HomeMy Public PortalAboutResolution 2020-10-03 Providing Temporary Relief for Businesses from Certain Requirements RESOLUTION 2020-10-03 A RESOLUTION OF THE TOWN OF FRASER, COLORADO PROVIDING FOR TEMPORARY RELIEF FOR BUSINESSES FROM CERTAIN REQUIREMENTS WHEREAS, the Board of Trustees of the Town of Fraser, Colorado, pursuant to Colorado statute, is vested with the authority of administering the affairs of the Town of Fraser, Colorado; and WHEREAS, on March 10, 2020, Governor Jared Polis, by Executive Order, declared a statewide disaster emergency due to the presence of COVID-19 in the State of Colorado. The Executive Order identifies the potential for community spread, and, activates disaster response and recovery efforts applicable to state, local and intergovernmental disaster emergency plans; and WHEREAS, on April 1, 2020, the Fraser Board of Trustees declared that there exists in Grand County and the Town of Fraser a disaster emergency; and WHEREAS, the Board of Trustees recognizes that Fraser businesses have been hard hit by COVID-19 and therefore adopted Resolution 2020-05-07 on May 20, 2020 providing for temporary relief from certain code requirements which expire on October 15, 2020; and WHEREAS, given the challenges these businesses face and their importance to our community, the Board of Trustees would like to provide these businesses temporary relief from certain requirements of the Town Code until such time as the pandemic concerns subside and compliance with Town standards and requirements can be reasonably achieved; and WHEREAS, there continue to be concerns about the spread of COVID19 through reusable bags. NOW, THEREFORE, BE IT RESOLVED by the Board of Trustees of the Town of Fraser, Colorado as follows: 1. Existing restaurants, brew pubs, distilleries, and similar establishments that are authorized by state or county health orders to begin reopening are encouraged to consider expanding their outdoor seating areas and the parking requirements are temporarily suspended to allow use of those areas for outdoor seating. Outdoor seating areas shall be clearly delineated from parking areas. 2. Any applicable fees related to installation of temporary tent structures are hereby waived. The installation of temporary tent structures and/or outdoor heating appliances are required to comply with the manufacturer's requirements. 3. The Town Manager or their designee is authorized to establish temporary "curbside pickup/drop off' zones in appropriate locations in the business district. Any such zones will be established in conformance with Colorado Department of Transportation requirements and may be signed accordingly. 4. The requirements of the Town Code as relates to temporary signage for existing businesses are temporarily suspended provided that such signage does not obstruct any public sidewalk, trail, or street or related snow management operations. 5. Businesses are encouraged to contact Town Staff for assistance with any proposals that may assist with reopening in compliance with the guidelines of state or county health orders. 6. The disposable bag fee imposed by Chapter 7 Article 8 of the Town Code is hereby temporarily suspended through April 30, 2021. 7. Staff is hereby directed to work with county and state entities to facilitate other provisions that may assist businesses with reopening in compliance with the guidelines of state or county health orders (such as relaxation of state liquor law requirements relating to modification of premise). 8. After the expiration of the provisions of this resolution, businesses must comply with any requirements of the Town Code that have been temporarily suspended. The provisions of this resolution shall expire on April 30, 2021, unless extended or otherwise amended by the Fraser Board of Trustees. The above and foregoing Resolution was, on motion duly made and seconded, adopted on the 7th day of October 2020.
