411 INITIATION
1. CALL TO ORDER
The regular meeting of the Planning Commission of the City of
Temple City was called to order at 7:30 p.m., March 13, 1979,
by Chairman Lawson.
2. PLEDGE OF ALLEGIANCE
Chairman Lawson led the Pledge of Allegiance to the Flag.
3. ROLL CALL
Present: Commissioners: Abraham, Breazeal, Seibert, Stacy, Lawson
Absent: Commissioners: None
Also present: City Manager Koski, City Attorney Martin, Planning
Director Dragicevich and Asst. Planner Alexanian.
4. APPROVAL OF MINUTES - Meeting of February 27, 1979
There being no additions or corrections to the minutes, Commissioner
Seibert moved to approve them as written. Motion was seconded by
Commissioner Breazeal and carried by roll call vote with Commission-
ers Abraham, Breazeal, Seibert and Stacy voting affirmative, and
Chairman Lawson abstaining.
5. Request for beer and wine license
Golddigger's Bar - 9022 Las Tunas Drive
Director Dragicevich reported that this item was continued by the
Planning Commission from their regular meeting of February 27, 1979,
to allow applicant to furnish more evidence to substantiate his
claim that the use was in operation until late August or September
of 1978. The business in question is considered nonconforming since
'a conditional use permit has never been requested or approved in the
past, and if the use is abandoned for more than 180 days, according
to the Zoning Code, a conditional use permit must be applied for.
Applicant has submitted a payroll sheet for August 13, 1978, and
several utility bills and a bill for merchandise ordered on July,
25, 1978.
Mr. Gary Garr, owner of the bar when it was open previously, said
it was he who submitted the evidence to support the claim the bar
had not been closed for 180 days. He was willing to answer any
questions.
City Attorney Martin said that, based on the evidence, which indicates
the bar was not abandoned for a period of six months, he suggested
that the proceedings be terminated. Commissioner Breazeal so moved,
seconded by Commissioner Stacy. Motion carried by a roll call vote
with Commissioners Abraham, Breazeal, Seibert and Stacy voting in
favor, and Chairman Lawson abstaining.
6. PUBLIC HEARING: CONDITIONAL USE PERMIT CASE NO. 79 -550

Director Dragicevich stated applicant proposes to use existing
classrooms for junior high age students Monday through Friday, in

addition to Sunday School activities. He explained the plot plan
marked Exhibit "A" showing existing facilities. Classrooms are
located on the second floor, as shown in Exhibit "B" (floor plan).
Exhibit "C" indicates the various exterior elevations of the Social
Hall building, he continued. He further gave the factual data on
the subject property and surrounding area, the zoning history and
said a zone variance was granted in 1966 for expansion and alteration
of the then existing facilities. The church facilities have been in
existence since 1947.
Pursuant to California Environmental Quality Act of 1970, as amended,
the Director said a Negative Declaration has been prepared indicating
that the proposed use will not have a significant adverse impact upon
the environment. He reviewed the staff proposals if the request is
granted. The basic issue in this case is that churches and educational
facilities are under the conditional use permit category. Replying to
inquiry from Commissioner Breazeal, the Director said the parking is
adequate, and in this case is based on the number of fixed seats in the
facility.
Mr. Tim Burlingame, 3510 Baldwin Park Boulevard, Baldwin Park, repre-
senting the applicant, said he would be happy to answer any questions.
8 The negative impact, if any, would be very slight, and the school
would be an asset to the community. Responding to question from Com-
missioner Seibert, he said that, although the school is based in Baldwin
Park, only a small percentage of the students will be from Baldwin Park,
as the students are from the Temple City area and west, predominantly.
There being no one else to speak to the issue, Commissioner Seibert
moved to close public hearing, seconded by Commissioner Breazeal and
the motion carried.
Commissioner Seibert moved to certify filing of a Negative Declaration
of Environmental Impact as the proposed use will not have an adverse
impact upon the environment. Motion was seconded by Commissioner
Breazeal and carried.
Commissioner Seibert, in closed discussion, said the proposed use would
be an asset to the community, that private education is a practical
alternative to public education. He was strongly in favor of granting.
Commissioner Breazeal complimented applicant on the way the application
was completed. He further said the request meets the criteria for
granting under Section 9203 of the Zoning Ordinance as the site is ade-
41P for the use, has sufficient access to streets and highways, and
will not have an adverse effect upon adjacent property or the public
welfare. The absence of public testimony indicates the public does not
object to the use. He, too, was in favor of granting.
Commissioner Stacy agreed, as did Commissioner Abraham and Chairman Lawson,
who added that the Fire Department recommendations should be adhered to.
Commissioner Breazeal moved to approve Conditional Use Permit Case 79 -550
with staff conditions as it meets criteria for granting as stated pre-
viously. Motion was seconded by Commissioner Seibert and carried.
City Attorney Martin read title to Resolution No.79- 838PC, A RESOLUTION
OF THE PLANNING COMMISSION OF THE CITY OF TEMPLE CITY GRANTING A CONDI-
TIONAL USE PERMIT IN CASE NO. 79 -550. Commissioner Seibert moved to
waive further reading and adopt, seconded by Commissioner Breazeal and
the motion carried.
7. COMMUNICATIONS
The Planning Director referred to letter sent by staff to the Los Angeles
Regional Planning Commission opposing a proposed tentative parcel map
411 on Acacia near the Southern Pacific Railroad Tracks, in the County area.
Notice from Regional Planning arrived in City Hall on March 6, 1979, on
the date conditional approval was to be made by the Regional Planning
Commission.
8. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK - No one
Mr. John Shaw, 5816 Temple City Boulevard, said he was representing the
Chamber of Commerce this evening.

9. MATTERS FROM CITY OFFICIALS
(a) Environmental Quality and Code
Enforcement Program Report
The report was reviewed, received and filed. Commissioner Breazeal
referred to letter from the City to the YMCA regarding overgrown
vegetation, and he asked that properties on either side of that one
be checked for the same condition. Staff assured him it would be
investigated.
(b) Minor Zoning Modification Committee
Meeting of March 13, 1979
Director Dragicevich gave a report on Minor Zoning Modification
Case No. 79 -87, 9224 Longden Avenue, wherein applicant proposes
to build a two -story addition with less than the required side
setback for the second story at that address. The Committee
granted the request, with conditions. The minutes are set forth
in the full records of the Committee.
(c) Director Dragicevich informed the Planning
Commission that a budget session with the City Council would be
held Monday, March 19, 1979, at 7:30 p.m.
10. ADJOURNMENT
There being no further business, Commissioner Seibert made a motion,
seconded by Commissioner Breazeal and carried, to adjourn. Time of
adjournment was 7:50 p.m.
