USERS; , -PROVIDING FOR MONTHLY SEWER SERVICE' CHARGES,` ESTABLISHING '.RATES THEREFOR AND PROVIDING FOR DISPOSITION -OF SUCH CHARGES; PROVIDING FOR TRUNK SEWER AND TREATMENT PLANT CONNECTION CHARGES, ESTABLISHING -RATES .THEREFOR AATD :PRO.VIDING FOR DISPOSITION' OF' SUCH CHARGES'; PROVIDING FOR SEWER SERVICE CONNECTION CHARGES, ESTABLISHING SUCH CHARGES AND PROVIDING FOR DISPOSITION THEREOF;' PROVIDING FOR CHANGE OF USE OF PROPERTY. AND PROVIDING .A METHOD OF ESTABLISHING_ TRUNK SEWER AND TREATMENT PLANT CONNECTION CHARGES AND SEWER SERVICE CONNECTION CHARGES UPON A CHANGE OF USE; PROVIDING FOR DISCONNECTION AND PLUGGING -OF SEWER FOR NON-PAYMENT AND DELINQUENCY IN PAYMENT OF SEWER CHARGES AND FEES AND CONNECTION FEES ESTABLISHED HEREIN; PROVIDING PENALTIES AND PROVIDING THAT ALL OF SUCH FEES IF NOT PAID AS .-PROVIDED HEREIN SHALL CONSTITUTE .A LIEN UPON THE PREMISES SERVED BY AND CONNECTED TO THE SEWER SYSTEM AND PROVIDING THAT DELINQUENT CHARGES .AND ,FEES AND PENALTIES SHALL- BE CERTIFIED TO THE TREASURER; EX- OFFICIO TAX COLLECTOR OF VALLEY . COUNTY, IDAHO, AND COLLECTED THE SAME AS TAXES ARE . COLLECTED. BE IT .ORDAINED' BY THE-.MAYOR AND .COUNCIL OF THE CITY 'OF McCALL; IDAHO; AS FOLLOWS: Section 1. That Chapter 4 of Title VIII of .the Village Code of McCall, Idaho, ,be, and the same is hereby repealed. Section 2. That Title VIII of the Village Code of McCall, Idaho, be, and the same is hereby amended -by the addition of a new Chapter, to - be known- and designated as Chapter 4 of Title VIII of the Village Code. of McCall, Idaho, and to read as follows: 8-4-1: SEWER CLASSIFICATIONS: All users of 'the sewer system of .the City are hereby classified as follows : Class. A Private residences. Class B All other uses. 8-4-2: SEWER CHARGES: The City shall charge and' the user shall- pay monthly for sewer service the following rates, to-wit: - For each Class A u.se, , seven dollars ($7. 00) per month; For each ClassB use, seven dollars ($7. 00) per .month or sixty percent (60%) of the, charges for City water ' service, whichever is greater. 8-4-3: SEWER CHARGE- BILLING: All charges for monthly sewer service furnished by the City -shall be- billed directly to the record title holder of the premises to. which the sewer'. service is, furnished, -according 'to the official records in the office of the Recorder of Valley County, Idaho. 8-474 : TRUNK SEWER AND TREATMENT PLANT CONNECTION CHARGES, TIME OF PAYMENT, DISPOSITION OF CHARGES: A trunk- sewer connection.,"change , shall be 'made and ,impo'sed upon .and collected from, every person,, firm, partner- ship, corporation '.or association or any other sewer user `before 'constructing a sewer service. Line by which to attach and connect the -property to the sanitary sewer system of McCall.. The rate for each connection charge is hereby fixed and established as follows: 1. Single-Family Residence: $600. 00. 2. Duplex or Triplex, per unit: $600. 00. 3. 'Mobile Home . Park,- per unit: $600. 00. 4. Condominiums, Townhouses and apartments . For the purposes of .this Section, the word "gross acre" . shall mean an .acre. of:, ground. including all public and private drives within" the development and one-half (2) of the ,width o_f. all, bordering ..public streets. (a) 4. _units or less per .gross . acre, per unit: .$60G. 00. (b) Over 4 units to:-:arid -including 5 units per gross acre, per unit.: $600. 00. (c) Over 5.-units to and. including 6 units per gross acre, per unit:. $600.-00. r (d) Over 6 units to and including 7 units per gross acre, per unit:- $600. 00. . t' (e) . .,Over '7 , units to and including 10 units per "gross acre, per unit: $700. 00. .(f) , Over 10 units to ,.and including 13 units per gross acre, per unit: $8.Oo. 00. (g) Over 13.. units per gross acre, per unit: $1., 000. 00 . 5 . Travel Trailer,. Motor Home.,. Truck .Camper, parking space per unit: $500. 00. 6. Commercial-Industrial-Institutional: To be fixed and determined .by the- City Council on a .basis of..equivalent single family..,residential ,units, and the determination of such equivalence. shall include the volume, type and content- of -liquid effluent and/or industrial waste water- discharged into the sewer -system. All trunk sewer and treatment 'plant connection charges shall be paid 'to .the City Clerk and shall be' deposited by the City Clerk. to the -Capital Improvements . Fund established and .created: by Ordinance No. 4.29 of- the City' of McCall.; Idaho. 8-4=5: SEWER SERVICE CONNECTION FEES; . PERMIT; INSPECTIONS; DISPOSITION. OF FUNDS: In addition -to a .trunk . sewer connection charge, . a person 'construct'ing a. sewer. service line by.-which to attach and connect the property to any sewer system transporting- sewage, industrial wastewater or other wastes and liquids to a McCall treatment plant shall. pay a sewer service connection charge, and such charge shall be made and -imposed upon and collected from such sewer users. The rate for each connection charge is hereby fixed and established -as follows: 1. Single-Family Residence: $150.00. 2. Duplex. or Triplex,. per unit: $150.. 00. 3. Fourplex and Larger, per unit: $150. 00. 4. Mobile Home Park, per unit: $150 . 00. 5. Condominium, Townhouses and apartments,per unit: $150. 00. 6. Commercial-Industrial-Institutional: To be fixed and determined by the, City',Council on a basis of equivalent single. family residential units; and. the determination .of such -'equivalence shall include the volume, type and content of liquid effluent and/or- industrial waste.-water -discharged into the sewer system. 1 Before any connection shall be. made to the . City sewer 'system a permit therefor shall be obtained from the. City. Clerk upon payment of the fees provided in this section and thereafter such connection to the City Sewer System shall be made at the expense ofI, the - person desiring. such connection and the same shall be .tade, under the supervision of the . Water Master and such connection shall not be -covered until final inspection and approval by the Water Master. All fees collected .by the City. Clerk hereunder shall be by the City Clerk deposited in the .General Fund of -the City. 8-4-6: CHANGE OF -USE; FEE:: Each sewer user changing use of his property now connected to the sanitary -sewer system of- McCall shall pay the difference between . the connection charges (trunk sewer-and treatment. plant charges and sewer service connection' charges) applicable to the use to which the property is being changed and. the use to which the property had been previously . applied. - If, for example, . a single family dwelling situated upon property now connected to the sewer is demolished and a duplex, triplex, multi-family mobile home park or commercial-industrial-institutional use is thereon constructed, the charge to be made for both •trunk sewer and treatment plant connection chaffges and sewer service connection charges shall be .the. difference between the total of the charges provided by sections 8=4-4 and 8-4-5 of this Chapter for the use intended to be made .of the property and, the charges so provided in said sections 8-4-4 and 874=5 above. . 8=4-7: DISCONNECTION; AND LIEN: (A) . In case of non-payment of delinquency in payment of the sewer charges and fees and connection fees herein required, the. Water Master is hereby authorized and directed to disconnect and -plug the sewer connection to the sewer system. (B) All service charges or fees not paid within thirty (30) 'days . o'f the, date when due,- and all fees .not paid.. prior to and upon connecting to the sanitary sewer system. of the City of McCall, shall be- come -delinquent and the - amount due and payable .shall constitute a lien upon and against thq property or premises being served by and connected to the sanitary sewer system. The.' delinquent charges and fees, service and connection, together witha penalty often percent ,' (loo) added thereto shall be certified to the Treasurer, Ex-officio �Tax Collector, of Valley_ County, . in the manner and at, the "'-time required by Section 50-1008 , Idaho Code, and the same shall be collected in the same manner and subject to the same penalties as' other city taxes.
