AN ORDINANCE RELATING TO DOGS;.,, AMENDING SECTION 5-4-7
OF THE VILLAGE CODE OF McC. ALL,' IDAHO, PROHIBITING
OWNERS OF FIERCE OR DANGEROUS DOGS FROM ALLOWING SUCH
DOGS TO RUN AT LARGE; MAKING IT LAWFUL TO KILL SUCH
DOGS, AND PROVIDING' THAT EACH DAY ANY SUCH DOG IS
ALLOWED TO RUN AT LARGE' CONSTI'T'UTES A SEPARATE OFFENSE;
AMENDING SECTION 5-4-16 OF THE VILLAGE CODE OF McCALL,
IDAHO, DEFINING DOG OWNER; AND AMENDING SECTION 5-4-17
OF THE VILLAGE CODE OF McCALL, IDAHO, PROHIBITING DOGS
RUNNING AT LARGE AND PROVIDING EXCEPTIONS.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE
CITY OF McCALL, IDAHO, AS FOLLOWS :
Section 1. That Section 5-4-7 of the Village Code of
McCall, Idaho, be, and the same is hereby amended to read as
follows :
5-4-7 : DANGEROUS DOG PENALTY KILLING SAME: If the
owner or possessoriof a fierce and dangerous dog permits
the same to go at large, he shall be liable to be fined
in any sum not to exceed fifty ($50 . 00) dollars , and it.
shall be the duty of the Chief of Police to kill such
dog found running at large, and it shall be lawful for
any person to kill such dog found running at large.
Each day that such, dog is permitted to go at large
shall constitute a separate violation of this ordinance.
Section 2. That Section 5-4716 of the Village Code of
McCall, Idaho, be, and the same is hereby amended to read as
follows:
5-4-16 : DEFINITIONS : The term "owner" as used in this
Chapter shall be construed to mean and include any
person owning, harboring or having in his or her con-
trol a dog within the City. The term "dog" as used in
this Chapter shall mean and include either male or
female.
Section 3. That Section 5-4-17 of the Village Code of
McCall, Idaho, be and the same is hereby amended to read as
follows:
5-4-17 : RUNNING AT LARGE PROHIBITED: Except as pro-
vided by Section 5-4-18 , any person who owns, harbors
or has in his or her control a dog, whether the dog is
licensed or not, which dog is found at large upon the
streets or alleys of the City, or in any public place
in the City or upon any other premises without the
consent of the person in possession of such premises,
is responsible for such dog being at large and is in
violation of this Code Section, except:
(A) , When such dog be in the presence of a person and
controlled by leash not exceeding ten feet (10 ' )
in length.
(B) Such dog be :confined in a motor vehicle. .
