� 7. . PUBLIC HEARING - PROPOSED AMENDMENT TO ZONING ORDINANCE REGARDING THE
ESTABLISHMENT OF PROCEDURES FOR PROCESSING GENERAL PLAN
ANENDMENTS DURING ANY CALENDAR YEAR. .
I Comment: The State Government Code requires that mandatory
elements of the General Plan not be amended more than
three (3) times during any calendar year. However,
the City of Lynwood does not have procedures for
� orderly processin9 amendments to the General Plan.
The proposed ordinance merely establishes a schedule
in February, June and October of any calendar year
for amendments to the General Plan.
Recommendation: Staff recommends that the Public Hearing be continued
until the regularly scheduled Council meeting of
September 21, 1982; and furthermore, staff requests
that the City Council schedule workshop sessions at
Councilmen's convenience so that staff may, at length,
discuss all aspects of the General Plan.

8. PUBLIC HEARING - SINGLE FAMILY USES IN THE M-F-R (R-3) ZONE
Comment: The proposed ordinance restores to the multiple family
cesidential zone the original concept utilized in the
City's zoning ordinance--that single family and two-
family residential uses would be conditionally permitted
in the multiple family residential (R-3) zone.

Comment: The ordinance, as proposed, would remove the existing
stigma of non-conforming use attached to single family
or two-family dwellings in the multiple family resi-
dential zone.
Recommendation: Council waive reading and introduce ocdinance entitled,
"AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LYN-
WOOD AMENDING THE MUNICIPAL CODE AND THE ZONING ORDINANCE
AUTHORIZING SINGLE FAMILY AND TWO FAMILY RESIDENTIAL USES

9. HUD 202 - PRELIMINARY INVESTIGATION GRANT l i

Comment: Request from the First Baptist Church of Lynwood et al
for an initial grant of $4,000 from the City of Lynwood
to facilitate a complete and timely assessment of develop-
ment opportunities and the preparation of the required
application for the Section 202 Program.
Recommendation: Council provide direction to staff concerning preparation I
of a contract to grant $4,000 of Community Block Grant
� funds to the First Baptist Church of Lynwood for the
purpose of preparing an application for the Section 202
Elderly/Disabled Housing Program.

10. ENFORCEMENT RESPONSIBILITY/MOBILEHOMES - MANUFACTURED HOUSING ACT i
I
Comment: Responsibility for enforcement of the Mobilehome -
Manufactured Housing Act was delegated by the City to
the County in 1962. The County no longer wishes to
assume this iesponsibility and it must be assumed by
the City or the State.
Recommendation: Council adopt a resolution entitled, "A RESOLUTION OF THE
CITY COUNCIL OF THE CITY OF LYNWOOD ASSUMING RESPONSIBILITY
FOR THE ENFORCEMENT OF THE MOBILEHOMES - MANUFACTURED
AOUSING ACT".
11. SENIOR CITIZENS HOME SECURITY PROJECT
Co�mnent: On July 6, 1982, Council approved the implementation of
a home security project for elderly-occupied households
and authorized staff to issue a Request for Proposal (RFP).
Two (2) proposals have been submitted, but only one (1)
has been evaluated by the Proposal Review Committee since
one of the submittals was not complete. The Committee
has recommended the selection of Veterans In Community,
Inc, as the Project Contractor.
The Project will provide home security services to 300
elderly-occupied households and will be administered by
the Community Development Department, Rehabilitation
Program.

11. Recommendation: Council adopt a resolution entitled, "A RESOLUTION

REQUIRED IN SUPPORT OF A HOME SECURITY PROJECT FOR
SENIOR CITIZENS".
12. TENNIS COURTS RELIGHTING - LYNWOOD CITY PARK
Comment: The aeneral contractor, Raymor Electric Company, com-
pleted the Lynwood City Park Tennis Courts Relighting
project as per plans and specifications, but seventeen
(17) days later than the contract time as extended by
the City for legitimate time extensions. The City
would be justified, according to contract, in with-
holding $200 per day or a total of $3,400 from the
final payment for liquidated damages.
The contractor, though legally liable for these "damages",
has been, to a certain extent, the victim of problems
with the manufacturers of the light poles, the lighting
fixtures and also of problems with the weather. These
were p=oblems over which the contcactor had little control.
Recommendation: Council grant the contractor the additional five (5) days
time extension for "rain time". In addition, that the
City Council withhold $2,400 from final payment to the
contractor for liquidated damages as the project was
completed twelve (12) days later than the contract time
as extended by the City for legitimate time extensions.
13. RE-ROOFING OF FIRE STATION NUMER ONE
Comment: Fire Station Number One was constructed in 1950. The
roof is original. For the past several years, leaks
have developed that have been spot patched. The condi-
tion of the roof now, however, dictates that the roof
be zeplaced. This project was approved in the 1982-83
Budget for $4,200.
Recommendation: Council authorize the re-roofing of Fire Station Number
One and award the bid to South Gate Roofing Company for
$3,970.
14. SALARY RESOLUTION
Comment: Employee negotiations have been concluded and the City
Council of the City of Lynwood has adopted Comprehen-
sive Memoranda of Understanding with Employee Associa-
tions, the City Manager and the City C1erk. A revised
salary resolution including salary schedules for fiscal
year 1982-83 should be approved implementing the salary
and wages provisions of adopted Memoranda.
Recommendation: Council adopt a resolution entitled, "A RESOLUTZON OF
THE CITY COUNCIL OF THE CITY OF LYNWOOD SETTING FORTH �

15. AMENDMENT TO THE FISCAL YEAR 1982-63 BUDGET/ADOPTION OF THE FISCAL
YEAR 1982-83 FUND BALANCE ESTIMATES AND TRANSFERS BETWEEN FUNDS
Comment: In order to implement the Memoranda of Understanding,
an additional appropriation of $244,632 to be distri-
buted among the departments and budgetary line items
as detai].ed in the resolution must be approved. A
revised Fund Balance analysis, which has been included
in the resolution, should also be adopted.
Recommendation: Council adopt a resolution entitled, "A RESOLUTION OF
THE CITY OF LYNWOOD AMENDING THE ANNUAL OPERATING
BUDGET FOR THE FISCAL YEAR 1982-83 AND APPROVING TAE
ESTIMATED FUND BALANCE FOR THE FISCAL YEAR 1982-83".
16. PAYMENT OF BILL - WARRANT REGISTER, DATED SEPTENBER 7� 1982
Recommendation: Council approve the payment of Warrant Register, dated
September 7, 1982.

Company Carnival in Lynwood from November 4th through 7th, 1982. Also,
request that the City waive any fee(s) and/or licenses pertaining to
the Carnival.

The City Council of the City of Lynwood met in a regular
session in the City Hall, 11330 Bullis Road, on above date
at 7:30 p.m.
Mayor Thompson in the chair.
Councilmen Byork, Green, Morris, Rowe, and Thompson answered
the roll call.
Also present were City Manager Gomez and City Attorney McE�aen.
It was moved by Councilman Byork, seconded by Councilman
Green, and carried, that the minutes of the regular meeting
of Auqust 3, 1982, be approved as written.
SCHEDULED MATTERS
?UBLIC HEARING The Mayor announced the time had arrived to conduct a
remanded to continuation public hearing on an amendment to zoning ordi-
Planning Comm nance pertaining to a mobile home park (MHP) zone. Staff
re rtxP zone stated that per Council instruction, the subject ordinance
was remanded to the Planning Commission for further study
with the understanding that provision be made for double-
wide and''triple-wide mobile homes. The Mayor stated that
the public hearina had been republished.
The Mayor inquired if anyone present wished to speak in
favor of or in opposition to the Mobile Park Zone Ordiaance.
There was no response and the public hearing was closed.
After some discussion, several Councilmen had reservations
about some of the provisions contained in the ordinance.
It was moved by Councilman Green, seconded by Councilman
Morris, that the subject ordinance be tabled until a later --
date allowing Council an opportunity to study the ordinance
in more detail.

Councilman Rowe subsequently requested that Item No. 10

INFORMATIONAL ITEMS

; YARD SALES The City Manager reported to Council that the way the City
CLARIFICATION Code is written regarding yard sales, clasification is
needed relative to when a 12-month period begins and ends.
It was suggested and Council consensus was that the 12-month
period be a Calendar Year. The City Attorney informed
Council that he would be coming back to Council with an
ordinance clarifying the two yard sales within a 12-month
period issue.
COUNCIL ORAL COMMUNICATIONS
LYNh'OOD DAY Th2 Mayor reported that he had received a letter from the
AT THE FAIR Lynwood Chamber of Commerce reminding the Council that the
sept. 15, '82 Lynwood Day at the Los Ange3es County Fair would be Wednesday,
September 15. The Chamber has made arrangements for round
trip transportation to the Fairgrounds and the ticket price
including admission will be $10 per person. The bus will
leave Bateman Hall at 10:45 a.m. and return from the Fair-
grounds at 4:45 p.m. The deadline for registratioa is
August 31, 1982.

� .. PUBLIC ORAL COMMLTNICATIONS
Ms. Ida Honorof, 2901 Los Flores, informed the Council i. Honorof
of a serious health hazard (flea infestation) to the healtn hazard
City of Lynwood along the Freeway Corridor. Also
Ms. Mary Bohanon, 11440 Peach, spoke personally of the
flea problem in the dwelling which she resides in at
the present time. The Mayor informed Ms. Honorof and
Ms. Bohanon that the Council would thoroughly investi-
gate the problem.
�` Mr. Nick York, 10752 San Jose, presented a petition to N. York fire
the City Council which read: We, the undersigned re- worxs petitic

gistered voters of the City of Lynwood do hereby petition
the City Council of the City of Lynwood to: a) Enact an ,
ordinance to prohibit the use of any and all types of
fireworks by any means within the bondaries of the City
of Lynwood; and b) Prohibit the sale of any and all types
of fireworks within the boundaries of Lynwood". The
petition was accepted by the Mayor and given to the City
Clerk for filing. •
Mr. Gene Miller, 3540 Virginia, requested the City's G. Miller re
position on the payment o£ storage charges for his storage charc
vehicles and miscellaneous materials. The City Attorney
stated that the City made an e£fort to get Mr. Miller's
vehicles back and made an offer to pay the bill with the
towing company and did so, and subsequently noti£ied
Mr. Miller that he could pick up the cars and he chose
to ignore that offer. The time has expired to pick up
the vehicles and the additional charges which.he is
incurring are of his own doing. Mr. Miller had an opportu-
nity to mitigate the damages and he chose to not mitigate.
Therefore, the City had no obligation to pay any impending
� bills which Mr. Miller chose to incur.

Section 65361 of the California Government Code states that "No
mandatory element of a general plan shall be amended more frequently
than three ti'mes during any calendar year, which a.�nendment or
amendments may occur at any time as determinec by the legislative
;body". This section does not apply to the amendment of a general
plan element requested for the development of residential units
which will be occupied by persons and families of 1ow or moderate
• income.
The City of Lyr.wood presently has•no orderly procedure for processing
amendments to'the Geaeral Plan. Applications for discretionary
planning approvals (conditional use permits, zone changes, etc.)
which require z General Plar Psnendment are processed on a first-come,
first-serve basis. Sta£f-generated amendments to the General Plan
are presently brought before the Planning Commission and City Council,
respectivelq.
PV�L,ySIS -
The present metnod of processing General Plan Amendments does not
encourage efficient allocztion of the three (3) amendments per
calendar year which are allowed by State law. The City tould con-
ceivably be left in a position in which its allotment of amendments
is exhausted ay the middle of any calendar year. If this were to
occur, the City could not process an application later in the year
�or a major project which required a Generzl Plan Amendment.
� Sta£f feels that Amenc:ments to the General Plan should be processed
during certain designated time periods only. The time periods
should ideally be spaced four (4) months apart, as the General Plan
can be amended no more than three (3) times in any calendar year.
Staff feels that the second Tuesdays of February, June and October
would be appropriate.

WHEREAS, Section 65361 of the State Government Code
provides that no mandatory element o£ a General Plan shall be
amended more frequently than three times during any calendar year,
with amendments to occur at any time as determined by the legisla-
tive body;
WHEREAS, the City of Lynwood presently has no orderly
procedure for processing amendments to said mandatory elements;
WHEREAS, on August 10, 1982, the Planning Commission did,
after public notification pursuant to law, hold a public hearing
on the proposed amendment;
WHEFcEAS, the Commission has considered all pertinent
testimony offered at the public hearing;
The Planning Commission of the City of Lynwood DOES
HEREBY RESOLVE as follows:
SECTION 1. The Planning Commission hereby finds and
concludes that the proposed amendment to the Zoning Ordinance will
be consistent with the objectives of the General Plan and the
development policies of the City.
SECTION 2. The Planning Commission hereby recommends
City Council approval of an amendment to Ordinance No. 570, the
Zoning Ordinance, establishing orderly procedures for processing
General Plan Amendments during any calendar year.

The City Council of the City of Lynwood DOES HEREBY
ORDAIN as follows:
SECTION 1 . Section 25-31.3e of Ordinance No. 570, the
Zoning Ordinance, shall be amended to read as follows:
"�. The Planning Commission shall hold public hearings on
any applications f.or, or any staff-recommended amend-
ments to any mandatory element of the General Plan.
Such hearings shall be conducted on the second Tues-
days of February,.�une and October of any calendar year.
"A hearing shall be conducted at the Commission's
regular meeting on the second Tuesday of February,
June, and October of any calendar year, unless a
majority of the entire Commission shall consent to
consideration of a proposed amendment at some other
time ,"
SECTIQN 2. Severability. If any section, subsection, sub-
division, sentence, clause, phrase or portion of this ordinance or
the application thereof to any person or place, is for any reason
held to be invalid or unconstiti.t�onal by the decision of any court
of competent jurisdiction, such decision shall not affect the validity
of the remaining portions of this ordinance or its application to
other persons or places. The City Council hereby deciares that it
would-have adopted this ordinance, and each section thereof, irres-
pective of the fact that any one or more sections, subsections, sen-
tences, clauses, phrases, or portions, or the application thereof to
any person or place, be declared invalid or unconstitutional.
SECTION 3. The City Clerk is hereby ordered and directed
to certify to the passage of this ordinance and to cause the same to
be published once in the Lynwood Press, a newspaper of general cir-
culation, printed, published, and circulated in the City of Lynwood.

SUBJECT: Sinqle Family Uses in the M-F-R (R-3) Zone
BACKGROUND
Under the comprehensive zoning ordinance adopted by the City of
Lvnwood . an R-1, R-2 and R-3 zone was established. Under
this zoning,any use authorized in the more restrictive zone r�uld
be maintained in the less restrictive zone with a Conditional Use
Permit; e.g., R-1 uses were authorized in the R-3 zone.
In June, 1981, the Planniag Commission adopted Resolution No. 756
recommendinG City Covncil adoption of an ordinance allowing mobile-
homes in single family and two-family residential zones, in accordzace
with SB 1960. The Senate Bi11 did not permit discriminztion between
convent.ional constructed houses'and mobilehome units, and the ordi-
nance as dra£ted included mobilehomes in the R-3 zone. However, the
Commission felt mobilehomes should.not be allowed in the multiple
family residential (R-3) zone. Consequently, single.family dwellir.gs
were no longer permitted in the R-3 zone. Therefore, any single
°amily dwelling located in an R-3 zone became a legal non-conforming
use. As a legal ron-conforming use, single �amily dwellings in an
R-3 zone could be maintained, but not expanded.

The issue of not allowing single family Lses ia the multiple family
resideatial zone has recently become one of major concern to the
citizens of Lynwood and the Council. The present code requirements
strictly limits the development and expansion of single fanily dwe11-
ings in R-3 2ones. A zone chanae, va�iance, or other administrative
remedies are available; however, such procecures present.a tremendous
burden upon the community and developers as well.
The attached c�raft ordinance restores to tne multiple family residen-
tial zone the original concept utilized in the zoning ordinance of
this city; that is,single 6 tvo- family residential uses would be
f conditionally permitted in the R-3 zone. The aroposed ordinance
' merely adds to the conditionally permitted uses in tne R-3 zone.
The effect of this proposed ordinance would also remove the existir.c
sti5ma of non-confbrming use attached to sinale family or two-family
dwellings in the multiple family residential zone.
The proposed amendment is substantially in accord with the Lynwood
General Plan, and will provide slexibility of development in the
multiple family residential zone.

WHEREAS, the Planning Commission of the City of Lynwood, pursuant
to law, held a public hearina on August 10, 1982, pertaining to the
authorization of single family residential uses in the multiple family
residential zone;
WHEREAS, the Commission has considered all pertinent testimony
offered at the public hearing; -
WHEREAS, the Director of Community Development has determined
that the amendmPnt would cause no substantial adverse impact on the
environment, and has issued a Negative Declaration;
The Planning Commission of the City of Lynwood does hereby resolve �
as follows:
Section 1. The proposed amendment is substantially in accord with
the Lynwood General Plan.
Section 2. The proposed amendment provides for flexibility of
development in the Multiple Family Residential (R-3) zone.
Section 3. The proposed amendment provides for substantial pre-
servation and enjoyment of property rights for those properties con-
taining a single family or two family residence as the principal use
in the multiple family residential (R-3) zone.
Section 4. Based on the foregoing findings, the Plannina Commis-
sion recommends that the City Council adopt the ordinance pertain3ng
� to single family and two family residential uses in the multiple
family :esidential (R-3) zone.

SUBJECT: HUD 202 - PRELIMINARY INVESTIGA7ION GRANT.
PURPOSE:
To consider a request from.the First Baptist Church of Lynwood et al
for an initial grant of. $4000 from the City of Lynwood to facilitate
a complete and timely assessment of development opportunities and the
preparation of the required application for the Section 202 Program. A
copy of the request is attached.
BACKGROUND:
The Section 202 Program provides direct federal 1'oans for a maximum
term of 40 years to assist private non-profit corporations in the de-
velopment of new housing-facilities to serve the elderly and handi-
capped. The program provides construction and permanent mortgage finan-
cing and guaranteed rents at levels necessary to cover the mortgage
payments. Tenants in the building must be low-moderate income, and
will pay no more than.30% of their income for monthly rental charqes
with the difference subsidized by the federal government.
During the first half of 1981, staff worked with an organizing committee
of local churches to identify non-profit corporations willing to act as
local sponsors for a Section 202 ProJect. Two sites in the City -- one
being the parking lot behind the shopping center at Century and Bullis,
the other being the City's Natatorium Parking Lot -- were given serious
consideration, but both were ultimately reJected.
ANALYSIS:
The City of Lynwood Community Development.Department has received a re-
quest from Mr. David W. Litsinger, on behalf of the.First Baptist Church
and other local churches. The church requests a$4000 grant from the
City for the purpose of assessing the development opportunities, and
preparing the required application for funding of a Section 202 Project.
A detailed budget has not been submitted at this time but wo�ld be re-
quested by staff if the City Council chose to qrant the requested
monies. If completed, the application would be submitted for considera-
tion in 1983, the last year currently scheduled for funding the Section
202 Program. Deadline for submittal to HUD may be as late as March
1983.
A contract granting the $4000.to City funds would specifically state
that the churches.could only use the funds to hire a qualified consul-
tant for the preparation of the Section 202.application as described
above. As a�further condition.of the contract, the City's grant would
be.reimbursed to the extent.that-work done under the. contract was an
aTlowable expense under an appi^oved and funded Section 202 applica-
tion.
The proposal from.the Church did not address the issue of site. Per-
haps, before executing a contract, Council would wish to appoint a
� site selection committee from a broad community base. The committee
• oould report to Council within 2 or 3 months regarding a recommended
site, rOr perhaps,,First Baptist Church could.be responsible for orga-
nizing 'the'committee and reporting to City Council.
If this is the case, the City.may want to authorize hiring a consultant
to advise the committee on a very limited basis regarding site selec-
tion.

PURPOSE:
The purpose of this item is to request adoption of the attached
resolution transferring certain enforcement responsibility from the
County to the City.
BACKGROUND:
On May 20, 1962 the.City of Lynwood.adopted Ordinance No. 721. As
a result, the City assumed responsibility for enforcement of Sections
18000 to 18879.of the.Health and Safety Code, now known as the Mobile-
homes-Manufactured Housing Act.
On May 15, 1962 the Health Services�Agreement between the County of
Los Angeles and'`the City of Lynwood was amended to delegate this
enforcement responsibility to the County. The County charges the
City.a sanitation inspection fee which is paid by the City from the
annual operating fees.charged to park owners. .According to Building
Division staff, the last fee charged by the County was 544.75/Park.
Building and safety inspections were accomplished by City staff.
The County has been notified that during the 1982-83 fiscal year,
the State will enforce its requirement to have building and safety
type inspections performed by the County in addition to the sanita-
tion inspection function. The program is already operating at a defi-
cit and the County now wishes to return the program to the State or
Contract cities. The City has received a notice from the County of
Los Angeles that unless otherwise advised_, the County would work to
transfer the enforcement responsibilities back to the State. ,
ANALYSIS:
County staff have advised that the City should pass a resolution
formalizing withdrawal of services. The Health and Services Agree-
ment according to the County, need not be amended.
If the City assumes enforcement responsibility, staff will add only
the sanitation inspection function as they were already performing the
health and safety inspection. Of course, the City does not have the
option of not assuming enforcement responsibility in which case
the State would assume the responsibility.
RECOMMENDATION:
Adopt the attached resolution-assuming responsibility for enforce-
ment of the Mobilehomes - Manufactured Housing Act.

WHEREAS, on May 15, 1962 the City Council of the City

PURPOSE: •'
The purpose of this item is (1) to approve the attached recommendations
of the Proposal Review-Committee for selection of contractor, and
_ (2) to approve the attached Agreement and authorize the Mayor to
execute it.
BACKGROUND:
The City of Lynwood is the recipient of a grant consisting of 300
sets of. dead bolt locks with an.approximate value of $6,000 from
the League of California Cities. .-Dead bolt locks are being pro-
vided to nineteen cities in Los Angeles County throuqh the League's
"Senior Citizens Target Hardening Project". This project is designed
to reduce the burglary rate for senibr citizens homes in selected
target areas in the county.
The City's Community Development Department has designed a comprehen-
sive home security project with the purpose of improving the protec-
tion and security of the City's elderly-occupied homes. The Project
will be administered by the Rehabilitation Program and implemented
through a qualified contractor. The P.roject will be implemented over
a twelve month period starting from date of execution of agreement
with selected contractor.
The Senior Citizens.Home Security.Project will provide 300 income-
eligible elderly households with a security check, required security
devices including two dead bolt locks, repair/replacement of doors
and windows if needed, and counseling on home security measures.
On �uly 6, 1982, Council approved t4e implementation of said project
and authorized staff to issue a Request for Proposal (RFP) soliciting
bids from qualified contractors. Two (2) proposals were received:
one submitted by Mr. Don Buhr on behalf of the Lynwood Legion Post,
and the other by Veterans in Community Service, Inc. Only the second
proposal was evaluated by the Proposal Review Committee since the
first mentioned proponent did not submit a complete bid. Thus, staff
and Committee members lacked the necessary information to evaluate
the submittal.
The Proposal Review Committee agreed.on recommending the selection
of Veterans in Community Service, Inc., with the condition that the
Rehabilitation Coordinator would negotiate with them the proposed
time frame for implementation and the.proposed price (see attached
minutes). As a result of said negotiation, the selected project
proponent agreed to: (1) operate the pro3ect over a one-year per.iod
in four time periods not to exceed 180 calendar days (see attached
Agreement, Section III..B.), and (2) reduce the amount of the bid from
$21,457.40 to $19,457.40 (see attached Agreement, Section.VII. A.).

ANALYSIS:
The Senior Citizens Home Security Project will provide approximately
300 elderly-occupied households with increased protection and security
against burglary. The proJected cost of implementing the ProJect is
$30,000, $100 per participating household. This amount includes the
cost of materials as well as all operating costs. The funding for
the ProJect will be provided with CDBG funds under Contract 81C-376.'
• The administration of the ProJect has been integrated within the
ongoing Rehabilitation Program (see attadhed Operational Procedures).
No need for additional staff is foreseen.
The selected contractor has a substantial track record in the pro-
vision of home repair and weatherization services to low income house
_ holds including senior citizens. The submitted bid is a reasonable
one for the level of services to be provided. Staff.verification of
submitted references indicates that Veterans In Community Service,
Inc., has been operating an efficient program since 1978.
• RECOMMENDATION:
Adopt the attached resolution which:
1. Approves the recommendation of the Proposal Review Committee
for selection of contractor.
2. Approves the attached Agreement providing for the use of
$19,457.40 in CDBG funds with the selected contractor and
authorizes the Mayor to execute said Agreement.

W I T N E S S E T H
WHEREAS, CITY entered into an agreement with,the County of Los
Angeles on , whereby CITY
agreed to administer a community development program utilizing
Housing and Community Development Block Grant Funds ("CDBG Funds");
and
WHEREAS, the City wishes to obtain the services of a qualified
. contractor to operate a home security project for the elderly; and
WHEREAS, the City's Community Development Department finds that
the Contractor is specially knowledgeable and competent to perform
those special services which will be required by this Agreement; and
. WHEREAS, the Project will further the City's ongoing e£forts in
providing its low and moderate income residents with healthier,
safer and more secure homes;

NOW, THEREFORE, in consideration of the mutual obligation of the
parties hereto, each of them does hereby covenant and agree with
the other as follows:
I. Retainer
, A. CITY does hereby retain CONTRACTOR to provide the
services and product hereinafter specified, and
product within the time limits hereinafter specified.
. 8. CONTRACTOR may employ subcontractors only with the
express written consent of the Community Development
' Director, hereinafter, the Director, which consent shall
not be unreasonably withheld. Any attempt by CONTRACTOR
to assign or subcontract any performance of this Agree-
ment without the express written consent of the
Director shall be invalSd and shall
constitute a material breach of the Agreement. Whenver
CONTRACTOR is authorized to subcontract or assign, the
terms of this Agreement shall prevail over those of any
such subcontract or assignment.
C. The fact that CONTRACTOR employs subcontractors shall not
relieve CONTRACTOR from any responsibility regarding the
adequacy of the proJect or other work of this Agreement.
D. CONTRACTOR shall comply with the requirements of Section
3 of the Housing and Urban Development Act of 1968, as
amended 12 USC 1701 (U). Section 3 requires that to the
greatest extent feasible, opportunities for training and
employment be given to lower income residents of the
proJect area and contracts for work in connection with
the project be awarded to business concerns which are lo-
cated in, or owned in substantial part by persons re-
siding in the area of the proJect.

• II. Scope of Work
CONTRACTOR shall perform security inspections and pro-
vide security services and counseling to three hundred (300)
' qualifying elderly households.
The security services and counseling shall include but
not be limited to:
A. Security inspections, work write-ups and cost estimates;
B. Provision and instaliation of security devices and re-
, lated hardware; (CITY will provide a set of deadbolt
locks per case to CONTRACTOR for installation).
, C. Provision of home security counsiling.
CON7RACTOR agrees to abide by the "PROJECT GUIDELINES AND
OPERATIONAL PROCEDURES" established by the City (Attachment
"B") for the operation of said project. If any of the require-
' ments of said guidelines and operational procedures proves un-
satisfactory to either party, amendment(s) may be made at the
request of either party. Any and all amendments to said guide-
lines and operational procedures shall be approved by the
Director;
III. Period of Performance
A. CONTRACTOR sha1T commence work no later than thirty (30)
days from the date of execution of this contract and shall
continue until services are diligently completed in accord-
ance with job description as stated in Article II above,
but in no event shall that time exceed one (1) year from
' the date of execution of this contract. Time is of the
essence in this Agreement, and failure of CONTRACTOR to
complete its duties and responsibilities under this Agree-
ment within the time frame specified above shall constitute
a material breach of this Agreement.

.' B. CONTRACTOR agrees to provide the security services de-
- scribed in Section II above to three hundred (300) house-
holds in no more than four (4) time periods within the
one (1) year term of this Agreement and at intervals de-
termined by the flow of applicants. The combined length
' of said time periods shall not exceed one hundred eighty
(180) calendar days.
IV. Responsibility of the Contractor
- A. CONTRACTOR shall be responsible for the quality and timely
completion of the services provided by the CONTRACTOR under
this Agreement.
B. CONTRAC70R shall perform such services as may be necessary
to accomplish the work required to be performed under this
Agreement and in accordance with this Agreement.
C. CONTRACTOR shall be responsible for the procurement of the
necessary security devices and related materials� except
300 sets of deadbolt locks (one set per project participant)
which shall be provided by the CITY to CONTRACTOR for in-
stallatiori. The cost of said security devices and materials
is not included in this Agreement. CITY shall reimburse
CONTRACTOR for all materials costs on a monthly basis upon
submittal by CONTRACTOR of a request for payment and suppor-
tive invoices from suppliers upon verification and approval
by the Director.
D. CONTRACTOR shall maintain accounting records, official
files, and other evidence pertaining to costs incurred
pursuant to all applicable HUO regulations, and all of
these shall be accessible for the purpose of making sur-
veys, audits and examinations by duly authorized repre=
sentatives of CITY or HUD. These records shall be kept
available at CONTRACTOR's office during the contract period
and thereafter for three (3) years from the date of final
payment of HUD CDBG funds. .

� V. Compliance with Federal, State and Local Laws
CONTRACTOR shall carry out all activities in conformity
with all applicable federal, state and local statutes,
rules, regulations, and policies including all applicable
Federal and State labor standards. In this regard, the
CITY and the CONTRACTOR acknowledge that this Agreement
is subject to the Housing and Community Development
Program regulations (24 C.F.R. 570 et sea.) and they each
agree to comply with all relevant provisions of such
regulations. Without limiting the foregoing, the CONTRAC-
TOR agrees to comply with the Special Provision zttached
hereto as Exhzbit "A" .to the extent applicable.
VI. Personnel
, �
The CONTRACTOR represents that he has, or will secure at
his own expense, all personnel required in per£orming the
services under this Agreement. Such personnel shall not
be employees of or have any contractual relationship with
the CITY.
VII. Pavment
A. The compensation paid to CONTRACTOR by CITY for his
performance under this Agreement shall be NINETEEN
' THOUSAND FOUR HUNDRED FIFTY-SEVEN APdD 4C/100 DOLLARS
($19,457.40).
B. CONTRACTOR shall receive THREE THOUSAND FIVE HUNDRED
AND NO/100 DOLLARS ($3,500.00) upon execution of this
Agreement. CONTRACTOR shall receive four (4) progress
payments in the amount of THREE THOUSAND FI�IE HUNDRED
AND NO/100 DOLLARS ($3,500.00) each upon satisfactory
completion of no less than seventy (70) cases each
time. Each progress payment shall be disbursed upon
receipt of an appropriate invoice for work performed
and upon verification and approval by the Director.

', Additionally, CONTRACTOR shall receive a final pay-
ment of ONE THOUSAND NINE HUNDRED FIFTY-SEVEN AND
40/100 DOLLARS ($1,957.40) thirty i30) days after
satisfactory completion of three hundred (300) cases
or one (1) year from the date of the execution of
� this Agreement, whichever occurs first. This final
payment shall be disbursed upon receipt of an appro-
priate invoice for work performed and upon verifica-
tion and approval by the Director. In the event any
invoice is not acceptable, the Director shall notify
the CONTRACTOR within fifteen (15) calendar days of
receipt of such inv_oice, s the reason(s) for
such unacceptability. Payment of approved invoices
s'hall be made bj� the CITY within thirty (30) calendar
days of receipt of such invoices.
VIII. Performance Evaluation
, CONTRACTOR agrees that the CITY shall evaluate the CON-
TRACTOR progress in complying with the terms of this
Agreement ninety (90) days after the execution thereof
and each ninety (90) days thereafter until completion
of the Project. CONTRACTOR shall cooperate fully in such
evaluation. CITY shall report the finding of each evalua-
tion to the CONTRACTOR's Board of Directors and the
Lynwood City Council. If it is determined by the CITY
that performance or progress on performance is unsatis-
factory, the City Council may terminate the contract or
withhold further funding on the Project pending unsatis-
factory conditions. The CONTRACTOR shall not be held
responsible for delays in Project caused by the CITY.
IX. Termination of Contract for Cause
A. If, through any cause, the CONTRACTOR shall fail to
fulfill in timely and proper manner his obligations
under this Agreement, or if the CONTRACTOR shall
violate any of the covenants, agreements, or stipuia-
tions of this Agreement, the CITY shall thereupon have
the right to terminate this Agreement by giving written
notice to the CONTRACTOR of such termination and

' specifying the effective date of such termination.
In such event, all completed work performed by the
CONTRACTOR under this Agreement shall be entitled to
� receive just and equitable compensation for such items
satisfactorily completed hereunder. '
B. After receipt of a Notice of Termination, and except
as otherwise directed by CITY, CONTRACTOR shall:
1. Stop work under this Agreement on the date
and to the extent specified in the Notice of
Termination;
2. Place no further orders or subcontracts for
materials,__services or facilities except as
may be necessary £or completion of such por-
� tion of the work under this Aqreement as is
not terminated;
3. Terminate all orders and subcontracts to the
extent that they relate to the per£ormance
of work terminated by the Notice of Termina-
� tion;
4. Settle all outstanding liabilities and claims
arising out of such termination of orders and
subcontracts which are not settled or paid by
, CITY;
5. Complete performance of such part of the work
as shall not have been terminated by the Notice
of Termination.
C. After receipt of a Notice of Termination, CONTRACTOR
shall submit to CITY a verified termination claim.
Such claim shall be submitted no later than twenty (20)
• working days from the effective date of termination,
unless one or more extensions in writing are granted
by the Director upon request oP the CONTRACTOR made in
writing within such twenty (20) working day period or
authorized extension thereof.

D. CONTRAC20R and CITY may agree upon the whole or any
part of the amount or amounts to be paid to CONTRACTOR
by reason of the total or partial termination of work
pursuant to this Paragraph; provided, however, that
such agreed amount or amounts, when added to the
compensation paid for the non-terminated tasks, shall
not exceed the total Agreement price. This Agreement
shall be considered to be amended accordingly, and
,' CONTRACTOR shall be paid the agreed amount.
x. 23otices Demands and Communications Between the Parties
: Formal notices, demands, and communications between the
CITY and the CONTRACTOR shall be suf£iciently given if
dispatched by registered or certified mail, postage pre-
paid,`return receipt requested, to the principal offices
of the CITY and/or the CONTRACTOR. Such written notices,
demands, and communications may be sent in the same manner
to such other addresses as each party may from time to
time designate by mail as provided in this section.
XI.. Disclaimer of Liabilities
No member, official, or employee of the CITY shall be
personally liable to the CONTRACTOR, or any of its suc-
cessors in interest, in the event of any default or breach
by the CITY under this Agreement.
XI2. Enforced Delav: Extension of Times of ?erformance
Neither CITY nor any officer or employee thereof shall be
responsible for any damage or liability occurring by reason
of any action or omission of CONTRACTOR under or in con-
nection with any work, authority or jurisdiction delegated
to CONTRACTOR under this Agreement. It is also understood
and agreed that CONTRACTOR shall fully indemnify, defend
and hold CITY harmless from any liability ir.tposed for
injury (as defined by Government Code Section 810.8) occur-
ring by reason of any action or omission of CONTRACTOR
under or in connection with any work, authority or juris-
diction delegated to CONTRACTOR under this Agreement.

Neither CONTRACTOR nor any officer or employee thereof
shall be responsible for any damage or liability occur-
ring by reason of any action or omission of CITY under
or in connection with any work, authority or jurisdiction
not delegated to CONTRACTOR under this Agreement. It is
also understood and agreed that CITY shall fully indemnify,
defend and hold CONTRA�I'OR harmless from any liability
imposed for injury (as defined by Government Code Section
810.8) occurrinr by reason of any action or omission of
CITY under or in connection with any work, authority or
jurisdiction not delegated by CONTRACTOR under this Agree-
ment.
Performance by any party under this Agreement shall not
be deemed to be in default where delays or defaults are
due to war; insurrections; strikes; lockouts; riots; floods;
earthquakes; fires; casualties; acts o£ God; acts of the
public enemy; epidemics; quarantine restrictions; freight
embargoes; lack of transportatior.; governmental restric-
tions or priority; litigation; unusually severe weather;
inability of CONTRACTOR to secure necessary labor, materials,
or tools; delays of any contractor, subcontractor or
supplies; acts of the other parties; acts or failure to
act of any public or governmental agency or entity (other
than that acts or failure to act by the Cl2'Y shall not
excuse performance by the CITY) or any other causes beyond
the control or without the fault of the party claiming an
extension of time to perform. An extension of time for
any such cause shall only be for the period of the enforced
delays; which period shall commence to run from the time
of the commencement of the cause. If, however, notice
by the party claiming such extension is sent to each other
oarty more than thirty (30) days after the commencement
' of the cause, the period shall commence to run only thirty
(30) days prior to the giving of such notice. Times of
performance under this Agreement may also be extended in
writing by the parties af£ected by such extension.

_ XIII. Dzfaults
Subject to the extensions of time set forth in Sectior.
XII, failure or delay by any party to per£orm any term
or provision of this Agreement constitutes a default under
this Agreement. The party who so fails or delays must
immediately commence to cure, correct or remedy such
failure or delay, and shall complete such cure, correc-
tion, or remedy with reasonable diligence and during any
period of curing shall not be in default.
The injured party or parties shall give written notice
. of default to the party in default specifying the de-
fault complained of bg_the injured party or parties.
Failure or delay in giving such notice shall not constitute
a waiver of any default, nor shall it change the time of
default.
Except as otherwise expressly provided in this Agreement,
any failure or delay by any party in asserting any of its
rights or remedies as to any default shall not operate as
a waiver of any de£ault or of any such rights or renedies
or deprive any such party of its right to institute or
maintain any actions or proceedings which it may deem
necessary to protect, assert, or enforce any such rights
or remedies.
XIV. Leaal Actions
Any garty.to this Agreement may institute legal action in
the Los Angeles County Superior Court or Municipal Court
or in the United States District Court for the Central
District o£ California, to cure, correct, or remedy any
default, to recover damages for any default, or to obtain
any other remedy consistent with the purposes of this
Agreement.
If any party hereto defaults under any of the provisions
of this Agreement, the nondefaulting party or parties
shall serve written notice of such default upon the deiault-
ing party. With thirty (30) days of service of the notice
of default, the nondefaulting party or parties at its or
their operation may thereafter, but not before, commence

an action for rece5sicn or specific performance of the
terms of this Agreement or for damages caused by the de-
fault. The prevailing party in any action arising out
of this Agreement shall be entitled to reasonable attor-
neys' fees.
XV. Entire Acreement, Waivers, and Amendments
This Agreement integrates all of the terms and conditions
mentioned herein or incidental hereto, and supersedes all
negotiations or previous agreements among the parties
with respect to all or any part of the subject matter
hereof.
All waivers of the provisions of this Agreement must be
in writing and signed by tne appropriate authorities of
the CITY and the CONTRACTOR, and all amendments hereto
must be in writing and signed by the appropriate authori-
ties of the CITY and the CONTRACTOR.

I. PROJECT GUIDELINES
A. PARTICIPANT ELIGIBILITY '

Project participant(s) shall meet the following

1. Resident of the City of Lynwood

and renters qualsfy for the Project. However,
renters are required to submit with their application
an "Authorization and Waiver" form signed by the
owner
' 3. Fifty-five (55) years of age or older

B. ELIGIBLE SECLSRITY WORtC AND SE.°.VICES
Only the work iCems described below will be eligible for
the Project:
1. Provision and installation of two deadbolt locks on
exterior doors of dwelling
2. Providion and installation of devices and
: related hardware for windows and sliding doors
3. Provision and installation af peep holes and chain
locks only upon Particip�nt's request
4. Repair and/or replacement of deteriorated exterior
doors. Replacement doors shall be solid core,
. paint grade
5. Repair and/or limited replacement of window sash

II. OPERATIONAL PROCEDURES
The Project will be implemented by the City's Rehabilitation
Program and a selected Contractor(s). The Contractor, through
an Operational Agreement.with the City, will provide the
security work and services as describecl in IB (1-6) upon re-
ferral of participaats by the Rehabilitetion Program. The
Rehabilitation_Coordinator sfiall be r�sponsible for the overall
administration of the Project. The Rehabilitation Program will
participate in the implementation of the Project as stated be-
low. . .
A. PROJECT PROMOTION
Rehabiiitation Program staff will promote the Project by
using:
1. Press�releases and advertisements;
2_ Fliers to be disseminated through:
- Neighborhood Watch Program
- Recreation and Parks Department, Community Center
- Churches and other community organizations.
The Rehabilitation Clerk will be responsible for coord�-
nating all promotional activities for the Project. The
Rehabilitation Clerk will keep a log of said activities.
B. PARTSCIPANT INTAKE
The Rehabilitation Program staff will process applications,
determine eligibility and refer anproved cases to Contractor
in blocks of at least five (5) cases at each time.
The task sequence, sta£f responsible for performing the
tasks, and forms to be used are enumerated below:
� 1. Provide "Application" forms and assist in completing

2. Screen applications, verify information and approve

C. INSPECTION, WORK DESCRIPTION AND COST ESTIMATE
Upon referral by Rehabilitation Program staff, Contractor
will schedule security inspections with applicants. Upon
completion of inspections and determination of security
work to be done and its cost, Contsactor will submit said
information to the Rehabilitation Program staff for approval.
This approval to be issued no later than three_ (3) working
days from_time of submittal. Rehabilitation Program staff
will obtain applicant's approval. The task sequence, staff
responsible £or performing the tasks and.forms to be used
are enumerated below.
1. Perform home security inspection and determine work
co be performed and its cost. (Contractor)
2. Submit completed "Work Write-Up and Cost Estimate"
form for evaluation/verification and approval.

D. PROUISION OF HOME SECURITY SERVICES
Contractor will provide and install all needed hardware and

Ups and Cost Est•imates" - Contractor will provide home
security counseling to Project participants upon completion
of security work. Contractor will-provide Project partici-
pants with home security literature: The task sequence,
staff responsible for performing the tasks and forms to be
used are enumerated below.

Leagiae of California Cities. These locks were intended to be install-
ed in qualifying low to moderate income senior citizen homes. Since
the City had no means implement such a project, it was decided to
set up a special program, which would not only install said.locks
but also provide necessary security devices such as window/slide door
locks, etc. and counceling on what precautionary measures should be

Mas further informed that the latter proposal could not be considered
since it was not a completed bid: the proponent hed not submitted the
requested information. Mas handed out a copy of said proposal.
The Committee reviewed the proposal submitted by Veterans in Community
Service, Inc.. Mas briefed .the Commi.ttee on staff's evaluation of the
proposal. He indicated the proposed budget was a reasonable one. He
stated that the projected salaries had been compared to equivalent
positions in the City and were.within the range. Frinye benefits (17%
of salaries/wages) and overhead costs (lOx of operational costs) �vere
all very reasonable (an average 26� for the fiz�st and 20% for the

Mas further stated that if the Committee recommend selection of. the
proposal, he would like to negotiate the'cost.and time =rzsne �o=
implementation with the proponent.
After the proposal's discussion, A1 Moncayo, represen±inc Jeterans in
Community Service, Inc. gave the Committee background informztion en
his organization. Moncayo explained that his agency is a�non-profit
organization which has been in operation for 5 years. The senrices
they provide are rehabilitation, weatherization and security services.
The organi2ation was formed to help low/moderate income families.

They provide services through a service area encompassing the First
and Second Snpervisoral Districts. Moncayo'stated that currently
they have about ten workers, but only two of these men would be imple-
menting the program. They have-.15 years of combined experience in
the type of work indicated on the Proposal, and they believe that
Veterans in Community Service, Inc. can provide the best service.for
Lynwood because of their track record.
Mas asked Moncayo that if his organization were selected would they
(1) provide references regarding completed services,(2) negoti�te the
time of program completion ar!d (3) negotiate the cost. Moncayo szin =ha=

OBJECTIVE
To fai.zly and equitably determine the liquidated damages to be assessed
if any, to the general contractor, Raymor Electric Company for the above
re£erenced project.
FACTS
The general contractor, Raymor Electric Company, completed the work of the
project as per plans and specifications, but seventeen (17) days later than the
contract time as extended by the City for legitimate time extensions.
The City would be justified, according to contract, in withholding 5200
per day or a total of 53,400 £rom the final payment for liguidated damages.
The contractor„ though legally liable�for these "damages':', has been to a
certain extent, the victim of the manufacturers of the light poles and of the
lighting fixtures. These were problems over which the contractor had little
control. The problems incurred by the manufacturers of the lighting poles
(Amezon) and of the lighting fixtures (Hubbell) contributed materially to the
projects being completed late as well as incurring extra cost on the contractor.
ANALYSIS AND CONCLUSION
There are three options the City may follow and each would be justified:
A. Withhold 53,400 from £inal payment to contractor Por liquidated
damages (17 calendar days at $200 per day).
B. Waive a11 damages, in view of the fact that contract has now been
completed as per plans and speci£ications, recognizing difficulties
contractor has encountered which wese possibly beyond his control.
C. The contractor asked for and received only seven (7) days time
extension in his contract foz "rain time" and the contractor £or
another City project, the "Refurbishment o£ Park Buildings" for the
same Lynwood City Park, asked for and received twelve (12) days
�extension during the same t�,me frame for "rain time". Therefore, the
City could equitably grant the contractor an additional five (5) days
time extension in his contract, leaving the contractor only twelve (12)
days late. This would result in the City withholding 52,400 from final
payment to contractor.
RECODII�fENDATION
It is the recommnendation of the project architect, Merritt Morris, Jr., AIA,
and the Director of Recreation and Pazks that option "C" be followed and that the
City Council grant the contractor an additional five (5) days time extension for
"rai.n time": In addition, that the City Council withhold $2,400 from final
payment to the contractor for liquidated damages.

FACTS
(1) On June 29, 1952 the City Council of the City of Lynwood recognized by
minute order the ongoing nature of negotiations and that certain of the
negotiated results might be retroactively applied.
(2) On August 17, 1982 the City Council of the City of Lynwood adopted Com-
prehensive 1`lemoranda of Understanding between the City of Lynwood and
Employee Associations, the City Manager and the City Clerk.
(3) The adopted Comprehensive hlemoranda Understanding necessitate the
adoption of a revised salary resolution and salary schedules.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
LYNWOOD SETTING FORTH THE SALARIES BY CLASSIFICATION
� OF ITS OFFICERS AND EMPLOYEES.
WHEREAS, negotiatioas w.ith employee associations have
been concluded and the City Council of the City of Lynwood has
adopted Comprehensive Memoranda of Understanding; and
WHEREAS, the. City Council of the City of Lynwood has
adopted Comprehensive Memoranda of IInderstanding with the City
Manager and the City Clerk; and
WHEREAS, on June 29, 1982, the City Council of the City
of Lynwood gave official recognition to the on-going nature of
negotiations, and that certain of�the negotiated results might
be retroactively applied; and
WHEREAS, the conclusion of negotiations necessitate the
adoption o£ revised salary schedules;
NOW, THEREFORE, the City Council of the City of Lynwood
does hereby resolve as follows:
Section 1: That Resolution No. 62-43 of the City of Lynwood,
adopted on the 3rd.day of July, 1962, prescribes
the time and method of paying salaries and wages of
the officers and employees of said City, as requir-
ed by Section 37106 of the Government Code of the
State of California.
Section 2: That the salaries and wages for officers and em-
ployees for the various classifications falling
within the schedules are attached hereto and made
a part hezeof. . '
Section 3: That the rates on the Special Assignment Compen-
sation Schedule (Exhibit D) for the following
assignments are retroactive to the first full pay
period in July:
1 Street, Parks and Water Standby;
Street, Park and Water Aoliday Standby;
Clerical Pool Leadperson;
� Public Works Leadman;
Parks Leadman;
I Sweeper Operator (full-time).
Section 4: That the salary specified for the City Manager on
the Elected and Appointed Schedule (Exhibit E) is
retroactive to July 1, 1982.
Section 5: That all wage and benefit provisions of the Compre-
hensive Memoranda of Understanding between the City
of Lynwood and Employee Associations, the City
� Manager and the City Clerk, as adopted on August 17,
1982, are made a part of this Resolution.

(A through F) shall be amended as required by
provisions of Comprehensive Memoranda of Under-

is at any time or in any way held to be contrary
to any law by any court of proper jurisdiction,
the remainder of the Memoranda and the remainder
of this Resolution s,hall not be affected thereby
and shall remain 3n fu11 force and effect. .
Section 8: That this Resolution shall take effect immediate-
ly upon adoption, and that Resolution No. 81-86
is hereby repealed.

ADOPTION OF THE FISCAL YEAR 1982-83 FUND BALANCE ESTIMATES
AND TRANSFERS BETWEEN FUNDS

OBJECTIVE
To amend certain line item appropriations in the Fiscal Year 1982-83 budget
in order to carry out the rlemoranda of Understanding between the City and
Employee Associations,the City Manager and the City Clerk, and to adopt a
revised Fund Balance analysis for Fiscal Year 1982-83.
FACTS ,
(1) On June 29, 1982 the City Council recognized the ongoing nature of the
meet and confer process with the employee associations over wages, hours
and other terms and conditions of,employment.
(Z) The management team has completed the negotiations and reached agreement
on new Comprehensive Nlemoranda of Understanding with the employee asso-
ciations. The City Council approved rlemoranda with all employee groups,
, the City Manager and City Clerk on August 17, 1982.
(3) During the budget process certain fire prevention charges were inappro-
priately placed in Code'Enforcement. The funds must be placed in Fire
Administration.
ANALYSIS AND CONCLUSION
In order to implement the Memoranda of Understanding an additional appropriation
of $242,866 to be distributed among the departments and budgetary line ±tems as
detailed in the attached resolution must be approved. ,
A revised Fund Balance analysis, which has been included in the resolution, should
also be adopted.
RE COMMENDATION
Adopt a Resolution entitled: "A Resolution of the City Council of the City of
Lynwood Amending the Annual Operating Budget for the Fiscal Year 1982-83 and
Approving the Estimated Fund Balance for the Fiscal Year 1982-83.�'

OF THE CIT� OF LYNWOOD RELATING TO EXE,�SPTIONS
FROM THE PERSONNEL SYSTEM •
The .City Council of the City of Lynwood does ordain as
follows:
SECTION 1 : Section 24-32 of the code of the City of
Lynwood is amended to read as follows:
"SEC. 24-32. Coverage of classified service.
"The provisions of this article shall apply to all o£fices,
positions and•employment in the service of the city excepL:
(a) Elective offices.
(b) Positions on appointive boards, commissions and
committees.
(c) Persons e�loyed under centract to supply expert
� professional or technical services for a definite
I period of time.
(d) Volunteer personnel, such as volunteer firemen who
receive no regular compensation £rom the city.
(e) City attorney and city manager.
(f) Part-time crossing guards; per diem, hoiarly and
I seasonal employees; reserve firemen aad reserve
policemen. "
(g) Such other offices, positions, and employment in the
� service o£ the city as may £rom time to time be
I specified by resolution of the city council."

� SECTION 2: Severabilitv. Zf any section, subsection,
i sub-division, sentence, clause, phrase or portion of this

sentences, clauses, phrases, or portions, or the application
thereof • to any person or place, be declared invalid or
unconstitutional.
SECTION 3 : The City Clerk is hereby ordered and directed to
certify to the passage of this ordinance and to cause the same
to be published once in the Lynwood Press, a newspaper of
general circulation, printed, published and circulated in the
City of Lynwoo3.
First read at a regular meeting of the City Council of said
City held on the 17th day of AuQUSt , 1982, and finally
ordered published at a regular meeting of said council held on

Company Carnival in Lynwood from NovemUer 4th through 7t'�, 1982;
however, they will arrive on November 1st to set up and wi11 depart
on November 9th. •

iJe have used this company on three prior occaisions and found them
to be cooperative and honorable.
We are requesting the City again permit us to use the redevelopment
property located on the west side of Long Beach Boulevard, between
Beechwood and Mulford Streets. A1so, since all profits derived
from the endeavor help support the Chamber, we are requesting the
City waive any fee and/or licenses pertaining to the Carnival.

The Agreement by and between the City of Lynwood, a
Municipal Corporation (the "City") and Lynwood Chamber o£
Commerce, a California non-profit corporation (the "Chamber")
' dated as of July 1, 1980, is hereby amended as follows:
l. The fol.lowing Section 5 is�hereby added to Article I,
and shall read as follows:
"5. The Chamber agrees to prepare an annual program
of work which program shall be attached to this
agreement as Exhibit "A" and incorporated herein by ,
reference. The program shall be revised annually and.
shall be approved by the City Council and attached to
this agreement in substitution of the previous program."
2. The first sentence of Article V is hereby amended to
read as follows:
"For and.in consideration of the aforesaid obligations
of the Chamber, the City agrees to pay annually to the
Chamber to sum of Twenty-eight thousand dollars
($28,000.00) which sum should be paid in four quarterly
� installments."

3. Article 8 is hereby amended to read as follows:
"This agreement shall be deemed effectiv.e as of July
1, 1982, and shall remain in effect until terminated as
hereinafter provided. Either party hereto may
terminate ttiis,,.agreement at any time by giving written
notice of its intention to do so not less than thirty
(30) days prior to the date of such termination. Upon
termin=_tion of the agreement, the payment provided for
in Article V shall be prorated to the date of such
termination."

1. ECCNOMIC DEW'LOPMETTT DEPART^�NT '
A. Business L�evelopment
The Lynwood Chamber of Commerce will actively pursae business
and industrial development With the City of Lynwood. Every
opportunity to entice husinesses within the city Will be
pvrsued.
The Chamber will give assis'tance as needed for relocation
and public relations in all redevelopment project areas.
8. Crime & SecuritY �
1. Wit1� tlze constant increase of crime in our business areas,
we must develop plans and programs in cooperation with tl�e
Sheriff's Department as well as new businesses comin9 to ouz
city.
2. Graffiti has been on tlze increase and the Chamber will
strive to assist the city, the Youth of Lynwood, and any other
organizations predisposed to assist with the removal of this
I unsightly blight.
3. The Sheriff, schools, city and Chamber must develop
juv�ile crime control in our c'.ity.
4. If consiAerations are required to carry out tl�e above
programs, the c�ty, schools, business co�¢nunity and Youth
of Lynwood should worlc together on budget needs.
C. Hiqhway 6 Transportation
The I,ynwood Chamber will continue to work with the•city
toward the development of the Century Freeway. In addition,
the Chamber will meet with the city on other matters pertaining
, to streets and highways. The ChamSer Highway and Transportation
c�mmittee will maintain communications with RTn and strive
to improve the system within the city limits of Lynwood.
2. RETAIL TRADE DEPARTMENT
A. Promotions
The Retail Trade cortanittee will continue its Fourth of July,
Christmas, Easter and Aalloween programs, which are to distri-
bute greetings £rom the Chamber and city, urging everyone to
shop in Lynwood.

B. Christsnas Lighting Cdntest
The Lynwood Chamber of c'ommerce's Annual Christmas Lighting
Contest will be held again t11is year. There will be two
categories, religious and seasonal. Five juc3ges will be
appointed from the Chamber and they will select first, second
anc� third place winners in each category. Winners will be
invited to the January Chamber Roard of nirectors meeting,
at which time they �aill receive engraved plagues.
C. Merchants Association --_
The Chamber will offer its se�vices to any center or area
wishing tc establish an active_Merc�ants Association within
the city limits of Lynwood.
D. City Promotion Projects
1. Annual Fireworks Show
The Chamber has offered to assiat the city to �elp plan and
develop the fireworks show. At the present time, the fireworks
show is under the jurisdiction of the city, however, as
indicated, the Chamber is most anxious to cooperate with its
I assistance.
2. Los Angeles County Fair
The Chamber will again hold a Lynwood Day at the County Fair.
We wi11 participate in the parad�, Lynwood Day at the Races,
and provide entertainment at the amphitheatre.
3, lOK Run
The Lynwood Chamber of Commerce will co-sponsor, along with �
the c'ity of I,ynwood, a lOK Run. As of this writing, the
proposed run will b2 in October or November 1982.
ihe professional organization ?tAC'E will be hired to assist
with the promotion and detai2s of the actual race.
3. b�MBERSHZP DEPART.�NT
A. Status
The Lynwood Chamber of Commerce will start off the new year
(July 1, 1982) with 136 members. The conservative goal for
the year ending June 30, 1983 is 200 members. An active
membership drive is being planned.

B. A.�nbassador Program "
An Ambassador Program will be formed, which primary responsi-
bilities will be to:
1. Call on perspective new members to explain the Chamber's
function and invite them to become a member.
2. Call on all new businesses to invite membership into
the Chamber. - -
3. Attend all new business openings.
C. tdeetings
1. Board of Director meetings will be held on the seconc�.
Tuesday of each month, with the exeption of August and June.
Special meetings will be called as needed. The annual General
Membership meeting will be held during �he month of March.
2. The Cham�ier will sponsor a minimvm of four business seminars
on problems relating to the business community such as shopliftin�
security, advertising or other matters of interest.
� 3. The Chamber will co-sponsor a minimum of two mixers during
the ensuing year. The o�ject of the mixer is to give the members.
an opportunity to socialize and for the co-host to pzomote his
business by hol@ing the mixer in his/her place of business.
4. PLJBLIC AFFAIRS DEPARTfL�'NT
A. Le4islative
Th� Chamber will develop a strong and effectiv2 legislative
committee with the attempt to accomplish the following goals;
I 1. nevelop position or, key issues, to all involved
legislators and interested cha.mbers of Commerce.
2. Take specific action on non-partisan legislation that
affects our ci,ty and business community.
3. Flork clos�ly with our city on all legislation that affects
our local control and economic stability.
4, Invite surrounding Chambers o£ Commerca to joint legislative
meetings on matters of mutual interest.

C. Variety Show
.., I� Variety Show is planned for winter. This��is an annual event
that is directed toward provi3ing entertainment to all of the
citizens of Lynwooa.
L�. Circvs Vargas
The Chamber will again sponsor Circus Vargas' appearance in`
Lynwood. This will be the third year that the circus has
appeared and we hope to mak.e it an annual event. It provides
entertainmsn± for I�ynwood and the surrounding cities.
1?. Golf Tournament �
^'he 22nd Annual Lynwood Cham�er of Cor.mierce Golf Tournam�nt
is being p.lanne3 anc��aill be held on May 4th, 1983. It is
anticipated that the same format which has been so succassful
in the past wi11 be used. nfter the tournament, a ban�uet
will be held 47here t�ophies anc? 3oor prizes will be distributed.
F. Buver's Gui�2 & Industrial �irectory
47ork has started. on up3ating the 7,ynwood Buyer's &uide and
Industrial Directory, which will list the names, addresses
an3 telephone num'�ers of all businesses vtithin the city oP
Lynwood. In addition, statisticel data, emergency num'�ers
and other pertinent information pertaining to Lynwood will
be found in this valuable directory. The directory will
be distributed to all ho�r�s and busin2sses in Lynwood. Also,
the Ruyer's Guide an� Industrial Directozy will be mailed
to anyone requesting information about I,ynwood.
G. Carnival
The Lynwood Chamber of Comm°rce will again sponsor a Winter
and Summer Cernival. '*he intent is to bring people to
Lynwooc� to the c`arnivel and *_hereby helping to increase
the tax b�se by their spen�?.ing their dollars in Lynwood.
5. EnL1CATI0r7
A. Youth Charm School
The Lynwood Chamber of Commerce wi11 co-sponsor, along with the
city of Lynwood, a charm school for yot+ng ladies. This will
be an eight week course with a formel graduation. Topics covered
will be: visual poise, wardrobe, hair/skin care, figure control_,
manicures, etc.
