LaPorte Also attending: Mrs. Kirton; Messrs William Koch, C. P. Young, R. A. Nilsen, Paul Knowles, J. W. Elliot, Gino DiMarco. Mayor Dodson called the meeting to order. The Minutes of the previous meeting were read, approved and adopted. The Financial Report for November 1961, was read and approved. All payments recorded in this report were approved. Mayor Dodson recognized the presence of Col. C. P. Young and stated the first order of business would be to discuss Col. Young's request for a variance in the Zoning Code so that he could construct a carport at the rear of his property. Dep. Town Clerk Gwynn read a letter signed by Curtis M. Shetler and Daniel W. Colhoun stating their objections to a variance being granted. This letter is attached and becomes a part of these Minutes. . Col. Young thanked the Commission for considering his request. He further stated that he felt his request was reasonable and cited examples of damage caused to his automobile because of rust. He stated that our zoning is similar to the Town of Palm Beach and they have been known to make exceptions where they were deemed a hardship. Mayor Dodson said that the Commission sympathized with him in the problem but had agreed to grant a variance only if there were no objections from the immediate neighbors. Mr. Iglehart stated that he believed the Commission was sold on the request, but felt the neighbors must be convinced also. Mayor Dodson called for a vote on the question: Mr. Hart voted Yes. Mr. Laporte voted No - stating that he the Commission should go against the neighbors in any matter of zoning. Mr. Hoyle voted No. Mr. Iglehart voted No. Mayor Dodson voted No. did not believe wishes of the Commission Meeting - Dec. 9, 1961 -2- Mr. Paul Knowles presented a request to the Commission from all the property owners on the south side of Pelican Lane and west of Andrews Avenue. These properties requested the Town of Gulf Stream to annex them into the Town. The Commission unanimously voted to annex these properties and instructed Mr. Knowles to work with the Town Clerk and the Town Attorney in preparing the necessary ordinance and conditions for annexation. Mr. Gino DiMarco presented a petition to the Commission requesting that the Town annex the five properties on the east side of County Road that have houses, all the property owners involved having signed the petition. The Commission indicated that the affected property owners must bear all expenses and if and when they should want the Town to furnish water, they would have to pay all costs for tieing in to the Town's distribution system. The Commission voted unanimously, except for Mr. Iglehart, who abstained, to annex these properties, and instructed the Town Clerk to work with these property owners and Mr. Lilienthal in preparing the necessary annexation ordinance and conditions for annexation. Mrs. Evelyn Uihlein called the Town Hall during the discussion of annexation of the properties on County Road, requesting that her property be included in the discussion. Mr. Iglehart stated that her property, which is vacant land, extends through from County Road to AlA. The Commission felt that her property should be annexed only to the place where the rear line of the five other properties crosses her property. And further, that since her property is vacant, it will be zoned as residence only and that certain deed restrictions should be placed on this property so that it will be in accordance with the Town's Zoning District A. The Town Clerk was authorized to discuss the matter with Mrs. Uihlein and learn her wishes. A letter from the Town of Ocean Ridge was read to the Commission. This letter urged the Town to adopt a resolution backing the construction of a bridge across the Intra - Coastal Waterway at S. E. 23rd Street in Boynton Beach. There was a general discussion of the subject and it was agreed by the Com- mission that in light of other needs of the area at this time, a bridge at this location was deemed inadvisable. The Dep. Town Clerk was instructed to write a letter to the Town of Ocean Ridge advising them of the Commission's feelings. A telegram from Mr. Amory Haskell, President of the Gulf Stream Golf Club was read to the Commission. Commission Meeting - Dec. 9, 1961 -3- This telegram stated the Club could not furnish water supply to the Reed development without major expenditure on the part of the Club. Mr. Hart was asked to get a written release from the Club stating that inability of the Town to supply water to the Reed property would not in any way violate the terms of our present water contract with the Club. Mr. Iglehart requested that the policemen be advised to fine the County Sanitation Co. $25.00 the next time they park their truck on the left side of any street in the Town. He further requested that they be advised that the fine will be doubled each time thereafter. At the request of the property owners on No. County Road, the Commission instructed the Dep. Town Clerk to contact the Palm Beach County Engineer and request that this road be made one -way South. it was moved, seconded and passed unanimously that the Mayor and Town Clerk be authorized to sign a contract for the leasing of the present dump site for a term of five years at an annual rental of $200.00 per year. Copies of the annual audit report, prepared by Himes & Himes, C.P.A.s, were given to each of the Commissioners for their study. It was moved that the Town pay the amount of $850.00 to them for their services rendered. Motion seconded and passed unanimously. Christmas bonuses of the following amounts were approved by the Commission_ Rafuse $15.00, Glass $75.00, Bradwell $50.00, and Brown, Partin, Cowart and Gwynn $100.00 each. Mr. Nilsen suggested to the Commission the need for a special police force to be appointed in the event of a hurrican or other disaster to prevent looting and aid in rescue work. There was a general discussion of the matter and it was agreed to discuss this matter further at the next meeting. Gentlemen: December 8 1961 Re: Application for zoning variance of Cecil Young. We strongly feel the present zoning restrictions good and should not be violated except for sound and substantial reason.In this caselwe feel it questionable that a variance is warranted as the present restrictions were in effect at the time this propertywas developed and also a t the time purchased by Mr. Young. Also,we feel any structure that comes to ar near this right— of— way,which is very narrow, wogld be objectionable and not practical.
