Enclosed is your agenda for the October meeting. , ' I i During the September meeting, we discussed several methods of i informing the public about the existence of the Community Access I Advisory Board and the opportunities available through the cable system. Before we proceed witn this campaign, I think it would � be wise to wait until we have adopted geaeral rules governing � public access, and our ocan unique set of rules regarding the dis- i tribution of funds to groups and individuals who desire to produce i access programming; otherwise we may find ourselves inuadated with I questions that we cannot approtiately answer. � Lynwood is a member of a five (5) city consortium that includes ' Bell Gardens, Downep, Santa Fe Springs and Paramount. The consor- tium will share the public access studio facilities (located in � Lynwood and Downey) therefore it is recommended that general rules � for access be established for the group. The consortium has not � met since late August and, at this writing, no date has yet been set for the next meeting. However, it would behoove this committee � to proceed with the establishment of its own policy to regulate the � possible funding of potential access users. � I have included, for your review, guidelines developed by several � di£ferent cities regarding access funding. I have also prepared, � for your review, a letter to be mailed to local community groups, � churches and other organizations that may wish to utilize the ! alpha-numeric channel for broadcasting their sponsored community � activities. � � i � � I I .r.. �. i • �1EMORANDUM: Community Access Advisory Board Page 2 We are involved in perhaps the most exciting and challenging_ cultural phenomenon since the creation of the printing press, and we owe it to ourselves as well as our community to take full advantage of the tremendous opportunities that cable television will provide. - I am looking forward to worki.^.g with you, and I anticipate a great deal 'of success with our program. I I � . ,.w� � � COMMUNITY ACCESS ADVISORY BOARD Minutes for the Meetinq of September 26, 1983 The meeting was called to order at 7:05 p.m. Members is attendance were.Arthur Waller, Carmen Hernandez, Mary Wright, Randy Williams. A motion was moved and seconded to excuse Pastor C.C. Coleman from the meeting because of a prior engagement. Mr. Robert downs was absent. The minutes of the July meeting were approved. Ms. Hernandez expressed concern as to the number of additional staff needed to provide service for public,access. Currently, the consor-, tium proposes the hiring of one person to serve as Access Coordinator. It was pointed out that as interest is generated and more staff is required, then the consortium will consider hiring additional staff. • It was moved and seconded that the hirinq of the Access Coordinator, per the proposed agreement, be recommended to the City Council: It was suggested that Arthur Waller be responsible for coordinating the listing of the L}�wood monthly calendar of events for broadcast- on the alpha-numeric �hannel. Ms. Hernandez also suggested the preparation of a form letter to be mailed to local civic and comm-- unity organizations to i.^.form them of the availability of public access, and the issuance of a news release announcing the formation of the Community Access Advisory Board. - It was moved and secoaded that the meeting be.adjourned until the next regularly scheduled meeting of October 17, 1983. `.. _ � � . � COMMUNITY ACCESS CORPORATION RULES AND REGULATIONS FOR APPLICATION OF SPECIAL PROJECT FUNDS - ELIGIBILITY The following individuals, groups, organizations, or . nonprofit cor�orations shall be qualified to apply for Special Project Funds: (A) nonprofit corporations qualifying as such under Section 501(c)(3), provided said nonprofit cor�oration provides, together with any such application far funds, a certified copy of its Articles of Incorporation, Bylaws, Internal Revenue Service tax-exemp- • tion authorization, and a certified copy of its federal and state income tax filing for the year preceding the year in which applica�ion is made (if nonprofit corporation is in its first yeas of operation, in lieu of the income tax filing for the previous year, applicant shall provide an itemized budget, including.all projected revenues and their sources, expevses for the year, siyned by an officer of'the applicant-corgoration; City of Downey, Downey School.Dis- trict, and College excepted; (B) any indivi- dual, individcals, yroup, or organization, which, in the sole opinion af the Board of Directors, upon recommenda- tion of the C�nmunity Access Advisory Committee, demon- strates throuuh thorough documentation as may be defined I from time to time by the Board of Directors, a cable , television pruject of clear entertainment,,informational, or edifying quality capable of being produced in a cost- ' effective manscer, the content of which is not violative of , the "Community Access Corporation Rules and Reyulations" and which is approved for production by the Board of Directors; (CD City of Downey, Downey School District, • and College. . � PROCEDURE FOR APPLICATION OF FUNDS All qualified applicants shall follow such procedures for application of Special Project Funds as may be determined , from time to time by the Board of Directors, i LIMITATION AS TO USE OF SPECIAL PROJECT FUNDS � Recipients �of Special Project Funds shall not use said funds . for any pus.pose whatsoever other than for the express � . j _ I '^� M � � purpose stated in applicant's application and project analysis, or by the Board of Directors upon gift of funds. ACCOUNTABILITY FOR FUNDS AND EXPENDITURES � Recipient of Special Project Funds shall at all times make ' available all records or other documents relevant to main- . tenance and expenditure of funds, and shall provide during normal business hours,.or at such other place and time as . may be notified by the Board of Directors or its agent, reasonable access to said records and other documents for the purpose of inspection by a representaEive of Community Access Corporation.� Further, recipient shall provide pre- cise, accurate details of all expended funds, i.e., receipts, invoices, and other original documents, and shall deliver to Community Access Corporation at such place and time as may be deemed necessary by the Board'of Directors, all said documents as evidence of said expenditures. Failure to . provide said accurate documentation shall result in a formal inquiry by the Board of Directors or its agent which may, at its sole discretion, request additional documentation or, if said additional documentation is not available, return of . all undocumented funds. Additionally, recipient shall at all times adhere to the accounting requirements as may be determined from time to I time by the Board of Directors and sha•11 demonstrate book- I keeping practices within the guidelines of Generally Accepted Accounting Principals.. � � LIMITATION AS TO LIABILITY OF GRANTOR � I Recipient shall indemnify and hold harmless Community Access � Corporation, its Board of Directors, Community Access i Committee members, and the City of Downey from any and all liabilities arising out of use of any grant monies given to Recipient by Community Access Corporation or use of the � Community Access Cablevision System. Further, neither Community Access Corporation, its Board of Directors, i Advisory Committee members, the City of Downey, or its agent shall be held liable primarily or secondarily for any debts ' incurred in the production of any program in which Community , � Access Corporation has contributed funds. i I � r � � i � f � .-� -' � � . STATEMENT OF COMPLIANCE 1. I have read and am thoroughly.familiar with Community Access Corporation Rules and Reyulations. 2. I am thorouqhly familiar with the contents of the ' program material to be shown, and state that: (a) Neither a lottery nor lottery information will be cablecast. (b) No advertising material will be cablecast. - (c) No obscene or indecent material will be cablecast. (d) Arrangements and clearances have been obtained from broadcast stations, networks, sponsors, � music licensing organizations, performers' representatives and any other persons necessary to authorize transmission of program material over the system. (e) To the best of my knowledge, the proyrams are not in breach of the applicable local, state or ^ federal law. ' (f) I a live cablecast, I have taken reasonable measures to ensUre compliance with this state- ment. 3. I understand that I may be criminally or eivilly liable for per.forming material which contains adver- tising, lottery or lottery information, or obscene or indecent material in violation of Community Access Corporation Rules and Regulation and the local, state or federal law. Activity S., goard of Directors announce the awards. � . � . r � EAST LANSING CABLE COMMUNICATIONS COMMISSION GUIDELlNES FOR USE OF GRANTS The authority of the East Lansing Cable Communications Commission to disburse monies for programming on their designated public , channels is provided by Chapter 82 of Title VII of the Code of the City of East Lansing, Section � 7.282(9): "The Commission shall have the following functions; ... (9) Disburse all City revenues from franchises for the development of the use of public channels, including production grants to users and ` the purchase and maintenance of equipment not required to be provided by the franchisee." In Section 7.210 of the same chapter, "public , channels" are detined as "channels which are � dedicated to the public interest, according to the � following categories (a) public access, (b) I 3 � educational use, (c) local government purposes, and (d) origination of programming by the � franchisee." The Commission shall consider the following I � objectives; � . 1. Encourage the use of public channels among � � . the widest range of institutions, groups and �� individuals within the City. � - 2. Advancement of the quality and amount of equipment and facilities. � 3. Increased variety of progiamming on public channels. 4. Education of the generaf public to the ' potential of cabie. � - 5.
