COUNCIL SPECIAL MEETING MINUTES

CALL TO ORDER:
Mayor Dicker Cahill called the meeting to order at 12:04 PM.
PRESENT:
Mayor: Dicker Cahill
Councilmembers: Mary Elmore
Steve Bush
Andy Valaas
Carl Scandella
David Feller — Excused
Staff: Anastasiya Warhol — Town Clerk -Treasurer
Roger Myklebust- Town Legal Representative
EXECUTIVE SESSION:
The Mayor announced that the Council would enter an Executive Session at 12:08pm for
45 minutes to discuss litigation. There were no members in the audience.
The Council entered the Executive Session at 12:08 PM
The Council concluded the Executive Session at 12:40PM
REGULAR BUSINESS:
AB 16-38 92" Ave UGC & Pathway Project, final payment, for Authorization
MOTION: Councilmember Valaas moved to aFYrove final payment to Jansen Inc. in the
amount of $70,000 as final payment of the 92" Ave UGC & Pathway project and final
settlement of the pending claims in the lawsuit. Councilmember Bush seconded the
motion. All in favor.
VOTE: 4 For, 0 Against, 0 Abstain. Motion Carried.
MOTION. Councilmember Valaas moved to amend the motion to include the words
"against the town" after pending claims, the amended motion reading: A prove final
payment to Jansen Inc. in the amount of $70, 000 as final payment of the 92" Ave UGC &
Pathway project in,full and final settlement of all pending claims against the Town in the
lawsuit. Councilmember Bush seconded the amended motion. All in favor.
VOTE: 4 For, 0 Against, 0 Abstain. Motion Carried.
ADJOURNMENT:
MOTION. Councilmember Valaas moved to adopt adjourn the meeting at 12:43 pm.
Councilmember Bush seconded the motion.
VOTE: 4 For, 0 Against, 0 Abstain. Motion Carried.
