PUBLIC HEARIN6 - APPLICATION fOR ZONE CHANGE - 12401-12433 AND 12511- 12531 ATLANTIC AVENUE - CASE N0. 80043 Comment: On January 6, 1981, City Council approved projected adoption of Ordinances to rezone three lots in this block from CB-1 to R-3, � to allow development of two residential condominium projects. f- Public Hearings on those zone changes were held December 16, 1980. Most of the existing uses on the block are residential. Deve1- opers have expressed interest in renovating convalescent home and developing condominiums on southern-most lot in this block. Staff has been notified by both.Fire Chief and the Park Water Company � � that water lines in this area would have to be upgreded prior to �o_�������I development of the property. Planning Commission adopted Reso- �� 0 lution No. 725 on December 3, 1980 approving zone change. Recommendation: Council waive reading and introduce the attached Ordinance i approving the re-zoning of Lots 1, 2, 3, 4, 5, 11, 12, 15, and 16 of Tract 7099 from CB-1 to R-3. I g, PUBLIC HEARIN6 - APPLICATION FOR ZONE CHANGE - 3182 NORTON AVENUE/ 3183 � POPLAR DRIVE, LYNWOOD - C.4SE N0. 80040 � Cortcnent Subject property consists of two adjacent parcels one-half block j west of Long Beach Boulevard, each with a single-family home. At ( the time dwelling units were constructed, land uses permitted in the P-1 zone included single and multiple-Tamily dwelling units. � Since that time, the Zoning Ordinance has been amended to permit , V ��� only parking lots in the P-1 zone. Current Ordinance also allows 4 +I appurtenant structures for uses adjacent to P-1. Under present i (w�� regulation, dwelling units are non-conforming siructures and could not be rebuilt if destrayed. Property could be used only �� for parking purposes. Proponents have offered properties for j sale and have found that lenders will not finance sale since � property would have..little value if structures are destroyed. � Applicants have applied for re-zoning to a residential zone. � I I I � 1 L . � � Recommendation: Council waive reading and introduce attached Ordinance approving the change of zone from P-1 to R-2 at 3182 Norton and 3183 Poplar, Lynwood. 9. REQUEST FROM LYNWOOD SERVICES CORPORATION FOR AN AGREEMENT WITH THE CITY Corrunent On January 6, 1981, City Council directed the City Manager to review the request from Lynwood Services Corporation to have an agreement for services rendered at a cost to the City of $4,750 per month. The attached report examines the history of Lynwood Services Corporation, the financial participation of the City to date, the services being offered by Lynwood Services Corporation, the funding sources available for the requested fees, - and finally, various actions that the Council can take in regards to the request. Recommendation While the various alternatives listed in the report are based on current information, it should be noted that at the time this agenda was prepared additional meetings have been scheduled for informational purposes, including one with the Board of Lynwood Services Corporation. NEW BUSINESS 10. COUNCIL CONSIDERATION Of PROPOSED HOSPITAL-MEDICAL-DENTAL (HMD) ZONE - CASE N0. 80020 Comment Many cities have instituted a zoning designation permitting only hospitals and medical facilities within areas zoned according.ly.. Staff of St. Francis Medical Center is requesting a similar zone in Lynwood to which the hospital property could be re-zoned. As � 1 � � drafted, Ordinance would restrict land uses in the HMD zone to �•� hospitals, medical and dental offices, laboratories and ancillary uses which exist to serve the primary uses. Ordinance was reviewed by Planning Commission at its January 13, meeting. Recbmmendation Counci.l waive reading and introduce attached Ordinance for establishment of a Hospital-Medical-Dental zone. 11. COUNCIL CONSIDERATION OF AMENDMENTS TO THE MUNICIPAL CODE AND THE ZONING ORDINANCE REGARDING FENCE CONSTRUCTION Comment: Staff has received inquiries from occupants with commercial property wishing to improve security by installing barbed wire atop their fences. Presently, barbed wire is used only in the � -� industrial zones. Staff suggests that barbed wire be used in ` conmiercial zones under certain conditions. Proposed Ordinance (�'Q'�' allows barbed wire fences at least six feet in height, only at sides or rear of buildings, and be at least twenty feet from, t street rights-of-way. Recanmendation Council waive reading and introduce the attached Ordinance. 12. ADOPTION OF THE CURRENT UNIFORM BUILDING CODE AND AMENDMENT OF LYNWOOD MUNICIPAL CODE AS APPROPRIATE Comment: Purpose of the Uniform Building Code is to promote better construction and greater safety via a.uniform set of laws. Since its inception new editions have been published, the latest being � in 1979. State law requires that all agencies empowered to issue ^� building permits adopt the Uniform Building Code. Along with N,rY'" this requirement, agencies are given authority to amend the Code as needed. Sections of the Unifottn Building Code which need to be tailored to Lynwood's needs are those which establish administrative procedures and which outline fees for building permits. Recommendation: Council waive reading and introduce Ordinance entitled �An Ordinance of the City of Lynwood Providing for the Pro- tection of Public Health, Life and Safety Through Adoption by Reference tne Uniform Building Code (1979 Ed.) and Standards, 'Establishing the Building Department as the Controlling Authority, Adding An Appeal Procedure Exempting Certain Minor Work, Amending Sections 8.1, 8.2. 8.3, 8.4, 8.5, and 8.6 of the Lynwood City Code and Repealing All Other Ordinances or Parts Thereof in Conflict Herewith." i� • 13. AMENDMENTS TO THE CITY'S ANNUAL OPERATING BUDGET Comment: ?his Amendment is to insure that annual operating budget accurately reflects the actual expenditure and revenue ��� �� — � account numbers as they are used in everyday operations and accounting. Because grant programs do not necessarily have � �/ � 7 the same operating fiscal year as the City of Lynwood, there �� _� is a need to carry over Grant Accounts from one city fiscal year to another. The City's Accounting System must contain a mirrored reflection of the annual operating budget. To accomplish this, every account maintained by the accounting system must be included in the current year's budget. Recornnendation: Council adopt the attached Resolutions, appropriating funds to specify Grant Accounts. 14. EXCLUSION OF TWO VACANT MANAGEINENT POSITIONS FROM THE CLASSIFIED SERVICE Comnent: Council has established an unclassified personnel system for grant and funded management positions. Management positions have been reviewed and designated by Council as exempt from classified service as vacancies occur. The positions of Utility Service Supervisor and Senior Building Inspector (now vacant) should be excluded from the classified service. Recommendation:. Council adopt the attached Resolution entitled "A � ��, � Resolution of the City Council of the City of Lyhwood Designa- ting the Positions of Utility Service Supervisor and'Senior Building Inspector as Excluded from the Classified Service." i5. CONTRACT FOR PRE-PLACEMENT AND PERIODIC PHYSICAL EXAMINATIONS Corrunent The City has used Tweedy Medical Group in South Gate since 1975. Service was unsatisfactory. Staff conducted tours of four other facilities, one of which was St. Francis Medical Center. St. Francis Medical Center will offer City the best service with a highly trained professional staff. The contract has been reviewed and approved by our City Attorney. Recommendation That Council approve and authorize the Mayor to execute a � contract between St. Francis Medical Center and the City of �� Lynwood for the City's pre-placement and periodic physical examination program. 16. PAYMENT OF BILLS - WARRANT REGISTER DATED JANUARY 20, 1981 Recommendation: Council approve payment of Warrant Register dated �� �� �� January 20, 1981. ROUTINE BUSINESS I THE COUNCIL MAY WITH A SINGLE MOTION ADOPT ALL ITEMS AS RECOMMENDED IN THIS SECTION 17. ECONOMIC RE50URCES REQUEST FOR BUSINESS LICENSE EXEMPTION Comment: The Economic Sources Corporation is requesting that they be granted the business license exemption. They have received ��� �� a letter (attached) from the Internal Revenue Service veri- i fying their tax exempt status as a Section 5D1(c)(3) charitable organization. 18. FIREFIGHTERS ASSOCIATION'S REQUEST TO PUT ON VARIETY SHOW Comment: The Lynwood Firefighters Association is requestin� permission to put on a variety show. These shows have been sponsored by � �� the Association for the past four years. Proceeds from the � G�jQ show will enable the Association to donate to various charities UV within our.community and perpetuate our Firemen's Association. PUBLIC ORAL COMMUNICATIONS • ADJOURNMENT Motion to adjourn to the Regular Meeting of the City Council of the City of Lynwood to be held February 3, 1981> at 7:30 p.m., in the Council Chamber of City Hall, 11330 Bullis Road, Lynwood, CA 2 a 4 REGULAR MEETING JANUARY 6, 1981 The City Council of the City of Lynwood met in a regular session in the City Hall, 11330 Bullis Road, on above date at 7:30 p.m. Mayor Green in the chair. Councilmen Byork, Morris, Rowe, Thompson and Green answered the roll call. Also present -were City Manager Weaver and City Attorney Murphy. SCHEDULED MATTERS It was moved by Councilman Byork, seconded by Councilman Thompson, and carried, that the minutes of the regular meet- ing of December 16, 1980 be approved as written. Pub.Hrg. The Mayor announced that the time had arrived to conduct Weed Abate. public hearing on proposed abatement of weeds at the follow - ing locations: Lot 6, Tract 14551; Lot 40, License Survey - or's Map; Lot 72, Tract 4936 and Lot 73, Tract 493 The City Manager presented his report and informed Council that notices of public hearing had been mailed to the affected property owners. The Mayor inquired if anyone present wished to speak for or against the proposed abatement. Mr. Bob Downs, 3920 Carlin Avenue, stated that the weed abatement program has been a failure, particularly in the area in which he resides. He stated he has complained on several occasions regarding the lack of weed abatement on Mr. DeWitt's property. Mr. Downs expressed dissatisfaction with the City Administration's public relations. The Mayor inquired if anyone else wished to speak in favor of or in opposition to the proposed abatement. There was -- no response and the hearing was closed. Res. 81 -1 RESOLUTION NO. 81 -1 entitled: "A RESOLUTION PASSING UPON Direct.Weed OBJECTION AND DIRECTING THE SUPERINTENDENT OF STREETS TO Abate. Noes: None. Absent: None. Lynwood Serv. The City Manager presented a letter from Lynwood Services Corp. Corporation requesting the City to enter into a formal discussion agreement for certain services. Councilman Morris recom- mended that staff be directed to prepare a contract with Lynwood Services Corporation setting forth the terms and conditions under which certain services would be rendered and specifying a dollar amount. Councilman Rowe recommended that the $42,000 shortfall could be obtained by deferring expenditure of $255,000 budgeted for seven items which are not high priority items. Councilman Thompson stated,he` had concerns about expending $42,000 over the next nine months. He further stated he is not in favor of'using revenue shar- ing funds for ongoing expenses. Councilman Rowe inquired if Council is willing to accept the Opinion. The City Attorney explained his .intterpretation,- ofl:Government. Code 013 Councilman recommended that the issue be tested in court and court costs be borne by the City. The Mayor stated that Council has no problem. Councilman Rowe advised that he will have the issue resolved by the court. FACTS For the purpose of this report it is necessary to examine five basic areas in regards to Lynwood Services Corporation. These are: (1) History of LSC (2) Financing of LSC (city's participation) (3) Services offered by LSC (4) Funding sources (5) Alternatives At the conclusion of each section a brief summary is provided for clarification. Sources of information include an item which was an attachment to the May 9th 1980 Newsletter, interviews with County Staff, Board Members, and prior budget documents. I. HISTORY OF LSC Lynwood Services Corporation was formed on March 17, 1978. The Corporation was formed initially to receive an assign- ment of the then existing CETA contracts between the City of Lynwood..and the County of Los Angeles. The decision for the City to discontinue its sponsor- ship of the CETA program was based on several major consid- erations. The first consideration was the continuing and expanding liability exposure of the City. With the many changes in eligibility and length of employment 11 _._._r t.. ---1A L... ...... .,t, ,-1 +-Ps ,* +-ko n“mE,or of Wnrlr- The second consideration in this decision was the change in CETA regulations relative to the amount the City would be able to subsidize CETA salaries. Under old CETA regulations, the City could charge $833 a month of a participant's salary to CETA, and subsidize that salary to any rate the City felt desirable. The new regulations will only allow a subsidy of 10% above the maximum CETA salary $915 a month. Initially this change could have cost the City between $2,500 and $3,500 each month. After a longer period this change would have necessitated a complete revision of the City's classification and salary plan. The third consideration in this decision was the possible liability to the General Fund for the cost of continued PERS benefits for CETA participants. At the time of the assignment a major change in the CETA regulations disallowing the expense of a retirement system for CETA participants was under discussion. The current regulations will pay the costs of Social Security for participants, but no new participants may be enrolled in the PERS system. The last consideration in this action not only benefited the City, but was for the direct benefit of the CETA participants also. At the time of assignment, the possibility of the passage of Proposition 13, was almost a certainty. As you are aware, after the passage of Proposition 13, a number of employees on City payroll were laid -off. If the City had been nnarat;nn the rFTA nrnnram at that time. all but two BUDGETARY HISTORY On April 4, 1978, the City Council agreed to loan the Lynwood Services Corporation $25,000 to meet all obligations for the month of April. In late April, the Lynwood Services Corporation received its first advance from the County of Los Angeles and repaid the $25,000 loan on May 8, 1978. The Los Angeles County Board of Supervisors, in re- sponse to requests from the Lynwood City Council and the Lynwood Services Corporation approved an assignment of the City's CETA contract to the Lynwood Services Corporation. Prior to the Board's action, represent- atives from the City, Lynwood Services Corporation, Los Angeles County Department of Community Development and the United States Department of Labor met to discuss the proposed assignment of contract. The position taken by the County and the Department of Labor rep- resentatives was supportive of the transfer, with one qualification. They felt that all CETA employees who would be required to accept a reduction in pay, as a result of the assignment, should be given a three -month period, in which to obtain unsubsidized employment, be- fore the reduction would become effective. (One of the CETA employees, while working for the City, was being paid as much as $1,335 per month. As a result of the assignment, his salary was reduced to $833 per month). The City representatives, and subsequently the City Council, agreed to pay the Lynwood Services Corporation $4,000 per month for the period of April through June to subsidize salaries. However, due to hiring freezes, declared by the Depart- ment of Labor, the Lynwood Services Corporation was never able to employ more than seventy persons. The budget for program administration at the time of assignment was $89,000 or slightly more than $14,800 per month. This relatively large administrative budget allowed the Lynwood Services Corporation to enter into two agreements with the City of Lynwood. A tenancy agreement was executed that was in force from April, 1978 to December 31, 1978. This agreement called for Lynwood Services Corporation to pay the City $700 per month for rent, telephones and utilities. A second agreement was executed for the rental of four motor vehicles. This agreement covered the same time period and called for the Lynwood Services Corporation to pay the City $1,830 per month. The rental of motor vehicles from the City was done for two reasons. Firstly, the vehicles were important to the Corporation in order to allow it to continue cleaning alleys and painting graffiti. Secondly, it was inportant to the City to continue to receive funds in order to pay off the re- maining balance on the lease of the vehicles. In October of 1978, the County of Los Angeles granted the Lynwood Services Corporation a three month extension of its then existing CETA contracts. The budget for this three month extension was $259,020. Of this amount, a total of $21,440 or $7,146 per month was for program ad- ministration. As can readily be seen, the Corporation's Administrative Budget was cut to approximately 48% of In January of 1979, the Lynwood Services Corporation and the County of Los Angeles executed a nine -momth contract for the operation of the CETA PSE Title IID and Project VI programs. The total budget allocation for these two programs was $612,093, of which $27, 643 or $3,071 per month was allowed for program administration. The Administrative Budget allocation was cut this time to 21% of the April 1978 amount. At that time, the con - tractural agreements between the Lynwood Services Corp- oration and the City were again discussed with Mr. Valliere. The points covered in this discussion were the budgetary constraints placed on the Corporation by its limited administrative allocation, the amount of work being performed by the Corporation for the benefit of the City, the amount of money saved by the City by having Corp- oration personnel perform certain duties, such as Crossing Guards, and the overall increase in City liability if the CETA programs were to be operated by the City. As a result of these discussions, Mr. Valliere agreed to lower the amount paid for motor vehicles by $400 per month. This agreement was to be reconsidered after its expiration date of March 31, 1979. On May 1, 1979, the Lynwood Services Corporation re- ceived a grant in the amount of $49,983 from the Community Services Administration to operate a "Handy- man" home repair program for City property owners. Money from this grant was allowed the Lynwood Services Corporation to continue to compensate the City in the amount of $509.50 per month for rent and utilities. It was the Corporation's and Mr. Valliere's opinion that This year's budget allows for a total funding level of $468,820 of which $25,684 of $2,140 per month, is allowed for administrative ex- penditures. This decrease in administrative allocation lowered the Corporation's Adminis- trative Budget to 14.5% of the April level. The current situation is that Lynwood Services Cor- poration has paid no rent, nothing for telephone and utilities or vehicle use since January 1, 1980. In May of 1980 City Staff began to prepare two Grant applications from C.S.A. One was a continuation of the expiring funding program and the other was for an additional $110;072 for pro- ject H.E.L.P. Both projects were turned down and the appeal process was started. In review- ing the application rating scores it appears that the site visit was the major factor for denial, receiving only a 44% figure. An appeal was prepared and mailed on November 6, 1980. This appeal is availabel in my office for your review. In conversations with the County it is not clear where the process concluded, how- ever, the two applications were denied. SUMMARY It appears that the City supported the creation of the L.S.C. for the purpose of reducing administration costs and liability to the City. The Federal Government has reduced funding of this program significantly since its conception (654 %) to the point where zero funds were made available to L.S.C. I have been in- formed by the County Officers that they are reviewing the C.S.A. Grant Application once again due to the increased interest in the W r.1 frnm thn rnii'nty ('nmmlinity Antinn Ananrv. During a twenty -one month period between April 1978 and December 1979, the Lynwood Services Corporation employed a total of one hundred and fortyseven (147) people. Of this number, fifty -three (53) people were laid -off due to the ex- piration of their eighteen months on the CETA program; eight (8) people resigned without having a job; twenty -six (26) people were terminated for cause and forty (40) were still employed by the Corporation on December 31, 1979. II. CITY'S INVOLVEMENT (Financially) The above history of the program indicated par - ticiaption by the City in funding certain supplies and salaries. The chart below identifies the amounts and the funds used in support of the L.S.C. Program. All other services and programs provided by LSC would be considered elective on the part of the City and if funding sources could not be located, would have been deleted. The chart below illustrated the savings to the City generated by the administration of the Crossing Guard Program by LSC for the past three years. .SUMMARY During the past three years the City has experienced .a short- fall of $26,628 due to the LSC Program. However when you compare the cost the City would have had to incur in relationship to the School Crossing Guard Program, the City has actually saved approx- imately $45,872 to date. ($72,500 - 26,628) LSC has also provided the City with furniture and equipment, however these supplies were for the use of LSC employees and are therefore not required by the City. III. SERVICES OF LSC In a memo of 12/16/80 LSC has offered to provide the City a total of seven (7) employees 32 hours a week as part of an agreement. The services listed in- clude street patching, alley clean up, and graffiti re- moval. Staff has reviewed the above mentioned services and has determined that graffiti removal is by far the most critical area in need of action. The alley clean up and street patching are services already provided by City crews, and their performance since July of 1980, when these two crews were created, is very good. Other services not mentioned in the 12/16/80 memo but implied are: Six positions in the City Departments assigned to the following areas, 2 Garage 2 General Services 1 Planning 1 Housing Rehabilitation 6 Total And the Crossing Guard Program which has a total of nine positions of which One is funded out of the City's general fund. SUMMARY: IV. FUNDING SOURCES As discussed previously with Council the term of the proposed agreement should only continue un- til June 30, not the September 30 date stated by LSC. At $4,750 per month plus the funds required to purchase paint ($6,000). The total amount required for the six month period is $3 In response to inquiries by one Councilman re- garding the use of funds already appropriated in the current budget, the following should be con- sidered: (1) The capital projects mentioned have already been i.nitiatedz*in = -as far as design stages. The reduction of funds appropriated to these projects would require the City to shelve them until the next budget. (2) The funding sources for a few of the items mentioned have restrictions on the type of goods and services that can be acquired. (3) A complete management training pro - gram has been laid out for this cur- rent year and any delitions would result in lowering the effectiveness of the total program. As you are aware, the economy has had a negative impact on the City in terms of revenues. Sales tax revenues are lower than anticipated along with taxes re cieved from transfers of home ownership. (This appar- antly is due to high interest rates). One positive impact the economy has had on revenues is the high return on investments. Taking both factors into account staff projects a shortfall of $158,900 in the general fund as compared to 80 -81 budget revenue estimates. The Revenue Sharing Fund has a projected $300,000 balance at year -end. It has been the direction of Council to utilize these funds for capital expenditures and not for on going expenses such as labor or services. This policy is excellent_ in'the sense that .revenue sharing is having increasing difficulty in passing in Congress, and many legislative analysts see an end to the program in two years. Other grant funds might be utilized for this program including ; Anti - litter Grant Funds, Bicycle Safety, Pedestrian Safety Programs and alike. Staff is currently reviewing these programs to see if any could apply to LSC.. As explained earlier City Staff has prepared Grant Applications in the past for LSC and is willing to con- tinue this policy. SUMMARY The LSC has requested $42,750, however this amount represents funding thru September 30, 1981. In order to be consistant with the City's budget year, the total amount thru June 30, including paint supplies is $34,500. The General Fund and the TRAFFIC Safety Fund both of which would be logical funding sources for the proposed programs are experiencing a shortfall in revenue. Revenue Sharing is available, however, the use of such funds is not consistant with prior Council policy. Staff is currently looking at Grant Programs that may be available for this project. THE CSA - FUNDS THAT THE LSC. DID NOT RECEIVE ARE APPARENTLY AVAILABLE AGAIN, STAFF HAS AHD CON- VERSATIONS WITH THE INDIVIDUALS INVOLVED WITH THESE FUNDS AND HAVE RECEIVED INFORMATION THAT $20,000 MIGHT BECOME AVAILABLE_ IN TWO WEEKS. V. ALTERNATIVES Certain individuals involved with LSC have com- municated that if the City did not fund the necessary $42,750, the program would be eliminated. It is While LSC is proposing to increase the services in the City (7 employees for street repair, graffiti etc.) The determination that these services are infact required should first be made. As mentioned earlier graffiti is on the increase and Staff has identified the eed for in- creased eradication of graffiti. Staff has also determined there has been an improvement in alley clean up and street repairs. Therefore in reviewing the services offered by LSC in the 12/16/80 memo all seven positions should be assigned to graffiti. The following is the relationship of those services offered by LSC and the City's minimum in staffing re- quirements. To make a comparison of annual cost the LSC costs should be converted: 4,750 x 12(months) = 57,000 Vehicles maintenance + utilities = 22,000 79.000 * This is assuming that LSC would NO longer exist. How- ever, its Staffs opinion that some programs will continue, and thus will still require the buildings on Lynwood Road and Redwood along with vehicles. The above analysis indicates that whether the City enters into an agreement with LSC or provides the nesessary services on its own, there is a substantial cost to the City, and as indicated before, funds are limited. While the analysis indicates all "hard" dollars, the impact of administrative time has been excluded. In both cases an an equal amount of time is required, however less would seem likely with LSC providing the services. Based on the information listed above the following steps can be taken: ( or any combination) A. Direct staff to pursue the CSA grant process and ensure to the best of the City's ability that any other granting agency be contacted that might fund LSC. An agreement between the City should also be drawn up as the City does in fact provide approx- imately $22,000 per year in vehicle, and utility costs. Included in the agreement should be the following: (1)Only the vehicles listed in agreement shall be used by LSC. (2)Consistant with Council action of May 20, 1980, office space will no longer be available for LSC staff. (3)A11 LSC employees assigned to a City Department will be under direct supervision of that Department Supervisor. (4)A list of all positions assigned to the City along with a replacement clause (5)That complaints recieved whether verbally or in writing, relating to programs B. Direct Staff to enter into an agreement for 4,750 per month using revenue sharing funds, with LSC and include those items listed above with the addition of the following items in said agreement. (1)Work orders will be utilized by LSC showing work accomplished along with work scheduled. (2)Purchasing procedures of the City to be followed when City funds are in- volved. (3)Monthly review of work accomplished by City Manager or designee with report sent to both Board Members and Council C. Direct Staff to prepare budget for Administering Crossing Guard Program along with other positions that might be required due to lack of CETA employees. Corporation agrees to provide two employees thirty -two hours per week each to provide street patching services for City. 2. Corporation agrees to provide three employees thirty -two hours per week each to provide alley cleaning services for City. 3. Corporation agrees to provide two employees thirty -two hours per week each to provide graffiti removal services for City. 4. City agrees to provide all materials necessary to perform functions as listed herein. 5. City agrees to provide Corporation with the sum of FOUR THOUSAND SEVEN HUNDRED AND FIFTY DOLLARS ($4,750.00) per month to offset the administrative costs of Corporation. The Board also approved Management's position that the Corporation will continue to provide Cross- ing Guard services to the City for as long as its Federal funding will allow. It is the Lynwood Services Corporation Board of Directors' opinion that the above listed terms of the proposed agreement are mutually advantageous. The Board feels that its relation- ship with the City has been highly satisfactory over the past three years and that this proposed agreement will continue that relationship. Barbed wire is presently permitted onLy in the industriaL zones,. and staff suggests that it be aLlowed in commerciaL zones under certain conditions. Simultaneousty, staff proposes the repeat of those regulations in the City Code governing fence construction �vhich are dualicated ia the Zoning Ordinance. SNALYSIS The proposed Ordinance allows barbed wire atop fences at teast six (6) fee± in height. Barbed wire is permitted only at the sides or rear of buildings, and must be at least twenty (20) feet from street rights-of-way. On1y straight, taut barbed �vire may be used; coiled barbed �vire is prohibited as are concer- tina wire and razor wire. Staff is in the process of revising and codifying the Zoning Ordinance. Since its inception in 1927, new editions have been published approximately every three years. The Latest edition was copyrighted in 1979. State law requires that all agencies empowered to issue building permits adopt the UBC and all amendments or new editions thereof. Along with this require- ment, agencies are given authority to amend the Code as needed to suit the localities' needs. The staff of the Building Department has reviewed the current edition (1979) and is requesting that Council adopt it with several changes thereto and with certain attendant amendments to the Lynwood Municipal Code. ANALYSIS The sections of the UBC which need to be tailored to Lynwood's needs are those which establish administrative procedures and which outline fees for building permits. The changes suggested by staff are: A. Right of Entry - The procedure contained in the UBC is vague and in some areas too restrictive as to the authority of the building in- spectors; a simplified, more efficient method is proposed. B. Unsafe,Buildings - The UBC is not extensive enough in this area to answer the needs of Lynwood. The changes proposed by staff de- lineate procedures for abating unsafe buildings and for notifying the landowners and tenants of such abatement. C. Inspections - This section is enhanced by the addition of a pro- vision allowing the building inspector to prevent the connection of utilities in a structure until final inspections have been made and approval for occupancy has been issued. D. Work exempted - The list of types of work to be exempted from building permit requirements is expanded to include tents (when used three (3) days or Less) and cranes ( and other similar equip- ment when not part of a building). E. Fee Refunds - The UBC bestows . fee refunding authority on the building official and staff prefers to have that authority within the City Manager's office. AGENDA ITEM F. Non - Public Records - This section prevents city staff from re- vealing information on file which -- under the law-- does not con - stitute a public record. Amendments to the Lynwood Municipal Code will promulgate the follow- ing: • Procedures whereby an applicant may go before the City Council if he or she wishes to appeal a decision of the Building Department; • Fire zones for the entire City; • Violations defined as infractions; Fee schedule for building permits outlined.
