Mayor Dodson called the meeting to order. The minutes of the
previous meeting were read, approved and adopted. The Financial
Report for April 1962 was read and approved. All payments recorded
in this report were approved.
Mayor Dodson gave the floor to Mr. Paul Knowles who discussed
the overall sewer and outfall system which Delray Beach is planning
to install. He pointed out that the State Board of Health will
eventually outlaw any septic tank installations and require munici-
palities to provide sewers. Delray's outfall system could be used
by Gulf Stream by tieing our sewer system to Delray's through the
use of pumping stations. Mr. Knowles suggested that the Town could
consult with Russell & Axom, for engineering study and cost estimates.
Mayor Dodson pointed out that the Town's cost would be sewer
mains and pumping stations to the nearest point of Delray's system.
Mr. Iglehart moved that we contact Delray and if they are interested
in having us tie in with them, we proceed to learn the cost of such
a plan. Motion seconded and passed unanimously.
Mr. Severn was given the floor and he presented sketches of the
proposed new building to be constructed on the Gulf Stream Bath &
Tennis property. He stated this work would commence in August.
A letter from Mr. Tully Scott, attorney for Col. C. P. Young,
was read to the Commission. This letter is included herewith as
part of these minutes. There was a short discussion on this letter.
Mr. Iglehart moved that the matter be considered closed and not be
given any further consideration. Motion was seconded and passed
unanimously.
A letter from the Tri County Govermental League urging the
Town to join the organization and pay an annual dues of $12.50 was
read to the Commission. It was moved, seconded and passed unanimously
that the Town join the organization.

Resolution 517, a resolution approving the position of the
Tri- County Governmental League on Reapportionment and Specific
Action to Be Taken, was read, approved and adopted.
A letter from Mr. Lilienthal pointing out the law requiring
the Town to levy and collect a Personal Property Tax was read and
discussed by the Commission. The Commission instructed the Deputy
Town Clerk to comply with the law and prepare a Personal Property
assessment and tax roll for the year 1962.
The Police Reports for April were read and approved.
The Commission approved the redemption of a $10,000.00, 90 -day
Certificate of Deposit and approved the purchase of a $5,000.00,
90 -day Certificate with the balance of $5,000.00 being deposited
in the General Fund bank account.
The Commission authorized payment of $2,750.00 to the City of
Boynton Beach as the second year's payment on fire protection con-
tract.
Mr. Hart stated that he had tried on several occasions to set
up a meeting between the Club and the Town to discuss the future
plans for the water system. He further stated that the Board of
Governors of the Club felt they were doing their part in fullfilling
the contract and did not see the necessity in having a meeting.
Mr. Dodson instructed the Water Committee of Mr. Koch, Mr. Hoyle
and Mr. Iglehart to get engineering advice on what the Town should
plan to do at the expiration of the contract with the Club. He
suggested they get a survey of the costs and expenses involved to
establish a water supply system for the Town.
The Commission authorized the Deputy Town Clerk to employ
his wife as part -time help at the Town Hall at a salary of $50.00
a month.

There being no further business to come before the Commission,
the meeting was adjourned.

Gentlemen:
April 30, 1962
I am counsel for Mr. Cecil P. Young, a resident of your
town. Mr. Young, in full observance of the Town Charter, requested
a variance in the Town Building and Zoning Ordinance for the construct-
ion of a car -port on the rear of his residence. His request, dated
November 7, 1961, apparently was summarily denied.
Mr. Young, owning two automobiles, requires some cover and
protection of his vehicles from the salt -laden and corrosive air.
The proposed car -port would consist merely of a concrete roof and
pillars, all in full compliance with Building Code Requirements,
and with architectual integrity to blend and add to, rather than
detract from, the beauty and structure of the present improved realty.
Mr. Young is informed that his adjacent property owners
and neighbors have merely made known their objection to Mr. Young's
request. There apparently was no hearing upon the matter, no objections
were voiced before the Commission upon duly called hearing with notice
to Mr. Young and an opportunity for him to meet the basic merits of
the objections by the objectors.
In my opinion, a blanket objection, without documentation
as to how a proposed variance would adversely affect the property
value or the right of peaceful enjoyment of adjacent property, and
without such being duly presented before the Commission with Mr. Young
and the objectors personally present, seems an improper basis upon
which to deny Mr. Young's application. In short, it tends to infringe
upon concepts of basic fairness and due process of law.
I also understand that the Town proposes to incorporate
within its limits some lots with less front- footage than is required
under the Zoning Ordinance. Mr. Young has advised that, on a prior
occasion, he sought an exception to the Ordinance to divide his vacant
160 foot Lot 3 and j6 of Lot 2, Town of Gulfstream into two BO foot lots,
which was refused. Would not this proposed action by the Town result
in some conflict with the Ordinance? If the conflict were cured by

special exception to those 5 lots- to -be- incorporated, would not
this result in some inconsistency anent Mr. Young?
I raise these questions because Mr. Young, who is not a
patient man, has turned the whole matter over to me, with a view
to litigation in the event matters cannot otherwise be amicably
determined. I personally would prefer to keep the matter from
burdening our otherwise overtaxed judiciary. But it takes two to
settle disagreements.
I would be pleased to hear your views, and confer, if
need be, with the Commission and the Town Attorney, Mr. Lilienthal,
if in due candor the Commission agrees there may be some merit to
Mr. Young's position.

A RESOLUTION APPROVING THE POSITION OF THE
TRI- COUNTY GOVERNMENTAL LEAGUE ON REAPPOR-
TIONMENT AND SPECIFIC ACTION TO BE TAKEN.
WHEREAS, the Tri- County Governmental League was
formed to obtain more adequate representation for all the
citizens in the Dade, Broward and Palm Beach County area
and to solve mutual problems that confront the Tri- County
area; and
WHEREAS, this League in the year 1959 took the
lead and actively fought for a fair reapportionment;
and
WHEREAS, the Legislature of the State of Florida
is again promoting a bill which will deprive the people in
the larger urban counties of fair representation; and
WHEREAS, the United States Supreme Court has
ruled that Federal Courts have jurisdiction and will remedy
wrongs that deprive any citizen of his rights secured by
the constitution; and
WHEREAS, the State Legislature by its many pre-
vious actions has shown it will not voluntarily apportion
equitably the State in accordance with the Constitution of
the State of Florida; and
WHEREAS, the Supreme Court has

NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COM-
MISSION OF THE TOWN OF GULF STREAM, FLORIDA, AS FOLLOWS:
1. The Town of Gulf Stream approves the Tri -
County Governmental League adoption as a matter of policy
the theory of equitable reapportionment based upon popula-
tion and supports the premise that those counties having
large populations should be given a fair and equal voice in
the State Legislature and in the Congress of the United
States.
2. A certified copy of this resolution shall be
forwarded to Hon. Farris Bryant, Governor of the State of
Florida.
