AMENDING THE KLONDIKE LANDFILL LOCAL GOVERNMENT GUARANTEE TO
ALLOW DEFERMENT OF CLOSURE AND POST -CLOSURE FUND
REQUIREMENTS
WHEREAS, Grand County (the "County") and the City of Moab (the "City") have adopted a Klondike
Landfill Local Government Guarantee (the "Guarantee");
WHEREAS, the Guarantee provides and the Grand County Solid Waste Management Special Service
District #1 (the "District") acknowledges that the District shall annually deposit into and build a closure
and post -closure card fund in the amount established by the District engineer; and
WHEREAS, the District requests the use of the funds already set aside and deferment of depositing
requirements for fiscal years 1999 and 2000;
WHEREAS, the County and the City deem it to be in the best interest of their constituents to provide
more operating funds to the District for the first few years of its new landfill operations, thereby
significantly reducing the cost that might be passed on to the residents of the County and the City.
NOW, THEREFORE, be it resolved by the City of Moab as follows:
I. That this resolution amends the guarantee.
2. That the City allows the District to utilize funds already set aside and defer building the closure and
post -closure care fund for Klondike Landfill for fiscal years 1999 and 2000, contingent upon the County
approving same deferment.
3. That the County and the City will review continued deferment in October of 2000, prior to the
District's formulation of its 2001 fiscal year budget, at which time the District may be required to begin
building the fund.
4. That this Resolution was adopted in compliance with the Utah Open and Public Meetings Act and
hereby is binding upon the City in accordance with its terms.
5. That the amendment to the Guarantee will become effective upon written acknowledgement from the
County and the District.
Passed and adopted by action of the Goveming Body of Moab City in open session this
12t day of January, 1999.
