LaPorte Also attending: Mrs. Kirton, Messrs. Harry Johnston, Jr., C. P. Young, R. A. Nilsen, Wm. F. Koch. Mayor Dodson called the meeting to order. The Minutes of the previous meeting were read, approved and adopted. The Financial Report for January 1962 was read and approved. All payments recorded in this report were approved. Mr. Iglehart presented a letter to the Commission which he had received from Major D. W. Colhoun and asked that it be read to the Commission. This letter is attached and becomes a part of these Minutes. The letter stated that he still objects to the granting of a variance to Mr. Young so that he could erect a carport on the rear of his property. Dep. Town Clerk Gwynn stated that he had contacted the Shetlers and the Colhouns, telling them that the Commission would be willing to grant a variance if they would give their consent. Mr. Gwynn stated further that he had urged the Colhouns and Shetlers to either attend this meeting or give a letter outlining their specific reasons for objecting to the variance. Col. Young again explained his reasons and type of construction he comtem- plated. Col. Young stated that Mr. Shetler had told him that he would not object to the granting of a variance. Mayor Dodson said that at the December meeting the Commission had agreed to granting a variance only if there were no objections from the neighbors. Mayor Dodson called for a vote on the matter. Mr. Iglehart voted - Yes, with the condition that no permit be issued until after April 1, 1962. Mr. Hart voted - Yes. Mayor Dodson voted - No. Mr. LaPorte voted - No. Mr. Hoyle voted - No. The first reading of "AN ORDINANCE DECLARING INTENTION TO ANNEX LANDS OF ETHEL P. PERKINS, HELEN VENINO, CONSUMER'S IMPORT CO., JOHN B. AND GWENDOLYN JEAN WOLFORTH, AND KATIN DiMARCO, TO THE TOWN OF GULF STREAM" was heard by the Commission. Mr. LaPorte asked that we hold up on this ordinance and that we reconsider all annexation until there is more discussion of Mr. Reed's subdivision. Commission Meeting - Feb. 10, 1962 Page 2 Mr. Hart stated that the Club is unhappy about the water contract not defining boundaries, and annexation of lands. He said that it is inconsistent to annex some lands and discuss de- annexing other lands. Mayor Dodson explained that in the annexation before us and the intended annexation on Pelican Lane, we are securing control of both sides of the streets Which now serve as Town boundaries. We are doing a service for the Town and the townspeople adjacent to the lands to be annexed. Mr. Hoyle moved that we accept the first reading of the ordinance. Motion was seconded. Mr. Hart, Hoyle, Iglehart, and Dodson, voted - Yes. Mr. LaPorte abstained, stating that he felt we should not rush into annexing any lands at the time. Mr. Iglehart suggested that Mayor Dodson appoint a committee to meet with officials of the Club to discuss all phases of the water situation. Mr. Hart agreed saying the Club would like to get out of the water business. Mayor Dodson appointed Mr. Hoyle, Mr. Iglehart, and Mr. Koch, to serve on this committee. Mr. Hart said he would arrange the meeting with a committee.to be selected by the Club. At this point of the meeting, Mr. Hoyle asked to be excused from the meeting. The Commission agreed that the Dep. Town Clerk should not assess the property owners being annexed until it has been accom- plished and the total costs can be accurately determined. A letter, signed by five property owners on Oleander Way,was read to the Commission. This letter requested that the Town abandon the idea of re- routing traffic on Oleander Way to one -way North. Mr. Gwynn stated that Chief Cowart had studied the road carefully and recommended that it be left as is, namely, one -way South. The Commission agreed to terminate further discussion on the matter. A request from Beymers, Inc. for a permit to construct a bath and shower room for Mr. Charles Lockhart. Mr. Gwynn stated that since our zoning ordinance prohibits the issuance of permits between December 1 and April 1st, he had contacted all the neighbors of Mr. Charles Lockhart requesting their feeling. All of them stated that they had no objections. Col. Young then stated that he did not realize that it would mean construction would start before April 1st. However, he did say that he would not object. Commission Meeting - Feb. 10, 1962 Page 3 There being no objections by the neighbors, it was moved that the Dep. Town Clerk issue a permit, when requested, for the said construction. Motion was seconded and passed unanimously. A letter from the Gulf Stream Civic Association, Inc. was read to the Commission. This letter stated that at a recent meeting of the Association attended by fifty -five members, the following resolution was unanimously adopted: "In view of the inaccessibility of the newly developed section of the Town of Gulf Stream on the western side of the Intracoastal Waterway and in view of the Town's inability to provide this new area with the customary public services, it is the sense of this meeting that all interested parties would be better served by a disassociation of the western area from the main body of the Town." Mr. Johnston explained generally the legal ways and means of de- annexing lands. Mayor Dodson suggested that the Town Attorney, Mr. Lilienthal, draft a letter to the Association explaining the necessary ways and means for de- annexation. However, it was the opinion of Mr. Iglehart, LaPorte, and Hart that a letter was not necessary due to the fact that the Association is already aware of this. Mr. Iglehart stated the Town should go on record in these Minutes that the Commission shall not admit to the "Town's inability to provide this area with the customary public services ". The police reports were read and accepted. Mr. Hart said that he thought the Commissioners and the Dep. Town Clerk should know when and who was on duty at all times. He cited several examples when emergencies had arisen and there had been no officer on duty. The situation where three 8 -hour shifts a week are unmanned was discussed in general. The Dep. Town Clerk was instructed to have Chief Cowart prepare a work schedule each month and furnish copies to each Commissioner and the Dep. Town Clerk. Mr. LaPorte discussed the danger that existed along AlA for people to drive onto AlA from the numerous private driveways and town streets. Mr. Hart moved that the Town write a letter to the State Road Department requesting that they make a study of the traffic on AlA with the purpose of double- lining AlA throughout the Town. Motion was seconded and passed unanimously. The Commission authorized the Deputy Town Clerk to have 200 sets of the present Zoning Ordinance mimeographed at a cost not to exceed $200.00. Commission Meeting - Feb. 10, 1962 Page 4 Deputy Town Clerk Gwynn stated he had received several complaints regarding the size of the "REAL ESTATE" sign on Webb Bros. office building. The Commission instructed Mr. Gwynn to see that the sign was made to conform with the Town Ordinances. Deputy Town Clerk Gwynn asked the Commission to consider giving Paul Bradwell a raise in pay. He pointed out that Paul Bradwell had been with the Town for three years and was still paid the same salary he started with - $46.00. It was moved that Paul Bradwell be given a $4.00 a week raise in pay. Motion seconded and passed unanimously. FLORIDA February 8, 1962 Town Council Town of Gulf Stream Delray Beach, Florida Gentlemen: At a meeting of the Gulf Stream Civic Association attended by fifty -five members (in person and by proxy) the following Resolution was unanimously adopted: " In view of the inaccessibility of the newly developed section of the Town of Gulf Stream on the western side of the Intracoastal Waterway and in view of the Town's inability to provide this new area with the customary public services, it is the sense of this meeting that all interested parties would be better served by a disassociation of the western area from the main body of / the Town."
