CALL TO ORDER Commissioner Lawson called to order the regular meeting of the Planning Commission of the City of Temple City at 7:30 p.m., November 27, 1973. 2. PLEDGE OF ALLEGIANCE Chairman Lawson led the Pledge of Allegiance to the Flag. 3. ROLL CALL Present: Commissioners Atkins, Breazeal, Clark, Stacy, Lawson Absent: Commissioners - None Also present were City Manager Koski, Asst. City Attorney White, Planning Director Dragicevich and Assistant Planner Burnham. " 4. APPROVAL OF MINUTES: Regular Meeting of November 13, 1973. There being no additions or corrections to the minutes, Commissioner Clark moved they be approved as presented. Commissioner Breazeal seconded the motion and it passed unanimously. 1 " 1 5. PUBLIC HEARING: CONSIDER AMENDMENT TO THE GENERAL PLAN RELATING TO INCONSISTENCIES OF ZONING MAP WITH GENERAL PLAN Director Dragicevich explained that the California Government Code requires the City's zoning ordinance be consistent with the City's adopted General Plan, and in the event a zoning ordinance becomes in- consistent with a general plan, the ordinance shall be amended within a reasonable time so it is consistent with the plan. He reviewed the present density standards in the City, and those proposed by the General Plan, and referred to the exhibits consisting of the Zoning Map, General Plan Map and Land Use Map. The inconsistencies were pointed out, and he concluded by saying the problem could be solved by either amending the General Plan and /or initiating zone change procedures. City Manager Koski pointed out that in three of the areas involved there were cases filed where the proposed development was in conflict with zoning. The City Council is continuing a hearing on a condo- minium project presently, looking for response from the Commission on this subject, and will hold hearings on the General Plan zone change and public hearing on the project at the same meeting. Some of the areas being considered tonight, he continued, do not have to have action until after January 1, 1974. It was recommended that Areas 3, 5, 6, 9, 10, 15 and 16, as illustrated on the General Plan map, be postponed for study after January 1, 1974. In referring to Area No. 7, the Planning Director stated a.survey was made of that area earlier this year, with 50% response. Property owners of smaller parcels are in favor of Low Medium density, how- ever, they own only 407 of the land in that area. The larger parcel owners comprise 60% in area and ar.e,in favor of higher density. He suggested upgrading the density to 17 -25 dwelling units per acre which will solve the existing problem and take care of several large apartment houses already there. He concluded that the Commission might cnnsider reducing density pattern for R -3 and R -4 from 43 units per acre to a more reasonable and realistic figure. PLANNING COMMISSION MINUTES MEETING OF November 27, 1973 PAGE TWO The public hearing was declared open. •Mr. Eldon Bowen, 5912 North Encinita, stated he had an interest in Area. No. 7 as he has a pending development (condominium) there, that would not be in conformance with the General Plano It is next to a major artery and has full facilities there. The 6 -15 unit per acre density will not warrant much development and that area would run down. .People-in that area don't realize that if you don't amend the General Plan they are IIIsetting on R -a land which is going to be down -zoned by R -2 if it is not changed, and this would lower the value of that land. There being no one else to speak to the issue. Commissioner Breazeal moved the public hearing be closed, seconded by Commissioner 'Clark, and the motion carried, 1 • 1 Commissioner Atkins expressed a desire for a more leisurely and in -depth look at the areas involved; residents don't want increased density. It is still necessary to work out rolling back zoning in large segments of the City. He was not in disagreement with the proposals, and realizes it is mandated by the State, but felt it was a "band -aid" action. Commissioner Clark rent' "rked that- making the proposed changes doesn't close the door: if something came up compatible to the Commission's thinking and the City's rules and regulations, the Plan could be changed. He feels Lower Azusa and along Rosemead the property will go pretty much commercial or high density. He doubted the borders of the City would go to high density. He is against apartments going into neighborhoods, Commissioner Stacy agreed with Commissioner Atkins, and felt where there was any question the Commission should look into the area in depth. He was in agreement with staff proposals. Chairman Lawson reviewed the areas for amendment and those to be held in abeyance for further study, and the Commissioners were in 'agreement. Commissioner Stacy moved to recommend to the City Council certain amend- ments to the General Plan of the City. Motion was seconded by Commis- sioner Breazeal and passed - unanimously. Asst. City Attorney White read title to Resolution 73- 535PC, A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TEMPLE CITY RECOMMENDING TO THE CITY COUNCIL CERTAIN AMENDMENTS TO THE GENERAL PLAN OF THE CITY. Com- missioner Stacy moved to waive further reading and adopt, seconded by Commissioner Breazeal, and the motion carried. 6. PUBLIC HEARING: MODIFICATION OF CONDITIONAL USE PERMIT 72 -375 Standard Oil Company of California - Owner /Applicant 444 West Ocean Boulevard Long Beach, California Site: 9425 Las Tunas Drive Asst. Planner Burnham stated applicant had a conditional use permit approved by the Planning Commission on August 12, 1972, to build a new automobile service station at the subject location, and now is request- ing installation of a recreational vehicle sanitary disposal facility in the planter area along the north property line. He explained Exhibits "A ", "B" and "C" and concluded with the staff proposals if the request for modification is granted, and that a negative Environmental Impact Report was prepared on the modification. PLANNING COMMISSION MINUTES MEETING OF NOVEMBER 27, 1973 PAGE-THREE In answer to questions from the Commissioners, Mro Burnh.anrsaid'there are no plans to advertise the facility; the two signs shown on the exhibit • are required by the law. The nearest similar facility is in El Monte. The public hearing was declared open, - Mr. Keith White, 5016 Daleview, said there is nothing objectionable about a facility o this type. The oil company is going beyond what is required in installing the facility. He has used the facility in El Monte, where he also fills up his trailer with gas, and reasons that the installa- tion of the facility in Temple City will bring business to Temple City as well. Mr. Carl Berme, 5523 Burton, Temple City, said that, as a realtor, he gets many calls from people for property that can accommodate storage of a recreational vehicle. He would like to see the facility installed to accommodate the owners of these vehicles. Mr. R. J. Silva, 444 'West Ocean Boulevard, Long Beach, representing the applicant, stated the company has such facility in Mission Viejo and has had no complaints. The ,Auto Club requested this installation in this area. Such a facility does help the service station business. 40 There being no one else to speak to the issue, Commissioner Atkins made a motion, seconded by Commissioner Clark, and passed, to close the public hearing. The Commissioners were in agreement that the facility would not be detrimental to the City or surroundings, and that a need exists for its installation. Commissioner Atkins made a motion, seconded by Commissioner Breazeal and passed unanimously, to grant modification in Conditional Use Permit Case No. 73 -375. IAsst. City Attorney White read title to Resolution 73- 534PC, A. RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TEMPLE CITY GRANTING MODIFICATION OF CONDITIONAL USE PERMIT CASE NO. 72 -375. Commissioner Breazeal made a motion, seconded by Commissioner Clark and passed, to waive further read - ing and adopt. • 1 • 7e COMMUNICATIONS - There were none. S. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK Mr, Carl Berge, 5523 Burton, asked the Commission to consider any request they might receive for recreational vehicle parking areas in the City, as there is a real need for such areas. He was told the Planning Commission did recently grant a conditional use permit for such a use. He was also invited to attend the study session following the meeting to discuss this matter further, 9. MATTERS FROM CITY OFFICIALS A. Chairman Lawson announced the regular meeting of the West San Gabriel Planning Council would be held on December 7, 1973, and asked those Commissioners who wished to attend to get in touch with the staff to make reservations. B. Asst. Planner Burnham reported on the cases considered by the Minor Zoning Modification Committee on November 26, 1973: Minor Zoning Modification Case 73 -29 was a request to develop an R -2 zoned property with reduced square footage per dwelling for one of the parcels. Property is located at ,6127 and 6131 North Golden West Avenue. Asst. Planner Burnham referred to plot plan, and said in review of the case it was determined also this de- velopment would be considerably short of legal open space,. The Committee determined it would be best to bring it before the Planning Commission for their review. City Attorney White said the applicant had the alternatives of joint ownership and lot combination, or applying for zone variance, PLANNING COMMISSION MINUTES MEETING OF NOVEMBER 27, 1973 PAGE-FOUR- Minor Zoning Modification Case 73 -30 was a request to construct a 10 -unit apartment complex in an R -3 zone with less than required open space. Mr. Burnham referred to Plot Plans Exhibits "A ", "B" and "C ". At issue was the useable open space. After discussion, the Committee determined the case should be presented to the Planning Commission as it was not a minor project, and further, they wanted the City Attorney's opinion regarding density con - sistency with the General Plan. Mr. White said a request must be compatible with the General Plan in order for the Committee to grant it. Minor Zoning Modification Case 73 -31 was a request to construct an addition to a single- family residence which would encroach l2 ft. into the rear yard area in an R -1 zone. Mr. Burnham explained Plot Plan Exhibit "A ", The Committee had no objection to the request and granted it, 10. ADJOURNMENT There being no further business, Commissioner Atkins made a motion, . seconded by Commissioner Clark and carried unanimously, to adjourn to a study session.
