8. PUBLIC HEARING - AMENDMENT TO ZONING ORDINANCE REGARDING SETBACKS
IN HOSPITAL-MEDICAL-DENTAL (H-M-D) ZONE.
Comment: In January of 1981, the City adopted an ordinance
which established a Hospital-Medical-Dental
i (H-M-D) zoning classification.
l One of the development standards of the H-M-D Zone
I, • requires that buildings be set back at least 20
feet from all property lines. Staff feels that
�� this requirement is overly restrictive in that the
I majority of the City's H-M-D lots are only 50 feet
�I wide. These.lots would be rendered useless if the
required setbacks were adhered to.

Staff feels that a 10 foot front yard setback is
� reasonable and that no side or rear setback re-
� quirements are necessary for the H-M-D Zoning
! classification.
� Recommendation: City Council adopt the attached ordinance entitled:

9, EQUIPPtENT PURCHASE (MOTOR VEHICLE -.SEDAN)
Comment: The 1983-84 approved Lynwood Redevelopment
' . Agency (LRA) Budqet provides Por the leasing
of a Sedan. In order to facilitate this, StafY
is proposing that the City purchase a Sedan out
of the Garage Fund and.lease it to LRA.
Based on past negotiated purchases of used
venicles from liertz Car rental four (4) Sedans
and two (2) Station Wagons, it is estimated that
the City could save approximately $2,000 when
compared to purchasing a new Sedan through the
Pormal bidding procedure.
Section 2-62 (c) of the Lynwood Code provides
for the acquisition oP equipment without going
through the Pormal competitive bidding procedures,
iP the City Council by Resolution adopted by not
less than 4/5 votes finds that such an acquisition
may be more economically and efficiently effected
through.the use oP an alternate procedure.
Recommendation:.�It is recommended that the City Council authorize
Staff to negotiate the purchase price of a Sedan,
and adopt the attached Resolution approving same.
10. AMBULANCE SERVICE AGREEMENT (1983-84 & 1984-85) °--
Comment: On �une 23, 1983, as authorized by the City
Council, Requests for Proposals were sent out to
area Ambulance Companies.
On �uly 18, 1983, a bid opening was held in the

The City Council of the City of L_vnwood met in an adjourned
regular meeting in the City Hall, 11330 Builis Road, on
above date at 2:00 p.m.
Mayor Thompson in the chair.
Councilmen Byork, Green, Morris, Rowe, and Thomoson answered
the roll call.
Also present were City Manager Gomez and City Attorney
Feldman.

The City Manager stated.there were a number of items on the
Agenda to close out the fiscal year.
RESOLUTION N0. 83-81 entitled: "A RESOLUTION OF THE CITY
COUNCIL OF THE CITY Of LYNWOOD AMENDING THE ANNUAL BUDGET
FOR 1982-83 BY APPROPRIATING MOP�IES TO ESTABLISH RENEWAL,
REPLACEMENT AND BENEFIT RESERVE FUfVDS IN THE GENERAL fUND
SPECIAL REVENUE FUNDS, ENTERPRISE FUNDS, AND EXPENDABLE
TRUST FUNDS." was presented. It was moved by Councilman

The Mayor stated that the City usuaily incurs expenses
before receipt of reimbursements from granting agencies.
Most grant funds are in de,'icit for the amount not yet
reimbursed. These deficits can be.eliminated by a loan
from the General Fund to the deficit funds, and it is
only a temporary loan.

1 The Mayor stated the state palice will patrol the I-105
I corridor effective July 1, 1983. The City has not signed
, � a new contract with the State to continue corridor services.
Captain Osborn of the Lynwood Sheriff's Department stated
the area needed to be patrolled as long as there were
buildings, and a two-man patrolwas.required in the area.
He will be meeting with Judge Pregerson in a few days to
discuss the matter. After Council discussion, it was
� moved by Councilman Rowe, seconded by Councilman Morris
and carried, that Council approve writing a letter to
Caltrans regarding the cost of providing a level of service
for the I-105 Corridor Patrol as requested by the Sheriff's.
It was moved by Councilman Green, seconded by Councilman
Morris, and carried, that Council authorize Councilman
Byork and Captain Osborn to meet with Judge Pregerson to

Quotes received for fiscal year 1983-84 result in savings over
fiscal year 1982-83 expenses. It was moved by Councilman

from a survey of surrounding cities pertaining to Council
salaries, car allowance, etc. Staff will present some

I� would be effective on November 9, 7983. This incr•ease
j, , would amend Ordinance No. 1026; no increase has been

Councilman Rowe stated the bylaws for the redevelopment.

at $25 per meeting. Our redevelo.pment only holds two
meetings per month. The only amendment to the bylaws.

from 325 to $30 per meeting. Council agreed to put ihe
bylaws change on the Lynwood Redevelopment Agency agenda
for the regular meeting of July 5, 1983.
CITY CLERK'S AGENDA
After Council discussion, Council agre�d to continue discus-
sion on the Mitchell's Word Processing and Training Center
for chari�able solicitartions to the regular meeting of
July 5, 1983.
The City Clerk stated that 500 dogs were vaccinated and
131 dog licenses were sold at the Vaccination Clinic held
at the Lynwood Recreation Center on June 28, 1983.
INFORMATIONAL ITEMS
The City Manager stated the State had not adopted its budget
yet. He asked department heads to fiold up blanket purchase
orders until more information is received an the State
budget.
Staff has recently reviewed the 1946 ballot measure pertain-
ing to retirement tax. The City now pays both City and .:
employee share of tax. The Memorandum of Understanding �_
wi11 end the employee's share in 1984. Staff needs to
have Council direction on setting a special assessment
which has to be done before September l, 1983.

I City Manager stated Public Works Director Williams would
like to dispense with competitive bidding procedures with
the MWD middle cross feeder repairs. It is necessary for
City to purchase water from MWD to meet its system demands.
The connection is leaking and needs immediate repairs. If
City utilizes the 3-quotation procedure, a contract can
� be acquired much sooner. Councilman Rowe inquired if this
� would be legal. After Council discussion, it was moved by
I Councilman Rowe, seconded by Councilman Morris, that staff
` be authorized to dispense with competitive bidding pro-
� cedures, and authorize staff to utilize the three (3)
j quotation informal bid procedure, subject to Council approval.

� "Women Against Sexual Abuse" had been received from Mrs. Martin

had been gi_ven to all councilmen.

The City Council of the City of Lynwood met in a regular
session in the City Hall, 11330 Bullis Road, on above date
at 7:30 p.m.
Mayor Thompson in the chair.
Councilmen Byork, Green, Morris, Rowe, and Thompson answered
the roll call.
Also present were City Manager Gomez and City Attorney Feldman. .
SCHEDULED MATTERS
The Mayor announced the time had arrived to conduct a public
hearing on request for General Plan amendment. The Mayor
inquired if anyone present wished to speak for or in opposi-
tion to the proposed amendment, ihere was no response, and
the public nearing was closed.
RESOLUTION N0. 83-86 entitled: "A RESOLUTIOPJ OF THE CITY
- COUNCIL OF THE CITY OF LYNWOOD APPROVING AN AMENDMENT TO
THE LAND USE ELEMENT OF THE LYNWOUD GENERAL PLAN." was
presented. It was moved by Councilman Green, seconded by
Councilman Morris, that the fcregoing resolution be adopted.

The Mayor announced the time had arrived to conduct a public
iiearing on second unit legislation (S3 1160 and SB 1534)
"Granny Flats" ordinance. The Mayor stated that at its
regular meeting of May i2, 1983, the Planning Commission
instructed staff to prepare an ordinance totally precluding
second residential units in any zone in the City in accord-
ance with Section 65552.2 (c) of the Government Code. Even
though the preclusion of second units may limit housing _,___
opportunities within the region, the Commission felt such
units would have significant adverse impact on the public
� health, safety and welfare. The City Manager stated state
legislation permits a city to adopt an ordinance totally
precluding second units within single family and multiple
family residential zones, provided said ordinance contains
findings acknowledging that such action may limit housing
opportunities of the region. The ordinance must contain
findings that specific adverse impacts on the public health,
safety and welfare would result from allowing second units..
The mayor inquired if anyone present wished to speak for or
in opposition to the proposed ordinance. There was no
response and the public hearing was closed. After discussion
an ordinance entitled: AN ORDINANCE OF THE CITY OF LYNWOOD
AMENDIYG CHAPTER 25 OF THE LYNWUOD MUNICIPAL CODE TO PROHIBIT
THE ESTABLISHMENT OF SECOND UNITS IN SINGLE FAMILY AND MULTI-
FAMILY RESIDENTIAL ZUNES. was presented. It was moved by
Councilman Green, seconded by Councilman Byork, to waive
reading and introduce ordinance for first reading.

Community Oevelopment Director Read explained that the
City's February 4, 1983, agreement with Willdan & Asso-
ciates for planning services expired on June 30, 1933.
ihe services of the firm are used on a limited basis
and used only when required by staf` workload or due to
lack o` in depth expertise on a par•ticular subject. The
"' agreement will provide for a maximum compensation of
$7,500 which is one-half of the budgeted amount, and
staff is trying to use the firm on a very limited basis.

Absent: None
Council asked the City Attorney for advice pertaining to
letter received from the Chamber of Commerce regarding
fees and licenses for carnivals. The attorney stated that
Council had waived fees in the past, but according to the
Code fees could be charged. Council still had the choice,
but needed to change the Code to a complete waiver of all
fees for carnivals, or enforce the fee provision and
collect fees. After Council discussion, it was moved by
Councilman Morris, seconded by Councilman Rowe, and carried,
to deny the waiver of fees.
The terms of Commissioners Dove, Mendoza and Walker of the
Housing and Commurity Develcpment Advisory Board ��ill expire -
in July. The City Clerk staied that Commissioner Mendoza
did not wish to be renominated. The following nominations
were then made by Council. Councilman Green nominated
Mr. Dale Steele; Councilman 6york nominated Mr. Donald Dove
and Mr. Alfred Walker. It was moved by Councilman Morris, �
seconded by Councilman Green, and carried, to close the
nominations. Council will vote at the next regular meeting.
A letter had been received from the Lynwood Fire Fighter's
Association requesting permission to conduct the 1983
Lynwood Firemen's Ball. There wiil be a Ball to include
music, comedy and magic acts rather than a Variety Show as

In regards to Council's request for more information
concerning Mitchell's Processing and Training Center,
the City Attorney stated the question was whether they
had attained federal and �tate tax-exempt status. Having
reviewed their application and contact with the State
Franchise Board and Internal.Revenue Service, it did not
appear that they had the tax-exempt status. After discus-
sion, it was moved by Councilman Morris, seconded by
Councilman Green, and carried, to deny the request until
such time as proper papers are presented concerning their —
non-profit status.
INFORMATIONAL ITEMS
The City Manager stated a letter is being sent to the
California Conservation Corporation regarding the City sub-
mitting an application for funds available throuoh the Park
Restoration and Urban Reforestation Program.

The proposed budget includes the planting of l0U parkway
trees, trimming 75 park trees, and renovating street
medians. The proposed project has been approved by
Council. It was also specified in the letter that the
proposed budget would not otherwise be completed by
October 1, 1983, without funds made available through
the Park Restoration and Urban Reforestation Program. It
was moved by Councilman Green, seconded by Councilman
Morris, and carried, that Council authorize the Mayor to
sign the letter.
_.. Regarding the request for proposal for the City's exclusive
Ambulance Contract, the Fire Chief stated that the pro-
posals were sent out to ten companies. The Bid Opening
will be held on July 18, 1983, at 9 a.m. in the Gity Clerk's
office.
A joint task force of Code Enforcement, Fire Department,
and Sheri£f's Department personnel rode around and arrested
people with illegal fireworks on the 4th of July. It was
_ a relatively quiet day with only a few minor fires.
The City Manager stated Council had approved an appl5ca-
�ion for a CDBG-Jobs Bill funding in the amount of 5352,379
under the Community t�evelopment CDBG Block Grant Jobs Bill
Contract. The City received copies of a blanket contract
from the County of Los Angeles, Community Development
Commission, outlining the relationship between the City
and County for ope.ration of CDBG-Jobs Bill projects. The
County requested the contract be executed and returned as
soon as possible. Time is of the essence in implementing
the jobs bill projects since any funds not encumbered within
six months will be withdr.awn. After discussion

last meeting, Council approved a proposal to have repairs
made to the City's water transmission lines without going.

for all projects costing in excess of $5,000 unless the

20162 and 20168. Although a high possibility exists that
the project does not meet the statutory concept or an

the Public Works Department to proceed on the project
°� without competitively biddin9 for repair services. The
City Council is required to follow the competitive bidding
process unless (1) there is an emergency such that neces-
sity and the public interest demand the immediate expendi-
ture of public money to safeguard life, health or property
or (2) competitive proposal would be unavailable or not
produce an advantaye. The public contract code defines

as an extraordinary fire, rlood, storm, epedimic, or
other disaster." Although a possibility exists that the
water feeder repair project does not constitute an emergency,

door; what can Council do about their removal from property.
Mr. D. Richman, 11106 Benwell, iharrked everyone for the
flowers and cards during his recent hospitalization. Stated __
he did not have backup material for Agenda Items No. l3 and
14. Councilman Rowe explained that the government code
allowed an increase of 5% per year for councilmen' salaries.
The attorney steted Council previously receiJed a car
mileage allowance, and now is substituting the mileage
for cer allowance of $175 per month.
Ms. I. Garcia, 2737 E. lllth Street, asked when tne last
census was taken; an incident where she called the Sheriff's;
Granny Flats action taken by Council. The Mayor replied
to her questions.

Fire Chief stated that this is done four time each year and
more often i�f necessary. Several sections of the Code
need to be revised to Lynwood's Municipal Code such as
establishing districts where flammable liquids can be
� stored, establishing limits for liquified petroleum gas
bulk storage, storage of explosives, etc.
There was no further response and the public hearing was
closed.

Nomesharing Program. Ms. Gretel Dukson from the Community
Development Department explained the Homesharing Program is
an alternative living. arrangement ;or senior citizens.
There are presently many Homesharing Programs in Orange,
Los Angeles and Ventura.Counties; as well as in other.
counties throughout the State. Programs are also operating
in numerous c.ities across the country. Homesharing is a
program that allows a senior having.a home or apartment
- to share with�a seniar seeking a plate to live. The senior.
owner would be paid a reasonable rent by the senior sharer
and the two would share all other living expenses.. In
other words, the proposed program would serve strictly as
a referral service for seniors. .Senior citizens, will.ing
to share their homes or.seeking to share a home, would
register with the.progr.am. Then they would be referred
to seniors with whom they might share. Two senior wishing
to share would meet with program staff to discuss living
habits and other.pertinent things. Upon their decision,
they draw up an agreement.outlining the terms of their •
� particular living arrangement. After discussion, it was

plementation of the Nomesharing Program for senior citizens.

INFORMATIONAL ITEMS
Fire Chief Lathrope stated the bids for the ambulance
proposals were opened.in the City Clerk's office on
July 18, 1983, at 9 a.m. Nine ambulance companies
. received the proposals, and five responded. Bids ranged
from a zero bid to $26,000. Council will have a recommenda-
tion on the August 2, 1983, agenda.
The City Manager requested an executive session be held
after Council Public and Oral Communications.
The City Manager reported to Council that the 13 cities
that have been collecting special assessment monies for their
pension plans were banding together to determine possible
legal action regarding an error made by the county in the
distribution of the funds. A request was made for staff
to apprapriate no more than $1,000 for legal analysis
for a determination as to, whether the City should file suit.
It was moved by Councilman Byork, seconded by Councilman
Green, to approve authorization to spend no more than $1,000
for legal analysis in the matter.

Councilman Rowe announced that a Lynwood Citizen, Ms. Ida
Honorof, had been selected by the National Nutritional
Foods Association to receive their highly coveted anQ
prestigious Rachel Carson Memorial Award for 1983, which
wi1T take place.in Denver, Colorado on July 25, 1983. "
Councilman Rowe read commendations from Congressman
Dymally, Assemblyman Katz, Mayor Bradley, supervisors
of Los Angeles County and several others. Councilman
Rowe offered his congratulations and moved, seconded
by Councilman Byork, and'.carried, to authorize a pre-
sentation by the City of Lynwood of a recognition award
to MrS. Honorof. Councilman Morris also congratulated
Mrs. Honorof, as well as Councilman Byork stated he was
proud of the people wha bring recognition to the City of
Lynwood.
The Mayor stated he had received a two-page brochure from
fhe Fire Department regarding earthquakes and fire: These
are also available to the citizens of Lynwood. The name
of the brochure is "Aid to V.ictims Flyer:" They issue
it when there has been a fire to help people know what to
do. The City Fire Department developed the flyer and has
been recognized in the National Service Fire, Today Magazine.
Mayor Pro Tem Morris inquired about the firework stands.
City Clerk stated she did not have a do]lar amount, but
understood good profits were made. Several stands had
zone problems, but were able to relocate properly.

Ms. I. Honorof, 2901 Los Flores, stated that on August 8,
1983, she will have a panel from the Water Quality and
Citizens for Better Environment on he.r KPFK radio station.
The subject will be underground tanks; Sepiember 24, 1983,
there wil] be a 5� hour program dealing with waste dump-
ing and hazardous dump sites. She questioned a letter
' received from the County Fire Department regarding fire-
protection and emergency servi.ces to the.City. The
Mayor and Councilman Rowe replied to her question.

an incident that occurred on July 2, 1983 pertaining to
� a Mr. Tom Overturf who was stopped by Commissioner
Malchow and threatened him..with an illegal arrest.
Mr.T. Overturf, stated the Commissioner asked for his
dri'ver's license, but he was.concerned as to his motives.
Mr. W. Cunningham, stated he desired Council to hear both

in a neighbor's driveway; conference attendance.
Rev. T. Mur.ray, First Christian Church, inquired about.signs
the City had removed from the lamp posts on Imperial Nighway
and Long Beach Soulevard. City Engineer Williams will
contact Rev. Murray.
Rev. C. C. Coleman, New Life Baptist Church, inquired whether signs
could be placed at State Street, Fernwood and Lynwood Road,
regarding speed limits in a school zone. Mayor Pro Tem

SUBJECT: A11END!�ENT TO ZONING ORDINANCE REGARDING SETBACKS IN
HOSPITAL-MEDICAL-DENTAL (H-M-D).ZONE.
BACKGROUND: -
In January of 1981, the..City Council adopted an ordinance which estab-
lished a ilospital-n4edical-Dental (H-hI-D) zoning classification. St.
Francis Medical Center originally requested the establishment of this
zoning classification, which restricts land,uses to hospitals and medi-
cal�dental offices as well as ancillary uses suc� as gift shops, phar-
macies, restaurants, etc, The H-M-D zone provides for design and
noise attentuation criteria. In early 1982, several properties in the
vicinity of, and including, St. Francis Medical Center were rezoned
to H-M-D.
ANALYSIS:
One of the development standards.of the H-M-D zone is that build-
ings must be set back at least 20 feet fron all.property lines. Sta�f
feels that this requirement is overly restrictive, in that the major-
ity of the City's lots zoned H-M-D are only 50 feet wide by 120 feet
deep. Thus, these lots would be rendered useless for development if
the required setbacks are adhered to.
Staff surveyed the City's existing H-�I-D properties and found that
the front yard setbacks range from 5 to 10 feet in depth. Most
oi thes� properties Iiave little or no side yard setbacks but have
ample rear yard setbacks. Staff feels that �, 10 foot deep landscaped

The City Council of the City of Lynwood DOES HEREBY
ORDAIN as follows:
Section 1. Section 25-13.2 of the Lynwood Municipal
Code shall be amended to read as follows:
"25-13.2 Setback
There shal? be a miaimum required front yard of ten
(10) feet which shall be landscaped and permanently
maintained and sprinklered."
Section 2. Severability. If any section, subsection,
subdivision, sentence, clause,.phrase or portion of this ordinance
or the application thereof to ar.y person or place, is for any rea-
son held to be invalid or unconstitutional by the decision of any
court or competent jurisdiction, such decision shall not affect
the validity of the remaining portions of this ordinance or its
application to other persons or places. The.City Council hereby
declares that it would have adopted this ordinance, and each sec-
tion thereof, irrespective of the fact that any one or more sec-
tion, subsection, sentence, clause, phrase, or portion, or the
application thereof to any person or place, be declared invalid
or unconstitutiona�.
Section 3 . The City Clerk is hereby ordered and directed
to certify to the passage of this ordinance and to cause the same

PURPOSE
To recommend that the City Council authorize Staff to negotiate
the purchase price of a Sedan, and adopt the attached Resolution
approving same.
BACKGROUND
The 1983-84 approved Lynwood Redevelopment Agency (LRA) Budget
provides for the leasing of a Sedan. In order to facilitate this,
Staff is proposing that the City purchase a Sedan out of the
Garage Fund and lease it to LRA.
ANALYSIS �
Based on past.negotiated purchases of used.vehicles from Hertz
Car rental four (4) Sedans and two (2) Station Wagons, it is
estimated that the City could save approximately $2,000 when
compared to purchasing a new Sedan through the formal bidding
procedure.
Section 2-62 (c) of the Lynwood Code provides for the acquisition
of equipment without going through the formal. competitive bidding
� procedures, if the City Council by Resolution adopted by not less
t;�an 4/5 votes finds that such.an acquisition may be more
economically and effic�ently effected. through the use of an
aiternate procedi:re.
RECOMMENDATIONS
It is recommended that the City Council authorize Staff to '

The purpose of this report is to recommend that the City Council award a
contract to the low bidder for providing ambulance service to the City
of Lynwood for the next two years.
BACK6ROUND
On June 23, T983 ReGuests For Proposals, authorized by the City Council, were
sent to Ambulance Companies which operate in Los A�geles County Southern Area.
On July 18, the bid opening was held in the City C7erk's Office at 9:00 a.m.
Bids were received from the following Ambulance Companies:
1. Adams Pmbulance Serdice, Inc. - South Gate -$ .-0-
2. Aids Medical Enterprises Inc. - Whittier 1.00/Yr.
3. Whitlock Ambulance Service - Maywood 18,000.00/Yr.
4. Goodhew Ambulance Service, Inc.-- Los Angeles 24,000.00�Yr.

Adams Ambulance Service, Inc., South Gate is the apparent low bidder.
Adams Ambulance has been in business in the Southeast Area for over 35 years.
Their bid is lowest and proposes two (2) ambulance units for the City.
The Fire Department has used Adams Ambulance Service for the past seven (7)
years with satisfactory service.
RECOh9NENDATION
It is recortonended that the City Council award a contract, which is being
prepared by the City Attorney, to the apparent low bidder, Adams Ambulance
Service, Inc., based on its bid of No Cost to the City for providing
ambulance service.

Adama should be recammended Co the City Council for the:follow-
iag reasons:
1. Zero cost to the City for twa yeara (Aids bid $1);
2: Longer length of servica (35 years to 25 pears for Aids);
3. Two units dedicated.to the City (Aids offered one
dedicated unit); _
4. Superior backup capability. Adama has far greater back-
up, siace they servica more cities in our immediata
area. They also indicated a specific backup provider
ahould they not be able to respond.

AMENDING CAAPTER 12 OF THE LYNWOOD MUNICIPAL CODE FOR TIiE
PURPOSE OF ADOPTING THE UNIFORM FIRE CODE - I982 EDITZON WITH
AMENDMENTS
T$E CITY COIIDTCIL OF THE CITY OF I.YNWOOD FiEREBY DOES ORDAIN AS
FOI.LOWS :
SECTION T. . Sectiona 12-1 through 12-10 of the Lynwood
Municipal Code are hereby amended to read as follawas
° Sec. !2-!. Adoption of Uni£orm Fire Code.
The City of Lynwood hereby adopts for the
purpoae o£ prescribing regulationa governing
coaditiona hazardous to life aad property from
fire or explosion, that certain code known as
the Uniform Fire Code recommended by the
� Weatern Fire Chiefs Aasociation and the
International Conference of Building officials
being particularly the 1982 edition thereof,
and the whole thereof, save and except auch
por:.inaa as aze hereinafter deleted, modified
or amended by sectioa i2-7 of this Code, of
which code not less than three (3) copies have
been aad are now.filed ia the office of the
clerk of the city; and the.same are hereby
adopted and incorporated as fully as if set
out at length herein; and from the date on
�rhich this ordinance ahall take ef�ect, the.
provision thereof shall be controlling within ,
the limits of the City of Lynwood.
"Sec. 12-4. Eatablishment of limita of
diatricts in which storage of
flammable or combustible liquids
in outside aboveground tanks is to
be prohibited.
(a) The limits referred to in Section
79.SOl.of the Uniform Fire Code, in which
storage of fla�able or combuatible liquids in
outside aboveground tanks is prohibited, are
hereby established as fol2ows: No flammable
or combustible liquids shall be stored
anywhere within the city limita escept on - -� -
property zoned M by the zoning ordinance.�
(b) No new bulk plants for flammable or
combuatible liquids shall be located anywhere ``-
within the city limits eacapt on property
zoned M by the zoning ordinance.
"Sec. 12-5. Establish of limits in which bulk

ordinance.
"Sec. 12-6. Establish of limits of districts

"Sec. ]:•2-7. Amendments made in the Uniform
Fire Code.
The Uaiform Fire Code is amended and
chanqed in the following respects:
(a) Section 2.107 is amended to read:
� Sec. 2.107. Whenever necessary to make
an inspection to enforce any of the provisions
of th3a Code, or whenever. the chief or his
authorized representative has reasonab2e cause
' to believe that there esists in any building
or upon any premises any conditioa which makes
such building or premises unsafe, the chief or
his authorized representative may enter'such
building or premises at all reasonable times
to inspect the same or to perform any duty
imposed upon the chief by this Code; provided,
however, that no auch entry shall be made
unleas an inspection warrant authorizing the
same has firat.beea isaued.
Any other provision herein contaiaed to
the contrary notwithstanding, the chief or his
authorized representative may enter a building
or premiaes to inspect the same or to perform
any duty imposed upon the chief by this Code •
without the necessity of firat obtaining an
inapection warrant whenever the owner of such
building or pzemises apecificallg consents to
such entry or whenever the chief or his
authorized representative reasonably believes
that said building.or premises ia too
dangerous ae to aause an immediate danger to
human life or an i�ediate hazard to public
safety.
No person shall hinder or prevent the
chie£ or his authorized representative while
in the performance of his duties from entering
upon and into any and all buildings or
premises within the city.

(d) Sectioa 78.102(b) is amended to read:
(b) Eacept as agecifically hereinafter
provided and except ae-apecifically permitted
in Article II.of Chapter 12 of the Code of the
City of Lynwood, it shall be unlawful for any
perscn to posseas, atore, to offer for sale;
ezpoas for sale, aell at retail, or use or
explode any fireworks; provided that the chief
shall have the power to adopt reasonable rules
and regulatians for the granting of permits
for supervised public displays of fireworka by
a jurisdiction,. fair associations, amusement
parks, other organizationa or for.the use of
firewor3cs by artisans in pursuit of their .
trade. Ever sucn use or display shall be
handled by a competent operator approved by
the chief; and shall be oa such character and
so located, discharged or fired as ia the
opinion of the chief after proper
inneetigation, so as not to be hazardous to
property or eadanger any person.
(e) Sectioa 10.207(g) is added to read as
followas
(g) Fire.Lanes. In any location where
accesa.for f re apparatus for fire suppression
qr rescue purpoaes is unduly difficult or
subject to obstruction the chief may designate
such location a fire lane and cauae notice of
- auch to be posted at the location.
No person shall obstruct any fire lane in
any manner that wou18 deter or hinder:the fire
departmont from gaining immediate accesa and
use o£ such £ire lane..
(f) Section 10.301(f) is added to read as
followsa
(f) Automatic Sprinkler Systems. Any
aew building conatructed as a noa-reaidential
occupancy exceeding 10,000 aquare feet of
floor area; and any eaisting non-residential
buil3iag that present2y does not exceed 10,000
square feet of floor area, but after

completion or major alteration o� ddition
will ezceed 10;000 square feet of floor area,
shall be provided with an approved automatic
fire sprinkler system. Buildings classi£ied
as Group "A" Occupancies shall conform to
requirements in the 1979 Uniform Building
. Code, Chapter 38. Any automatic sprinkler
aystem installed pursuant herato shall be
equipped with an approved device that
automatically transmits a water flow alarm to
the fire department upon activation of the
system. Such an alarm's tansmission will be
in a manner aad form approved by the chief.
°Sec. 12-10. Penalti�s for Violation of This
Fire Code.
(a) Any person who shall violate any of
the provisions of this code hereby adopted, or
who shall £ail to comply therewith, or who
ahall violate or fail to coiaply with any order
made thereunder, or who shall build in
violat3on of any detailed statement of
spec�.fications or plans submitted and approved
- thereunder, or permit
issued thereunder, and from which no appeal
has been taken; or who shall fail to comply
with such an order as a£firmed or modified by
the city council or by a court of competent
jurisdiction; within the time fiaed herein,..
shall severally for each and every such
violation and noncompliance, respectively, be
guilty of a misdemeanor, punishable by a fine
of not lesa than fifty dollars ($50.00) nor
more than five.hundred dollars ($500.00) oz,by
imprisotuneat for not more than one hundred
eighty (180) days or by both such fine and
imprisonatent. The impositian of one (1)
penalty for any violation shall not excuse the
violation or'permit it to continue; and all
auch persons ahall be required to correct or
remedy such violations or defects within a
reasonable time; and when not otherwise
specified, each ten (10) days that prohibited
conditiona are maintained shall constitute a
separate offense. ,
(b) The application of the above penalty
shall not be held to prevent the enforced
removal of prohibited conditions or the .. _..
enforcement of other provisions of the code.°
SECTION 2 . . Severability . I£ any eection, subsection,
aubdiviaion, aentence, clauae; phrase or portion of this
Ordiance, or the applicaiton thereof to aay pezson or place, is
for any reason held to be invalid or unconstitutional by the
decision of any court of competent jurisdiction, such decisiton
ahall not affect the validity of the remainiag portiona of thia
Ordinance or its application to other persons or placea. 'I'he
City Council hereby declarea that it would have adopted this
Ordinance, and each section, subsection, subdiviaion, sentence,

that any one ore more sections, subsections, subdivisions,
sentences, clauses, phrases, or portions, or the application
thereof to any persoa or place, be declared invalid or

SECTION 3. The City Clerk is hereby authorized and
directed to,certify as to the passage of this ordinance and to
cauae the same Lo be published once in the Lynwood Presa, a
newspaper of general circulation, printed, published, and
circulated in the City of Lynwood.
