HomeMy Public PortalAbout2011.154 (06-29-11) RESOLUTION NO. 2011.154 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD AUTHORIZING THE ESTABLISHMENT OF A HOUSING AUTHORITY FUNDING ACCOUNT AND THE TRANSFER OF AN AMOUNT NOT TO EXCEED THE BALANCE OF REDEVELOPMENT AGENCY LOW AND MODERATE INCOME HOUSING FUNDS TO THE NEWLY ESTABLISHED HOUSING AUTHORITY FUND IN ACCORDANCE WITH THE CALIFORNIA HOUSING AUTHORITIES LAW WHEREAS, The California Housing Authorities Law (Health and Safety Code Section 34200 et seq.), authorizes the establishment of a housing authority in every city where the city council, by resolution, declares there is a need for such housing authority, and pursuant to Health & Safety Code Section 34242, this City Council may adopt a resolution declaring there is a need for a housing authority if it finds either: (a) the existence of unsanitary and unsafe inhabited dwelling accommodations in the city, or (b) a shortage of safe or sanitary dwelling accommodations in the city available to persons of low income at rentals they can afford; and WHEREAS, on March 15, 2011 a Housing Authority in the City of Lynwood was so established; and WHEREAS, the Authority Commission desires to now establish a funding source for the Housing Authority from the Lynwood Redevelopment Agency's Low and Moderate Income Housing Funds, currently held by the City of Lynwood for purposes of accomplishing the Agency's housing obligations; and WHEREAS, the City Council wishes to transfer to the Housing Authority Fund pursuant to Health and Safety Code 34315.3 in an amount not to exceed the remaining balances of active Community Development Housing funds A and B amounting to $680,464.87 (Housing A-$469,081.48; Housing B-$211,383.39) into a fund established for the Housing Authority. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD, DOES HEREBY FIND, DETERMINE, ORDER AND RESOLVE AS FOLLOWS: Section 1. The above recitals are all true and correct and are hereby adopted as findings. Section 2. Pursuant to the broad powers granted to Redevelopment Agencies in the expenditure of housing fund moneys, including Health & Safety Code sections 33070, 33071, 33334.2 and 33449, and the Authority's power to receive funds for restricted income housing purposes pursuant to Health & Safety Code Section 34315.3, the City Council hereby approves the transfer in an amount not to exceed the remaining balances of active Community Development Housing funds A and B amounting to $680,464.87 (Housing A-$469,081.48; Housing B-$211,383.39) into a fund established for the Housing Authority, the amount of which will be set by the City Manager/Executive Director, as needed to meet the Housing Authority's obligations. The City Manager/Executive Director shall periodically report to the City Council, Agency Board and Authority Commission, as appropriate, the amounts so transferred. Section 3. In anticipation of legislation proposed by the California Legislature, AB X1 26 and 27, the Council, on behalf of the Agency, wishes to fund the Authority in the amounts set forth in Section 2 above. However, the City reserves the right to rescind this authority by November 1, 2011 if deemed unnecessary to preserve the right to the continued use of same to accomplish the housing obligations of the Agency and Authority. Section 4. The Mayor and City Manager are authorized and directed to take such actions and execute such documents as may be necessary to implement and effect this Resolution on behalf of the Agency and City. Section 5. The City Clerk shall certify to the passage and adoption hereof. PASSED, APPROVED and ADOPTED this 29 day of June, 2011. � ,__� .
