A RESOLUTION OF THE VILLAGE COUNCIL OF THE
VILLAGE OF KEY BISCAYNEO FLORIDA, SUPPORTING
STATE LEGISLATION PROHIBITING THE USE OF
HANDHELD COMMUNICATION DEVICES WHILE
OPERATING A MOTOR VEHICLE; PROVIDING FOR
TRANSMITTAL; AND PROVIDING FOR AN EFFECTIVE
DATE
WHEREAS' the Village of Key Biscayne (the "Village") is committed to the safety of its
residents and visitors; and
\üHEREAS, the National Safety Council reports that the risk of a crash is four times more
likely when a cellular or mobile phone is in use; and
WHEREAS, according to a study from the University of Miami and Florida Atlantic
University, laws that ban or curb a drivers' use of cell phones and other handheld devices greatly
reduces the rate of fatalities for motorcyclists; and
WHEREAS, a study from the University of Utah concluded that the degree of cognitive
distraction associated with mobile phone use is so high that drivers using mobile phones while
driving exhibit greater impairment than legally intoxicated drivers; and
WHEREAS, the National Highway Traffic Safety Administration has reported that 3,450
lives were lost due to distracted driving in20l6 alone; and
\ilHEREAS, Senate Bill76 and House Bill 107 (the "Bills") have been filed in the 2019
Florida State Legislature to prohibit operating a motor vehicle while touching or holding a wireless
communications device; and
WHEREAS, the Village Council supports the Bills and urges the Florida Legislature's
passage of such legislation; and

\ryHEREAS, the Village Council finds that this Resolution is in the best interest and
welfare of the residents of the Village.
NOWO THEREFOREO BE IT RESOLVED BY THE VILLAGE COUNCIL OF
THE VILLAGE OF KEY BISCAYNE, FLORIDA, AS FOLLOWS:
Section 1.Recitals Adopted. Each of the above stated recitals are hereby adopted,
confirmed and incorporated herein.
Section 2. Support. The Village Council hereby supports the Florida Legislature's
passage of the Bills.
Section 3. Transmittal. The Village Clerk is directed to transmit this Resolution to
the Miami-Dade County State Legislative Delegation, Florida State House of Representatives
Speaker Jose R. Oliva, Florida State Senate President Bill Galvano, and Florida Governor Ron
DeSantis for their review.
Section 4. Effective Date. This Resolution shall be effective immediately upon
adoption.
