INITIATION
1. CALL TO ORDER
I Commissioner Lawson called to order the regular meeting of the Planning
Commission of the City of Temple City at 7:30 p.m., April 23, 1974.

2. PLEDGE OF ALLEGIANCE
Chairman Lawson led the Pledge of Allegiance to the Flag.
3. ROLL CALL
Present: Commissioners Atkins, Breazeal, Clark, Stacy, Lawson
Absent: Commissioners - None
Also present: City Manager Koski, Asst. City Attorney White, Planning
Director Dragicevich and Asst. Planner. Burnham.
4. APPROVAL OF MINUTES - Regular Meeting of April 9, 1974:
There being no additions or corrections to the minutes, Commissioner
Breazeal moved they be approved as written. Commissioner Atkins seconded
the motion which passed by roll call vote with Commissioners Atkins,
Breazeal, Clark and Lawson voting affirmative .and •Commissioner Stacy
abstaining.
5. CONTINUED PUBLIC HEARING:
CONSIDER RECOMMENDATIONS TO AMEND THE
TEMPLE CITY MUNICIPAL CODE RELATING TO
MINOR LOT LINE ADJUSTMENTS.
Planning Director Dragicevich reported that this item had been before
the Planning Commission for consideration several times at past meet-
ings, and as a result of discussions with the Planning Commissioners
and Regional Engineer and study sessions on this matter, the proposed .
resolution was prepared. The minor lot line adjustment was proposed
by staff to eliminate nonconformity in setback lines in order to build
accessory structures, or add square footage to an existing lot from an
adjacent one. He listed the conditions under which a final parcel map
would not be required in granting such adjustments. He concluded his
presentation by saying that a Negative Declaration on the Environmental
Impact Report had been prepared.
The public hearing was declared open. No one came forward to speak..
Commissioner Atkins moved to close public hearing, seconded by Commis-
sioner Breazeal and the motion carried.
In closed discussion the Commissioners were in agreement that the pro-
posed resolution reflected the results of their discussions and recom-
mendations. Commissioner Atkins moved to recommend to the City Council
addition of Section 9605 to the Zoning Code with reference to Minor
Lot Line Adjustments. Motion was seconded by Commissioner Stacy and
passed. unanimously.
Asst. City Attorney White read title to Resolution 74- 553PC, A RESOLU-
TION OF THE PLANNING COMMISSION OF THE CITY OF TEMPLE CITY RECOMMENDING
TO THE CITY COUNCIL THE ADDITION OF NEW SECTION 9605 TO THE TEMPLE CITY
ZONING CODE RELATING TO MINOR LOT LINE ADJUSTMENTS. Commissioner
Breazeal moved to waive further reading and adopt. Motion was seconded
by Commissioner Atkins and carried unanimously.

6. PUBLIC HEARING: CONDITIONAL USE PERMIT CASE 74 -413

The Planning Director stated notices, as required by law, had been
sent, and then proceeded to give the staff report saying this applicant
had been granted a zone variance recently with respect to parking re.
quirements and expansion of existing business. However, the City's
Zoning Ordinance did not permit apartment uses in the C -2 zone and it
was necessary to amend the ordinance to include living quarters as an
auxiliary use to mortuaries with conditional use permit approval. Now
the applicant is before the Commission with a request to add living
quarters for attendants in conjunction with the existing (mortuary)
business facilities located in a C -2 zone. The Director referred to
the plot plan marked Exhibit "A "showing existing and proposed develop -
ment, gave the factual data on the property and staff proposals if the
request is granted, He concluded his presentation by:saying.that a
Negative Declaration on the Environmental Impact had been prepared for
the proposed use.
The public hearing was declared open.
Mr. Louis Randall, 4800 Temple City Boulevard, President. of Lee R. Hi1L..
Mortuary, stated he had been working on this matter with the City for .
over a year. He would be happy to answer any questions.•.
There being no questions, and no one else to speak for or against the
issue, Commissioner Breazeal moved to close. public hearing. Commissioner
Stacy seconded the motion and it passed.
In closed discussion the Commissioners agreed they had no objection.

C. Approve Tentative Tract Map No. 32040
The Planning Director stated notices had been sent as required by law,
and also published in the newspaper. He went on to say this case was
presented before the Planning Commission in May of last year for the first
time under a different application.procedure. The request before the
Commission tonight is a change of zone from R -1, Single Family, to RPD,
Residential Planned Development. With the assistance of Mr. Burnham,
Asst. Planner, The Director explained the plot plan Exhibits "A ", "B"
and "C" and "C -1 ", showing the proposed 79 unit condominium, the archi-
tectural appearance of the proposed structures and the floor plans of the
proposed units. He gave the factual data on the subject property and the
surrounding area and zoning history, and concluded with the staff pro-
posals.
Director Dragicevich continued that Tentative Tract Map No.32040 on the
subject project be recommended for approval with staff conditions as
proposed, and highlighted for the Commission. He called attention to
the request for new fire hydrants made by the Fire Chief, and upgrading
of hydrants, at certain locations, and referred the Commission to the
letters from the advisory agencies in connection with the preparation
of proposed conditions.
The Director next referred to the Environmental Impact Report, saying
there were several areas where the project could have adverse environ-
mental impact, consequently a detailed report was prepared and attached
to the staff report. He stated it was felt there would be an increase
in traffic, noise level, safety and air pollution. It would result
in the displacement of a few families, there would be an increase in
dust and there would be a higher residential density. Positive effects
included the removal of existing older homes and ground areas will be
landscaped in trees and greenery. Summing it up, he concluded there
would be an adverse effect on the environment as described in the
California Environmental Quality Act of 1970.
In answer to questions from the Commissioners, the Director said that on
Parcels, 2, 3, 4, 5 and 6 as shown on Exhibit "A -1 ", it will be required
to put in public works improvements inasmuch as the developer is changing
the shape of these lots. The density of the previous plan submitted
was 14.6 units per acre vs. 12.8 in the present case; there is a basic
change in the interior circulation and type of buildings.
The public hearing was declared open.
Mr. James Baldwin, 16811 Hale Avenue, Irvine, said the present plan is
11 units less than the previous one. The present plan is a street -
oriented frontage development; the previous plan was a mall- frontage
oriented one and the public streets were at the back door. This plan
provides more open space. He questioned the requirement for public
works improvements on Zadell and Olive Streets and upgrading of the fire .
hydrants on Olive. He said he had seen the requirements of the Los
Angeles County, and the water, sewer and fire flows would present no
problems.
There was no one else to speak in favor of the development.

The second item for consideration was the change of zone from R -1 to RPD.
Commissioner Breazeal opened the discussion by saying the proposal is con-
sistent with the General Plan for density in that area; open space is in
• excess of requirements in similar developments; the project abuts a second.-
ary highway. The fact that there are areas zoned for multiple density that
are not developed to their zoned potential is not relevant to the considera-
tion of this case. He informed those persons who requested a delay to study
the RPD ordinance and secure petitions that the case would automatically .
Igo before the City Council for a public hearing, giving them the additional .
time they want. He was in favor of the project.
Commissioner Atkins commented that he considered the project from a Planning
Commissioner's viewpoint, and also from the viewpoint of a resident in
that area for 12 years, and he has been concerned what would go in that
area - shopping center, apartments, or houses. Commissioner Breazeal had
expressed a Planning Commissioner's viewpoint, and he, as 'a resident, wished
to add that he felt the residents in that area want houses; which is what
is being proposed; something the people could live with
Commissioner Clark said to divide the lots and build 2 -3 houses on each one
would be expensive as land is costly in this area; he could see nothing
against the plan, other than the higher density and that complies with the
General Plan.
• Commissioner Stacy considered the plan excellent -and an attractive addition
to the community. The circulation . pattern and entrance -exits will prevent
interference with adjacent land owners, with the, exception of Mr.. Lucas.
With reference to Mr. Lucas' complaint of loss of privacy; this condition
could occur with any new residential construction on the propertiessurround
ing him. At the price level of the homes, it is unlikely the people who •
buy them will be any problem, and many of them will be elderly - and there.
is an equal possibility that the buyers will be assets to the community. He
concluded by saying he objected to the two fire hydrants required to be .
upgraded on the north side of Olive Street.
Chairman Lawson stated when this case was originally submitted to the.
Planning Commission to change the zone to R -3, he voted against it as he
felt it was not the proper zoning for this property. With the RPD zoning
the City has some latitude and restrictions on the builder for development
of the property. He was in favor.
Commissioner Clark.moved to recommend to the City Council a change of zone
from R -1 to RPD in Case 74 -415 and that the Provisional Plan as presented,
and in accordance with. Exhibits "A ", "A -1" and "B ", be approved and merged

into the zone change. Motion was seconded by Commissioner Stacy and
passed unanimously.
Asst. City Attorney White read title to Resolution 74- 555PC, A RESOLUTION OF
THE PLANNING COMMISSION OF THE CITY OF TEMPLE CITY RECOMMENDING A CHANGE OF
ZONE IN RESIDENTIAL PLANNED DEVELOPMENT CASE NO. 74 -415. Commissioner
Atkins made a motion, seconded by Commissioner Breazeal and passed unanimously
to waive further reading and adopt.
The third item for consideration was the Tentative Tract Map 32040. Com-
missioner Clark questioned the requirement for sidewalks on streets the
project will not border. It was explained that portions of lots facing these
streets will be included in the project and it is legal and within the
Isubdivision ordinance to require public works improvements in such cases..
Conditions 8 and 22 of the staff report were deleted as not being applic-
able to the case under consideration..
Commissioner Stacy felt the condition for fire hydrants required to be up
graded on the north side of Olive Street, at Robinhood and Zadell Avenues,
should be deleted as the remaining fire hydrant requests for this project
• would provide adequate fire protection for the project. The other Commis-
sioners,were in agreement.

Commissioner Atkins moved to approve Tentative, Tract Map No. 32040 with
conditions as revised in the staff report (i.e. deletion of Items 8 and.
22, and deletion of upgrading of the two fire hydrants on Olive Street).
Motion was seconded by Commissioner. Stacy and passed unanimously.
Asst. City Attorney White read title to Resolution 74- 556PC, A RESOLUTION
OF THE PLANNING COMMISSION OF THE CITY OF TEMPLE CITY APPROVING TENTATIVE
TRACT MAP NO. 32040. Commissioner Stacy moved to waive further reading
and adopt. Motion was seconded by Commissioner Breazeal and passed unanimo-
usly.
City Manager Koski advised the audience that both the zone change and
Tentative Tract Map would be considered by the City Council automatically
and that public hearing notices to all property owners woule again be sent
as required by law.
8. COMMUNICATIONS - There were none.
9. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK
Mr. Arthur A. Lochte, 10021 E. La Rosa Drive, expressed the opinion
that the fire hydrants on Olive Street should be upgraded because of
increase in density in the area when the project is completed. It .
was explained that the Commission determined the fire hydrants along
Olive Street are sufficient to serve the area with the addition of
the other fire hydrants required on Green Street and in the project
area. These improvements, it was explained, are at the developer's
expense, as are all public works improvements made in connection
with the project.
A recess was called by Chairman Lawson.. at 9:40 p.m., and the meeting
was called to order again at 9:50 p.m.
10. MATTERS FROM CITY OFFICIALS
A. Establishment of the Relocation Appeals
Board - Temple City Community Redevelopment Agency
Planning Director Dragicevich informed the Commission this item is
postponed for action .. to the next regular meeting on May 14, 1974.
B. Conflict of Interest Statements
Commissioner Stacy asked when these statements were due, and Asst.
City Attorney said to withhold submission of them until .further notice.
C. Seismic Safety Element
Planning Director Dragicevich explained that the Seismic Safety and
Noise Elements are required elements that must be included in the City's
General Plan by September 20, 1974. Several cities in the San Gabriel..
Valley selected a professional firm to perform a study on geologic
and seismic hazards for the West San Gabriel Valley, and Temple City
has been invited to participate in contracting with this firm for a
seismic safety study which will comply with the State guidelines, The
cost for Temple City to participate will not exceed $1942, which compares
favorably against the fees paid by cities acting alone in the prepara-
tion of this Element. He concluded by asking the Commission to recommend
inclusion in the 1974 -75 FY budget a sum of 1942 for the seismic safety .
study to be performed by this consultant firm.,
Commissioner Stacy moved to recommend inclusion of .$1942 in the 1974-75
FY budget for the seismic safety study to be performed by a consultant
firm. Motion was seconded by Commissioner Atkins and passed by roll
call vote with Commissioners Atkins, Clark, Stacy and Lawson voting
affirmative. Commissioner Breazeal abstained stating he felt that budget

D. Property Nuisances
Commissioner Atkins referred to properties at 6038 Rosemead and at
9044 Olive, both of which had been before the Planning Commission
as property nuisances and the cases had been terminated. In each
instance the properties were still in a deteriorating or unkempt
condition. Staft was instructed to investigate.
Commissioner Clark asked what progress could be reported on property
nuisance case at 9661 Las Tunas Drive, and was informed the City
Council had required certain improvements and if they were not done
the City had the right to have those improvements made at the
property owner's expense.
11. ADJOURNMENT
There being no further business, Commissioner Breazeal made a motion
seconded by Commissioner Atkins and passed unanimously, to adjourn
to the next regular meeting of the Planning Commission. Meeting ad-
journed at 10 p.m.
