SPECIAL TOWN MEETING

In accordance with the Warrant, the Special Town Meeting was held in the Stony Brook
Elementary School, Monday, May 1st, 2006.
The meeting was called to order at 7:10p.m. by the Moderator, Stephen L. Doyle. The
Tellers were June Gallant, David Lahive, Ruth Hanlon, Philip Kerrivan, Sheila Gerhardt,
and Pat Galante. The Checkers were Jane Nixon, John Nixon, Mary Ducharme, John
Unger, Ann Golini, Nancy Berbrick, Colette Williams, Elizabeth Hardy, and Gennaro
Tursi.
A quorum was present.
The Town Clerk, Mildred A. Unger, read the Special Town Meeting Warrant and the
return of the Warrant. There being no objection, the Moderator dispensed with the
reading of all the articles.
UNPAID BILLS
ARTICLE NO. 1: To see if the Town will vote to transfer from available
funds the sum of ONE THOUSAND EIGHT HUNDRED SEVENTY-THREE AND
00/100 ($1,873.00) DOLLARS to pay the following bills incurred but unpaid
during a previous fiscal year:
1. Cape Cod Hospital $1,459
2. Memphis Equipment $197
3. Asst. Wiring Inspector $25
4. Brewster Veterinary Hospital $15
5. Intercity Alarms $87
6. Medical Affiliates of Cape Cod $90

MOTION: I move that the town vote to approve article no. 1 as printed in the
warrant and, and to transfer the sum of $217.00 from Free Cash and
$1,656.00 from the Ambulance Receipts Reserved for Appropriation account
for these purposes.
ACTION: ADOPTED UNANIMOUSLY.
BUDGETARY TRANSFERS
ARTICLE NO. 2: To see if the Town will vote in the following manner to
appropriate from available funds and/or transfer the surplus funds in some
departments the amounts needed to prevent deficits in other departments this
fiscal year:
a) Transfer the sum of $1,000.00 from Line Item No. 7 (Assessor Wages) to
Line Item No. 8 (Town Treasurer/Collector’s Wages) of Article No. 5 of the
2005 Annual Town Meeting.
b) Transfer the sum of $1,000.00 from Line Item No. 7 (Assessor Wages) to
Line Item No. 14 (Vehicle Pool Maintenance) of Article No. 5 of the 2005
Annual Town Meeting.
c) Transfer the sum of $25,000.00 from the Ambulance Receipts Reserved for
Appropriation Account to Line Item No. 26 (Fire/Rescue Wages) of Article
No. 5 of the 2005 Annual Town Meeting.
d) Transfer the sum of $5,000.00 from the Ambulance Receipts Reserved for

MOTION: I move that the town vote to approve article no. 2 as printed in the
warrant and, and to transfer the total sum of $126,500.00 for these
purposes.
ACTION: ADOPTED UNANIMOUSLY.
PRIVATE ROAD BETTERMENT ENGINEERING FOR CRANVIEW ROAD
ARTICLE NO. 3: To see if the Town will vote to transfer from available
funds the sum of EIGHT THOUSAND AND 00/100 ($8,000.00) DOLLARS to
finance costs associated with engineering services for a private road betterment for
Cranview Road and to authorize the Town Administrator to solicit bids and/or
proposals, enter into a contract or contracts and expend said funds for this
purpose, said expense to be recovered through the betterment assessments
against the abutters, or to take any other action relative thereto.

MOTION: I move that the town vote to approve article no. 3 as printed in the
warrant, and to transfer the sum of $8,000.00 from the article no. 33 of the
May 2, 2002 Annual Town Meeting (Millstone Road Betterment project) for
this purpose.
ACTION: ADOPTED.
STONY BROOK ELEMENTARY SCHOOL RENOVATION PROJECT
ARTICLE NO. 4: To see if the Town will vote to transfer from available
funds the sum of THREE HUNDRED AND FORTY THOUSAND AND 00/100
($340,000.00) DOLLARS to pay costs associated with the engineering, design,
construction, renovation, appurtenances and all other costs incidental and related
thereto for the repair and improvement of the Stony Brook Elementary School, and
to authorize the Town Administrator to solicit bids, enter into contracts, and expend
these funds for this purpose, or to take any other action relative thereto.

MOTION: I move that the town vote to approve article no. 4 as printed in the
warrant, and to transfer the sum of $340,000.00 from the Stabilization fund
for this purpose.
ACTION: ADOPTED.
LAND ACQUISITION / COMMUNITY PRESERVATION ACT
ARTICLE NO. 5: To see if the Town will vote to act upon the recommendations
of the Community Preservation Committee and authorize the Board of Selectmen to
acquire a parcel of land designated on Brewster Assessors’ Map 38 as Parcel 93,
located off Slough Road in Brewster, Barnstable County, Massachusetts, consisting
of eight and a half (8.5 ac.) acres, more or less, and more accurately described in a
deed recorded in the Barnstable County Registry of Deeds in Deed Book 11898,
Page 302, together with a right of way over Scarsella Road (now known as
Glenwood Road) to Slough Road described in the Stipulation filed in Land Court
Confirmation Case No. 37173; to acquire said parcel by gift, purchase and/or
eminent domain taking under Massachusetts General Laws, Chapter 79, or any
other enabling authority; to acquire said land for open space, watershed protection,
conservation and passive recreation purposes for the general public, consistent with
the provisions of Mass. Gen. Laws, ch. 40, §8C, 310 C.M.R. 22.00, and Article 97 of
the Amendments to the Constitution of the Commonwealth of Massachusetts; to
appropriate the sum of SIX HUNDRED AND THREE THOUSAND AND 00/100
($603,000.00) DOLLARS to pay for land acquisition, and other costs incidental
and related thereto; to authorize the Town Treasurer, with the approval of the
Board of Selectmen, to borrow up to the sum of SIX HUNDRED THOUSAND
AND 00/100 ($600,000.00) DOLLARS in anticipation of revenue and grant
receipts pursuant to the provisions of Chapter 149, §298 of the Acts of 2004, as
amended by Chapter 352, §§129-133 of the Acts of 2004, the so-called Barnstable
County Community Preservation Act, and/or to borrow money pursuant to the
provisions of Massachusetts General Laws, Chapter 44, Section 7(3) and Section
8C, and/or any other enabling authority, and to issue bonds and/or notes of the
Town therefor; to authorize the Town Treasurer to transfer from available sums the
sum of THREE THOUSAND AND 00/100 ($3,000.00) DOLLARS for the
purpose of paying incidental and related costs, including grant funding applications,
grant compliance fees, costs for the preparation, issuance and marketing of notes
and bonds issued hereunder and for paying interest on temporary notes issued in
anticipation thereof; to authorize the Board of Selectmen and the Conservation
Commission to apply for, accept and expend any funds which may be provided by
the Commonwealth or other public or private sources to defray a portion or all of
the costs of acquiring this property, including but not limited to funding under the
Massachusetts Executive Office of Environmental Affairs Drinking Water Supply
Protection Grant Program, provided that the amount of notes or bonds issued
hereunder shall be reduced by the amount of any such grants received or funds
accepted prior to the sale of such notes or bonds; to authorize the Board of
Selectmen to grant to the Trustees of the Brewster Conservation Trust, for no
consideration, a perpetual Conservation Restriction on said premises pursuant to
the provisions of General Laws, Chapter 184, Sections 31 through 33, allowing the
aforementioned uses; to authorize the Board of Selectmen, pursuant to the
provisions of General Laws, Chapter 40, Section 4A, to grant to the Dennis Water
District a perpetual Watershed Protection Restriction on the Slough Road
Woodlands Properties, over Tracts I and II, pursuant to the provisions of General
Laws, Chapter 184, Sections 31 through 33, for consideration in an amount up to
One Million ($1,000,000.00) Dollars; to authorize the Conservation Commission to
assume the care, custody, control and management of the property; and to
authorize the Board of Selectmen and Conservation Commission to enter into all
agreements and execute any and all instruments as may be necessary on behalf of
the municipality to effect this purchase and obtain reimbursement funding; or to
take any other action relative thereto.
(Two-thirds Vote Required) (Community Preservation Committee)
MOTION: That in accordance with the recommendations of the Community
Preservation Committee, the Board of Selectmen is hereby authorized to
acquire, by purchase, gift, eminent domain or otherwise, a parcel of land
designated on Brewster Assessors’ Map 38 as Parcel 93, located off Slough
Road in Brewster, Barnstable County, Massachusetts, consisting of eight and
a half (8.5 ac.) acres, more or less, and more accurately described in a deed

AND 00/100 ($600,000.00) DOLLARS in anticipation of revenue and grant
receipts pursuant to the provisions of Chapter 149, §298 of the Acts of 2004,
as amended by Chapter 352, §§129-133 of the Acts of 2004, the so-called
Barnstable County Community Preservation Act, and/or to borrow money
pursuant to the provisions of Massachusetts General Laws, Chapter 44,
Section 7(3) and Section 8C, and/or any other enabling authority, and to
issue bonds and/or notes of the Town therefor; that the additional sum of
THREE THOUSAND AND 00/100 ($3,000.00) DOLLARS is hereby transferred

marketing of notes and bonds issued hereunder and for paying interest on
temporary notes issued in anticipation thereof; that the Board of Selectmen
and the Conservation Commission are each authorized to apply for, accept
and expend any funds which may be provided by the Commonwealth or other
public or private sources to defray a portion or all of the costs of acquiring
this property, including but not limited to funding under the Massachusetts

the Board of Selectmen is hereby authorized to enter into an intermunicipal
agreement with the Dennis Water District, pursuant to the provisions of
Chapter 40, Section 4A of the General Laws, with respect to the granting of a
perpetual Watershed Protection Restriction to the Dennis Water District on
the Slough Road Woodlands Properties, over Tracts I and II, pursuant to the
provisions of General Laws, Chapter 184, Sections 31 through 33, for
consideration in an amount up to One Million ($1,000,000.00) Dollars, and
which intermunicipal agreement would among other things, permit the
Dennis Water District to borrow funds on its full faith and credit to raise
funds needed to pay for this Watershed Protection Restriction; that the
Conservation Commission is authorized to assume the care, custody, control
and management of the property; and that the Board of Selectmen and
Conservation Commission are each authorized to enter into all agreements
and execute any and all instruments as may be necessary on behalf of the
Town to effect this purchase and obtain reimbursement funding.
ACTION: THE FOLLOWING ARTICLE WAS DECLARED ADOPTED BY A 2/3
VOTE.
LAND ACQUISITION / COMMUNITY PRESERVATION ACT
ARTICLE NO. 6: To see if the Town will vote to act upon the
recommendations of the Community Preservation Committee and authorize the
Board of Selectmen to acquire the parcels of land designated on Brewster
Assessors’ Map 38 as Parcels 59, 61, 67, 122, 123, 124, 125 and 126 located off
Slough Road in Brewster, Barnstable County, Massachusetts, consisting of fifty-one
(51 ac.) acres, more or less, and more accurately described in Document No.
574740, which Document is registered with the Barnstable County Registry District
of the Land Court, and further shown on Land Court Plan 37208A, as Lots 1
through 6 and Land Court Plan 37207A, as Lots 1 and 2; to acquire the parcels in
two (2) separate phases, acquiring some of the parcels in Fiscal Year 2006 and the
remaining parcels in Fiscal Year 2007; to acquire said parcels by gift, purchase
and/or eminent domain taking under Massachusetts General Laws, Chapter 79, or
any other enabling authority; to acquire said land for open space, watershed
protection, conservation and passive recreation purposes for the general public,
consistent with the provisions of Mass. Gen. Laws, ch. 40, §8C, 310 C.M.R. 22.00,
and Article 97 of the Amendments to the Constitution of the Commonwealth of
Massachusetts; to appropriate the sum of THREE MILLION SEVEN HUNDRED
AND FIFTEEN THOUSAND AND 00/100 ($3,715,000.00) DOLLARS to pay
for land acquisition, and other costs incidental and related thereto; to authorize the
Town Treasurer, with the approval of the Board of Selectmen, to borrow up to the
sum of THREE MILLION SIX HUNDRED AND FIFTY THOUSAND AND
00/100 ($3,650,000.00) DOLLARS in anticipation of revenue and grant
receipts pursuant to the provisions of Chapter 149, §298 of the Acts of 2004, as
amended by Chapter 352, §§129-133 of the Acts of 2004, the so-called Barnstable
County Community Preservation Act and/or to borrow money pursuant to the
provisions of Massachusetts General Laws, Chapter 44, Section 7(3) and Section
8C, and/or any other enabling authority, and to issue bonds and/or notes of the
Town therefore; to authorize the Town Treasurer to transfer from available sums
the sum of SIXTY-FIVE THOUSAND AND 00/100 ($65,000.00) DOLLARS for
the purpose of paying incidental and related costs, including grant funding
applications, grant compliance fees, costs for the preparation, issuance and
marketing of notes and bonds issued hereunder and for paying interest on
temporary notes issued in anticipation thereof; to authorize the Board of Selectmen
and the Conservation Commission to apply for, accept and expend any funds which
may be provided by the Commonwealth or other private or public sources to defray
a portion or all of the costs of acquiring this property, including but not limited to
funding under the Massachusetts Executive Office of Environmental Affairs Drinking
Water Supply Protection Grant Program, provided that the amount of notes or
bonds issued hereunder shall be reduced by the amount of any such grants
received or funds accepted prior to the sale of such notes or bonds; to authorize
the Board of Selectmen to grant to the Trustees of the Brewster Conservation
Trust, for no consideration, a perpetual Conservation Restriction on said premises

allowing the aforementioned uses within the meaning of Massachusetts General

easement over said premises to access abutting land of the Trust; to authorize the
Board of Selectmen, pursuant to the provisions of General Laws, Chapter 40,
Section 4A, to grant to the Dennis Water District a perpetual Watershed Protection
Restriction on the Slough Road Woodlands Properties, over Tracts I and II,
pursuant to the provisions of General Laws, Chapter 184, Sections 31 through 33,
for consideration in an amount up to One Million ($1,000,000.00) Dollars; to
authorize the Conservation Commission to assume the care, custody, control and
management of the property; and to authorize the Board of Selectmen and
Conservation Commission to enter into all agreements and execute any and all
instruments as may be necessary on behalf of the municipality to effect this
purchase and obtain reimbursement funding; or to take any other action relative
thereto.

MOTION: That in accordance with the recommendations of the Community
Preservation Committee, the Board of Selectmen is hereby authorized to
acquire, by purchase, gift, eminent domain or otherwise to acquire the
parcels of land designated on Brewster Assessors’ Map 38 as Parcels 59, 61,
67, 122, 123, 124, 125 and 126 located off Slough Road in Brewster,
Barnstable County, Massachusetts, consisting of fifty-one (51 ac.) acres,
more or less, and more accurately described in Document No. 574740, which
Document is registered with the Barnstable County Registry District of the
Land Court, and further shown on Land Court Plan 37208A, as Lots 1 through
6 and Land Court Plan 37207A, as Lots 1 and 2; that such parcels may be
acquired in two (2) separate phases at the discretion of the Selectmen, with
some of the parcels to be acquired in Fiscal Year 2006 and the remaining
parcels in Fiscal Year 2007; that such land shall be acquired for open space,
watershed protection, conservation and passive recreation purposes for the
general public, consistent with the provisions of Mass. Gen. Laws, ch. 40,
§8C, 310 C.M.R. 22.00, and Article 97 of the Amendments to the Constitution
of the Commonwealth of Massachusetts; that the sum of THREE MILLION
SEVEN HUNDRED AND FIFTEEN THOUSAND AND 00/100 ($3,715,000.00)
DOLLARS is hereby appropriated to pay for the costs of this land acquisition,
and other costs incidental and related thereto; that to meet this
appropriation, the Town Treasurer, with the approval of the Board of
Selectmen, is hereby authorized to borrow up to the sum of THREE MILLION
SIX HUNDRED AND FIFTY THOUSAND AND 00/100 ($3,650,000.00)
DOLLARS in anticipation of revenue and grant receipts pursuant to the

FIRE & WATER FACILITIES / OWNER PROJECT MANAGER SERVICES
ARTICLE NO. 7: To see if the Town will vote to transfer from available
funds the sum of SIXTY-FIVE THOUSAND AND 00/100 ($65,000.00)
DOLLARS to pay costs associated with the requirements of the provisions of
Chapter 193 of the Acts of 2004, which require that the town contract for
professional services for an owner project manager to assist with the coordinating
and managing the engineering, design, construction and/or renovation,
appurtenances and all other costs incidental and related thereto for the Water
Department Office/Garage buildings and the Fire Station, and to authorize the
Town Administrator to solicit bids, enter into contracts, and expend these funds for
this purpose, or to take any other action relative thereto.

MOTION: I move that the town vote to approve article no. 7 as printed in the
warrant and to transfer the sums of $15,000.00 from Free Cash and
$50,000.00 from Water Revenues for this purpose.
ACTION: ADOPTED.
WATER DEPARTMENT OFFICE/GARAGE DESIGN SERVICES
ARTICLE NO. 8: To see if the Town will vote to transfer from available
funds the sum of ONE HUNDRED THOUSAND AND 00/100 ($100,000.00)
DOLLARS to pay costs associated with the engineering, design, construction,
appurtenances and all other costs incidental and related thereto for the
construction of a new Water Department Office and Garage facility, and to
authorize the Town Administrator to solicit bids, enter into contracts, and expend
these funds for this purpose, or to take any other action relative thereto.

MOTION: I move that the town vote to approve article no. 8 as printed in the
warrant and to transfer the sum of $100,000.00 from article no. 24 (Water
Standpipe No. 2 project) of the May 2001 Annual Town Meeting for this
purpose.
ACTION: ADOPTED.
FIRE STATION FEASIBILITY STUDY
ARTICLE NO. 9: To see if the Town will vote to transfer from available
funds the sum of TWENTY-FIVE THOUSAND AND 00/100 ($25,000.00)
DOLLARS in order to pay for professional consulting services in order to conduct a
feasibility study for the Fire Station in order to evaluate department’s building and
space needs as well as to undertake an analysis of renovating the current building
versus new construction, and to authorize the Town Administrator to solicit bids,
enter into contracts, and expend these funds for this purpose, or to take any other
action relative thereto.

MOTION: I move that the town vote to approve article no. 9 as printed in the
warrant and to transfer the sum of $25,000.00 from Free Cash for this
purpose.
ACTION: ADOPTED.
ANIMAL CONTROL SERVICES / RABIES CONTROL FUNDING
ARTICLE NO. 10: To see if the Town will vote to authorize the Board of
Selectmen to enter into and perform an intermunicipal agreement for animal
control services with neighboring communities, and to transfer from available funds
the sum of SEVENTY-SEVEN THOUSAND AND 00/100 ($77,000.00)
DOLLARS for the purpose of providing funding for the annual budget, to include
wages, benefits, expenses and equipping, of the rabies/wildlife and domestic
animal control program, or to take any other action relative thereto.

MOTION: I move that the town vote to approve article no. 10 as printed in
the warrant and to transfer the sum of $72,000.00 from Free Cash and
$5,000.00 from article no. 4 (Rabies Expenses) of the November 2005
Special Town Meeting for this purpose.
ACTION: ADOPTED.
OTHER BUSINESS
ARTICLE NO. 11: To act upon any other business that may legally come
before this meeting.
MOTION: I move that the town vote to dissolve the 2006 Special Town
Meeting.
ACTION: ADOPTED.
