INFORMATION REGARDING GENERAL PLAN: .PROPOSAL AND ZNTENT � Staff will discuss the growing importance of the General { � Plan, particularly since the consistency legislation of i � 1971, which required that zoning and subdivision approvals ! be consistent with the General Plan. The nine (9) manda- I �, tory elements and the other permissive elements will also be discussed. { � Other items to be discussed will include.the legal imoli- I cations of the failure to have a completed and up-dated ` Plan, the meaning of "consistency", and the procedures � for adoption. I B. GENERAL PLAN OF THE CITY OF LYNWOOD The present General Plan of the City of Lynwood was adopted in Apri1 of 1977. It contains all the mandatory elements ' required by State Planning Law. It consists of a General Plan Map and a Text. The Housing Element was completely revised in 1981 and a Recreation Element was adopted earlier this year--the latter is an optional element. The Land Use Element has been amended several times since its adoption in 1977. C. GENERAL PLAN AMENDMENTS On September 7, 1982, the City Council considered an item which would permit the orderly processing of General Plan ' Amendments on a tri-annual basis. State law restricts amendments to any one of the mandatory elements to three (3) per year. This is aimed at preventing continual General Plan Amendments every time an inconsis- tency between a proposed zoning action and the General Plan f surfaces. I OB,7E CTIVE Several items relating to the administration of the City's Cable T,V. franchise I need to be discussed with the City Councii. rACTS I (1) City staff has received a proposed contract for consultant services with Telecommunications �lanagement Corporation. This is the Cornoration which the City has used in the past for contract monitoring. (Z) Staff has met with the other cities in the consortium (Santa Fe Springs, Be11 Gardens, Downey, and Paramount) on access programming. �`lutual agree- ment was reached to have Car1 Pilnick of Telecommunications ,Ianagement eva- luate the proposal received from California Cablesystem and advise the con- sortium on how to proceed. (3) City starf needs to begin the process of establishing the non-pro£it corpora- tion for Coc�unity access Progra�ing. (4) Included in this agenda item is a List of rate increases proposed 'oy California Cable Systems. . A;IALYSIS & CONCLUSIONS (1) Staff feels that the City wi11 continue to need Carl Pilnick of Telecommuni- cations �lanagement Corporation to monitor construction oF the cable system in the City. �11so, Mr. Pilnick's sarvices wili be needed co evaluate and recommend a course of action on access programming in the City. (2) The non-profit corporation for access programming wi11 reauire �lrticles of Incorporation and Bylaws. The corporation wi11 also need to be designated as non-profit by the IRS and the State Franchise Tax Board. (3) The rate increase requests have been included to get Council input on this proposal. Staff will be meeting nest month with the consortium, and a deci- sion will be made at that time on how to proceed.
