PUBLIC HEARING - AMENDMENT TO ZONING ORDINANCE REGARDING SETBACKS IN HOSPITAL-MEDICAL-DENTAL (H-M-D) ZONE. Comment: In January of 1981, the City adopted an ordinance which established a Hospital-Medical-Dental i (H-M-D) zoning classification. l One of the development standards of the H-M-D Zone I, • requires that buildings be set back at least 20 feet from all property lines. Staff feels that �� this requirement is overly restrictive in that the I majority of the City's H-M-D lots are only 50 feet �I wide. These.lots would be rendered useless if the required setbacks were adhered to. NEW BUSINESS 9, EQUIPPtENT PURCHASE (MOTOR VEHICLE -.SEDAN) Comment: The 1983-84 approved Lynwood Redevelopment ' . Agency (LRA) Budqet provides Por the leasing of a Sedan. In order to facilitate this, StafY is proposing that the City purchase a Sedan out of the Garage Fund and.lease it to LRA. Based on past negotiated purchases of used venicles from liertz Car rental four (4) Sedans and two (2) Station Wagons, it is estimated that the City could save approximately $2,000 when compared to purchasing a new Sedan through the Pormal bidding procedure. Section 2-62 (c) of the Lynwood Code provides for the acquisition oP equipment without going through the Pormal competitive bidding procedures, iP the City Council by Resolution adopted by not less than 4/5 votes finds that such an acquisition may be more economically and efficiently effected through.the use oP an alternate procedure. Recommendation:.�It is recommended that the City Council authorize Staff to negotiate the purchase price of a Sedan, and adopt the attached Resolution approving same. 10. The City has not signed , � a new contract with the State to continue corridor services. Captain Osborn of the Lynwood Sheriff's Department stated the area needed to be patrolled as long as there were buildings, and a two-man patrolwas.required in the area. He will be meeting with Judge Pregerson in a few days to discuss the matter. After Council discussion, it was � moved by Councilman Rowe, seconded by Councilman Morris and carried, that Council approve writing a letter to Caltrans regarding the cost of providing a level of service for the I-105 Corridor Patrol as requested by the Sheriff's. Our redevelo.pment only holds two meetings per month. The only amendment to the bylaws. is to continue with the four meetings and allow.a change from 325 to $30 per meeting. Council agreed to put ihe bylaws change on the Lynwood Redevelopment Agency agenda for the regular meeting of July 5, 1983. CITY CLERK'S AGENDA After Council discussion, Council agre�d to continue discus- sion on the Mitchell's Word Processing and Training Center for chari�able solicitartions to the regular meeting of July 5, 1983. The City Clerk stated that 500 dogs were vaccinated and 131 dog licenses were sold at the Vaccination Clinic held at the Lynwood Recreation Center on June 28, 1983. INFORMATIONAL ITEMS The City Manager stated the State had not adopted its budget yet. He asked department heads to fiold up blanket purchase orders until more information is received an the State budget. Staff has recently reviewed the 1946 ballot measure pertain- ing to retirement tax. The City now pays both City and .: employee share of tax. The Memorandum of Understanding �_ wi11 end the employee's share in 1984. Staff needs to have Council direction on setting a special assessment which has to be done before September l, 1983. I I City Manager stated Public Works Director Williams would like to dispense with competitive bidding procedures with the MWD middle cross feeder repairs. It is necessary for City to purchase water from MWD to meet its system demands. The connection is leaking and needs immediate repairs. If City utilizes the 3-quotation procedure, a contract can � be acquired much sooner. Councilman Rowe inquired if this � would be legal. RESOLUTION N0. 83-86 entitled: "A RESOLUTIOPJ OF THE CITY - COUNCIL OF THE CITY OF LYNWOOD APPROVING AN AMENDMENT TO THE LAND USE ELEMENT OF THE LYNWOUD GENERAL PLAN." was presented. ROLL CALL Ayes: Councilmen Byork, Green, Morris, Rowe, and Thompson Noes: None Absent: �one � The Mayor announced the time had arrived to conduct a public iiearing on second unit legislation (S3 1160 and SB 1534) "Granny Flats" ordinance. The Mayor stated that at its regular meeting of May i2, 1983, the Planning Commission instructed staff to prepare an ordinance totally precluding second residential units in any zone in the City in accord- ance with Section 65552.2 (c) of the Government Code. Even though the preclusion of second units may limit housing _,___ opportunities within the region, the Commission felt such units would have significant adverse impact on the public � health, safety and welfare. The City Manager stated state legislation permits a city to adopt an ordinance totally precluding second units within single family and multiple family residential zones, provided said ordinance contains findings acknowledging that such action may limit housing opportunities of the region. The ordinance must contain findings that specific adverse impacts on the public health, safety and welfare would result from allowing second units.. The mayor inquired if anyone present wished to speak for or in opposition to the proposed ordinance. There was no response and the public hearing was closed. Community Oevelopment Director Read explained that the City's February 4, 1983, agreement with Willdan & Asso- ciates for planning services expired on June 30, 1933. ihe services of the firm are used on a limited basis and used only when required by staf` workload or due to lack o` in depth expertise on a par•ticular subject. The "' agreement will provide for a maximum compensation of $7,500 which is one-half of the budgeted amount, and staff is trying to use the firm on a very limited basis. ROLL CALL: —�: Councilmen Byork, Green, Morris, Rowe, Thompson Noes: None Absent: None Council asked the City Attorney for advice pertaining to letter received from the Chamber of Commerce regarding fees and licenses for carnivals. The attorney stated that Council had waived fees in the past, but according to the Code fees could be charged. Council still had the choice, but needed to change the Code to a complete waiver of all fees for carnivals, or enforce the fee provision and collect fees. After Council discussion, it was moved by Councilman Morris, seconded by Councilman Rowe, and carried, to deny the waiver of fees. The terms of Commissioners Dove, Mendoza and Walker of the Housing and Commurity Develcpment Advisory Board ��ill expire - in July. The City Clerk staied that Commissioner Mendoza did not wish to be renominated. The following nominations were then made by Council. Councilman Green nominated Mr. Dale Steele; Councilman 6york nominated Mr. Donald Dove and Mr. Alfred Walker. It was moved by Councilman Morris, � seconded by Councilman Green, and carried, to close the nominations. Council will vote at the next regular meeting. A letter had been received from the Lynwood Fire Fighter's Association requesting permission to conduct the 1983 Lynwood Firemen's Ball. There wiil be a Ball to include music, comedy and magic acts rather than a Variety Show as in prior years. It was moved by Councilman Byork, seconded by Councilman Green, and carried, to approve the request. In regards to Council's request for more information concerning Mitchell's Processing and Training Center, the City Attorney stated the question was whether they had attained federal and �tate tax-exempt status. Having reviewed their application and contact with the State Franchise Board and Internal.Revenue Service, it did not appear that they had the tax-exempt status. After discus- sion, it was moved by Councilman Morris, seconded by Councilman Green, and carried, to deny the request until such time as proper papers are presented concerning their — non-profit status. INFORMATIONAL ITEMS The City Manager stated a letter is being sent to the California Conservation Corporation regarding the City sub- mitting an application for funds available throuoh the Park Restoration and Urban Reforestation Program. � � The proposed budget includes the planting of l0U parkway trees, trimming 75 park trees, and renovating street medians. The proposed project has been approved by Council. It was also specified in the letter that the proposed budget would not otherwise be completed by October 1, 1983, without funds made available through the Park Restoration and Urban Reforestation Program. Programs are also operating in numerous c.ities across the country. Homesharing is a program that allows a senior having.a home or apartment - to share with�a seniar seeking a plate to live. The senior. owner would be paid a reasonable rent by the senior sharer and the two would share all other living expenses.. In other words, the proposed program would serve strictly as a referral service for seniors. .Senior citizens, will.ing to share their homes or.seeking to share a home, would register with the.progr.am. Then they would be referred to seniors with whom they might share. Two senior wishing to share would meet with program staff to discuss living habits and other.pertinent things. The City Manager reported to Council that the 13 cities that have been collecting special assessment monies for their pension plans were banding together to determine possible legal action regarding an error made by the county in the distribution of the funds. A request was made for staff to apprapriate no more than $1,000 for legal analysis for a determination as to, whether the City should file suit. BACKGROUND: - In January of 1981, the..City Council adopted an ordinance which estab- lished a ilospital-n4edical-Dental (H-hI-D) zoning classification. St. Francis Medical Center originally requested the establishment of this zoning classification, which restricts land,uses to hospitals and medi- cal�dental offices as well as ancillary uses suc� as gift shops, phar- macies, restaurants, etc, The H-M-D zone provides for design and noise attentuation criteria. In early 1982, several properties in the vicinity of, and including, St. Francis Medical Center were rezoned to H-M-D. ANALYSIS: One of the development standards.of the H-M-D zone is that build- ings must be set back at least 20 feet fron all.property lines. Sta�f feels that this requirement is overly restrictive, in that the major- ity of the City's lots zoned H-M-D are only 50 feet wide by 120 feet deep. Thus, these lots would be rendered useless for development if the required setbacks are adhered to. Staff surveyed the City's existing H-�I-D properties and found that the front yard setbacks range from 5 to 10 feet in depth. Most oi thes� properties Iiave little or no side yard setbacks but have ample rear yard setbacks. Staff feels that �, 10 foot deep landscaped front yard se�back is a reasonable standard for this zoning.classifi- cation and that no side or rear yard setback requirements are necessary. BACKGROUND The 1983-84 approved Lynwood Redevelopment Agency (LRA) Budget provides for the leasing of a Sedan. In order to facilitate this, Staff is proposing that the City purchase a Sedan out of the Garage Fund and lease it to LRA. ANALYSIS � Based on past.negotiated purchases of used.vehicles from Hertz Car rental four (4) Sedans and two (2) Station Wagons, it is estimated that the City could save approximately $2,000 when compared to purchasing a new Sedan through the formal bidding procedure. Section 2-62 (c) of the Lynwood Code provides for the acquisition of equipment without going through the formal. competitive bidding � procedures, if the City Council by Resolution adopted by not less t;�an 4/5 votes finds that such.an acquisition may be more economically and effic�ently effected. through the use of an aiternate procedi:re. Sectiona 12-1 through 12-10 of the Lynwood Municipal Code are hereby amended to read as follawas ° Sec. !2-!. Adoption of Uni£orm Fire Code. The City of Lynwood hereby adopts for the purpoae o£ prescribing regulationa governing coaditiona hazardous to life aad property from fire or explosion, that certain code known as the Uniform Fire Code recommended by the � Weatern Fire Chiefs Aasociation and the International Conference of Building officials being particularly the 1982 edition thereof, and the whole thereof, save and except auch por:.inaa as aze hereinafter deleted, modified or amended by sectioa i2-7 of this Code, of which code not less than three (3) copies have been aad are now.filed ia the office of the clerk of the city; and the.same are hereby adopted and incorporated as fully as if set out at length herein; and from the date on �rhich this ordinance ahall take ef�ect, the. provision thereof shall be controlling within , the limits of the City of Lynwood. "Sec. 12-4. Eatablishment of limita of diatricts in which storage of flammable or combustible liquids in outside aboveground tanks is to be prohibited. (a) The limits referred to in Section 79.SOl.of the Uniform Fire Code, in which storage of fla�able or combuatible liquids in outside aboveground tanks is prohibited, are hereby established as fol2ows: No flammable or combustible liquids shall be stored anywhere within the city limita escept on - -� - property zoned M by the zoning ordinance.� (b) No new bulk plants for flammable or combuatible liquids shall be located anywhere ``- within the city limits eacapt on property zoned M by the zoning ordinance. "Sec. ]:•2-7. Amendments made in the Uniform Fire Code. The Uaiform Fire Code is amended and chanqed in the following respects: (a) Section 2.107 is amended to read: � Sec. 2.107. Whenever necessary to make an inspection to enforce any of the provisions of th3a Code, or whenever. the chief or his authorized representative has reasonab2e cause ' to believe that there esists in any building or upon any premises any conditioa which makes such building or premises unsafe, the chief or his authorized representative may enter'such building or premises at all reasonable times to inspect the same or to perform any duty imposed upon the chief by this Code; provided, however, that no auch entry shall be made unleas an inspection warrant authorizing the same has firat.beea isaued. Any other provision herein contaiaed to the contrary notwithstanding, the chief or his authorized representative may enter a building or premiaes to inspect the same or to perform any duty imposed upon the chief by this Code • without the necessity of firat obtaining an inapection warrant whenever the owner of such building or pzemises apecificallg consents to such entry or whenever the chief or his authorized representative reasonably believes that said building.or premises ia too dangerous ae to aause an immediate danger to human life or an i�ediate hazard to public safety. (d) Sectioa 78.102(b) is amended to read: (b) Eacept as agecifically hereinafter provided and except ae-apecifically permitted in Article II.of Chapter 12 of the Code of the City of Lynwood, it shall be unlawful for any perscn to posseas, atore, to offer for sale; ezpoas for sale, aell at retail, or use or explode any fireworks; provided that the chief shall have the power to adopt reasonable rules and regulatians for the granting of permits for supervised public displays of fireworka by a jurisdiction,. fair associations, amusement parks, other organizationa or for.the use of firewor3cs by artisans in pursuit of their . trade. Ever sucn use or display shall be handled by a competent operator approved by the chief; and shall be oa such character and so located, discharged or fired as ia the opinion of the chief after proper inneetigation, so as not to be hazardous to property or eadanger any person. (e) Sectioa 10.207(g) is added to read as followas (g) Fire.Lanes. In any location where accesa.for f re apparatus for fire suppression qr rescue purpoaes is unduly difficult or subject to obstruction the chief may designate such location a fire lane and cauae notice of - auch to be posted at the location. No person shall obstruct any fire lane in any manner that wou18 deter or hinder:the fire departmont from gaining immediate accesa and use o£ such £ire lane.. (f) Section 10.301(f) is added to read as followsa (f) Automatic Sprinkler Systems. Any aew building conatructed as a noa-reaidential occupancy exceeding 10,000 aquare feet of floor area; and any eaisting non-residential buil3iag that present2y does not exceed 10,000 square feet of floor area, but after / 06-13-83 5200P/1269/00 -3- � completion or major alteration o� ddition will ezceed 10;000 square feet of floor area, shall be provided with an approved automatic fire sprinkler system. Buildings classi£ied as Group "A" Occupancies shall conform to requirements in the 1979 Uniform Building . Code, Chapter 38. Any automatic sprinkler aystem installed pursuant herato shall be equipped with an approved device that automatically transmits a water flow alarm to the fire department upon activation of the system. Such an alarm's tansmission will be in a manner aad form approved by the chief. °Sec. 12-10. Penalti�s for Violation of This Fire Code. (a) Any person who shall violate any of the provisions of this code hereby adopted, or who shall £ail to comply therewith, or who ahall violate or fail to coiaply with any order made thereunder, or who shall build in violat3on of any detailed statement of spec�.fications or plans submitted and approved - thereunder, or permit issued thereunder, and from which no appeal has been taken; or who shall fail to comply with such an order as a£firmed or modified by the city council or by a court of competent jurisdiction; within the time fiaed herein,.. shall severally for each and every such violation and noncompliance, respectively, be guilty of a misdemeanor, punishable by a fine of not lesa than fifty dollars ($50.00) nor more than five.hundred dollars ($500.00) oz,by imprisotuneat for not more than one hundred eighty (180) days or by both such fine and imprisonatent. The impositian of one (1) penalty for any violation shall not excuse the violation or'permit it to continue; and all auch persons ahall be required to correct or remedy such violations or defects within a reasonable time; and when not otherwise specified, each ten (10) days that prohibited conditiona are maintained shall constitute a separate offense. , (b) The application of the above penalty shall not be held to prevent the enforced removal of prohibited conditions or the .. _.. enforcement of other provisions of the code.° SECTION 2 . . Severability .
