HomeMy Public PortalAbout2017-059 Resolution Granting Preliminary and Final Plat Approval for Hamel Road Thirty TwoMember Pederson introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION 2017-59 RESOLUTION GRANTING PRELIMINARY AND FINAL PLAT APPROVAL FOR HAMEL ROAD THIRTY TWO WHEREAS, the city of Medina (the "City") is a municipal corporation, organized and existing under the laws of Minnesota; and WHEREAS, 32 Hamel Road LLC (the "Owner") owns property located at 32-42 Hamel Road (the "Property"), which is legally described in Exhibit A, attached hereto; and WHEREAS, the Owner has requested preliminary and final approval of a plat to re -plat the Property into a single parcel; and WHEREAS, the Planning Commission reviewed the plat on July 11, 2017; and WHEREAS, the City Council reviewed the proposed plat at the July 18, 2017 meeting; and WHEREAS, the City Council has, subject to the terms and conditions contained herein, made the following findings of fact with regards to the requested plat: (a) Because the plat results in a combination of lots, it is appropriate to waive the requirement for a public hearing pursuant to City Code Section 820.65. (b) The proposed subdivision is consistent with the Comprehensive Plan and is not premature, as defined in City Code Section 820.28. (c) The physical characteristics of this site appear suitable for the type of development contemplated and the design of the subdivision is not likely to cause environmental damage or cause public health problems. (d) The resulting parcel meets minimum lot size standards and the density of development is consistent with City regulations. (e) The design of the subdivision will not conflict with public or private streets, easements or right-of-way. NOW, THEREFORE, BE IT RESOLVED, that the City Council of Medina, Minnesota hereby grants preliminary and final plat approval for the plat received by the City on June 14, 2017, subject to the following terms and conditions: 1. The Owner shall meet the requirements of the City Attorney with regards to plat corrections and title documentation; 2. The plat shall be filed with Hennepin County within 180 days of the date of the city council resolution granting final approval or the final plat shall be considered void, unless Resolution No. 2017-59 August 2, 2017 a written request for time extension is submitted by the Owner and approved by the City Council; and 3. The Owner shall pay to the City a fee in an amount sufficient to reimburse the City for the cost of reviewing the preliminary and final plat and related documents. Dated: August 2, 2017.
