This matter was continued from the Apri1 12, 1988 meetinq of the Planning Commission. Recommended Action: Staff respectfully requests that, after consideration, � the Planning Commission adopt Resolution No. 2189: a. Finding that Conditional Use Permit No. 88015 is „ exempt from the provisions of the State CEQA Guidelines, as amended. b. Conditional Use Permit - Case No. 88018 >'� 3225 Carlin Avenue (Mark Bruss) ...-�v� Applicant requests a Conditional Use Permit to build two ,_..� apartments at the rear of an existing single-family dwelling. ,� The Public Hearing was opened by Chairperson Kanka and Brian Callahan, Contractor, 2380 Glendale Avenue, Los Angeles, I.?� 90039, rose to speak. He stated that Mark Bruss is his architect, not the applicant. He questioned page 2, paragraph 4 of, the staff report under "Project Characteristics", which stated the total height of the ;`.� building to be fourteen feet. This was corrected by staff, yz � it should be thirty-five feet. Mr. Callahan requested that Condition No. 9, for a block wall or fence, be changed to chain link or wood, because either is cheaper than a block wall. Mr. Karefa-JOhnson stated this _ requirement is policy for all developments in the high density residential zones. A.permit must be obtained by the _�;;1' applicant, and Mr. Karefa-Johnson recommended that the block ;;;,;>_,, i;r,;�-.,: wall stay as a requirement. Mark Bruss rose at this time to state that there are single family dwellings arround the property; it was established that the zoning is R-3. Mr. Callahan questioned Conditions No. 21 and No. 24. Mr. � Murga stated that wheelchair ramps are required when new construction is performed, and the sidewalk in front of the ve to be re laced. Mr. Callahan questioned Condition No. 25, regarding the sewer connection. Mr. Murga replied that each building must have separate sewers, but this can also be worked out with staff. Mr. Murga said it may be possible to tie-in the sewer. Ultimately, Mr. Murga agreed that this condition could be waived. '° ` i �z;-i I Mr. Callahan questioned Conditions No. 26 and No. 27, the '--%;,1 ' undergrounding of utilities. Mr. Murga stated these `, conditions will depend largely on the Southern California � Edison Company. Again, staff will work with the applicant. In response to Commissioner Pryor's question, Ms. Tilford ",� said there was no density bonus involved in the total number of units. The block wall fence was brought up several times throughout „{ the following discussion by the applicant, staff, and all of ,., the Commissioners, but was not waived. MOTION by Commissioner pove, SECONDED by Commissioner Penalber, to approve RESOLUTION NO. 2190, "A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF LYNWOOD APPROVING CONDITIONAL USE PERMIT NO. 88018 FOR THE CONSTRUCTION OF A TWO (2) UNIT DUPLEX AT 3225 CARLIN AVENUE, LYNWOOD, CALIFORNIA, IN THE R-3 (MULTIPLE FAMILY RESIDENTIAL) ZONE," with Conditions No. 25 and 26 as stated, to be negotiated with staff, other conditions and requirements to remain, and find that said Conditional Use Permit is Categorically Exempt from the State CEQA Guidelines, as amended. He also plans to build eleven, two- ; bedroom units, with one and one-half baths. There is a i courtyard and play apparatus in the middle, with the units surrounding the courtyard. Conditional Use Permit - Case No. 88016 4255-4257 Carlin Avenue (Alex Galindo) . Applicant is requesting a Conditional Use Permit to build fourteen units at the above address in the R-3 zone. Chairperson Kanka opened the Public Hearing. Alex Galindo was not present, and no one was present to represent him. Commissioner Pryor wanted to postpone the Public Hearing until Mr. Galindo could be present because the Commissioner " wanted to discuss the two bonus units with Mr. Galindo. Commissioner Pryor was willing to vote without the presence of Mr. Galindo, only if denial of the bonus was part of the motion. Mr. Barnes explained the regulations regarding the density bonus. The present Code provides a bonus for large lot developments at the discretion of the Planning Commission. The proposed amendment would provide a 25� bonus above the basic density, if the developer will rent/sell to low or moderate income families or senior citizens. The 25o bonus is not discretionary, it is mandated by State law. The bonus Mr. Galindo is requesting is under the existing Code, and therefore can be denied by the Commission. MOTION by Commissioner Penalber, SECONDED by Commissioner Dove, to continue the hearing on Item No. 2, Conditional Use Permit - Case No. 88016, to the next regular meeting of the Planning Commission on May 10, 1988. Conditional Use Permit - Case No. 88017 11236 Louise Avenue (Alex Galindo) Since the proposal is for the same developer, Mr. Galindo, � the Public Hearing was not opened. � I i I' l DISK M-1:Adjourn I I z _ i : . � � � ;l Mr. Emilio Murqa stated that the Engineerinq Division has a total of sixteen conditions, some of which were not ; addressed, such as grading, full width sidewalks, driveways, i two wheelchair ramps, connectin of sewers, marbelite street � lights, tree wells, meters, installation of curb, etc. Mr. Galindo went over the list with Mr. Murga and accepted the eight additional conditions, making a total of 41 conditions accepted by Mr. Galindo. Commissioner Pryor asked Mr. Galindo if the bonus two units were dropped, would he continue with the development. Mr. I Galindo replied that it would probably not be financially � feasible. Chairperson Kanka asked if anyone in the audience wished to :_.,� speak for or against the proposal. There being no one, she closed the Public Hearing. MOTION by Commissioner pove, SECONDED by Commissioner Penalber, to adopt RESOLUTION NO. 2188, "A RESOLUTION OF THE PLANNING CONIl�IISSION OF THE CITY OF LYNWOOD APPROVING CONDITIONAL USE PERMIT - CASE NO. 88016 FOR THE CONSTRUCTION OF FOURTEEN (14) UNITS AT 4255 AND 4257 CARLIN AVENUE, LYNWOOD, CALIFORNIA, IN THE R-2 ZONE," subject to the stated conditions and requirements, and find that the project will `: not have a significant effect on the environment and certify ; the Negative Declaration as adequate. MOTION failed because,of the following vote: AYES: Commissioners Dove, Kanka, Penalber -�� -.::::i NOES: Commissioners Cole-Dennis, Pryor, Willis ABSENT: None � - ABSTAIN: None Mr. Barnes explained that a majority must approve, and a three-three tie is therefore a denial of the Conditional Use Permit. Commissioner Pryor offered to change his vote if the 2 bonus units were eliminated. The Commission required that'Mr. Galindo keep all the three-bedroom units, and eliminate two of the two-bedroom. The Commission %� instructed Mr. Galindo to submit new site plans for staff ;:<>:<.1 review. � �':. � 3. Conditional Use Permit - Case No. 88017 11236 Louise Avenue (Alex Galindo) Applicant requests a Conditional Use Permit to build six V ,=:~� apartments at subject address in the R-3 zone. The existing single family dwellinq will be demolished. Staff received - one letter in opposition to the proposal. The six apartments :=s:;1 include one bonus unit. '';'.� Chairperson Kanka opened the Public Hearing and asked for `�j comments from Alex Galindo, 6812 Pacific Avenue, Huntington i +',� Park, CA., 90255. Mr. Galindo stated his acceptance of all conditions. He stated his plans to build an owner's apartment with three bedrooms and two and a half bathrooms, ;':;'� plus five, two-bedroom apartments. The owner's unit will be '� two stories, while the five two-bedroom apartments will be built above garages with overhead garage doors. Chairperson Kanka asked if anyone wished to speak either for ';.;� or against the proposal. There being no one, the Public Hearing was closed. <i-;i`-� , s :, :! Both City ;:?%; Council and the Planning Commission will be involved in the : proposed revision of .the City's goals for the next ten to fifteen years. Mr. -'� Karefa-Johnson replied that he will convalesce for another six to ,,=;� eight weeks. ;.� Commissioner Penalber noted that he had spoken to one of the managers of the Goodyear plant and the tires that were stored on the property have been removed. He requested staff send a letter of thanks to Goodyear. A short discussion about the Goodyear property followed. Commissioner Pryor and Mr. Karefa-Johnson discussed the three Code Enforcement officers and their schedules. Commissioners Cole-Dennis discussed her dissatisfaction with the street lights on the Alpha Beta property.
