Hughes A Stop Work order was posted at Wearhouse Bargains, 201 McKenzie Street, on July 14, 2011. A fence had been constructed without a building permit and a large metal carport was under construction within the fence. On July 19, 2011, Ms. Green applied for a building permit for the fence and the carport. Paperwork for the carport was provided by Ms. Green, however, it did not include documentation by a Georgia registered engineer that the carport had been designed to withstand a 130 mph 3- second wind gust as required by the City's design standards. In addition, an accessory structure on a commercial lot may not extend beyond the front building line of the principle structure, may not be located nearer than 5 -feet from any property line, may not reduce the amount of required parking, and may not be erected without approval of the City (Section 3 -070). This letter is notice that within 14 -days of receipt of this letter either the fence must be removed or a building permit must have been issued. If you are able to demonstrate that the fence has not reduced the amount of required parking it would be possible to permit the construction of the fence. Enclosed is an application. For the reasons stated in paragraph two, within 14 -days of receipt of this letter the carport must be removed. A teardown permit is required prior to beginning work. Enclosed is an application. FINDINGS OF FACT 1. Respondent was certified to practice as a professional engineer in the State of Georgia at all times relevant to the matters asserted herein 2. On or about October 22, 2009, Respondent entered into a Settlement Agreement with the Missouri Board of Architects, Professional Engineers, Professional Land Surveyors and Landscape Architects ( "MO Settlement Agreement "), for signing and sealing architectural drawings despite not having a Missouri license to practice architecture. Respondent did hold a Missouri license to practice as a professional engineer at the time. 3. The MO Settlement Agreement placed Respondent's license to practice as a professional engineer on probation for a period of five years. 4. On or about March 19, 2010, Respondent entered into a Settlement Agreement with the New Hampshire Board of Licensure for Professional Engineers ( "NH Settlement Agreement "), for failing to disclose his disciplinary action in Missouri when answering applicable questions on his renewal application to practice as a professional engineer in New Hampshire. 5. The NH Settlement Agreement ordered Respondent to pay an administrative fine of two thousand five hundred dollars ($2,500.00), within ninety days of the effective date of the Agreement. 6. O.C.G.A. § 43 -1 -19 (a) states: "A professional licensing board shall have the authority to ... discipline a person licensed by that board, upon a finding by a majority of the entire board that the licensee has: (5) Had his or her license to practice a business or profession licensed under this title revoked, suspended, or annulled by any lawful licensing authority other than the board; or had other disciplinary action taken against him or her by any such lawful licensing authority other than the 2 board..." 7. Respondent admits to the above - styled Findings of Fact and waives any further findings of fact not already contained in this Order. CONCLUSIONS OF LAW Respondent's conduct and the above Findings of Fact constitute sufficient grounds for imposition of sanctions upon his professional engineering certificate of registration in the State of Georgia, pursuant to O.C.G.A. Title 43, Chapters 1 and 15, and the Rules promulgated thereunder. ORDER The Georgia Board of Registration for Professional Engineers and Land Surveyors, having considered all the facts and circumstances surrounding this case, hereby orders, and Respondent hereby agrees, that this matter shall be disposed of as follows: 1. Respondent's certificate of registration to practice as a professional engineer in the State of Georgia shall be immediately placed on probation to run concurrent with the probation on Respondent's Missouri license, subject to the following terms and conditions: 3 a. Respondent agrees to comply with all applicable state and federal laws relating to the practice of professional engineering. If Respondent fails to abide by all state and federal laws relating to the practice of professional engineering in the State of Georgia, the Rules and Regulations of the Georgia Board of Registration for Professional Engineers and Land Surveyors, or the terms of this Consent Order and probation, Respondent's certificate may be suspended, upon substantiation thereof. If the Board has substantiated that Respondent has violated the terms of his probation under this Consent Order, the Board shall notify Respondent by sending written notification to Respondent's address of record with the Board that within thirty (30) days his certificate to practice professional engineering in the State of Georgia will be placed on suspended status for five years. Respondent may respond to the notice in writing or request an appearance before the Board in order to explain why the probation should be continued and no suspension imposed. b. After Respondent's certificate has been on probation for the required period, Respondent may petition the Board for termination of the probationary status of his certificate by certifying under oath before a notary public that Respondent has complied with all conditions of probation as set forth in this Consent Order. Respondent acknowledges that to ensure the Board terminates the probationary status of Respondent's certificate, Respondent must petition the Board for such termination. That is, Respondent's failure to 4 petition the Board for termination of the probationary status of Respondent's certificate may result in the probationary status continuing indefinitely, notwithstanding anything to the contrary in this Consent Order. 2. In addition to and in conjunction with any other sanctions contained herein, this Consent Order and the dissemination thereof shall serve as a public reprimand to the Respondent for his conduct. 3. Approval of this Consent Order by the Georgia Board of Registration for Professional Engineers and Land Surveyors shall in no way be construed as condoning Respondent's conduct, and shall not be construed as a waiver of any lawful rights possessed by the Board. 4. Respondent has read this Consent Order and understands its contents and implications. Respondent understands that he has a right to a hearing in this matter and freely, knowingly and voluntarily waives that right by signing this Consent Order. Respondent understands that this Consent Order will not become effective until approved by the Board, signed by the Division Director, and docketed by Legal Services. Respondent further understands and agrees that a representative of the Legal Services Section of the Professional Licensing Boards may be present during the presentation of this Consent Order and that the Board shall have the authority to review the investigative file and all relevant evidence in considering this Consent Order. Respondent understands 5 that this Consent Order, once approved and docketed, shall become effective and constitute a public record, evidencing disciplinary action by the Board. However, if this Consent Order is not approved, it shall not constitute an admission against interest in this proceeding, or prejudice the right of the Board to adjudicate this matter.
