AN ORDINANCE RELATING TO POOL AND BILLIARDS, REPEALING .
CHAPTER 4 OF TITLE IV OF THE VILLAGE CODE OF McCALL,
IDAHO; AMENDING TITLE IV OF THE VILLAGE CODE OF McCALL,
IDAHO, BY THE ADDITION THERETO .OF A NEW CHAPTER 4
REQUIRING LICENSING' OF POOL. AND BILLIARD TABLES AND
PROVIDING EXCEPTIONS-; PROVIDING FOR APPLICATION FOR
LICENSES AND CONTENTS THEREOF; ESTABLISHING LICENSE
TERMS AND FOR RENEWAL OF LICENSES AND FIXING FEES
THEREFOR; PROVIDING FOR REVOCATION OF LICENSE AND .
PROCEDURES THEREFOR; AND PROVIDING PENALTIES .
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE..
CITY OF McCALL, IDAHO; AS FOLLOWS:
Section l. - That. Chapter 4 of Title IV:.bf the Village
Code of McCall, Idaho-, be- and - the same is ,hereby repealed.
Section 2. That Title IV of. .the Village .Code of McCall,
Idaho, be -and -The- same is 'hereby amended by, the addition
thereto of a new chapter to be known and designated as
Chapter. 4 and to read as follows:
4-4-1: POOL AND BILLIARD TABLES, LICENSE REQUIRED,
EXCEPTIONS: It shall be unlawful for any person .to possess,
sell, lease, rent,' license or permit the use of, or control,
place,, maintain or permit the operation of any pool or
billiard table unless and until said table or tables shall
be 'licensed_ as hereinafter -provided, except that ,the State.
of Idaho, or any o.f ,its agencies or departments, the McCall-
Donnelly School District�, . or any other political subdivisions
of' the State of Idaho are hereby -exerpt from--the provisions
of this Ordinance.
4-4-2: !APPLICATION: Prior to the issuance of a pool-
or billiard table license,, the applicant shall file with the
City Clerk an application' signed by the applicant, in "such
form and containing such- information and statements relative
to the applicant and the table to be - licensed as may, be'
prescribed by the City Clerk.
47-4-3 : LICENSE TERM; RENEWAL' AND FEE:
(A) The 'annual license. period ;shall .be.- from .January
1 to and through December. 31 of the year for which
-
a license has been issued or for ,any portion of
such year.
(B) Each .license must be renewed by the licensee
orior before January l of each year upon appli-
cation and payment of, the annual license fee.
. (C) Upon approval of an application for a pool or
billiard table license, and the renewal thereof;
the "City Clerk shall issue a license to each'
applicant upon paying the license fee of ten.
dollars ($10. 00) for each such table described on
the application . for license.
4-4=4: REVOCATION OF LICENSE: ..-Licenses is.s.ued..under
the provisions of this- Chapter may be revoked by the City
Council afternotice and hearing before the Council whenever
it shall be shown that a licensee has violated any of the
. provisions of this Chapter; has misrepresented or made a
false statement ,in . an application for- a license. or has
failed to acquire a; license for. each table used, operated
and maintained for public .patronage. Notice .of the hearing
or revocation shall ' be given i-n. writing setting forth: speci-
'fically. the grounds of complaint and the time .and .place of
hearing. Such notice. shall , be mailed, postage prepaid; to
the licensee at his last known address at least five (5)
days prior- to .the date set for hearing.
4-4-5: PENALTIES..: Any :person violatinq any of the
provisions of .this Chapter; .or.', fi'l ng,- or causing to be
filed an application for a license under this Chapter containing
false or, fraudulent statemen.ts,, :or. .using.,. operating, :and
maintaininga ,pool or...bi'lliard ,table, :or tables; 'not licensed
as herein required, shall ,be- deemed guilty of a� misdemeanor
and upon conviction thereof shall be fined not less ..than
fifty- dollars ($50. 00): nor. more . than three hundred dollars.
($300. 00) , or shall be imprisoned for not more. -than thirty
.(30).. days, `or, be punished by both such fine and imprisonment.
