A CAPITAL AUTHORIZING RESOLUTION OF THE
VILLAGE COT]NCIL OF THE VILLAGE OF KEY
BISCAYNE, FLORIDAO SELECTING STJN EAGLE
GENERAL CONTRACTORS CORPORATION FOR THE
LAKE PARK GAZEBO IMPROVEMENTS PROJECT IN AN
AMOUNT NOT TO EXCEED $66,000; PROVIDING FOR
AUTHORIZATION; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the Village of Key Biscayne (the "Village") issued Invitation to Bid No. 2020-
65 (the "ITB") for construction of the Lake Park Gazebo Improvements Project (the "Capital
Project"); and
WHEREAS, one sealed bid was received by the ITB deadline; and
WHEREAS' as a result of receiving only one bid, the Village rejected all bids due to a
lack of competition and proceeded to reopen the solicitation process for the Capital Project; and
WHEREAS, the Village received two proposals after reopening the solicitation, including
one from the original bidder, Sun Eagle General Contractors Corporation (the "Contractor"), for
the Capital Project; and
WHEREAS, after review and evaluation of the bids submiffed, the Village Manager
recommends that the Contractor be selected to perform the Capital Project as the lowest responsive
and responsible bidder; and
WHEREAS, pursuant to Section 3.07(b) of the Village Charter, the Village Council desires
to authorize the expenditure of Village funds for the Capital Project, select the Contractor to
perform the Capital Project, and authorize the Village Manager to negotiate and execute an
agreement with the Contractor, in an amount not to exceed $66,000, in substantially the form
affached hereto as Exhibit "A" (the "Construction Contract"); and

WHEREAS, the Village Council finds that this Resolution is in the best interest and
welfare of the residents of the Village.
NOW THEREFOREO BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF KEY BISCAYNE, FLORIDA, AS FOLLOWS:
Section 1. Recitals. That each of the above-stated recitals are hereby adopted,
confirmed, and incorporated herein.
Section 2. Selection. That the Village Council hereby selects the Contractor to
perform the Capital Project.
Section 3. Authorization. That the Village Council hereby authorizes the Village
Manager to negotiate and execute the Construction Contract with the Contractor for the Capital
Project, in an amount not to exceed $66,000, in substantially the form attached hereto as Exhibit
"A," subject to the Village Attorney's approval as to form, content, and legal sufficiency. If an
agreement cannot be reached with the Contractor, the Village Manager is authorized to negotiate
and execute an agreement with the next highest ranked bidder, until an agreement in the best
interest of the Village is reached.
Section 4. Effective Date. That this Resolution shall be effective immediately upon
adoption.
