CALL TO ORDER Chairman Breazeal called to order the regular meeting of the Planning Commission of the City of Temple City at 7:30 P.M., February 11, 1975. 2. PLEDGE OF ALLEGIANCE Chairman Breazeal led the Pledge of Allegiance to the Flag. 3. ROLL CALL Present: Commissioners Atkins, Clark, Lawson, Stacy, Breazeal Absent: Commissioners - None Also present: Asst. to City Manager Biel, Planning Director Dragicevich and Assistant Planner Richards. 4114. APPROVAL OF MINUTES: Regular Meeting of January 28, 1975 There being.no additions or corrections to the minutes,. Commissioner Stacy moved they be approved as written. Motion was seconded by .Commissioner Clark and passed. by roll call vote with Commissioners Clark, Stacy and Breazeal voting affirmative,,and Commissioners Atkins and Lawson abstaining. 5 PUBLIC HEARING: TEMPLE CITY'S PARTICIPATION IN HOUSING AND COMMUNITY DEVELOPMENT ACT OF 1974 The Planning Director. referred the Commissioners: to summary of the purpose, objectives, activities. and. application. requirements of the Act... He explained that Temple City. and other cities under 50,000 population would not receive funds directly from the federal govern- ment, but through the County.. The first year Los Angeles County will receive 14 million dollars and the Board, by resolution, agreed to share their funds on an equitable basis with, cities under 50,000. City. Council authorized. the Mayor and. City Clerk to. sign a cooperative agreement with the. County to. enable.participa.tion with the County " provided a supplemental agreement is developed specifying an exact program for.. first -year funding. Asst....to.City Manager .Biel outlined. the.. program. in some detail and answered.ques.tions. . He listed some of the eligible. activities the City can consider. to qua.lify.for funds,. that this Act combines the . activities. of 6 funding: agencies for the distribution of funds. One of. the criter.ia..imp.osed.upon cities requesting this funding is that two. pubiic..hearings..be..held.prior to submitting an application, which .is the purpose_of the hearing tonight. Commiss ..ioners.Atkins_and.Breazeal expressed concern that this evening's public. hearing...would.not result. in. ade.qua.te. citizen input inasmuch as no program for Temple. City was prepared. under the funding requirements of the. act.... ..It.was..explaine.d.that.there would be future public hearings and Citizen-participation would be encouraged as the program developed. . The: fir.s.t..year. funds., if .approved, would. be used for planning a program for the Ci.ty.. Because-of a very. tight deadline, the City Council had .to authorize. the Mayor and..City Clerk to sign a cooperative agreement, and also., because. of..deadlines, .it was necessary to schedule two public .hearing.s_immediately. These requirements were mandated from Washington, " .D..C., and .while .they.were not practical, Mr. Biel continued, the cities had to comply to be eligible under the Act. Commissioner.Atkins._sta.ted.he was against seeking funds that should have been left in the community in the first place. . 6. COMMUNICATIONS Chairman..Breazeal referred to. letter sent by City staff to the Reginnal Planning.Commissio-n opposing a. proposed Tentative Parcel Map No. 5610, .located. within the sphere.of influence of. Temple City. The Commissioners commended the Planning Director for opposing the Parcel Map for reasons . which reflected their. dissatisfaction with it. TIME FOR THOSE IN THE .AUDIENCE WHO WISH TO SPEAK - No one came forward. . Commissioner. Atkins,. at. 8:10.p.m.,, moved. to.recess the Planning Commission meeting. and meet.. as. the. Relocation. Appeals Board of Temple City Community Redevelopment Agency. Motion was seconded by Commissioner Clark and passed. 0 The Board members considered. a. relocation complaint from Howard B. Campbell, 8847 E. Live Oak Avenue, and set the matter for public hearing for February 25,1.975. They. further moved. to. consider an amendment to the By -Laws, Section 4.05, of the. Relocation Appeals Board,. submitting written notice to the City Council of the proposed amendment in accordance with Section 500 of the By -Laws. There being. no further business., Commissioner. Atkins made a motion, seconded by Commissioner Lawson.and. carried.,. to adjourn as the Relocation Appeals. Board and.reconvene as the Planning Commission. 07. 1 *8. 1 MATTERS FROM CITY OFFICIALS (a) • .Set Public Hearing to Determine Existence of Public Nuisance 10659 Daines Drive Direc .tor.Dragi.cevich..referred to communication from the City Manager .re.the. subject. property, the. .condition. of. which has been noticed by s,taff.for. some time. in. the past. . He reviewed the conditions existing on the .property contrary to Section 9480 of the Municipal Code, and methods of abatement -. .Mrs.. Helen. Ofn.er.,..owner, 3105 Farnsworth. Avenue, Los Angeles, addressed the. Cornmissio.n., .saying .tha.t.because of ill health, and the recent in- clement weather, .she was..unable.to correct the conditions listed for abatement... She .had .rented. the property at 10659. Daines Drive to people • .who were.. not. responsible. and they caused much exterior damage. She intends. to.. cooperate. with the City,. and. asked. for an extension of time .to.accomplish..the necessary.work.. Her tenants moved out January 18,1975, and. she. asked. for 30. days'. extension before..the..- Commission considers setting. public. _hearing.., . The. Commissioners were in. agreement that, if the. owner. would cooperate. with. the City. in. correcting objectionable conditions that..exis.t.oh .the.proper.ty., they would be willing to post- pone. setting_ public. hearing.. f or .6 weeks., or. until the regular meeting .of March. 25, 19.75..... " The Director. further. pointed out. that the Uniform Building Code requires. , only: 3: ft, .setback s.e.tback (with fire. wall) whereas the Municipal Code. requires 5. ft. ,. and. the Cdiuiissioners may wish to consider chang- ing .the Municipal Code to be consistent with the Building Code. The Commissioners..were in agreement that the Committee's decision was acceptable, and, felt there was no need to modify the Zoning Ordinance. This case .had unique .circumstances, (c) New.Planning and Engineering Aide Chairman Breazeal informed the Commission that the City had employed the services of Michael Wrona as Planning and Engineering Aide. It was hoped Mr. Wrona would be present this evening, but Director Dragi- cevich explained his absence was due to illness. II9 . ADJOURNMENT_ There being no further. business, Commissioner Atkins made a motion, at 8:45 p.m., seconded by Commissioner Stacy and carried, to adjourn the meeting. 1 "
