HomeMy Public PortalAboutORD 75/05ORDINANCE NO. 75 -5 AN ORDINANCE OF THE TOWN OF GULF STREAM, FLORIDA, AMENDING ORDINANCE NO. 74 -6 TO PROVIDE IN THE FLOOD HAZARD AREAS THAT NEW CONSTRUCTION OR SUBSTANTIAL IMPROVEMENT IN THE COASTAL HIGH HAZARD AREA BE LOCATED LANDWARD OF THE REACH OF THE MEAN HIGH TIDE; BE ELEVATED ON ADEQUATELY ANCHORED PILES OR COLUMNS TO A LOWEST FLOOR LEVEL AT OR ABOUT THE ONE - HUNDRED YEAR FLOOD LEVEL AND SECURELY ANCHORED TO SUCH PILES OR COLUMNS; AND HAS NO BASEMENT AND HAS THE SPACE BELOW THE LOWEST FLOOR FREE OF OBSTRUCTIONS SO THAT THE IMPACT OF ABNORMALLY HIGH TIDES OR WIND - DRIVEN WATER IS MINIMIZED. BE IT ORDAINED by the Town Council of the Town of Gulf Stream, Florida, as follows: SECTION 1. Ordinance No. 74 -6 of the Town of Gulfstream is hereby amended at Section 3, entitled "Permitted Uses in Flood Hazard Areas" by adding thereto Paragraph 5 which shall read as follows: 5. No land below the level of the 100 -year flood in a coastal high hazard area may be developed unless the new construction or substantial improvement: tide; a) is located landward of the reach of the mi�in high b) is elevated on adequately anchored piles or columns to a lowest floor level at or above the 100 -year flood level and securely anchored to such piles or columns; and c) has no basement and has the space below the lowest floor free of obstructions so that the impact of abnormally high tides or wind - driven water is minimized. SECTION 2. Severability. If any article, section, or phrase of this Ordinance is for any reason declared invalid or unconstitutional by a court of competent jurisdiction, such JOHNSTON decision shall not effect the validity of the remaining portions 'GASSER & RANDOLPH 15 HARVEY BUILDING [ST PALM BEACH, FLA. 33402 of this Ordinance. SECTION 3. Inconsistent Ordinances, all ordinances or parts of ordinances inconsistent with this Ordinance are hereby repealed to the extent of such inconsistencies. SECTION 4.
