 2002 Regular and December
® 11, 2002, Special Session was made by George Murphey, seconded by Mayor Michael. Vote was
unanimous.
Greencastle Township Fire Protection Service Contract in the amount of $30,000.00, 1/2 paid
after spring distributions and 1/2 after the fall distribution, was approved on a motion by Sue
Murray, seconded by George Murphey. Vote was unanimous.
Police Chief Hendrich recommended hiring Chris Jones pending PERF approval. This position is
not available until the retirement of Paul Wilson, which will be in February 2003. Motion to
accept the recommendation contingent upon PERF approval was made by Mayor Michael,
seconded by George Murphey. Vote as follows: Mayor Michael, yes and George Murphey, yes.
Sue Murray abstained due to being absent from the interview process.
Chief Hendrich recommended Robert Sharp be accepted as a Reserve Officer. Mayor Michael
made the motion to accept the recommendation, seconded by George Murphey. Vote was
unanimous.
Chief Hendrich explained an accident report that involved the Parking Violation Officer Vehicle.
Chief Hendrich stated that PVO Darcy Hendershot had parked the vehicle by the old Police
Station to do her rounds. There was a two car accident which pushed one of those vehicles into
the parked PVO vehicle. George Murphey made the motion to accept the accident report and
deemed the accident as non - chargeable, seconded by Sue Murray. Vote was unanimous.
Chief Hendrich distributed revisions to the Police Department SOP. Motion to accept the SOP
pending review and approval of the City Attorney was made by Sue Murray, seconded by George
Murphey. Vote was unanimous. The effective date of the SOP is to be January 1, 2003.
Wastewater Superintendent Mike Neese reported to the Board that the new NPDES permit
requires us to participate in a hybrid pretreatment program. WWTP Superintendent Neese
recommended hiring Stevens Resource Management to review our present Sewer Use Ordinance
to confirm it meets permit requirements set forth by IDEM. Susan Stevens, President Stevens
Resource Management, presented a contract with a not -to- exceed figure of $5,000.00 (billed on
an hourly rate of $70.00 per hour), plus $0.345 cents per mile.
Sue Murray asked when all of this would take place. Superintendent Neese stated they have
already requested an extension from IDEM for the NPDES Permit. George Murphey asked if we
are going to charge for permits. Superintendent Neese stated that we can charge for permits and
set costs for testing. Sue Murray stated that we will need to amend our Ordinance to add fees
and the mechanisms to collect the fees.
Superintendent Neese stated the fees will be paid from the Engineering Contract line item in his
budget. Superintendent Neese further stated that they hope to have everything done by the end of
March except setting up limits, which IDEM will have to approve first.
Motion to approve the Contract for Providing Services Relative to Hybrid Pretreatment
Ordinance Development, contingent upon attaching a standard contract and City Attorney
Robertson and Susan Stevens approval made by Sue Murray, seconded by George Murphey.
Vote was unanimous.
Engineer Morrow submitted information regarding an ADA Curb Ramp Program which has been
attached to and made a part of these minutes. Mayor Michael made the motion to move forward
with the program, seconded by Sue Murray. Vote was unanimous.
Engineer Morrow gave the update on Indianapolis Road stating a meeting is tentatively set for
January 2, 2003 at 6:00 p.m. The project cost is estimated at over $2 million with MOT paying
approximately $1.8 million. The property acquisition, which the City is responsible for, has been
estimated at $3.5 million. Engineer Morrow stated Pat Martin is working to see if INDOT will
pay 80% of property acquisition costs.
Eastside Waterworks Update was given by Attorney Robertson.
Water Tower Demolition Contract with Pittsburg Tank and Tower was discussed. Attorney
Robertson stated the contract with Sprint requires a 180 day notice. Attorney Robertson stated
she will send a letter and also stated that Sprint is working with US Cellular to see if they can
share their tower. Attorney Robertson suggested adding language to the Pittsburg Tank and
Tower contract which includes that the City will not issue a Notice to Proceed for 180 days.
Motion to authorize the Mayor to sign the contract with Pittsburg Tank and Tower with the
addition that the Notice to Proceed will not be issued for 180 days, was made by Sue Murray,
seconded by George Murphey. Vote was unanimous. (Engineer Morrow is to notify Pittsburgh
Tank & Tower by letter) This is a not to exceed contract in the amount of $72,365.00.
Attorney Robertson distributed the Norman Noe Contact for Inspection Services for the Water
Tower Demolition. Attorney Robertson explained changes that need to be made to the contract
as follows: 180 days before Notice to Proceed to be issued; 97 needs additional language
...unless due to negligence...; #10 change to 45 days not 7 days. Changes will be discussed with
Mr. Noe and a new contact will be brought back next month. Sue Murray made the motion to
table the Norman Noe contract, seconded by George Murphey. Vote was unanimous.
Engineer Morrow discussed the I & I Reduction Policy stating that Chapter 9 of the City Code is
the chapter that will have the most changes. Sue Murray recommended bringing back to the
Board a recommendation on fines and consistency of fines.
Engineer Morrow stated Triad Engineering will begin smoke testing January 13, 2003.
Engineer Morrow updated the Board on the progress of the WWTP stating the lift station is at
final completion, the South Side Interceptor is at substantial completion and the new plant is
operating, but there is a punch list.
Two Ulrich Chemical contracts for the Water Plant were submitted to the Board. One contract is
for Chlorine Liquid and the second is for Hydrofluosilicic Acid 23 %. Motion to approve made by
Sue Murray, seconded by George Murphey. Vote was unanimous.
The Board discussed leases for the Police Department Vehicles and the Fire Department 2003
Expedition. Motion to authorize Police Chief Hendrich to send a letter of intent to purchase
police cars in order to maintain the 2002 prices was made by George Murphey, seconded by Sue
Murray. Vote was unanimous. The Board also requested CT Jones work with the local banks to
secure leasing for the above vehicles.
Motion to approve Water Write Offs in the amount of $1,518.18; Wastewater Write Offs in the
amount of $956.16 and Trash Write Offs in the amount of $933.81 was made by George
Murphey, seconded by Sue Murray. Vote was unanimous. Sue Murray requested clarification on
the Policy for Utility Write Offs. CT Jones stated she does not believe the Policy was ever
adopted by the Board.
Motion to table information submitted by Garth HughesCivil Engineering, regarding the
Heartland Sewer Project was made by Sue Murray, seconded by George Murphey. Vote was
unanimous.
Software License Agreements were added to the agenda. City Attorney Robertson stated she has
looked at the agreements and believes they are ok. Motion to approve made by Sue Murray,
seconded by George Murphey. Vote was unanimous.
Motion to approve Water claims in the amount of $97,865.37 was made by Sue Murray,
seconded by George Murphey. Vote was unanimous.
Motion to approve Wastewater Treatment claims in the amount of $152,095.55 and Bond
Proceeds in the amount of $26,170.60, for the new WWTF, was made by George Murphey,
seconded by Sue Murray. Vote was unanimous.
Motion to adjourn made by Mayor Michael, seconded by George Murphey. Vote was
unanimous.

Rex ADA Curb Ramp Program
® This memo outlines my intent to have Greencastle implement a program for compliance with
the American with Disabilities Act (ADA) of 1990. After discussing this with a person from
the Federal Highway Administration (FHWA), he forwarded to me an article that he wrote
concerning this issue. Per FHWA's direction, I am recommending that Greencastle
implement the following program:
Self Evaluation- by August 2003:
1. Designate Tom Arthur, current Building Commissioner as the "ADA Coordinator" in
addition to his Commissioner duties.
2. Publish Tom Arthur's telephone number in the telephone directory white pages under
the "Greencastle, City of as "ADA Coordinator/ Building Commissioner".
3. Issue a memo to all city personnel that we now have a ADA Coordinator and the
purpose of his role. This will alert all city personnel about the position so that they can
direct public complaints to the proper personnel.
4. Develop a Board of Works policy on how to document complaints about curb ramps
and a procedure to address the problem situations.
5. Complete an inventory on curb ramps within the City. This past year, Thomas Miles
completed an inventory on the location and quality of sidewalks. I anticipate that a
2003 summer engineering intern will update the conditions and locations of our
sidewalk list and also document the locations and conditions of curb ramps.

Transition Plan- Adopted by December 2003:
1. The City Engineer, with the assistance of the Street Commissioner will develop a
prioritized list of the installation of new curb ramps and upgrading the substandard
ramps.
2. The City Engineer will write a Board of Works policy on how to document
yl s complaints about curb ramps and a procedure to address the problem situations.
This Policy should be written and adopted by the BOW by January 2003.
f- 3. After a complete inventory is conducted, a prioritized list and projected yearly
expenditures will be recommended to Council in September 2003. This
ti recommendation will consider available financial resources.
4. A public hearing regarding this transition plan is held in October 2003.
In addition to the above procedures, l am recommending that we immediately publish a
handbook to be distributed to all contractors, developers, engineers, and others that intend
to construct sidewalks with the City ROW. Attached to the handbook will be the latest
INDOT standards, as attached.
For your use, I am also attaching the fax from FFIWA.
As I have been told, Brazil was sued in Federal Court for violating the ADA statutes.
They have drastically changed their capital improvement projects such that they are
building a $1.5 million sidewalk project.

AMERICANS WITH DISABILITIES ACT — CURB RAMP PROGRAMS

Most, if not all, cities, towns, and counties in Indiana have been installing curb ramps for the
handicapped since the 1970's. The majority of the earlier installations were made on Federally
funded street projects as a result of a requirement in Section 504 of the 1973 Rehabilitation Act.
Section 504 required curb ramps on projects with sidewalks that utilized Federal funds.
The Americans with Disabilities Act (ADA), which was passed on July 26, 1990, drastically
changed the requirements relative to curb ramp installations. The implementing regulation,
which was published in the Federal Register on July 26, 1991 by the Department of Justice, had
three basic requirements and accompanying target dates for all public entities that have
sidewalks under their jurisdiction. They are:
1. By July 26, 1992 complete, a Transition Plan*
2. By January 26, 1993 accomplish a Self Evaluation
3. By July 26, 1995 install curb ramps throughout the public entity's area
* Written Transition Plans are only required for public entities with 50 or more
employees. Public entities with less than 50 employees are still required to meet the
target date for installing curb ramps throughout their areas.
Many of you are probably unfamiliar with the terms "Self -evaluation" and "Transition Plan".
Therefore, the following description of what each should involve will be of interest:
® SELF EVALUATION
This is essentially an evaluation of current practices and procedures pertaining to all aspects nt
curb ramps and implementation of needed changes to be in compliance with ADA requirements.
Some of the questions that a public entity must address in the evaluation are:
1. Do you have an ADA Coordinator?
2. Is the name of the ADA Coordinator published in the local phone book under
government offices and/or in the yellow pages under handicapped services?
3. Are receptionists and others answering phones at government offices aware of the
name of the ADA Coordinator and the coordinator's telephone number?
4. Do you have published grievance procedures providing for prompt and equitable
resolution of complaints about curb ramps.
5. Have you completed an inventory of your entire city, town or county to determine
where curb ramps are non - existent, non - standard and standard? The inventory is
essential to determine the extent of curb ramp needs and the financial meal resources that
will be required to fulfill those needs in a reasonable length
conducting the inventory it would be desirable to inventory sidewalks and their
condition. Very little is accomplished by installing curb ramps if the sidewalks are
not traversable by persons in wheelchairs.

TRANSITION PLAN
A Transition Plan is a prioritized schedule for installation of new curb ramps and for upgrading
those that are substandard. The Transition Plan should include the following:
1. The person responsible for implementing the Transition Plan
2. Written procedures for receiving and resolving curb ramp complaints
3. A prioritized listing of curb ramps to be installed based on high demand areas such as
hospitals, doctor's offices, schools, public buildings, medical equipment stores,
neighborhood areas with handicapped persons in wheelchairs, etc.
4. A listing of lower priority areas where curb ramps need to be installed and possibly
coordinated with sidewalk replacement programs and street resurfacing.
5. The number of curb ramps to be installed or upgraded each year.
6. Financial Resources needed and sources.
In developing the Transition Plan it is required that there be public input from public hearings
held on the draft Transition Plan. It is also helpful to obtain input from handicapped
organizations during development of the Transition Plan.
There has been significant effort over the years to obtain a time extension beyond the July 26,
1995 target date for completing the installation of curb ramps. However, the Department of
Justice decided to retain the July 26, 1995 date realizing that most public entities have not met
this date. Therefore, it is imperative that public entities strive to have a Transition Plan in place
and make a good faith effort to complete it.
The Federal Highway Administration is planning to visit public entities, in the not to distant
future, to determine if they have accomplished a "Self Evaluation" and have a "Transition Plan".
Currently, they are only performing this review when a complaint is made to the Department of
Justice against a public entity.
