CALL TO ORDER Chairman Breazeal called to order the regular meeting of the Planning Conaaission of the City of Temple City at 7:30 P.M., February 25, 1975. 2. PLEDGE OF ALLEGIANCE Chairman Breazeal led the Pledge of Allegiance to the Flag. 3. ROLL CALL • 4. 1 Present: Commissioners Atkins, Clark, Lawson, Breazeal Absent: Commissioner Stacy Also present: City Manager Koski, Asst. City Attorney White, Planning Director Dragicevich and Asst. Planner Richards. Chairman Breazeal announced that Commissioner Stacy would be late in arriving at the meeting due to conflicting commitments. APPROVAL OF MINUTES: Regular Meeting of February 11, 1975 There being no additions or corrections to the minutes, Commissioner Clark moved they be approved as written. Motion was seconded by Commissioner Atkins and carried. Included in these minutes were the minutes of February 11, 1975, for the Relocation Appeals Board. Chairman Breazeal announced that the Commission had set for public hearing for this evening an item not on the agenda which would be heard presently under Old Business. OLD BUSINESS: PUBLIC HEARING: ABATEMENT OF ABANDONED AND NONCONFORMING CURB CUTS AND DRIVEWAYS The Planning Director gave the background data on this item, saying the Traffic Commission originally had raised this issue for the follow- ing reasons: 1) abandoned and nonconforming curb cuts contribute to front. yard parking violations, 2) curb cuts eliminate. 20 -40 lineal feet of on- street, parking at each. location, 3) many of these curb cuts are difficult to maintain,. and 4) unimproved curb cuts pose hazards to pedestrians. It is..estimated that over :200 of-these curb cuts exist in. the.. City. Public Works.and Planning Depar.tmen.ts..are: working closely .whenever, a new permit for garage. or driveway apron is requested in order to assure that .these curb cuts. are removed or not constructed. `Chairman Breazeal referred to the.proposed ordinance which would require comp.liance :within 90 days, and he considered this short time unreasonable.: The. City. Attorney replied compliance must be tied to the date the ordinance becomes effective The Commissioners were•fur- ther informed.tha.t no. letters would be sent out to property owners with nonconforming. curb cuts and. driveways, rather, compliance:would be re- quired following complaint. The City had no intentions of issuing citations.. Commissioner Stacy arrived at 7:45 p.m. There being.no further questions., the public hearing was declared open. No one. came forward to. speak. to. the issue, therefore Commissioner Atkins moved to close public hearing, seconded by Commissioner Clark and the motion carried. In. closed discussion the Commissioners were•in agreement that the draft •of the proposed ordinance reflected their intentions in this matter, and .having such an. ordinance. will enable the. City to solve the problem of obsolete curb cuts and. illegal driveways. Commissioner Atkins made a motion, seconded by Commissioner Lawson and passed, to recommend to. the City Council an addition to the Municipal Code relating to abandoned driveways and nonconforming curb cuts. City Attorney White read title to Resolution 75- 607PC, A RESOLUTION F THE PLANNING COMMISSION OF THE CITY OF TEMPLE, CITY RECOMMENDING TO THE CITY COUNCIL THE ADDITION OF NEW SECTIONS.9296.1, 9296.2 and 9296.3 TO THE TEMPLE CITY MUNICIPAL CODE RELATING TO DRIVEWAYS AND CURB CUTS. Commissioner Lawson moved to waive further reading and adopt, seconded by Commissioner I tkins and carried unanimously. PUBLIC HEARING: MODIFICATION OF CONDITIONAL USE PERMIT NO. 74 -416 Bill Nikolopoulos and George Zamanis -Owner /Applicant 6933 Rosemead Boulevard San Gabriel, Calif. Site: 9202 East Las Tunas Drive Request: Modify Resolution No. 74 -561PC with respect to the architectural appearance and floor plan of the original plan. The Planning Director gave the background of this case, saying it was approved on June.11, 1974, then the property changed ownership and the • new owners are proposing to modify the plot plan. He referred to Exhibit "A-1", the new plot plan and explained the major changes, and Exhibit "B -1" the new floor plan, and Exhibit "C ", a rendering of the remodeled structure. All conditions of. Resolution 74 -561PC granting the original conditional use permit will apply if this case is approved. In answer to questions .: from the Commissioners, the Director said 350 sq. ft. of storage space has been added and the seating capacity has been reduced, and that there is only one door in the front and one in the rear. The second story will be used for .storage and for employees' use. There being no further questions, the public hearing was declared open. Mr. John Giakas, contractor for the applicant, 453 Fairview Avenue,Arcadia, in answer to question from Commissioner Atkins, said the door in the rear was not for public use, but for emergency and service. There'being no further testimony, Commissioner Atkins moved to close public hearing, seconded by Commissioner Stacy and the motion carried. Commissioner Atkins, in closed. discussion., said there was no drastic change from the original. plot plan which the_ Commission approved. The storage area will act as a sound barrier to the apartment next door. Commissioner Stacy agreed, adding that he felt the modification request met requirements. Chairman Breazea-1 .- said,,.he: wondered .'why- the - LLapp,lacant was . required to come before" the Commie`s -s-ion a:s' .tha:s :change :was -hardly a "''substantia1"' one as specified in the Code to require a. modification hearing. Commissioner' Atkins moved to approve modification as it meets the criteria for granting, having adequate access to public streets, is not injurious to other properties, and the property is adequate in size, shape and topography for the proposed use. Motion was seconded by Commissioner Clark and passed unanimously. Asst. City Attorney White read title to Resolution 75- 608PC, A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TEMPLE CITY GRANTING MODIFICA- TION IN CONDITIONAL USE PERMIT CASE 74 -416. Commissioner Stacy moved to waive further reading and adopt, seconded by Commissioner Lawson and the motion passed. 06. PUBLIC HEARING: CONDITIONAL USE PERMIT CASE NO. 75 -433 Violet E. Smith, Trustee, Star Route 2, Box 383 Dexter, Oregon . 1 1 PLANNING COMMISSION MINUTES MEETING OF FEBRUARY 25, 1975 Alex Avouris - Applicant 9217 Wedgewood Temple City, Ca. Site: 5850 Cloverly Avenue Director Dragicevich.gave the staff report, saying the applicant proposes to establish and operate a small fast food, take -out restaurant (snack bar.) in a C -1 zone. He referred to the plot plan marked Exhibit "A" showing the proposed site which includes kitchen facilities and a counter, gave the factual data on the property and reviewed the staff proposals if the request is granted. There will be no eating at tables in the establishment; there would be some seating available for the comfort of customers waiting for take -out food., There being no questions from the Commissioners, the public hearing was declared open. Mr. Alex Avouris, applicant,. 9217 businesses in Temple City area in . at his establishments at any time to 6:30 - 7:00 p.m. There being no one else to speak to the issue, Commissioner Atkins moved to close the public hearing. Motion was seconded by Commissioner Clark and it carried unanimously. In closed discussion the Commissioners were in agreement that the request met the criteria for granting a conditional use permit. It was adequate in size, shape and topography for what the applicant proposes to use it, has adequate access to public parking and streets, and will not be in- jurious to surrounding properties. Commissioner Lawson moved to grant Conditional Use Permit 75 -433 with staff conditions for the reasons men- tioned. Motion was seconded by Commissioner Stacy and passed unanimously. Asst, City Attorney. White read title to Resolution 75- 609PC, A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TEMPLE CITY GRANTING CONDITIONAL, USE. PERMIT IN CASE NO. 75 -433. Commissioner Stacy moved to waive further reading and adopt, seconded by Commissioner Atkins and the motion passed. 1 PAGE THREE Wedgewood, said he had a couple other previous years., and had no trouble . TO .REHABILITATION :APPEALS BOARD The .Planning Comaniss.ion.recessed at 8-:15 p.m, to meet as the Rehabilita- tion Appeals...Board :,.all members being present. Minutes of the previous meeting had been. approved earlier in. the evening along with the Planning Commission minutes'of.February 11, 1975. Rehabilitation Appeals Board Case. 75- 01.was. considered_ by. the Board and Resolution RAB 75 -01 was passed.denying.same. The Board considered amendment to By -Laws of the Rehabilitation Appeals Board and passed. Resolution RAB 75 -02 recommend- ing amendment to the Agency. Minutes are set forth in full in the minutes. of.the Board. • RECONVENE AS THE. PLANNING COMMISSION 9. MATTERS FROM CITY OFFICIALS (a) Set Public Hearing to Determine Existence of Public Nuisance - 9553 Garibaldi Avenue Director, Dragicevich. said the property owner is making an effort to clean up the property, and he listed what was being done, and suggested this item be postponed to the next Planning Commission meeting. Com- missioner Atkins so moved, seconded by Commissioner Clark and the motion carried. 1 PLANNING COMMISSION MINUTES MEETING OF FEBRUARY 25, 1975 PAGE FOUR (b). Environmental Quality and Code Enforcement Program Asst.. Planner Richards ._. gave a report on this program, listing the violations observed for the period. of January. 23 through February 20, 1975. He concluded his report by saying that, in the month of March., he will be concentrating on sight obstruction violations and signs attached to utility poles or in public right -of -way. (c) Southern Terminus of Golden West Avenue Commissioner- Atkins inquired about the status of the southern terminus of Golden West Avenue and was told that the Public Works Department was acquiring the necessary street dedication prior to the construction of the project. (d) Contract Cities Convention City Manager. Koski said this. convention is scheduled for April 10 -12, 1975, and while no official invitation from. the City Council has been issued, yet, it is a budgeted item, and if the Commissioners are interested in attending, they can plan accordingly. 10. ADJOURNMENT. There being no. further business, Commissioner Atkins moved to adjourn to the next regular meeting of the Planning Commission. Motion was seconded by Commissioner Lawson and carried.
