CALL TO ORDER Chairman Atkins called to order the regular meeting of the Planning Commission of the City of Temple City at 7:30 p.m., November 25, 1975. I 2. PLEDGE OF ALLEGIANCE Chairman Atkins led the Pledge of Allegiance to the Flag. 3. ROLL CALL: Present: Commissioners Clark, Lawson, Stacy, Atkins Absent: Commissioner Breazeal Also present: City Manager Koski, Asst. City Attorney White, Planning Director Dragicevich and Assistant Planner Richards. Commissioner Lawson moved to excuse Commissioner Breazeal for cause, seconded by Commissioner Clark and the motion carried. 4. APPROVAL OF MINUTES - November 25, 1975: " Commissioner Lawson called attention to several omissions in the minutes, and they are herewith included for the record: 1 Item 3 of the Agenda: "Commissioner Lawson made a motion, seconded by Commissioner Breazeal and carried, to excuse Commissioner Stacy's ab- sence for cause." Item 4 of the Agenda - Approval of Minutes - Meeting of November 11, 1975: "There Deing no additions or corrections to the minutes, Commissioner Breazeal made a motion, seconded by Commissioner Clark and carried, to approve them as written." Commissioner Clark made a motion, seconded by Commissioner Lawson, to approve the minutes of the meeting of November 25, 1975, as corrected. Motion passed by roll call vote with Commissioners Clark, Lawson and Atkins voting for, and Commissioner Stacy abstaining. 5. CONTINUED PUBLIC HEARING: DETERMINATION OF EXISTENCE OF PUBLIC NUISANCE 6117 Sultana Avenue Temple City, Ca. Director Dragicevich gave a staff report saying that no substantial change was observed by staff on the subject property. He reviewed what progress had been made by the property owner. Inspection was made on December 4, 1975. 1 The Continued Public Hearing was opened. No one came forward to speak to the issue. Commissioner Stacy made a motion, seconded by Commissioner Lawson and carried, to close Public Hearing. In Commission discussion it was the concensus of those present that the Commission had been fair and patient, the action by the property owner has been token in nature and a nuisance exists. Commissioner Lawson made a motion, seconded by Commissioner Stacy and carried, to declare the subject property a public nuisance and order abatement thereof. Asst. City Attorney White read title to Resolution 75- 663PC, A RESOLU- TION OF THE PLANNING COMMISSION OF THE CITY OF TEMPLE CITY DETERMING 411 THE EXISTENCE OF A PUBLIC NUISANCE AND RECOMMENDING ABATEMENT THEREOF. Commissioner Stacy moved to waive further reading and adopt, seconded by Commissioner Clark and the motion carried. PLANNING COMMISSION MINUTES Meeting of December 9, 1975 PAGE TWO •6 PUBLIC HEARING: CONSIDER RECOMMENDATION TO AMEND ZONING CODE RELATING TO KENNELS, RESTAURANTS AND SHOPPING CENTERS 1 1 The Planning Director explained that currently the Temple City Zoning Code contains no definitions or has inadequate explanations on the matter of kennels, restaurants and shopping centers. The Commission had discussed these definitions at study sessions this past Fall, and on November 11, 1975, set Public Hearing for this evening on the matter. The Public Hearing was declared open, No one came forward to speak, therefore Commissioner Lawson made a motion, seconded by Commissioner Stacy and carried, to close Public Hearing. Commissioner Lawson questioned the definition of fast food and take - out restaurants, how one would classify a restaurant such as, for instance, Carls, Jr., where most of the food is consumed on the premises. Chairman Atkins said that it depends on what the bulk of the business is. It was determined that there would be'no difference in the . license for the various types of restaurants, but certain restaurants would require a conditional use permit. The Coimiissioners were in agreement that the proposed definitions reflected their thinking and discussions in study session. Commissioner Stacy moved to recommend to the City Council an amendment to the Temple City Zoning Code to include definitions for kennels, restaurants and shopping centers. Motion was seconded by Commissioner Lawson and carried. Asst. City Attorney White read title to Resolution 75- 664PC, A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TEMPLE CITY RECOMMENDING TO THE CITY COUNCIL THE AMENDMENT OF THE TEMPLE CITY ZONING CODE RELATING TO DEFINITIONS. Commissioner Stacy moved to waive further reading and adopt, seconded by Commissioner Lawson and the motion carried. 7. PLANNING COMMISSION CONSIDERATION: MINOR LOT LINE ADJUSTMENT NO. 75 -02 Dillman & Dillman ) 311 Walnut ) Costa Mesa, California ) John E. Orsi, et al ) Owners 124 W. Arthur ) Arcadia, California ) • 1 Dillman & Dillman - Applicant 311 Walnut Costa Mesa, California Site: 5304 -6 Welland Avenue and 10919 Freer Street Zone: R -1, Light Multiple Residential The Planning Director explained that the applicant proposes to effect a minor lot line adjustment between two contiguous parcels. He ex- plained the plot plan marked Exhibit "A" showing proposed Tentative Parcel Map with proposed lot line adjustment and the existing property lines for Parcels 1 and 2, and the factual data on the subject property and adjacent area. He continued by saying that a recommendation had been received from the City Engineer regarding reserving an easement for the sewer, which he pointed out on Parcel 1 of Tentative Parcel Map No 556. It was explained to the Commission that the case could not be considered • as a Minor Lot Line Adjustment inasmuch as that portion of the City's Code had inadvertently been deleted by adoption of the new Subdivision Ordinance, However, the new Subdivision Ordinance permits the Planning Commission to waive the requirement for applicant to file a Final Parcel Map. He concluded the report by saying a Negative Declaration had been filed on this matter as no adverse impact on the environment would result as defined by the California Environmental Quality Act of 1970, because of the project. PLANNING COMMISSION MINUTES MEETING OF DECEMBER 9, 1975 PAGE THREE In response to Chairman Atkins' question, the Director said the sewer easement served only Parcel No. 1, and there is a separate line for Parcel • 2. He replied to Commissioner Stacy's question that no public works im- provements were required for the duplex being built on Parcel No. 1 since such improvements are not imposed on R -1 or R -2 zoned properties. Mr. Jim Dillman, 311 Walnut, Costa Mesa, representing applicants, and owner of Parcel No. 1, said the proposed lot adjustment would eliminate a useless Iparcel on which nothing could be built. He intends to landscape his property when the improvements are completed, and will be able to do it properly with the line adjustment as proposed. Mr. John Orsi, 124 W. Arthur, Arcadia, owner of Parcel No. 2, was in favor of the lot line adjustment, but questioned if the owner could rebuild if the existing improvements were destroyed as the lot is substandard. He was in- formed he could rebuild to the limits of 50% lot coverage along with setback requirements. In Commission discussion it was the concensus that the proposed lot line adjustment would be beneficial to both property owners and the City, and would also straighten out an ackward configuration. Commissioner Lawson made a motion to approve Tentative Parcel Map No. 556 and waive the filing of Final Parcel Map upon the express finding of the Planning Commission glithat the proposed division of land complies with requirements as to area, improvement and design, flood water drainage control, appropriate improved public roads, sanitary disposal facilities, water supply availability and environmental protection. Commissioner Stacy seconded the motion and it carriec Asst. Commissioner Stacy made a motion, seconded by Commissioner Clark and carried, to waive further reading and adopt. 8. PUBLIC HEARING ZONE CHANGE CASE NO. 75 -457 Temple City Community Redevelopment Agency et al - Owners • 1 • Site: Temple City Community Redevelopment Agency and the City of Temple City - Applicant 8918,8922 -8926 East Wedgewood Street and 8913 through 89492 East Broadway, and vacated portions of Live Oak Avenue and Wedgewood Street located 337,31 ft. westerly of the centerline of Rosemead Boulevard. Zone: R -1, Single Family residential and R -3, Heavy Multiple residential Director Dragicevich gave the staff report, saying that it is proposed to change the zone from R -1, Single Family, and R -3, Heavy Multiple residential to C -2, General Commercial. The subject area is located in Parcel "B" of the Rosemead Boulevard Redevelopment Project, which is the site for retail commercial development. An Environmental Impact Report, relating to the proposed shopping center, was certified by the Community Redevelopment Agency on March 28, 1975.' No significant changes have taken place since that date to supplement or require preparation of a new Environmental Impact Report. The Director gave the factual data on the property, summarized the zoning history, the circulation, and said the General Plan of the City portrays the subject area as suitable for commercial development. The staff recommends the change of zone from R -1 and R -3 to C -2 for the reasons that the proposed site had adequate access for commercial development, the proposed zone change is compatible with existing development in the vicinity and with the General Plan and Redevelopment Plan. Koski, Executive Director of the Community Redevelopment Agency, requested the Planning Commission's favorable consideration of rezoning • as outlined by the Planning Director.. This change will enable the program of work in the Rosemead Redevelopment Project to continue and bring zoning into conformance with the Project plan. No oneelse cane forward'tosp eak either in favor or opposition, therefore Com- missioner Lawson made a motion, seconded by Commissioner Stacy and carried, to close Public Hearing. In closed discussion the Commissioners were in agreement that this zone change is an on -going step that has to betaken in the redevelopment project, and is consistent with the Environmental Impact Report, public interest and General Plan. Commissioner Stacy moved to recommend a change of zone from R -1 and R -3 to C -2 in Zone Change Case 75 -457, as the proposed site has adequate access and is otherwise suitable for commercial development., is compatible with existing development in the vicinity and with the General Plan of the City and the Redevelopment Plan. Motion was seconded by Commissioner Lawson and carried. Asst. City Attorney White read title to Resolution 75- 666PC, A RESOLUTION • OF THE PLANNING COMMISSION OF THE CITY OF TEMPLE CITY RECOMMENDING TO THE CITY COUNCIL A CHANGE OF ZONE IN ZONE CHANGE CASE NO. 75 -457. Commissioner Lawson made a motion, seconded by Commissioner Stacy and carried, to waive further reading and adopt. 1 1 • 9. PUBLIC HEARING: ZONE VARIANCE CASE NO. 75 -458 L. M. and Mary Franco - Owner /Applicant 4906 North Agnes Avenue Temple City 91780 Site: 4906 North Agnes Avenue Zone: R -1, Single Family Residential Director Dragicevich gave the staff report, saying the applicant pro- poses to enclose an existing covered patio with less than the required rear yard setback. He reviewed the plot plan marked Exhibit "A" which shows existing and proposed development, gave the factual data on the subject property and surrounding area, and reviewed the staff proposals if the Commission grants the request. A Negative Declaration of En- vironmental Impact has been prepared as the request would have no adverse effect on the environment. The Public Hearing was declared open. Mr. Louis M. Franco, 4906 N, Agnes, said a contractor had built the open patio last year, and this year he wanted to screen it in and -came to the Building Department before he proceeded. The City Hall staff had been most helpful. He intended to screen only the upper portion of the patio, and have solid enclosure up to 40" from the ground as it would be safer for his grandchildren. Mr. Edward Rice, 4908 N. Agnes Avenue, whose property abuts the pro- posed enclosed patio, said he had no objection to the request. There being no one else to speak to the issue, Commissioner Lawson made a motion, seconded by Commissioner Stacy and carried, to close Public Hearing. In closed discussion the Commissioners concurred that the house, being oriented to the north, and the fact that this is a land - locked parcel, causes unusual -circu tances. The granting of the request would not have any adverse effect on surrounding properties or contrary to the General Plan. It would be difficult to expand the residential structure in any other configuration. PLANNING COMMISSION MINUTES MEETING OF DECEMBER 9, 1975 PAGE FIVE Commissioner Stacy moved to grant the zone variance in Case No. 75 -458 • as the house is, in fact, oriented to the north, the property has limited access, the variance would not have an adverse effect on the public welfare and other property in the vicinity or on the General Plan. Motion was seconded by Commissioner Lawson and carried. Asst. City Attorney White read title to Resolution 75- 667PC, A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TEMPLE CITY GRANTING VARIANCE IN CASE NO. 75 -458. Coniuiissioner Lawson moved to waive further reading and adopt, seconded by Commissioner Stacy and the motion carried. 1 • 1 10. COMMUNICATIONS - There were none. 11. TIME FOR. THOSE IN THE AUDIENCE WHO WISH TO SPEAK Mr. Ron Guffy, 2330 E. Del Mar, Pasadena,said the organization he repre- sents, H. & R. Block, Inc., Income Tax Consultants, wished to locate at 9605 Las Tunas Boulevard, however, checking with the City, he learned that the zoning would not permit this use. Chairman Atkins informed him that the C -1 zone, applicable to that address, was established for retail businesses and the Commission had worked closely with the Chamber of Commerce in developing permitted uses for that zone. He suggested Mr. Guffy should contact the Chamber of Commerce Business Committee and get their input regarding the location of the requested use. 12. MATTERS FROM CITY OFFICIALS (a) Set Public Hearing to Consider Amendment. to Zoning Code Development Standards for R -3 and R -4 zones (b) Set Public Hearing to Consider Amendment to Zoning Code Appropriate Zoning for Adult Business Commissioner Stacy moved to set both items for Public Hearing for Janu- ary 13, 1976. Motion was seconded by Commissioner Lawson and carried. (c) Garage and Yard Sales Chairman Atkins said that, at the Mayor's Meeting recently, the subject of yard sales was discussed, and he would like to have a study session to explore this item further. City Manager Koski said the City Council • may put a draft of an ordinance on first reading and report the matter back to the Planning Commission, The Council is anxious to move ahead on it. 1 (d) Zoning of Vacated Streets City Manager Koski suggested the Commission, at a study session the possibility of an ordinance change, similar to an ordinance communities, where the vacated street assumes the_zoning of sur property.
