Iglehart Also attending: Henry Lilienthal, Harold Martyr. The Commission Meeting held August 11, 1962 and recessed to reconvene September 15, 1962 at 9:30 A.M. was called to order by Mayor Dodson. The minutes of the meeting held August 11, 1962 were read and approved. The financial report for August 1962 was read and approved. All expenditures recorded in this report were approved. A request from Mr. Harold Martyr for a variance in the setback requirements at his property was read. Dep. Town Clerk Gwynn stated that he had mailed copies of this request to adjacent property owners and property owners across the street and had received no replies expressing opinions one way or the other. It was moved seconded and passed unanimously that this variance be granted. `i'his request is attached hereto and becomes a part of these minutes. The police reports for August, 1962 were read and approved. The minutes of the meeting of the Board of Equalization held August 14, 1962 were read approved and adopted. Resolutions 519 and 520 as passed by the Board of Equalization were read approved and adopted by unanimous vote. Said minutes and resolutions are attached hereto and become a part of these minutes. Resolution #521 setting the tax millage for 1962 at 5.7 mills was read to the Commission. It was moved seconded and passed urXmously that this resolution be adopted. The second and final reading of ordinance #132, annexing properties on Pelican Lane, was read to the Commission. It was moved seconded and passed unanimously that this reading be accepted and that said ordinance be adopted on this the second and final reading. It was noted that the Town had recently received a check from Palm Beach County in the amount of 401,400.40 as the Towns share of road and bridge tax money collected by the County. A letter from Mr. Harrison Chauncey, Jr. Attorney for the Gulf Stream School Foundation was read to the Commission. This letter requested the Town exempt the school from Real estate taxes for 1962 even though the Tax Assessor for Palm Beach County is not going to exempt them."there was a general discussion of this matter. Commission Meeting - September 15, 1962 1 - Page 2 C It was the unanimous feeling of the Commission that the Town should hot exempt this property from taxes for 1962. The Commission felt that the Town should not deviate from its policy of using the same valuations, and policies of Palm Beach County. They unanimously agreed that if the school meets the legal requirements as required by the County for 1963 and is exempt in 1963 the Town will be glad to exempt the school from taxes in 1963. The Commission authorized Himes & Himes, Certified Public Accountants in Delray Beach to proceed with the annual Audit of the Towns books and records for the Fiscal year October 1, 1961 through September 30, 1962. Ramsey 15.00 Total 2,332.31 August 16, 1962 The Gulf Stream Town Commission Gulf Stream, Florida gentlemen: I respectfully request a special exception to Section III, Para. "F" of the Zoning Ordinance pertaining to my residence recently constructed on Lot 6, Block I, Polo Fields Plat ft, located at 3425 Polo Drive. The walls of the residence are placed 10' -7" from the South boundary of the property; the overhang of the roof being 3 feet, which is in violation of the above men- tioned paragraph by 29 ". This situation occurred through a misinterpretation by the Architect of the Ordinance; he interpreted the information given him that the build- ing walls were to be 10' from the adjacent property line. I was absent in the North when the building construction began and the error was not discovered until the walls of the building were up and the roof was on. As the lot referred to is of more than ample width, I can assure you that the error of building location was entirely inadvertant. Yours very truly, Harold A. Martyr 1031 Bauhinia Road Delray Beach, Florida MINUTES OF THE MEETING OF THE TOWN COMMISSION SITTING AS A BOARD OF EQUALIZERS ON: August 14, 1962 The Town Commissioners of Gulf Stream, Fla., met at the Town Hall in Gulf Stream, Fla., at 10:00 A.M. on August 14, 1962, to hear and consider complaints of the property owners and to receive and equalize values of real estate and improved property on the Town's Assessment Rolls as of January 1, 1962. The Deputy Town Clerk called the Commissioners' attention to Resolution #516 which set the date and time for the Equalization meeting and to the fact that the equalization meeting was postponed until August 14, 1962. The Town's tax assessment roll was presented to the Commissioners sitting as a Board of Equalizers. The following summation of valuations was disclosed: Total value of all real estate and improvements and personal property as recorded on the Town's Tax Assessment Roll on January 1, 1962 ........ $8,919,040.00 Exemptions $ 216,000.00 Total taxable value of real estate and improvements and personal property $8,703,040.00 The Town Commission sitting as a Board of Equalizers, after reviewing the tax roll and the valuations, passed the following resolution: RESOLUTION #519 WHEREAS, the Town Commission, sitting as a Board of Equalizers on August 14, 1962 between 10:00 A.M. and 12:01 P.M., did hear all complaints by property owners of Gulf Stream, Florida, relative to the values placed on property as of January 1, 1962, did affirm and agree that all valuations are fair, reasonable and just and DO HEREBY RESOLVE that the Tax Assessment and Valuation Roll as recorded by the Town Tax Assessor as of January 1, 1962, be HEREBY approved and adopted. It is hereby recorded that no tax- payer tendered a written complaint to the Board of Equalizers during the Equalization meeting. Equalization Meeting Minutes Page 2 The following Resolution as passed, approved and adopted: RESOLUTION #520 BE IT RESOLVED that the 1962 Tax Roll, as has on August 14, 1962 been equalized, be returned to the Tax Assessor and that the Tax Assessor is hereby instructed and directed by the Town Commissioners to fix values on the said assessment roll, and we do HEREBY DECLARE the said values to be equalized. The said values shall not be altered in value except there be a change adopted by Palm Beach County on their Tax Assessment Rolls. The meeting was adjourned at 12'e01 P.M. Attest: RESOLUTION #521 BE IT RESOLVED, that all real property as recorded on the Town Tax Rolls for the year 1962, and as equalized on August 14, 1962, be assessed at the rate of five and seven - tenths (5.7) mills for the taxable year - 1962. The Deputy Town Clerk is hereby authorized to levy the tax of five and seven-tenths mills on each and every taxable piece of real4property within the Town limits of Gulf Stream, Florida, for the taxable year - 1962. RESOLVED that the following schedule of percentages shall be paid by the Water Fund for the fiscal year October 1, 1962 through September 30, 1963: 1. Bookkeeping Service: 1/4 of total 2. Legal & Professional: Annual Audit 1 /10 of Total Attorneys 1 /10 of Retainer Fee 3. Postage & Stationery - Actual 4. Salaries: Roy Cowart 1/20 of Total Clerk & Assistant 1 /10 of Total 5. OASI Tax: 3 -1/8 of 04 6. Secretarial Service - Actual 7. Car use: Upkeep - 1/20 of 1/2 of Police Cars Maintenance Gas & oil - 1/20 of 1/2 of Police Cars Gas & Oil.
